The Maharashtra Regional and Town Planning Act, 1966.

NOTIFICATION

No.-TPS-2221-1884-C.R.-162-2021-UD-9.–

Whereas, the Government in Urban Development Department vide Notification No.-TPS-2299-1001-C.R.111- UD-9, dated 28th June, 2002 has sanctioned the development plan for the Bramhapuri Town & came into force with effect from the 26th Agust 2002 and excluding part of the Development Plan has been sanctioned by the Govern- ment vide Urban Development Department's Notification No.-TPS-2299-1001-C.R.111- UD-9, dated the 13th July, 2005 (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");

And whereas, in the said Development Plan, area admeasuring 1.53 hectare of land bearing Survey No.113 of Mouje Delanwadi is included in Agriculture Zone (hereinafter referred to as "the said Land");

And whereas, the Brampuri Municipal Council being the Planning Authority (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No.16, dated 21st December, 2020 has resolved to delete the said Land from Agriculture Zone and include the same in Residential Zone and accordingly submitted a modification proposal to the Government, for its sanction as per the provisions of sub-Section (1) of section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned is some conditions;

And whereas, the said Lands Owners have deposited Rs. 56,650/- towards the 50% Government share of 5% premium amount as per the rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2022-23 in the Government Treasury on 10th January, 2024 through the Assistant Director of Town Plan- ning. Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs.56,650/- payable to the Planning Authority has been deposited with the Chief Officer, Brampuri Municipal Council on 04th December, 2023;

Now therefore, in exercise of the powers conferred on it under sub-Section (2) of section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated 28th June, 2002 as follows;

"In the Schedule of Modifications appended to the Notification dated 28th June, 2002 sanctioning the said Development Plan, the following new entry shall be added after the last entry"

ENTRY

"The area admeasuring 1.53 hectare of land bearing Survey No.113 of Mouje Delanwadi is deleted from Agriculture Zone and included in Residential Zone as shown on the plan.

Condition No.1–In addition to open space, necessary 10% additional Amenity Space shall be provided & handover to Municipal Council instead of T.D.R. / F.S.I.

Condition No.2–It is necessary to construct compound around the open space.

Condition No.3–It is compulsory for the land owner / developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewerage & drainage etc.

Condition No.4–If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Officer Bramhapuri Municipal Council, Bramhapuri in relation to development of basic amenities as per the stages given below.

(a) After final approval of layout sale of 25% of the total plots shall be permissible.

(b) After completion of 40% basic Amenities. sale of 50% of the total plots shall be permissible.

(с) After completion of 60% basic Amenities. sale of 75% of the total plots shall be permissible.

(d) After completion of 80% basic Amenities. sale of 90% of the total plots shall be permissible.

(e) After completion of 100% basic Amenities. sale of 100% of the total plots shall be permissible.

If Group Housing Scheme is proposed in the layout, then occupation certificate shall not be given by Chief Officer Bramhapuri Municipal Council, Bramhapuri unless all the basic amenities are fully developed.

A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer Bramhapuri Municipal Council, Bramhapuri during office hours on all working days for a period of one month.

This Notification shall also be available on the Government web site www.maharashtra.gov.in By order and in the name of the Governor of Maharashtra

And whereas, the Chandrapur Municipal Corporation being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution No.68, dated 29th December, 2018, has resolved to modify the said Development Plan proposal by deleting the development plan road of 60.00 m. width and about 5.00 km. long and to include the land in the Residential Zone deleted from the said road and accordingly submitted to the Government, for its final sanction, a modification proposal as per the provisions of sub- Section (1) of section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed modification under the said proposal should be sanctioned as detailed below with some modifications;

6. H-I 60.00 Mt. Road width is kept 24.00 Mt. instead of 60.00 Mt. and excluded area under the road is included in Adjacent Zone.

And whereas, in the above sanctioned modification only land owner of Survey No. 30/3 of Mouje Dewai Govindpur Raiyyatwari admeasuring area of 5408.00 Sq. Mt. out of the total land admeasuring area 1.61 Hectare under the modification have deposited Rs. 1,00,048/- towards the 50% Government share of 5% premium amount as per the value of the land as prescribed in the Annual Statement of Rates (ASR) for the year 2022-2023 in the Government Treasury on 19th January, 2023 through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs.1,00,048/- payable to the Planning Authority has been deposited with the Commissioner, the Chandrapur Municipal Corporation on 13th January, 023;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated 02nd June,1997 as follows.

In the Schedule of Modifications appended to the Notification dated 02nd June,1997 sanctioning the said Development Plan, the following new entry shall be added after the last entry. -

ENTRY

"Land bearing No.30/3 of Mouje Dewai Govindpur Raiyyatwari in Development Plan of Chandrapur Town (Extended area) area admeasuring 5408.00 Sq. Mt.under the 60.00 Mt. Development Plan road out of total area 1.61 Hectare is included in Agriculture Zone as shown on the plan"

A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Commissioner, the Chandrapur Municipal Corporation Dist. Chandrapur during office hours on all working days for a period of one month.

This Notification shall also be available on the Government web site www.maharashtra.gov.in

Whereas, Revised Development Plan of Nagpur City has been sanctioned partly by the Government vide Urban Development Department's Notification No.TPS-2496-2643-CR-300(A)-97-UD-9, Dated the 7th Janu- ary, 2000 and finally sanctioned by the Government vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, Dated the 10th September, 2001 & has come into force with effect from the 1st March, 2000 & 21st September, 2001 (hereinafter referred to as "the said Development Plan") under Section 31(1), of the Maharashtra Regional and Town Planning Act, 1966 (Maha. XXXVII of 1966) (hereinafter referred to as "the said Act");

And whereas, in the said Development Plan, Notified slum and 18.00 mtr. wide DP road is proposed on NS- Sheet No. 138 Plot No. 107, SS-Sheet No.138, Plot No. 561, NS- Sheet No. 136, Plot No. 126, SS-Sheet No.136, Plot No.117 of Mouja Bhankheda and Lashkaribagh (hereinafter referred to as "the said Road");

And whereas, the Nagpur Municipal Corporation, Nagpur (hereinafter referred to as 'the said Planning Authority"), vide its General Body Resolution No. 219, Dated 28th December, 2022 has resolved to widen the said road from 18.00 Mt. to 23.00 Mt. as per the provisions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act, (hereinafter referred to as "the Proposed Modification") the Planning Authority has submitted the said proposal of modification to the Government for sanction vide its letter dated 30th June, 2023;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Modification proposal and for that purpose amends the said Development Plan Notification as follows;

"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry -

"The width of the 18.00 Mt. wide Development Plan road in Mauza-Bhankheda to Lashkaribagh (LC GATE NI-77) area connecting from Pachpavali flyover to Pahelwanshah Dargah road from Gupta Atta Chakki (NS-Sheet No. 138, Plot No. 107 and SS-Sheet No. 138, Plot No. 561) to Babbu Hotel (NS-Sheet No. 136, Plot No. 126 and SS-Sheet No. 136, Plot No. 117) is increased to 23.00 Mt. wide D.P.Road as shown on the Plan"
