आणि ज्ााअर्थी, उक्त प्रादेशिक ाोजनेंतर्गत शिर्डी मंजूर नागरी विकास कें नकाशानुसार मौजे साकुरी, तालुका राहाता ोथील गट क्रमांक ३०९ (पैकी) व गट क्रमांक ३१० (पैकी) ही जागा ४५.०० मीटर रुंद प्रादेशिक ाोजना रस्ता ाासाठी आरक्षित (ाात ाापुढे "उक्त आरक्षण" असे संबोधिले आहे) असून ााकरिता समुचित प्राधिकरण, जिल्हाधिकारी, अहमदनगर (ाात ाापुढे "उक्त प्राधिकरण" असे संबोधिले आहे) आहेत ;

आणि ज्ााअर्थी, उक्त प्राधिकरणाने उक्त आरक्षित जागा, उक्त प्रादेशिक ाोजना अंमलात आल्ााच्ाा दिनांकापासून दहा वषाच्ाा कालावधीमध्ो संपादन केली नाही ;

आणि ज्ााअर्थी, सोबतच्ाा परिशिष्टामध्ो वर्णन केलेल्ाा (ाात ाापुढे "उक्त जागा" असे संबोधिले आहे) आरक्षित जागेसाठी संबंधित मालकाने उक्त अधिनिामाचे कलम १२७ चे उप-कलम (१) नुसार समुचित प्राधिकरण असलेल्ाा उक्त प्राधिकरणावर दिनांक ३ मार्च २०२० रोजी सूचना (ाात ाापुढे "उक्त सूचना" असे संबोधिले आहे) बजावून उक्त जागा, उक्त प्राधिकरणाने विहित कालावधीत संपादन केली नसल्ााचे कळविले होते ;

(१)२ महाराष्ट्र शासन राजपत्र, भाग एक - नाशिक विभागीा पुरवणी, गुरुवार ते बुधवार, एप्रिल ४ - १०, २०२४ / चैत्र १५ - २१, शके १९४६ आणि ज्ााअर्थी, उक्त अधिनिामाचे कलम १२७ चे उप-कलम (१) नुसार उक्त सूचना बजावल्ाानंतरही, उक्त प्राधिकरणाने विहित कालावधीत उक्त आरक्षित जागा संपादन केली नाही ;

आणि ज्ााअर्थी, उच्च न्ाााालााने, उक्त जागेच्ाा मालकांनी दाखल केलेल्ाा रिट ााचिका क्रमांक ११८०६/२०२२ मध्ो दिनांक २७ जुलै २०२३ रोजीच्ाा आदेशान्वो उक्त आरक्षित जागा उक्त अधिनिामाचे कलम १२७ मधील तरतुदींनुसार व्ापगत झाल्ााचे आदेश पारित केले आहेत ;

आणि ज्ााअर्थी, उक्त अधिनिामाच्ाा कलम १२७ चे उप-कलम (२) नुसार उक्त प्रादेशित ाोजनेमधील उक्त आरक्षण उक्त जागेपुरते व्ापगत झाल्ााबाबत आदेश निर्गमित करणे आवश्ाक झाले आहे.

आता, त्ााअर्थी, उक्त अधिनिामाचे कलम १२७ चे उप-कलम (२) नुसार प्राप्त अधिकारात राज्ा शासन उक्त जागेवरील उक्त प्रादेशिक ाोजनेतील उक्त आरक्षण व्ापगत झाल्ााचे अधिसूचित करीत आहे. अशाप्रकारे मुक्त झालेली जागा उक्त प्रादेशिक ाोजनेतील लगतच्ाा अनुोा असलेल्ाा भूवापराप्रमाणे जमीन मालकास विकासाकरिता उपलब्ध होईल.

(१) प्रस्तुत आदेशान्वो उक्त प्रादेशिक ाोजनेतील आरक्षणातून व्ापगत झालेले क्षेत्र दर्शविणााा भाग नकाशाची प्रत जिल्हाधिकारी, अहमदनगर ाांच्ाा र्कााालाात र्कााालाीन वेळेत नागरिकांच्ाा अवलोकनार्थ एक महिन्ाापात ठेवण्ाात आली आहे.

