ORDER
No. D.T.P.-D.P.Umerkhed (R)-Sec-127(2)-Order-TPV-VI-1935.-----
Whereas, the Revised Development Plan of Umarkhed Municipal Council has been sanctioned as per the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No. TPS-2798-1026-CR-55-98-UD-13, dated 27th January, 1999 (hereinafter referred to as "the said Notification") & came into force with effect from dated 15th April,1999 (hereinafter referred to as the "said Sanctioned Revised Development Plan");
And whereas, in the said Sanctioned Revised Development Plan, an approximate area of 1.3244 Ha. of the land bearing S. No. 331 (Part) of Mouza Umarkhed, Taluka Umarkhed is affected by Reservation No. 28 "Housing for Dishoused" (hereinafter referred to as "the said Reservation") and part area is affected by 9 mt. wide East-West Development Plan Road (hereinafter referred to as "the said Road") for which Appropriate Authority for acquisition and development of the said Reservation & said Road is Municipal Council, Umarkhed (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said Reservation & said Road have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Revised Development Plan come into force;
And whereas, the concerned land owners (hereinafter referred to as "the said Land Owners") of the land bearing S. No. 331/1, area admeasuring 1.03 Ha. of Mouza Umarkhed, Part 2, Tal. Umarkhed (hereinafter referred to as "the said Land") had served a notice dated 8th April, 2019 as per the provisions of Section 127(1) of the said Act in respect of the areas affected by the said Reservation & said Road (hereinafter referred to as "the said Notice") on the said Appropriate Authority and the same has received to Appropriate on same day;
And whereas, the said land under the said Reservation & said Road is not acquired or on steps as required as per the provisions of Section 127 (1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice by the said land owner.
And whereas, in Writ Petition No. 3185/2022 filed by the said Land Owners, the Hon'ble High Court of Judicature at Mumbai, Nagpur Bench has directed vide it's decision dated 17th August, 2023 (hereinafter referred to as "the said Judgement") that, the said Reservation on the said Land has lapsed and accordingly the respondents shall take consequent steps to indicate lapsing of the reservation;
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, द्ध २-८, २०२४ / म् १२-१८, ॅ १९४६And whereas, the Chief Officer, Municipal Council, Umarkhed has submitted the proposal vide it's letter No. 351/2023-24, dated 4th October, 2023 to issue an order in respect of lapsing of the said Reservation under the provisions of Section 127 (2) of the said Act as per said Judgement of Hon'ble High Court;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati has submitted report vide letter No. 1585, dated 13th December, 2023; mentioned mainly therein that, as per the said Judgement there is no objection to issue and order in respect of lapsing of area under Reservation & such area including said Road as it is mentioned in said Notice; though, only the said Rservation (R. No. 28) is mentioned in the said Judgement, with opinion that, there is necessity of continuity of said Road in the layout of said Land while prepapring it, as per the land use of adjacent lands;
And whereas, as per the Measurement Plan (M.R.No. 44/2019, dated 2nd February, 2019 of said Land, it is clear after due verification that, areas affected by the said Reservation & said Road are measured as 8506 Sq. mt. & 1164 Sq. mt. respectively;
And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Revised Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of only the said reservation partly on the area admeasuring approxi- mately 8506 Sq. mt. (0.8506 Ha.) of the said land;
And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, date 1st December, 2016, has delegated the powers exercisable by it under the provisions of Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director ot Town Planning, Maharashtra State, Pune.
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation partly in respect of the said land as per the provisions of Section 127 (2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows.-----
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added :-

ORDER
No.-D.T.P.-D.P.Umerkhed (R)-Sec-127(2)-Order-TPV-VI-2086.-----
Whereas, the Revised Development Plan of Umarkhed Municipal Council has been sanctioned as per the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No. TPS-2798-1026-CR-55-98-UD-13, dated 27th January, 1999 (hereinafter referred to as "the said Notification") & came into force with effect from dated 15th April,1999 (hereinafter referred to as the "said Sanctioned Revised Development Plan");
And whereas, in the said Sanctioned Revised Development Plan, the land bearing S. No. 4 an area admeasuring 3.29 Ha. of Mouza Umarkhed, Taluka Umarkhed is affected by Reservation No. 33 "Sho ping Centre and Stadium" (hereinafter referred to as "the said Reservation") for which Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Umarkhed (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Revised Development Plan come into force;
And whereas, the concerned land owners (hereinafter referred to as "the said Land Owners") of the land bearing S. No. 4/1/7, area admeasuring 0.47 Ha. of Mouza Umarkhed, Part 1,Tal. Umarkhed, Dist. Yavatmal (hereinafter referred to as "the said Land") had served a notice dated 25th September, 2018 through Adv. Santosh P. Jain as per the provisions of Section 127 (1) of the said Act in respect of the area affected by the said Reservation (hereinafter referred to as "the said Notice") on the said Appropri- ate Authority and the same has received to Appropriate Authority on 26th September, 2018 ;
And whereas, the said land under the said Reservation is not acquired or no steps as required as per the provisions of Section 127(1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice by the said land owner.
And whereas, in Writ Petition No. 3585/2022 filed by the said Land Owners, in the Hon'ble High Court of Judicature at Mumbai, Nagpur Bench the Hon'ble High Court has directed to the State Govern- ment vide decision dated 28th November, 2023 (hereinafter referred to as "the said Judgement") that, to notify the lapsing of the said Reservation on the said Land by an order to be published in the Official Gazzette.
And whereas, the Chief Officer, Municipal Council, Umarkhed has submitted the proposal vide letter No. 557/2023-24, dated 11th January, 2024 to issue an order in respect of lapsing of the said Reservation under the provisions of sections 127 (2) of the said Act as per said Judgement of the Hon'ble High Court;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati has submitted report vide it's letter No. 207, dated 16th February, 2024; mentioned mainly therein that, it is necessary to issue order under the provisions of Section 127(2) of the said Act as directed by the Hon'ble High Court in respect of lapsing of the said Reservation of the said Land;
८ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, द्ध २-८, २०२४ / म् १२-१८, ॅ १९४६And whereas, as per the Measurement Plan (M.R.No. 539/2015, date 13th March, 2015) of said Land, it is clear that area affected by said Reservation on the said Land is 0.47 Ha.;
And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Revised Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of only the said reservation partly on the area admeasuring approximately 0.47 Ha. (4700 Sq.mt.) of the said land;
And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No.-TPS-1813-3211-CR-508-UD-13, dated 1st December, 2016, has delegated the powers exercisable by it under the provisions of section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director ot Town Planning, Maharashtra State, Pune.
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation partly in respect of the said land as per the provisions of Section 127 (2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows-----
After the last entry in the Scheduled of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added :-

Note:- 1. The said Land so released from the said Reservation shall become available to the said Land Owners for the purpose of development as otherwise permissible in the case of adjacent lands under the said Sanctioned Revised Development Plan.
2. A copy of the part plan of the said Sanctioned Revised Development Plan showing the part area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Umarkhed, District Yavatmal during office hours on all working days for inspection to public upto one month.
3. This Order shall also be published on the Director's official website www.dtp.maharashtra.gov.in.
