The Maharashtra Regional & Town Planning Act, 1966:

(hereinafter referred to as "the said Lands") had served notices for the said Reservation on the said Lands as per the No. D.T.P./D.P. Gangakhed (R.+AA)/Site No.30/ Sec- provisions of section 127(1) of the said Act dated 26/12/2017 127(2)/Order TPV-V/1884 Date : - 1-04-2024

Whereas, the Development Plan of Gangakhed Munici- pal Council (R+AA) has been partly sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) ( hereinafter referred to as "the said Act") by the Government of Maharashtra in Urban Development Depart- ment vide Notification No. TPS - 3105/1357/C.R.-206(A)/ 2005/UD - 30, dated 17/07/2006 ( hereinafter referred to as " the said Notification") and the same has come into force with effect from 01/09/2006 ( hereinafter referred to as "the said Sanctioned Development Plan"), while the Development Plan of the Excluded Part has been sanctioned by the Govern- ment of Maharashtra in Urban Development Department vide Notification No. TPS-3107/1130/C.R.-261(B) /2007/UD-30, dated 16 -07-2008 and the same has come into force with effect from 01/09/2008.

And whereas, as per the said sanctioned Devleopment Plan , approximate area of 0.30 Ha.of the land bearing S. No.451 (Part) and 0.69 Ha. of the land bearing S. No 452 (Part) of Mouje Gangakhed, Tal. Gangkhed, Dist. Parbhani is affected by Reservation Site No. 30- 'Children Park' ( hereinafter referred to as "the said Reservation") and the Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Gangakhed ( hereinafter referred to as "the said Appropriate Authority");

And whereas, the land under the said Reservation has not been acquired by the said Appropriate Authority within (10) years from the date on which the said sanctioned Development Plan came into force;

( hereinafter referred to as "the said Notices") on the said Appropriate Authority which was received by the said Ap- propriate Authority on 28/12/2017;

And whereas, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of section 127(1) of the said Act have been taken by the said Appropriate Authority, within a stipulated period of 24 months after receipt of the said Notice;

And whereas, in the Writ Petition No. 2714/2021 filed by the said Land Owner in the Hon'ble High Court Mumbai, Aurangabad Bench, the Hon'ble Court has passed an order dated 16/01/2023 ( hereinafter referred to as "the said Order") stating that, the said Reservation on the petiitioner's land bearin S. No. 451 (Part), approximate area 0.30 ha. and S. No. 452 (Part), approximate area of 0.69 ha. of mouje - Gangakhed T.q. Gangakhed Dist. Gangakhed stand lapsed and the Respondents shall take immediate steps for issuance of modification under subsection 2 of section 127 of the MRTP Act ;

And whereas, the Chief Officer, Municipal Council, Gangakhed vide letter No. 1769, dt. 24/03/2023 has submitted a report.

And whereas, the Assistant Director of Town Planning, Parbhani Branch, Parbhani vide letter No. 653, dt. 31/08/2023 and the Joint Director of Town Planning Chhatrapati Sambhajinagar Division, Chhatrapati Sambhajinagar vide letter No. 1561, dt. 27/09/2023 has stated that, in regards with the said Notice, the said Reservation on the said land has been lapsed and accordingly has submitted a report for issuance of notification as per the provisions of section 127(2) of the said Act.