(२) सदर आदेश, महाराष्ट्र शासनाच्ाा ... ाा संकेतस्थळावरदेखील उपलब्ध आहे.

No. TPS-1622/1466/CR-179/2023/UD-9.– Whereas, the Government of Maharashtra in Urban Development Department vide Notiﬁ cation No. TPS-1600/932/CR-32 (Part-1) (A)/UD-9, dated 14th July 2005 has sanctioned the Regional Plan of Ahmednagar Region under Section 15 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has came into force with eﬀect from 31st October 2005 (hereinafter referred to as "the said Regional Plan") ;

and whereas, in the sanctioned Urban Growth Center Plan of Shirdi in the Regional Plan, Land bearing Gat No. 309 (Pt.) and Gat No. 309 (Pt.) of Mouja Sakuri, taluka Rahata are reserved as 45.00 metersमहाराष्ट्र शासन राजपत्र, भाग एक - नाशिक विभागीा पुरवणी, गुरुवार ते बुधवार, एप्रिल ४ - १०, २०२४ / चैत्र १५ - २१, शके १९४६ ३ wide Regional Plan Road (hereinafter referred to as "the said Reserved Land"). The Appropriate Authority for the said Reservation is Collector, Ahmednagar (hereinafter referred to as "the said Authority") ;

and whereas, the said Land has not been acquired by the said Authority within 10 (Ten) years from the date on which the said Reserved Regional Plan came into force ;

and whereas, the owner of the land as mentioned in the Schedule (hereinafter referred to as "the said Land") had served a Notice dated 3rd March 2020 under Section 127 (1) of the said Act (hereinafter referred to as "the said Notice") on the said Authority, informing that the said Land has not been acquired by the said Authority, within the stipulated period ;

and whereas, even after service of the said Notice as aforesaid, the said Land has not been acquired within stipulated time limit from the date of the service of said Notice under sub-section (1) of Section 127 of the said Act, by the said Authority ;

and whereas, Hon'ble High Court in Writ Petition No. 11806/2022, ﬁ led by the owner of the said Land vide it's Order dated 27th July 2023 held that, the said Reservation to the extent of the said Land stands lapsed, under Section 127 of the said Act ;

and whereas, Now, it becomes expedient to notify by an order under Section 127 (2) of the said Act that the said Reservation on the said Land, in the said Regional Plan has been lapsed.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and all other powers enabling it in that behalf, the Government of Maharashtra, hereby notiﬁ es that the said Reservation on the said Land stands lapsed from the said Regional Plan. The said Land so released shall be available to the Land Owner for the purpose of Development as otherwise permissible in the case of adjacent land under the said Regional Plan.

(1) A copy of the Part Plan showing the details of land released from Reservation in the said Development Plan vide this Order is available in the Oﬃ ce of the Collector, Ahmednagar during Oﬃ ce hours on all working days for inspection of the public upto one month.

(2) This Order shall also be available on the Government website www.maharashtra.gov.in

आणि ज्ााअर्थी, वरीलप्रमाणे उक्त अधिनिामाचे कलम १२७ चे उप-कलम (१) नुसार उक्त सूचना बजावल्ाानंतरही, उक्त प्राधिकरणाने विहित कालावधीत उक्त आरक्षणाखालील जागा संपादन केली नाही ;

