क्रमांका संकाीर्णग-२०२३/प्र.क्र.११९/दिदि-४.—माहुाराष्ट्र खाजगी दिद्यापीठे (स्थापीनांा दिदिनांयमानां ) अदिदिनांयमा, २०२३ (२०२४ चा माहुा. ८) याच्या कालमा १७ च्या पीोट-कालमा (२) याद्वारे प्रदानां काेलेल्या अदिकारांचा ापीर कारूनां, माहुाराष्ट्र ासंनां, याद्वारे, डॉ. डॉी. ाय. पीाटील ज्ञानां प्रसंादा दिद्यापीठे, पीुर्णे या दिद्यापीठेाच्या अध्यक्ष पीदाचाी रीता पीात्राता दिनांकाष दिदिहुता कारण्यासंाठेी पीुढील दिनांयमा कारीता आहुे:—

१. संकिंक्षप्त नाव.—या दिनांयमांसं, डॉ. डॉी. ाय. पीाटील ज्ञानां प्रसंादा दिद्यापीठे, पीुर्णे (अध्यक्ष पीदाचाी रीता पीात्राता दिनांकाष) दिनांयमा, २०२४ असंे म्हुर्णाे.

२. व्येाख्येा.—(१) या दिनांयमांमाध्ये संदाभागनांुसंार दाुसंरा अथाग आश्यका नांसंेल तार,-

(का) "अदिदिनांयमा" याचा अथाग, माहुाराष्ट्र खाजगी दिद्यापीठे (स्थापीनांा दिदिनांयमानां ) अदिदिनांयमा, २०२३ (२०२४ चा माहुा.

८) असंा आहुे ;

(खा) "नांादिमाका" याचा अथाग, ो संदिमाताीनांे दिफारसं काेलेल्या पीात्रा व्यक्तांचाी संूचाी, असंा आहुे ;

(ग) "ो संदिमाताी" याचा अथाग, दिनांयमा ३ च्या पीोट दिनांयमा (३) अन्ये घदिटता काेलेली ो संदिमाताी, असंा आहुे.

(२) या दिनांयमांता ापीरलेले पीरंताु व्याख्या नां काेलेले ब्दा ब्दाप्रयोग यांनांा, अदिदिनांयमाता अनांुक्रमाे जे अथाग नांेमाूनां दाेण्याता आले असंताील ताेचा अथाग असंताील,

३. अध्येक्षाचाी नेमणूक.—(१) दिनांयमा ४ ला अीनां राहुूनां, दिद्यापीठेाच्या पीदिहुल्या अध्यक्षाचाी, ासंनांाच्या मान्यताेनांे प्रायोजका मांडॉळाकाडॉूनां नांेमार्णूका कारण्याता येईल.

(१)

भाग चार-ब-१९५–१२ महाराष्ट्रट शासन राजपत्र असाधाराण भाग चारा-ब, मे १०, २०२४/वैशाख २०, शाके १९४६ (२) या दिनांयमाच्या पीोट दिनांयमा (१) माध्ये तारताूदा काेली असंेल त्याखाेरीज, नांतारच्या अध्यक्षाचाी नांेमार्णूका कारण्यासंाठेी संुयोग्य व्यक्तांचाी दिफारसं कारण्याकारिरता प्रायोजका मांडॉळानांे घदिटता काेलेली एका ो संदिमाताी असंेल.

(३) ो संदिमाताीमाध्ये पीुढील संदास्यांचा संमाे असंेल :—

(एका) उच्चा न्यायालयाचा एका संेादिनांृत्त न्यायाी दिकांा उच्चा न्यायालयाचा न्यायाी म्हुर्णूनां दिनांयुक्ताी काेली जाण्यासं पीात्रा असंलेली एखादाी व्यक्ताी- अध्यक्ष ;

(दाोनां) दिद्यापीठेाी संबंदिता नांसंलेली, जी प्रख्याता दिक्षर्णताज्ज्ञा आहुे दिकांा प्रासंका आहुे अी एका व्यक्ताी ;

(ताीनां) जी प्रायोजका मांडॉळाचाी संदास्य आहुे अी एका व्यक्ताी.

