Whereas, Development Plan of Additional area of Chandrapur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2294-1315-CR-253-96-UD-9, dated the 2nd June, 1997 and has come into force with effect from the 15th August, 1997 (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional and Town Planning Act. 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing Survey Nos. 16, 17, 43, 44. 45, 46, 48, 49, 50, 52, 53, 55 of Mouje Wadgaon, land bearing Survey Nos. 20, 22, 23, 34/1, 30, 32, 31, 41/1, 46, 45, 47, 76, 82, 83, 90/1, 91, 92, 79, 78, 69, 68/3, 69/3, 107/1Chh, 107/1Ch, 107/1J, 107/46. 107/45, 107/44. 107/43, 107/42 of Mouje Dewai Govindpur Raiyyatwari & land bearing Survey Nos. 14, 15, 16. 17 of Mouje Dewai Govindpur Tukum is reserved for Mul-Chandrapur-Nagpur 60.00 Mt. wide and 5.00 K. Mt. long development plan road (hereinafter referred to as "the said Development Plan Proposal");
And whereas, the Chandrapur Municipal Corporation being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution No. 68, dated 29th December, 2018, has resolved to modify the said Development Plan proposal by deleting the development plan road of 60.00 m. width and about 5.00 km. long and to include the land in the Residential Zone deleted from the said road and accordingly submitted to the Government, for its final sanction, a modification proposal as per the provisions of Sub-section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed modification under the said proposal should be sanctioned as detailed below with some modifications:--

And whereas, in the above sanctioned modification only land owner of Survey No. 107/45/B of Mouje Dewai Govindpur Raiyyatwari admeasuring area of 2160.87 Sq. Mt. out of the total land admeasuring area 3600 Sq. Mt. under the modification have deposited Rs. 3,72,210/- towards the 50% Government share of 5% premium amount as per the value of the land as prescribed in the Annual Statement of Rates (ASR) for the year 2022-2023 in the Government Treasury on 31st August, 2023 through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs. 3,72,210/- payable to the Planning Authority has been deposited with the Commissioner, the Chandrapur Municipal Corporation on 25th August, 2023;
Now therefore, in exercise of the powers conferred on it under Sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated 02nd June, 1997 as follows.
In the Schedule of Modifications appended to the Notification dated 02 June, 1997 sanctioning the said Development Plan, the following new entry shall be added after the last entry-

" Development plan road under land bearing No. 107/45/B of Mouje Dewai Govindpur Raiyyatwari is kept 18.00 Mt. from North side instead of 60.00 Mt. in development plan of Chandrapur Town (Extended area) as shown on the plan and area of land owner admeasuring 2160.87 Sq. A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Commissioner, the Chandrapur Municipal Corporation, Dist. Chandrapur during office hours on all working days for a period of one month.

Whereas, Development Plan of Sewagram (N.M.C.) has been sanctioned by the Director of Town Planning, Maharashtra State, Pune vide Notification No. D. P. Sewagram (N.M.C.) TPV-6-7691, dated 19th December,1989 and came into force with effect from 15th July,1990 (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, the land admeasuring area 11.77 Hector bearing Survey No. 109/1, 109/2, 109/3, 112/2, 113/1, 113/2, 130/1, 130/3 & 131 of Mouje Kamathwada is included in "Agriculture Zone" (hereinafter referred to as "the said Land");
And whereas, the Chief Executive Officer, Zilla Parishad, Wardha being the Planning Authority (hereinafter referred to as " the said Planning Authority"), vide its General Body Resolution No. 3, dated 02nd June, 2010 & Resolution No. 8(5), dated 17th August, 2010 has resolved to delete the said land from Agriculture Zone and include the same in Residential Zone and accordingly submitted a modification proposal to the Government, for its sanction as per the provisions of Sub-section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification ");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned with certain conditions;
And whereas, the said Lands Owners have deposited Rs. 3,71,822/- towards the 50% Government share of 5% premium amount as per the rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2022-23 in the Government Treasury on 24th August, 2023 through the Assistant Director of Town Planning, Wardha Branch, Wardha and remaining 50% of the 5% premium amount Rs. 3,71,822/- payable to the Planning Authority has been deposited with the Chief Executive Officer, Zilla Parishad, Wardha on 21st November, 2023;
Now therefore, in exercise of the powers conferred on it under Sub-section (2) of Section 37 of the said Act, the Government of the Maharashtra hereby, sanctions the Proposed Modification with certain conditions and for that purpose amends the aforesaid Notification dated 19th December,1989 as follows.
" In the Schedule of Modifications appended to the Notification dated 19th December, 1989 sanctioning the said Development Plan, the following new entry shall be added after the last entry "
ENTRY
" The land bearing Survey No. 109/1, 109/2, 109/3, 112/2, 113/1, 113/2, 130/1, 130/3 & 131 totally admeasuring 11.77 hector of Mouje Kamathwada is deleted from Agriculture Zone and included in Residential Zone as shown on the plan, subject to the following conditions."
Condition No. 1.—In the layout of the said Land, in addition to 10% compulsory open space as per the prevailing Development Control Regulations for Sewagram city, it will be compulsory to provide an additional 10% amenity space.

Condition No. 3.—It is compulsory for the land owner/developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewerage & drainage etc.
Condition No. 4.—If the above said infrastructure amenities are proposed to the developed by stages, then sale of plots shall be monitored by the Chief Executive Officer, Zilla Parishad, Wardha in relation to expected development of civic facilities as per the stages given below -
(a) After final approval of layout Sale of 25% of the total plots shall be permissible.
(b) After completion of 40% basic Amenities. Sale of 50% of the total plots shall be permissible.
(c) After completion of 60% basic Amenities. Sale of 75% of the total plots shall be permissible.
(d) After completion of 80% basic Amenities. Sale of 90% of the total plots shall be permissible.
(e) After completion of 100% basic Amenities. Sale of 100% of the total plots shall be permissible.
In case of violation of the above, the layout and Non-Agriculture permission will be eligible for revocation. If Group Housing Scheme is proposed in the layout, then occupation certificate shall not be given unless all the basic amenities are fully developed.
A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Executive Officer, Zilla Parishad, Wardha during office hours on all working days for a period of one month.

Whereas, Revised Development Plan of Nagpur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, Dated 7th January, 2000 and finally sanctioned by the Government vide Notification No. TPS-2400-1628- CR-200-2000-UD-9, Dated 10th September, 2001 & has come into force with effect from the 1st March, 2000 & 21st September, 2001 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") Also Nagpur Improvement Trust has been declared as "Planning Authority" for the 7 Improvement Scheme being implemented by the Nagpur Improvement Trust vide Government Notification No.TPS-2401-855-CR-76-2000-UD-9, Dated 27th February, 2002 (hereinafter referred to as 'the said Planning Authority");