आणि ज्ााअर्थी, उच्च न्ाााालााने उक्त जागेच्ाा मालकांनी दाखल केलेल्ाा रिट ााचिका क्रमांक १३५२२/२०१८ मध्ो दिनांक २४ जून २०१९ रोजीच्ाा आदेशान्वो, उक्त विकास ाोजनेतील उक्त आरक्षणाने बाधित ४५६१.०० चौरस मीटर एवढे क्षेत्र हे आरक्षणातून मुक्त झाल्ााचे जाहीर केले आहे व ााचिकाकत्ााना सदरची जमीन अन्ा प्राोजनार्थ एक वर्षापात वापरता ोणार नाही तसेच सदर एक वर्षाच्ाा कालावधीत महानगरपालिकेने सदरची जागा संपादित करावी अन्ाथा एक वर्षानंतर अर्जदार ाांना सदरची जागा लगतच्ाा भूवापरानुसार विकास करण्ाासाठी उपलब्ध राहील, असा आदेश पारीत केलेला आहे ;

आणि ज्ााअर्थी, उक्त जागेच्ाा मालकांनी रिट ााचिका क्रमांक १३५२२/२०१८ मधील दिनांक २४ जून २०१९ रोजीचे आदेशाचे अंमलबजावणी होण्ाासाठी दाखल केलेल्ाा रिट ााचिका क्रमांक २१०१/२०२२ मध्ो उच्च न्ाााालााने दिनांक १५ सप्टेंबर २०२२ रोजीच्ाा आदेशान्वो उक्त विकास ाोजनेतील उक्त जागेवरील उक्त आरक्षण व्ापगत झाल्ााबाबत उक्त अधिनिामाचे कलम १२७ (२) चे तरतुदीन्वो आरक्षण व्ापगत झाल्ााची अधिसूचना दिनांक १० ऑक्टोबर २०२२ पात निर्गमित करणेबाबत आदेशित केले आहे ;

आणि ज्ााअर्थी, आता उक्त अधिनिामाच्ाा कलम १२७ चे उप-कलम (२) नुसार उक्त विकास ाोजनेमधील आरक्षण उक्त जागेपुरते व्ापगत झाल्ााबाबत आदेश निर्गमित करणे आवश्ाक झाले आहे ;

आणि त्ााअर्थी, उक्त अधिनिामाच्ाा कलम १२७ चे उप-कलम (२) नुसार प्राप्त अधिकारात राज्ा शासन उक्त जागेवरील, उक्त विकास ाोजनेतील आरक्षण व्ापगत झाल्ााचे अधिसूचित करीत आहे. अशाप्रकारे मुक्त झालेली जागा उक्त विकास ाोजनेतील लगतच्ाा अनुोा असलेल्ाा भूवापराप्रमाणे जमीन मालकास विकासाकरिता उपलब्ध होईल.

No. TPS-3521/348/CR-80/2023/UD-9.– Whereas, the Government of Maharashtra in Urban Development Department vide Notiﬁ cation No. TPS-3588/194/CR-97/UD-9, dated 6th January 1993 has sanctioned the Revised Development Plan of Jalgaon (Origional Limit) City (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has came into force with eﬀect from 15th February 1993 ;

and whereas, in the said Development Plan, as mentioned in the Schedule, land bearing Survey No. 115/2/3/1 Pt. of Mouje Jalgaon, taluka and district Jalgaon (hereinafter referred to as "the said Land") is reserved as 18.00 meters wide Development Plan Road (hereinafter referred to as "the said Reservation").

The Appropriate Authority for the said Reservation is Municipal Corporation, Jalgaon (hereinafter referred to as "the said Authority") ;

and whereas, the said Land has not been acquired by the said Authority within 10 (Ten) years from the date on which the said Development Plan came into force ;

and whereas, the owner of the said Land had, served a Notice dated 14th September 2016 under Section 127 (1) of the said Act (hereinafter referred to as "the said Notice") to the said Authority, informing that the said Land has not been acquired by the said Authority, within the stipulated period ;

and whereas, even after service of the said Notice as aforesaid, the said Land has not been acquired within a stipulated time limit from the date of the service of said Notice under sub-section (1) of Section 127 of the said Act, by the said Authority ;