(४) ो संदिमाताी, प्रायोजका मांडॉळाच्या दिचाराथाग, ताीनांपीेक्षा कामाी नांसंताील इताक्या व्यक्तांच्या एका नांादिमाकाेचाी दिफारसं कारील.

नांादिमाकाेता संमाे असंलेल्या प्रत्येका व्यक्ताीच्या संुयोग्यताेबाबताचा संदिस्तार लेखाी तापील अहुालासंोबता जोडॉण्याता येईल.

(५) प्रायोजका मांडॉळाला, प्रायोजका मांडॉळाच्या बैठेकाीता, संाध्या बहुूमातानांे ठेरा संमाता कारूनां, नांादिमाकाेता संमादिष्ट असंलेल्या व्यक्तांपीैकाी एका व्यक्ताीचाी, दिद्यापीठेाचा अध्यक्ष म्हुर्णूनां दिनांयुक्ताी कारता येईल:

पीरंताु, जर प्रायोजका मांडॉळानांे, अा प्रकारे दिफारसं काेलेल्या व्यक्तांपीैकाी काोर्णत्याहुी व्यक्ताीला मान्यता दिदाली नांाहुी तार, प्रायोजका मांडॉळाला, एकातार त्याचा संदिमाताीकाडॉूनां दिकांा या प्रयोजनांासंाठेी घदिटता काेलेल्या नांीनां ो संदिमाताीकाडॉूनां नांीनां नांादिमाका मागदिता येईल.

४. पात्रता किंनकर्ष.—अध्यक्षाच्या दिनांयुक्ताीसंाठेी ो संदिमाताीनांे दिफारसं कारायाच्या व्यक्ताीनांे,- -

(का) याचाी पीस्ताीसं षे पीूर्णग काेलेली असंाीता ;

(खा) मान्यताप्राप्ता संस्थाेमाूनां काोर्णत्याहुी दिद्याखाेताील पीदाव्युत्तर-पीदाी ारर्ण काेली असंाी ;

(ग) दिताच्या स्ता:च्या उदाहुरर्णाताूनां नांेताृत् दाेण्यासं संक्षमा असंाी ;

(घ) दिताच्याकाडॉे संस्थाेच्या बांर्णीसंाठेी प्रबल काुाग्र बुद्धीमात्ता असंाी ;

(ङ) ताी, दिद्यार्थ्यांयाच्या संमाजाच्या दिहुताथाग भाी योजनांा दाेण्यासं संक्षमा असंाी आदिर्ण दिताच्याकाडॉे ताो ास्ताता आर्ण्याचाी योग्यता असंाी ;

(चा) दिताच्याकाडॉे जागदिताका दाजागचाी ैक्षदिर्णका संस्था उभारण्याचाी बांीलकाी असंाी ;

(छ) दिताच्याकाडॉे उद्याोग, संोनां, संमाुपीदाेनां (संल्ला), संमाज कायग, कायदा, दिक्षर्ण, आरोग्य दिकांा काल्यार्णकारी कायगक्रमा या क्षेत्राताील अनांुभा असंा.

५. अटी व शाती.—अध्यक्ष पीदाच्या अटी ताी, दिनांयमा ३ च्या पीोट दिनांयमा (५) माध्ये नांमाूदा काेल्याप्रमार्णे, व्यस्थापीनां संदिमाताीच्या बैठेकाीता, प्रायोजका मांडॉळाकाडॉूनां ठेरदिण्याता येताील त्याप्रमार्णे असंताील.

६. मानधान व भात्ते.—अध्यक्ष, प्रायोजका मांडॉळाकाडॉूनां, ेळाोेळाी ठेरदिण्याता येताील असंे मानांनां, खाचाग भात्ते दिमाळाण्यासं हुक्कादार असंेल.

