NO.SPP.2024/U.O.R.15/-D-XIV :- In exercise of the powers conferred by sub- section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No.2 of 1974) and Section 32 of The Protection of Children from Sexual Offences Act 2012 (POSCO Act, 2012), the Government of Maharashtra hereby appoints Adv. Ujjwal Nikam as "Special Public Prosecutor" for conducting the case/s pending before Sessions Court, Jalgaon, which is/are arising out of C.R.No.226/2023 registered at Bhadgaon Police Station, Dist. Jalgaon.

2. The fees of Adv. Ujjwal Nikam as "Special Public Prosecutor" shall be paid by Home Department as per the fee proposal agreed by Home Department and approved by this Department.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Condition Of Service and Remuneration) Rules, 1984.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

No.TPS-3321/42/CR-08(PART-2)/2021/EP SANCTION/ UD-30: Whereas, in accordance with sub section (1) of section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as "the said Act"), the Government of Maharashtra has sanctioned a part of the draft Republished Development Plan for the Ashti Nagar Panchayat, Dist. Beed (hereinafter referred to as "the said Development Plan") vide Urban Development Department's Notification No.TPS-3321/42/CR-08/2021/Part Sanction/UD-30, dated the 22.05.2021 (hereinafter referred to as "the said Notification") and the Corrigendum is issued on 02.11.2021;

And whereas, the Government published the proposed modifications of substantial nature (EP-1 to EP-14) as the excluded parts of the said Development Plan (hereinafter referred to as "the said Excluded Parts") vide Urban Development Department's Notice No. TPS-3321/42/CR- 08(A)/2021/E.P./Notice/UD-30, dated the 22.05.2021 (hereinafter referred to as "the said Notice"). The said Notice is published in the Official Gazette, Part IA, Chhatrapati Sambhajinagar Divisional Supplement, dated the 06-12.05.2021 for inviting suggestions / objections from the general public under second proviso to sub section (1) of section 31 of the said Act, and the Corrigendum is issued on 02.11.2021;

And whereas, in accordance with sub-section (2) of section 31 of the said Act, the Government, vide the said Notice, appointed the Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar as "the Officer" to hear the persons submitting objections or suggestions within the stipulated time period of 30 days from the publication of the said Notice in the Official Gazette, in respect of the proposed modifications of substantial nature and to submit his report to the Government (hereinafter referred to as "the said Officer");

And whereas, the said Officer submitted his report to the Government vide his Marathi No.1142, dated 07.07.2022.

the period or periods during which any action could not be completed due to enforcement of any Code of Conduct by the Election Commission of India or the State Election Commission in respect of any Election shall be excluded;

And whereas, in accordance with the provisions of section 148-A of the said Act, in computing the period, in relation to any Development Plan, Regional Plan or Scheme under the provisions of Chapter II, III, IV and V of the said Act, the periods during which any action could not be completed under the said chapters, due to enforcement of any Guidelines or lockdown measures by the Government of India or the State Government, as the case may be, to prevent the spread of any pandemic or epidemic or disaster situation arising in the Country or State shall be excluded;

Now, therefore, in exercise of the powers conferred on it by sub section (1) of section 31 of the said Act and all other powers enabling it in that behalf, and after consulting the Director of Town Planning, Maharashtra State, the Government of Maharashtra hereby,

A) Sanctions the draft Republished Development Plan of the Ashti Nagar Panchayat, Dist. Beed as regards the said Excluded Parts (for EP-1 to EP-14) as specified in the Schedule of Modification (Schedule) annexed hereto.

B) The Final Republished Development Plan in respect of the said Excluded Parts of the Ashti Nagar Panchayat, Dist. Beed (viz. EP-1 to EP-14), shall come into force after 30 days from the date of publication of this Notification in the Official Gazette.

A Copy of plan showing the aforesaid sanctioned as regards the said Excluded Parts in terms of EP-1 to EP-14 as specified in the Schedule of Modification (Schedule) shall be available in the office of the Chief Officer, Ashti Nagar Panchayat, Dist. Beed during office hours on all working days for inspection of public for a period of 30 days.

2) This Notification shall also be available on the Govt. website www.maharashtra.gov.in

Act, 1966 (hereinafter referred to as "the said Act") and as per the said Regional plan, the land admeasuring about 24.8150 hectare bearing Gut. No. 37 of Mauje Hasanapur. 149,150,151,152,155 of Mauje Pedgaon And Gut No.539/2,544/ 2,545/2 of Mauje Pedgaon Ta. Dist. Parbhani, (hereinafter re- ferred to as "the said Area") is included in Agriculture Zone.

And whereas, the Government vide Resolution No. TPS- 1815/C.R.49/15/UD-13, Dt. 06.05.2015 and Resolution No. TPS- 1815/C.R.49/15/UD-13, Dt. 04.01.2016 (hereinafter referred to as "the said Government Resolution") has issued the directives under section 154 of the said Act, regarding the procedure to be followed under section 20 of the said Act, for making changes in the use of land in the areas of sanctioned Regional Plans, and for that purpose constituted "Proposal Scrutiny Committee".

And whereas; the "Proposal Scrutiny Committee" con- stituted under the said Government Resolution, is of the opin- ion that, the said area shall be deleted from Agriculture Zone and proposed to be included in Residential Zone, and accordingly it is necessary to modify the said Regional Plan (hereinafter referred to as "the said modification") in accordance with the provisions of sub-section (2) of section 20 of the said Act, subject to the following conditions;

01.01.2018 ( hereinafter referred to as "the said Regional Plan") under the provisions of Maharashtra Regional & Town Planning water Harvesting and Water Recyling while developing the said area.

5) While developing the said area, in addition to 10% statutory open Space, 10% area for Amenity space shall be provided as per the prevailing Development Control Regula- tions applicable for the Regional Plan, Chhatrapati Sambhajinagar. This Amenity Space shall be developed by the Land owner/Developer, as suggested by the Collector, Parbhani.

6) It shall be binding to Applicant/Developer to plant 250 trees per Hect, while developing the land and Plot holder of sanctioned layout to plant 5 trees per plot. This shall be verifyed at the time of final sanction to development.

7) It shall be necessary to confirm that, land slope of this land is in proper way as per Standardize Development Control & Promotion Rule before giving Development Permission for this land by Parbhani Branch Office.

8) If the said area is proposed to be development by way of plotted layout, then sale of plots under such layout shall be monitored by the colletor, Parbhani, as per the Stages given below.

And whereas; as per the provision of sub-section (1) of section-151 of the said Act, Government vide Notification No.. TPS-1815/CR49/15/UD-13/ Dt. 11.06.2015 has delegated the powers under section 20 (2), section 20(3) & section 20 (4) of the said Act to the concerned Joint Director of Town Planning;

Now, therefore, in exercise of powers delegated by the Government in this regard, as per section 20 (3) of the said Act, the Joint Director of Town Planning, Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar, by this notice, declares intention to make the said modification in the said Regional Plan and for the proposed said modification invites suggestions/ objections from the public in writing, within 30 days from the date of publication of this notice in the Maharashtra Government Gazette;