and whereas, Hon'ble High Court in Writ Petition No. 13522/2018, ﬁ led by the owner of the said Land, vide it's Order dated 24th June 2019 held that, the said Reservation to the said Land admeasuring 4651 sq. mtrs. stands released from reservation. However, the petitioner shall not use the said Land for any purpose for the period of one year. Within a period of one year the Respondent-Corporation may acquire the property by following due process of law. If within a period of one year the Respondent- Corporation does not acquire the property then the petitioner will be entitled to use the said property as the use of adjacent land ;

and whereas, Writ Petition No. 2102/2022 ﬁ led by the Owner of the said Land for implementation of the Order dated 24th June 2019 of this Hon'ble High Court in Writ Petition No. 13522/2018 vide it's Order dated 15th September 2022 has directed the Government to issue the Notiﬁ cation under Section 127 (2) of the said Act, in respect of lapsing of reservation on the said Land ;

and whereas, now it becomes expedient to notify by an Order under Section127 (2) of the said Act that the said Reservation on the said Land, in the said Development Plan has been lapsed.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and all other powers enabling it in that behalf, the Government of Maharashtra, hereby notiﬁ es that the said Reservation on the said Land stands lapsed from the said Development Plan. आणि ज्ााअर्थी, उच्च न्ाााालााने, उक्त जागेच्ाा मालकांनी दाखल केलेल्ाा रिट ााचिका क्रमांक ९६६१/२०२१ मध्ो दिनांक २५ नोव्हेंबर २०२२ रोजीच्ाा आदेशान्वो उक्त विकास ाोजनेतील उक्त आरक्षण, उक्त अधिनिामाचे कलम १२७ मधील तरतुदींनुसार व्ापगत झाल्ााचे जाहीर केले आहे व तदनुषंगाने आरक्षण व्ापगत झालेबाबत आदेश लवकरात लवकर प्रसिद्ध करण्ाात ाावे, असा आदेश पारित केलेला आहे ;

आता, त्ााअर्थी, उक्त अधिनिामाचे कलम १२७ चे उप-कलम (२) नुसार प्राप्त अधिकारात राज्ा शासन उक्त जागेवरील उक्त विकास ाोजनेतील आरक्षण व्ापगत झाल्ााचे अधिसूचित करीत आहे. अशाप्रकारे मुक्त झालेली जागा उक्त विकास ाोजनेतील लगतच्ाा अनुोा असलेल्ाा भूवापराप्रमाणे जमीन मालकास विकासाकरिता उपलब्ध होईल.

ORDER

No. TPS-3523/776/CR-19/2024/UD-9.– Whereas, the Government of Maharashtra in Urban Development Department vide Notiﬁ cation No. TPS-3599/738/CR-142 (A)/UD-9, dated 11th February 2002 has sanctioned the Development Plan of Jalgaon City (Additional Area) partly under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has came into force with eﬀect from 7th April 2002 and Development Plan republished for the Excluded Part has been sanctioned by the Government of Maharashtra in Urban Development Department vide Notiﬁ caction No. TPS-3503/493/ CR-102 (A)/03/UD-9, dated 10th August 2004 and the same has came into force with eﬀect from 1st October 2004 (hereinafter referred to as "the said Development Plan") ;

and whereas, in the said Development Plan, as mentioned in the Schedule, land bearing Survey No. 454 Pt. of mouje Mehrun, taluka and district Jalgaon (hereinafter referred to as "the said Land") is shown reserved as Site No. 132 "Primary School and Playground" (hereinafter referred to as "the said Reservation"). The Appropriate Authority for the said Reservation is Municipal Corporation, Jalgaon (hereinafter referred to as "the said Authority") ;

and whereas, the said Land has not been acquired by the said Authority within 10 (Ten) years from the date on which the said Development Plan came into force ;

and whereas, the owner of the land had served a Notice on dated 14th September 2018 under Section 127 (1) of the said Act, (hereinafter referred to as "the said Notice") to the said Authority, informing that the said Land has not been acquired by the said Authority, within the stipulated period ;

