भारतेाचे संप्रिवधान.
क्र. सेप्रतिनां. २०२२/प्र.क्र. ४६/ऊजाच-१.—भारतीय संतिधानांाच्या अनांुच्छेदा ३०९ खालील परंतुकान्ये प्रदानां करण्यात आलेल्या शक्तंचा ापर करुनां, मंहुाराष्ट्राचे राज्यपाल याद्वारे मंहुाराष्ट्रा शासनांाच्या उद्योग, ऊजाच, कामंगार खातिनांकमंच तिभागाच्या प्रशासकीय तिनांयंत्राणाखालील "मंुख्य तिद्योुत तिनांरीक्षक" यांच्या कायाचलयातील अतिधाक्षक अतिभयंता, गट-अ (राजपतित्रात) या पदाच्या सेाप्रेशाचे तितिनांयमंनां करण्यासाठी याद्वारे पुढील नांीनां तिनांयमं करीत आहुेत :-
१. संप्रिप्ते नाव, ारंभ :—
(१) या तिनांयमंांनांा मंुख्य तिद्योुत तिनांरीक्षक यांच्या कायाचलयातील मंहुाराष्ट्रा तिद्योुत अतिभयांतित्राकी सेतील अतिधाक्षक अतिभयंता, गट-अ (राजपतित्रात) सेाप्रेश तिनांयमं, २०२४ असे संबोधाण्यात याे.
(२) सदार तिनांयमं शासनां राजपत्र प्रतिसद्ध झाल्याच्या तिदानांांकापासूनां अंमंलात येतील.
२. व्येाख्येा :— या तिनांयमंात संदाभाचनांुसार दाुसरा अर्थच अतिभप्रेत नांसेल तर,-
(क) "शासनां" याचा अर्थच, मंहुाराष्ट्रा शासनां असा आहुे ;
(खा) "उद्योग, ऊजाच, कामंगार खातिनांकमंच तिभाग" याचा अर्थच भारतीय संतिधानांाच्या अनांुच्छेदा -१६६ अन्ये बनांतिलेल्या मंहुाराष्ट्रा शासनां कायचतिनांयमंालीच्या पतिहुल्या अनांुसूचीमंध्ये तितिनांतिदाचष्ट केलेला उद्योग, ऊजाच, कामंगार खातिनांकमंच तिभाग असा आहुे ;
(ग) "मंुख्य तिद्योुत तिनांरीक्षक" यांचे कायाचलय याचा अर्थच उद्योग, ऊजाच, कामंगार खातिनांकमंच तिभागाच्या प्रशासकीय तिनांयंत्राणाखालील मंहुाराष्ट्रा शासनांाचे मंुख्य तिद्योुत तिनांरीक्षक यांचे कायाचलय असा आहुे ;

