ORDER
No. TPS-2422-1373-CR-114-2022-UD-9.—
Whereas, Revised Development Plan of Nagpur City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300 (A)-97-UD-9, dated 7th January, 2000 and finally sanctioned vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September, 2001 & has come into force with effect from 1st March, 2000 & 21st September, 2001 respectively (hereinafter referred to as "the said Development Plan") under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah No. XXXVII of 1966) (hereinafter referred to as "the said Act") ;
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध २८-ह्य ३, २०२४/ ८-१४, ॅ १९४६ ३And whereas, in the said Development Plan, the land bearing Khasara No. 24/1 & Khasara No. 27/2 totally admeasuring about 0.4224 Hector of Mouja Bhandewadi (hereinafter referred to as "the said Reserved Land") are reserved as Site No. ME-41 "Dispensary & Maternity Home" (hereinafter referred to as "the said reservation") and the Appropriate Authority for the said reservation is Nagpur Improvement Trust, Nagpur (hereinafter referred to as "said Authority") ;
And whereas, the said land has not been acquired by the said authority within ten years from the date on which the said Development Plan came into force ;
And whereas, the owner of the land bearing Khasara No. 24/1 (hereinafter referred to as "the said Land") more particularly described in Schedule appended hereto, out of the said reserved land, had served a notice dated 25-02-2019 & 31-12-2019 under section 127(1) of the said Act (hereinafter referred to as "the said Notice") on the said Authority ;
And whereas, even after service of the said Notice as aforesaid, the said land has not been acquired within a stipulated period from the date of the service of the said Notice under sub-section (1) of Section 127 of the said Act ;
And whereas, it is accordingly expedient to notify that the reservation in the said Development Plan on the said land to the extent of 1900 sq.mt. (hereinafter referred to as "the said area") has lapsed under sub-section (2) of Section 127 of the said Act, from the said Development Plan ;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby Notifies that, the said reservation on the said area stands lapsed and the land so released shall be available to the landowner for the purpose of Development as otherwise permissible in the case of adjacent land under the Development Plan.
(1) A Copy of the part plan showing the area which is lapsed vide this order is available in the office of the Commissioner, Nagpur Municipal Corporation, Nagpur during Office hours on all working days for inspection of public up to one month.
(2) This Order shall also be available on the Government website at www.urban.maharashtra.gov.in
