MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No. D.T.P-D.P.Umarkhed (R)-Sec-127(2)-Order-TPV-VI-1936-2024.—
Whereas, the Revised Development Plan of Umarkhed Municipal Council has been sanctioned as per the provisions of Section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") by the Government in Urban Development Department vide its Notification No. TPS-2798-1026-CR-55-98-UD-13, dated 27th January, 1999 (hereinafter referred to as " the said Notification ") & came into force with effect from dated 15th April, 1999 (hereinafter referred to as " the said Sanctioned Revised Development Plan ") ;
And whereas, in the said Sanctioned Revised Development Plan, the land bearing S. No. 31 (Part) of Mouza Umarkhed, Taluka Umarkhed is affected by Reservation No. 28 of " Housing for Dishoused " an approximate area of 1.3244 Ha. (hereinafter referred to as " the said Reservation ") for which Appropriate Authority for acquisition and development of the said Reservation & said Road is Municipal Council, Umarkhed (hereinafter referred to as " the said Appropriate Authority ") ;
And whereas, the land under said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Revised Development Plan come into force ;
And whereas, the concerned land owner (hereinafter referred to as " the said land Owner "), of the land bearing S. No. 331/2, area admeasuring 0.89 Ha. of Mouza Umarkhed, Part 2, Tal. Umarkhed (hereinafter referred to as " the said Land ") had served a notice on dated 19th August, 2019 through Adv. J. R. Pawar as per the provisions of Section 127(1) of the said Act in respect of the areas affected by the said Reservation (hereinafter referred to as " the said Notice ") on the said Appropriate Authority and the same has received to Appropriate Authority on 21st August 2019 ;
And whereas, the said land under the said Reservation is not acquired or no steps as required as per the provisions of Section 127(1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said Notice by the said land owner ;
And whereas, in Writ Petition No. 5195/2021 filed by the Land owner Shri Bhagwanrao Shamrao Shinde as per latest 7/12 Extract of the said Land, the Hon'ble High Court of Judicature at Mumbai, Nagpur Bench as directed vide it's decision dated 24th August 2023 (hereinafter referred to as " the said Judgement ") that, the said Reservation (Reservation Number is mentioned in one place in the said Judgement as 22 instead of 28) on the said Land has lapsed and accordingly the Respondent No. 1 to take necessary steps to notify the lapsing of said reservation on the said Land ;
And whereas, the Chief Officer, Municipal Council, Umarkhed has submitted the proposal vide it's letter No. 346/ 2023-24, dated 4th October, 2023 to issue an order in respect of lapsing of the said Reservations under the provisions of Section 127(2) of the said Act as per the said Judgement of the Hon'ble High Court ;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati has submitted report vide it's letter No. 209, dated 16th February, 2024; mentioned mainly therein that, it is necessary to issue order under the provisions of Section 127(2) of the said Act as per the directed by the Hon'ble High Court in respect of lapsing of said Reservation on the said Land ;
And whereas, as per the Measurement Plan (M. R. No. 44/2019, dated 16th February 2019) of the said Land, it is clear after due verification that, area affected by the said Reservation on the said Land is measured as 8068 Sq. mt. ;
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, ह्य २५-द्ध १, २०२४/म् ५-११, ॅ १९४६And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the said Reservation partly on area admeasuring approximately 8068 Sq. mt. (0.8068 Ha.) of the said land ;
And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December, 2016, has delegated the powers exercisable by it under the provisions of Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation partly in respect of the said land as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows.—
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added :—

A copy of the part plan of the said Sanctioned Revised Development Plan showing the part area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Umarkhed, District Yavatmal during office hours on all working days for inspection to public upto one month.