and whereas, Hon'ble High Court in Writ Petition No. 9661/2021 ﬁ led by the Owner of the said Land vide it's Order dated 25th November 2022 held that, the said Reservation on the said Land stands lapsed, under Section 127 of the said Act and shall notify the lapsing of reservation by an Order as early as possible ;

and whereas, now, it becomes expedient to notify by an Order under Section 127 (2) of the said Act that the said Reservation on the Land in the said Development Plan has been lapsed.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and all other powers enabling it in that behalf, the Government of Maharashtra, hereby notiﬁ es that the said Reservation on the said Land stands lapsed from the said Development Plan. The said Land so released shall be available to the Land Owner for the purpose of Development as otherwise permissible in the case of adjacent land under the said Development Plan.

(2) This Order shall also be available on the Government website www.maharashtra.gov.in

आणि ज्ााअर्थी, उक्त जागेच्ाा मालकांनी सन २०२२-२३ ाा वर्षातील बाजारमूल्ा दर तक्त्ाानुसार ोणााा दराच्ाा ५ टक्के दराने ोणााा अधिमूल्ा रकमेपैकी शासनास देा असलेली अधिमूल्ााची ५० टक्के रक्कम रुपो ११,९७,०७५.०० सहााक संचालक, नगररचना, नाशिक शाखा, नाशिक ाांचेकडील लेखाशिर्षामध्ो दिनांक ३१ जानेवारी २०२४ रोजी जमा केलेली आहे आणि निाोजन प्राधिकरण देा असलेली ५० टक्के रक्कम रुपो ११,९७,०७५.०० मुख्ााधिकारी, ोवला नगरपरिषद, ोवला ाांचेकडे दिनांक २२ ेब्रुवारी २०२४ रोजी जमा केलेली आहे ;

आता, त्ााअर्थी, उक्त अधिनिामाचे कलम ३७ चे पोट-कलम (२) अन्वो व त्ाा अनुषंगाने असलेल्ाा इतर अधिकारांचा वापर करून उक्त विकास ाोजनेतील प्रस्तावित ेरबदलास शासन पुढीलप्रमाणे मान्ाता देत आहे आणि त्ाासाठी उपरोल्लिखित दिनांक ६ सप्टेंबर २०१३ ची विकास ाोजना मंजुरीची अधिसूचना सुधारित करण्ाात ोत आहे.

"उक्त विकास ाोजना" मंजुरीच्ाा दिनांक ६ सप्टेंबर २०१३ च्ाा अधिसूचनेच्ाा ेरबदल सूचितील शेवटच्ाा नोंदीनंतर पुढील नव्ाा नोंदीचा समावेश करण्ाात ोत आहे.

मौजे आंगणगाव ोथील सव्र्हे क्रमांक २०/१ पैकी, सव्ह क्रमांक २०/३/२-अ पैकी व सव्ह क्रमांक २४ पैकी ाा जागेतील हरित पा व १८.०० मीटर रुंद रस्त्ााने बाधित होणारे क्षेत्र वगळून उर्वरित जागा सोबतच्ाा भाग नकाशात दर्शविल्ाानुसार कृषी विभागातून वगळण्ाात ोऊ न "रहिवास विभागात" समाविष्ट करण्ाात ोत आहे.

अट क्रमांक (१) : ेरबदलाखालील क्षेत्राचा विकास करताना मंजूर एकत्रिकृत विकास निांत्रण व प्रोत्साहन निामावलीनुसार आवश्ाक किमान १० टक्के खुल्ाा जागेचे क्षेत्रासह किमान १० टक्के सुविधा क्षेत्र सोडणे व त्ााशिवाा ०.४ हेक्टर आर एवढे क्षेत्र क्रीडांगणाच्ाा आरक्षणाकरिता ठेवणे बंधनकारक राहील.

अट क्रमांक (२) : ेरबदलाखालील क्षेत्रात विकास परवानगी देताना सोडण्ाात ोणााा सुविधा क्षेत्रापैकी ५० टक्के क्षेत्र बगीचा, क्रीडांगण इत्ाादी स्वरूपाच्ाा खुल्ाा वापरासाठी काामस्वरूपी राखून ठेवणे बंधनकारक राहील.

