BY DIRECTOR OF TOWN PLANNING

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

ORDER

No. D.T.P-D.P.Morshi (AA)-Sec-127(2)-Order-TPV-VI-1928.—

Whereas, the Development Plan of Additional Limit of Morshi Municipal Council has been sanctioned as per the provisions of Section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") by the Government in Urban Development Department vide its Notification No. TPS-2803-1698-CR-377(B)-2003-UD-30, dated 11th July, 2005 (hereinafter referred to as " the said Notification ") & came into force with effect from dated 1st September, 2005 (hereinafter referred to as " the said Sanctioned Development Plan of Additional Limit ") ;

And whereas, in the said Sanctioned Development Plan of Additional Limit, an approximate area of 0.23 HA. & 0.37 HA. of the land bearing S. No. 13 of Mouza Yerala, Taluka Morshi are respectively affected by Reservation No. 16 " Dispensary & Maternity Home " and Reservation No. 17 " Shopping Center " (hereinafter referred to as " the said Reservations ") for which Appropriate Authority for acquisition and Development of the said Reservations is Municipal Council, Morshi (hereinafter referred to as " the said Appropriate Authority ") ;

And whereas, the land under said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Development Plan of Additional Limit come into force ;

And whereas, the concerned land owner (hereinafter referred to as " the said land Owner "), of the land bearing S. No. 13/2, area admeasuring 1.63 HA. of Mouza Yerala, Tal. Morshi (hereinafter referred to as " the said land ") had served a notice on dated 12th November, 2018 as per provisions of Section 127(1) of the said Act in respect of the areas affected by the said Reservations (hereinafter referred to as " the said Notice ") on the said Appropriate Authority and the same has received to Appropriate Authority on same day ;

And whereas, the said land under the said Reservation are not acquired or no steps as required as per the provisions of Section 127(1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said Notice by the said land owner ;

And whereas, the Chief Officer, Municipal Council, Morshi has submitted the proposal vide it's letter No. 458/ 2023, dated 29th September, 2022 to issue an order in respect of lapsing of the said Reservations respectively on areas approximately 2340 Sq. mt. & 625 Sq. mt. of the said Land under the provisions of Section 127(2) of the said Act ;

And whereas, the Joint Director of Town Planning, Amravati Division, Amravati has submitted report vide it's letter No. 1004, dated 4th August, 2023; mentioned mainly therein that, the said Reservations on areas of concerned Land Owner have lapsed due to no action of land acquisition of area affected by the said Reservations in stipulated period from the date of service of the said notice by the said Appropriate Authority;

And whereas, as per the Non-agricultural Layout Plan of said Land, it is clear that, areas affected by the said Reservations are 2340 Sq. mt. & 625 Sq. mt. respectively;

And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Development Plan of the Additional Limit, the Director of Town Planning, Maharashtra State, Pune is of theopinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the Reservation No. 16 " Dispensary & Maternity Home " fully on area admeasuring approximately 2340 Sq. mt. (0.2340 HA.) and Reservation No. 17 " Shopping Center " partly on area admeasuring approximately 625 Sq. mt. (0.0625 HA.) of the said land ; ४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, ह्य १८-२४, २०२४/ २९-म् ४, ॅ १९४६ And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December, 2016, has delegated the powers exercisable by it under the provisions of Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said land as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows—

After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Development Plan, the following new entry shall be added :—

Note :–1. The said Land so released from the said Reservation shall become available to the said Land Owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan of Additional Limit.

2. A copy of the part plan of the said Sanctioned Development Plan of Additional Limit showing the part area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Morshi, District Amravati during office hours on all working days for inspection to public upto one month.

3. This Order shall also be published on the Directorate's official website www.dtp.maharashtra.gov.in.