भाग चार-अ—१२ महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुधवार, एप्रिल ४-१०, २०२४/चैत्र १५-२१, शके १९४६ (घ) "पदाी" याचा अर्थच, पदाी याचा अर्थच ैधातिनांक तिद्योापीठीाची अतिखाल भारतीय तांतित्राक तिशक्षणा परिरषदाेनांे मंान्यता तिदालेली तिद्योुत अतिभयांतित्राकी पदाी तिकंा तितच्याशी समंतुल्य असलेली अहुचता असा आहुे ;
(ङ) "तिनांयुक्ती प्रातिधाकारी" याचा अर्थच, शासकीय सेतील संबंतिधात पदार उमंेदाराची तिनांयुक्ती करण्यासाठी सक्षमं असणारे मंा. मंुख्यमंत्राी, मंहुाराष्ट्रा शासनां हुे प्रातिधाकारी असा आहुे ;
(च) "ज्येष्ठीता अतिधानां पात्राता" याचा अर्थच, सेाज्येष्ठीता यादाीनांुसार ज्येष्ठीता सामंान्य प्रशासनां तिभागानांे तिदानांांक १ ऑगस्ट २०१९ च्या आदाेशाद्वारे त्यानांतर ेळोेळोी यासंदाभाचत तिनांगचतिमंत केलेल्या आदाेशाद्वारे पदाोन्नांतीसाठी तितिहुत केलेल्या अटी शतीनांुसारची पात्राता असा आहुे.
३. प्रिनयेुक्तेरीचा मागष :—
पदाोन्नांतीनांे तिनांयुक्तीचा मंागच-
"अतिधाक्षक अतिभयंता, गट-अ (राजपतित्रात)" या पदार "तिद्योुत तिनांरीक्षक, गट-अ (राजपतित्रात)" हुे पदा धारणा करणाऱ्या तसेच सदार पदार पाच षापेक्षा कमंी नांसेल इतकी सलग तिनांयतिमंत सेा झालेल्या तसेच तिद्योुत अतिभयांतित्राकी तिषयातील पदाी हुी शैक्षतिणाक अहुताच धारणा करणाऱ्या व्यक्तंमंधाूनां ज्येष्ठीता अतिधानां पात्राता या तिनांकषार योग्य व्यक्तंच्या पदाोन्नांतीनांे तिनांयुक्ती करण्यात येईल.
४. प्रिहंदरी व मराठेरी भार्षा पररीेबुाबुतेचरी तेरतेूद :—
तिनांयमं ३ येर्थे नांमंूदा केलेल्या पदार पदाोन्नांतीनांे तिनांयुक्त हुोणाऱ्या व्यक्तीनांे, पदाोन्नांतीपूी तिहुंदाी भाषा परीक्षा मंराठी भाषा परीक्षा या दाोन्हुी परीक्षांसंदाभाचत मंराठी भाषा तिभागानांे ेळोेळोी केलेल्या तिनांयमंांनांुसार, तिहुंदाी भाषा मंराठी भाषा परीक्षा अगोदारच उत्तीणाच केलेली असणाे अर्था उत्तीणाच हुोण्यापासूनां सूट तिमंळोतिलेली असणाे आश्यक राहुील. अन्यर्था तिनांयमं ३ येर्थील पदार पदाोन्नांती अनांुज्ञेय ठीरणार नांाहुी.
५. संगिक अहषतेा मािपत्राबुाबुतेचरी तेरतेूद :—
तिनांयमं ३ येर्थील पदार पदाोन्नांतीनांे तिनांयुक्त हुोणाऱ्या व्यक्तीनांे, पदाोन्नांतीपूी संगणाक अहुचता प्रमंाणापत्रासंदाभाचत शासनांानांे ेळोेळोी केलेल्या तिनांयमंांनांुसार, संगणाक अहुचता प्रमंाणापत्रा धारणा करणाे अर्था सामंान्य प्रशासनां तिभाग (मंातिहुती तंत्राज्ञेानां) यांनांी ेळोेळोी शासनां आदाेशाद्वारे नांमंूदा केलेल्या संगणाक / मंातिहुती तंत्राज्ञेानां तिषयक परीक्षा उत्तीणाच हुोणाे अर्था सामंान्य प्रशासनां तिभागानांे ेळोेळोी शासनां आदाेशानांुसार तिनांश्चिश्चत केलेल्या योमंयाचदाेनांुसार संगणाक अहुचता प्रमंाणापत्रा सादार करण्यापासूनां सूट तिमंळोतिलेली असणाे आश्यक राहुील. अन्यर्था तिनांयमं ३ येर्थील पदार पदाोन्नांती अनांुज्ञेय ठीरणार नांाहुी.
६. बुदलरीबुाबुतेचरी तेरतेूद :-
तिनांयमं ३ येर्थील पदार तिनांयुक्त हुोणाऱ्या व्यक्तंची सेाज्येष्ठीता यादाी हुी राज्य स्तरार ठीेण्यात येईल. त्यामंुळोे सदार व्यक्ती हुी मंहुाराष्ट्रात राज्यस्तरार बदालीसाठी पात्रा राहुील.
७. शासकरीये सेवेते वेश केल्येानंतेर सेवाप्रिवर्षयेक अन्ये आदेश/ प्रिनयेम लागू होतेरील :-
शासकीय सेतील तिनांयुक्तीसाठी या तिनांयमंांद्वारे तितिहुत करण्यात आलेल्या अटी शतीची पूतचता करणाे आश्यक आहुे. सदार तिनांयमंांनांुसार शासकीय सेत तिनांयुक्ती झाल्यानांतर, संबंतिधात शासकीय कमंचचाऱ्यास, शासकीय सेच्या कालाधाीत, मंहुाराष्ट्रा नांागरी सेा तिनांयमं, तसेच सेातिषयक बाबंसंदाभाचत राज्य शासनांानांे ेळोेळोी अतिधातिनांयमं / अतिधासूचनांा/ शासनां तिनांणाचय / शासनां आदाेशाद्वारे तिनांगचतिमंत केलेले अन्य तिनांयमं लागू राहुतील.

No. SRR 2022/C.R. 46/Energy-1.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post Superintending Engineer, Group-A (Gazetted), in the office of Chief Electrical Inspector under the administrative control of the Industries, Energy, Labour and Mining Department of the Government of Maharashtra, namely :-
1. Short title, commencement and application :–
1. These rules may be called the "Superintending Engineer, Group-A (Gazetted) in the office of Chief Electrical Inspector (Recruitment) Rules, 2024.
2. Definition :– In these rules unless the context requires otherwise,-
(a) "The Government" means the Government of Maharashtra ;
(b) "Department" means the Industries, Energy, Labour and Mining Department of the Government ;
(c) "Chief Electrical Inspector" means in the office of Chief Electrical Inspector under the Administrative control of the Industries, Energy, Labour and Mining Department of the Government of Maharashtra ;
(d) "Degree" means a degree in Electrical Engineering of a statutory university or any other qualification declared by the Government to be equivalent thereto ;
(e) "Appointing Authority" means Hon'ble Chief Minister, Government of Maharashtra, who is competent to appoint a candidate to the concerned post in the Government Service ;
(f) "Eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department of the Government, from time to time.
3. Mode of Appointment :–
Appointment to the post of Superintending Engineer. Group-A (Gazetted), in the office of the Chief Electrical Inspector shall be made by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Electrical Inspector. Group-A(Gazetted), in the office of the Chief Electrical Inspector and having not less than five years regular and continuous service on the said post and possessing a degree.
4. The Provision regarding Hindi and Marathi Language Examination :–
A person to be appointed to the post mentioned in rule 3 by promotion shall pass the Marathi and Hindi language examinations as per the rules made in that behalf by the Government from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.
5. Provision regarding possessing Certificate in Computer Professional :–
A person to be appointed to the post mentioned in rule 3 by promotion shall possess a Certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

A person appointed to the post mentioned in rule 3 shall be liable for transfer anywhere in the State of Maharashtra.
7. Applicability of other Orders / Rules regarding Services after entry into
Government Service :–
The terms and conditions specified by the Government, subsequent to the appointment of any Government Servant in any rules, orders or resolutions issued by the Government from time to time, shall also be applicable to the Government Servant.