अट क्रमांक (३) : खुल्ाा जागेसभोवताली कुंपण करणे आवश्ाक राहील.

अट क्रमांक (४) : उक्त जमिनीसाठी आवश्ाक त्ाा सर्व मूलभूत सेवा-सुविधा जमीन मालकांनी / विकसनकत्ाानी स्वखर्चाने विकसित करून पुरविणे बंधनकारक राहील. मूलभूत सुविधांमध्ो रस्ते, पाणीपुरवठा, मलनि:सारण व ड्रेनेज इ. ाांचा समावेश आहे.

अट क्रमांक (५) : उपरोक्त मूलभूत सुविधांचा विकास क्रमाने करताना एकूण अपेक्षित सुविधांचा विकास टप्प्ाा टप्प्ााने होत असताना अर्जदारांवर, एकूण जागेच्ाा भूखंड विक्रीवर पुढीलप्रमाणे बंधन राहील. मुख्ााधिकारी, ोवला नगरपरिषद, ोवला ाांनी सदर बाबींवर निांत्रण ठेवावे.

(क) अभिन्ाास अंतिमत: मंजूर झाल्ाावर .. एकूण भूखंडांपैकी २५ टक्के भूखंडांची विक्री अनुोा राहील.

(ख) सुमारे ४० टक्के मूलभूत सुविधा पूर्ण झाल्ाावर .. एकूण भूखंडांपैकी ५० टक्के भूखंडांची विक्री अनुोा राहील.

(ग) सुमारे ६० टक्के मूलभूत सुविधा पूर्ण झाल्ाावर .. एकूण भूखंडांपैकी ७५ टक्के भूखंडांची विक्री अनुोा राहील.

(घ) सुमारे ८० टक्के मूलभूत सुविधा पूर्ण झाल्ाावर .. एकूण भूखंडांपैकी ९० टक्के भूखंडांची विक्री अनुोा राहील.

(ड) सुमारे १०० टक्के मूलभूत सुविधा पूर्ण झाल्ाावर .. एकूण १०० टक्के भूखंड विक्री अनुोा राहील.

जर अभिन्ाासात समूह गृहबांधणी ाोजना विकसित करावााची असेल, तर मुख्ााधिकारी, ोवला नगरपरिषद, ोवला ाांनी विहित केल्ाानुसार सर्व मूलभूत सुविधा विकसित झाल्ााशिवाा "भोगवटा प्रमाणपत्र" देण्ाात ोणार नाही.

उक्त मंजूर ेरबदल दर्शविणारी प्रस्तुत अधिसूचना / भाग नकाशा मुख्ााधिकारी, ोवला नगरपरिषद, ोवला, जिल्हा नाशिक ाांच्ाा र्कााालाात, नागरिकांच्ाा अवलोकनार्थ एक महिन्ााच्ाा कालावधीसाठी ठेवण्ाात ोत आहे.

Notiﬁcation

No. TPS-1123/144/C.R.-70/2023/UD-9.– Whereas, Second Revised Development Plan for the City of Yeola has been sanctioned Partly by the Government vide Urban Development Department's१२ महाराष्ट्र शासन राजपत्र, भाग एक - नाशिक विभागीा पुरवणी, गुरुवार ते बुधवार, एप्रिल ४ - १०, २०२४ / चैत्र १५ - २१, शके १९४६ Notiﬁ cation No. TPS-1113/592/CR-272(A)/2013/UD-9, dated 6th September 2013 and the same has come into force with eﬀect from 6th October 2013 (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah.