७. राजीनामा.—अध्यक्षासं, एका मादिहुन्याचाी लेखाी नांोटीसं दिदाल्यानांतार, प्रायोजका मांडॉळासं उद्देूनां त्याच्या स्ाक्षरीनांे, आपील्या पीदाचा लेखाी राजीनांामा दाेता येईल आदिर्ण प्रायोजका मांडॉळानांे त्याचा राजीनांामा स्ीकाृता काेल्यार दिकांा उक्ता नांोदिटीचाी माुदाता संपील्याच्या तारखाेपीासंूनां, यांपीैकाी जे आी घडॉेल ताेव्हुापीासंूनां अध्यक्ष त्याचाे पीदा ारर्ण कारण्याचाे संमाप्ता कारील.

NOTIFICATION

Maharashtra Private Universities (establishMent and regUlation) act, 2023.

No.SFU-2023/C.R.119/Vishi-4.—In exercise of the powers conferred by sub-sections (2) of section 17 of the Maharashtra Private Universities (Establishment and Regulation) Act, 2023 (Mah.VIII of 2024), the Government of Maharashtra hereby makes the following rules to prescribe the manner and eligibility criteria for the post of President of the Dr. D.Y. Patil Dnyan Prasad University, Pune namely :—

1. Short Title.—These rules may be called the Dr. D.Y. Patil Dnyan Prasad University, Pune (manner and eligibility criteria for the post of President) Rules, 2024.

2. Definitions.—(1) In these rules, unless the context otherwise requires,–

(a) "Act" means Maharashtra Private Universities (Establishment and Regulation) Act, 2023 (Mah.VIII of 2024) ;

(b) "panel" means a list of eligible person recommended by the Search Committee ;

(2) Words and expressions used but not defined in these rules shall have the meanings respectively assigned to them in the Act.

3. Appointment of President.—(1) Subject to rule 4, the first President of the university shall be appointed by the sponsoring body with the approval of the Government.

(2) Save as provided in sub rule (1) of this rule, there shall be a Search Committee constituted by the sponsoring body to recommend suitable persons for appointment of the subsequent President.

(3) The Search Committee shall consist of the following members, namely:–

(i) a retired High Court Judge or a person eligible to be appointed as High Court Judge – Chairperson ;

(ii) a person who is an eminent educationist or administrator, not connected with the University ;

(iii) a person who is a member of the sponsoring body.

(4) The Search Committee shall recommend a panel of not less than three persons for consideration of the sponsoring body. The report shall be accompanied by a detail write up on suitability of each person included in the panel.

(5) The sponsoring body may appoint one of the persons included in the panel, to be the President of the University by passing a resolution in the meeting of the sponsoring body the simple majority:

Provided that, if the sponsoring body does not approve any of the persons so recommended, the sponsoring body may call a fresh panel either from the same Committee or from a new Search Committee constituted for the purpose.

4. Eligibility criteria.—Person to be recommended by the Search Committee for appointment of President shall,–

(a) have completed the thirty five years of age ;

(b) possess post-graduate degree in any discipline from the recognized institute ;

(d) have strong acumen for institution building ;

(e) be able to provide vision and have ability to translate the same into reality in the interest of students and society ;

(f) have commitment to build a world class educational institution ;

(g) Have experience in the field of industry, research, consultancy, social work, law, education, health or welfare activities.

5. The terms and conditions.—The terms and conditions for post of the President shall be such as may be decided by the sponsoring body, in the meeting of Managing Committee, as mentioned in sub rule (5) of rule 3.

6. Honorarium and allowances.—The President shall be entitled to receive such honorarium, expenses and allowances as may be decided by the sponsoring body, from time to time.

7. Resignation.—The President may, by writing under his signature addressed to the sponsoring body, after giving one month's notice, resign from his office and shall cease to hold his office on the acceptance of his resignation by the sponsoring body or from the date of expiry of the said notice period, whichever is earlier.