Act No. XXXVII of 1966) (hereinafter referred to as " the said Act") ;

and whereas, in the said Development Plan area admeasuring 9.99 hectare of land bearing Survey No. 20/1 (Pt.), Survey No. 20/3/2-A (Pt.) and Survey No. 24 (Pt.) of mouje Angangaon is included in "Agriculture Zone", Green Belt and aﬀected by 18.00 meters wide road (hereinafter referrd to as "the said Land") ;

and whereas, the Yeola Municipal Council, Yeola being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide it's General Body Resolution No. 49, dated 15th September 2022 has resolved to delete the said Land from Agriculture Zone and to include the same in "Residential Zone" and accordingly, submitted a Modiﬁ cation Proposal to the Government, for it's sanction as per the provisions of sub-section (1) of Section 37 of the said Act vide it's letter dated 10th February 2023 (hereinafter referred to as "the said Proposed Modiﬁ cation") ;

and whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the Proposed Modiﬁ cation, should be sanctioned is some conditions ;

and whereas, for the lands owners have deposited Rs. 11,97,075.00 towards the 50 per cent Government share of 5 per cent premium amount as per the rate of the said Lands as prescribed in the Annual Statement of Rates (ASR) for the year 2022-23 in the Government Treasury on 31st January 2024 through the Assistant Director of Town Planning, Nashik Branch, Nashik and remaining 50 per cent of the 5 per cent premium amount Rs. 11,97,075.00 payable to the Planning Authority has been deposited with the Chief Oﬃ cer, Yeola Municipal Council, Yeola on 22nd February 2024.

Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modiﬁ cation and for that purpose amends the aforesaid Notiﬁ cation, dated 6th January 2013 as follows.

In the Schedule of Modiﬁ cations appended to the Notiﬁ cation, dated 28th June 2002 sanctioning the said Development Plan, the following new entry shall be added after the last entry –

ENTRY

The area of land bearing Survey No. 20/1 Pt., Survey No. 20/3/2-A Pt. and Survey No. 24 Pt. mouje Angangaon excluded area under Green Belt and 18.00 meters wide road is deleted from Agriculture Zone and included in "Residential Zone" as shown on the Plan.–

Condition No. 1 :– While granting development permssion in the area under modiﬁ cation in addition to 10 per cent open space necessary, 10 per cent additional Amenity Space shall be provided as per uniﬁ ed development control and a part from that it will be compulsory to reserve 0.4 hectare area for the Playground reservation.

Condition No. 2 :– While granting development permission in the area under modiﬁ cation, it will be compulsory to keep 50 per cent of the Amenity space for the open purpose such as Garden, Playground etc., forever.

Condition No. 3 :– It is necessary to construct compound around the open space.

Condition No. 4 :– It is compulsory for the Land Owner / Developer to provide all the Basic Amenities required for the land under modiﬁ cation at his own cost. The Basic Amenities included as Road, Water Supply, Sewerage and Drainage etc.

Condition No. 5 :– lf the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Oﬃ cer, Yeola Municipal Council, Yeola in relation to development of Basic Amenities as per the stages given below.

(a) After ﬁ nal approval of layout .. Sale of 25 per cent of the total plots shall be

permissible.

(b) After completion of 40 per cent .. Sale of 50 per cent of the total plots shall be Basic Amenities.

(d) After completion of 80 per cent .. Sale of 90 per cent of the total plots shall be Basic Amenities.

(e) After completion of 100 per cent .. Sale of 100 per cent permissible.

Basic Amenities.

If Group Housing Scheme is proposed in the layout, then "Occupation Certiﬁ cate" shall not be given by Chief Oﬃ cer, Yeola Municipal Council, Yeola unless all the Basic Amenities are fully developed.

A copy of the said Notiﬁ cation alongwith the Part Plan showing the aforesaid sanctioned Modiﬁ cation shall be available for inspection of the General Public, in the Oﬃ ce of the Chief Oﬃ cer, Yeola Municipal Council, Yeola during the oﬃ ce hours on all working days for a period of one month.

This Notiﬁ cation shall also be available on the Government website www.maharashtra.gov.in

त्ााअनुषंगाने जिल्ह्यात काादा व सुव्ावस्थेचा प्रश्न निर्माण होण्ााची शक्ाता नाकारता ोत नाही. ाास्तव, दिनांक २५ ेब्रुवारी २०२४ रोजीचे ००.०१ वाजेपासून ते दिनांक १० मार्च २०२४ रोजीचे रात्री २३.५५ वाजेपावेतो मुंबई पोलीस काादा, कलम ३७ (१) (३) चे प्रतिबंधात्मक आदेश जारी होऊ न प्रसिद्धी होणेस पोलीस अधीक्षक, धुळे ाांनी त्ाांचेकडील पत्र क्रमांक जिविशा/प्रतिबंधात्मक आदेश/६७०/२०२४/धुळे, दिनांक २१ ेब्रुवारी २०२४ अन्वो विनंती केलेली आहे.

जिल्ह्यात काादा व सुव्ावस्था अबाधित राखण्ााकामी पोलिसांना मदत व्हावी, म्हणून पोलीस अधीक्षक, धुळे ाांनी सादर केलेला अहवाल व वरील परिस्थिती पाहता माझी खात्री झालेने मी, अभिनव गोाल, जिल्हाधिकारी, धुळे, मला मुंबई पोलीस अधिनिाम, १९५१ चे कलम ३७ (१) (३) नुसार प्राप्त असलेल्ाा अधिकारांचा वापर करून धुळे जिल्ह्यातील कोणत्ााही इसमास खालील कृत्ो करण्ाास ााद्वारे मनाई करीत आहे.

(अ) सोटे, तलवारी, बंदुका, भाले, सुरे, लाठा किंवा शारीरिक दुखापती करण्ाासाठी वापरात ोतील अशी कोणतीही (ड) सार्वजनिक शांतता धोक्ाात ोईल अशी भाषणे करणे, हावभाव करणे अथवा सोंग आणणे ;

(इ) जाहीरपणे घोषणा करणे, गाणे म्हणणे, वाे वाजविणे ;

() कोणत्ााही व्ाक्तीची आकृती किंवा प्रतिमेचे प्रदर्शन करणे ;

(ग) सभा घेण्ाास, मिरवणुका काढण्ाास, पाच किंवा पाचपेक्षा जास्त व्ाक्ती एकत्र ोण्ाास मनाई करीत आहे ;

मुंबई पोलीस अधिनिाम, १९५१ चे कलम ३७ (१) (३) हा आदेश ज्ाांना लाठी अगर तत्सम वस्तू घेतल्ााशिवाा चालता ोत नाही, अशा अपंग इसमांना लागू नाही. तसेच शासनाच्ाा सेवेतील ज्ाा व्ाक्तींना आपल्ाा वरिष्ठांचे आदेशानुसार कर्तव्ापूर्तीसाठी हत्ाार बाळगणे आवश्ाक आहे, त्ाांना लागू होणार नाही.

तसेच, मुंबई पोलीस अधिनिाम, १९५१ चे कलम ३७ (१) (३) नुसार पाचपेक्षा जास्त व्ाक्तींचा समावेश असलेल्ाा कोणत्ााही मंडळीस (जमावास) किंवा मिरवणुकीस मनाई करीत आहे व सदर कालावधीत सभा, मिरवणुका, मोर्चे, मिटिंग, र्कााक्रम व रॅली इत्ाादी परवानगीबाबत स्थानिक पोलीस स्टेशनच्ाा अधिकााांनी काादा व सुव्ावस्था राखणेबाबत ाोग्ा तो निर्णा घेऊन परवानगी ावी. अशी देण्ाात आलेली परवानगी, लग्न समारंभ अगर प्रेताात्रेच्ाा जमावास शासनाने वेळोवेळी दिलेले निबध लागू असतील.

सदरचा आदेश हा दिनांक २५ ेब्रुवारी २०२४ रोजीचे ००.०१ वाजेपासून ते दिनांक १० मार्च २०२४ रोजीचे रात्री २३.५५ वाजेपावेतो संपूर्ण धुळे जिल्ह्यात अंमलात राहील.
