भारताचे संकिंवधान.

क्रमांका वक्फ २०२२/प्र.क्र. ५४/कायागसनां-४.— भारताीय संदिवधानांाच्या अनांुच्छेदा ३०९ खालील परंताुकान्वये प्रदानां कारण्याता आलेल्या शक्तांचा वापर कारूनां माहुाराष्ट्राचे राज्यपाल याद्वारे अल्पसंख्याका दिवकास दिवभागाच्या अदिधापत्याखालील माहुाराष्ट्रा राज्य वक्फ न्यायादिधाकारण, छेत्रापताी संभाजीनांगर या शासकाीय कायागलयाताील "सहुायका अधाीक्षका, लघुलेखाका (दिनांम्नांश्रेणी), गट-ब (अराजपदित्राता) आदिण वरिरष्ठ दिलदिपका, लेखापाल (दिलदिपका), बेलीफ, गट- का" या पदांवरील सेवाप्रवेशाचे दिवदिनांयमानां कारण्यासाठी याद्वारे पुढील दिनांयमा कारीता आहुेता :—

(१) या दिनांयमांनांा "माहुाराष्ट्रा राज्य वक्फ न्यायादिधाकारण, छेत्रापताी संभाजीनांगर "सहुायका अधाीक्षका, लघुलेखाका (दिनांम्नांश्रेणी), गट-ब (अराजपदित्राता) आदिण वरिरष्ठ दिलदिपका, लेखापाल (दिलदिपका), बेलीफ, गट-का " या पदांचे (सेवाप्रवेश) दिनांयमा, २०२४ असे संबोधाण्याता यावे;

(२) सदार दिनांयमा शासन राजपत्र प्रदिसद्ध झाल्याच्या दिदानांांकापासूनां अंमालाता येताील.

२. या दिनांयमांमाध्ये संदाभागनांुसार अन्यथा अथाग लावणे आवश्यका नांसेल तार,—

(अ)"दिनांयुक्ताी प्रादिधाकारी" याचा अथाग, "सहुायका अधाीक्षका, गट-ब (अराजपदित्राता) आदिण "दिलदिपका-टंकालेखाका" या पदावर सरळसेवेनांे उमाेदावाराची दिनांयुक्ताी कारण्यासाठी सक्षमा असणारा प्रादिधाकारी म्हुणजेच "शासनां" असा आहुे. तासेच, "लघुलेखाका (दिनांम्नांश्रेणी), गट-ब (अराजपदित्राता) आदिण वरिरष्ठ दिलदिपका, लेखापाल (दिलदिपका), बेलीफ, गट-का" या पदावर उमाेदावाराची दिनांयुक्ताी कारण्यासाठी सक्षमा असणारा प्रादिधाकारी म्हुणजेच "अध्यक्ष, माहुाराष्ट्रा राज्य वक्फ न्यायादिधाकारण" असा आहुे;

(ब) "आयोग" याचा अथाग माहुाराष्ट्रा लोकासेवा आयोग असा आहुे;

भाग चार-अ-८७–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मे २१, २०२४/वैशाख ३१, शके १९४६ (का) "पदावी" याचा अथाग, सांदिवदिधाका दिवद्यापीठाची काोणत्याहुी शाखाेताील पदावी दिकांवा शासनांानांे त्याच्याशी समाताुल्य म्हुणूनां घुोदिता काेलेली अन्य काोणताीहुी अहुगता;

(खा) "पदाोन्नांताीसाठी पात्राता" याचा अथाग, पदाोन्नांताीसंदाभागता सामान्य प्रशासनां दिवभागानांे वेळोवेळी दिनांगगदिमाता काेलेल्या अटी व शताी, दिनांयमा, ठराव आदिण आदाेश असा आहुे;

(ग) "शासनां" याचा अथाग, माहुाराष्ट्रा शासनां असा आहुे;

(घु) "शासकाीय वादिणज्य प्रमाणपत्रा" म्हुणजे शालेय दिशक्षण, माहुाराष्ट्रा शासनांाच्या दिनांयंत्राणाखाली कायगरता असलेल्या माहुाराष्ट्रा राज्य परीक्षा परिरदाेनांे जारी काेलेले प्रमाणपत्रा, याता माहुाराष्ट्रा शासनांानांे त्याच्याशी समाकाक्ष म्हुणूनां दिवदिनांदिदागष्टपणे जाहुीर काेलेल्या अन्य काोणत्याहुी संस्थाेकाडूनां दाेण्याता येणाऱ्या प्रमाणपत्राचा समावेश असेल;

(ङ) "दिवभाग" याचा अथाग भारताीय संदिवधानां ाच्या अनांुच्छेदा -१६६ अन्वय े बनांदिवलेल्या माहुाराष्ट्रा शासनां कायगदिनांयमावलीच्या पदिहुल्या अनांुसूचीमाध्ये दिवदिनांदिदागष्ट काेलेला अल्पसंख्याका दिवकास दिवभाग असा आहुे;

(च) "न्यायादिधाकारण" याचा अथाग अल्पसंख्याका दिवकास दिवभाग या प्रशासकाीय दिवभागाच्या अदिधापत्याखालील माहुाराष्ट्रा राज्य वक्फ न्यायादिधाकारण, छेत्रापताी संभाजीनांगर असा आहुे;

(छे) "दिनांवडू सदिमाताी" याचा अथाग, शासकाीय सेवेताील दिलदिपका टंकालेखाका हुे पदा वगळता गट-ब (अराजपदित्राता), गट- का व गट- डू च्या पदांवरील सरळसेवा भरताीकारिरता उमाेदावारांच्या दिनांवडूीच्या प्रयोजनांाथाग शासनांाकाडूनां वेळोवेळी गठीता कारण्याता आलेली सदिमाताी असा आहुे.

३. सहुायका अधाीक्षका, गट-ब (अराजपदित्राता) या पदावरील दिनांयुक्ताी वरिरष्ठ दिलदिपका, गट-का/ लेखापाल (दिलदिपका), गट-का हुे पदा धारण कारणाऱ्या तासेच सदार पदावर ताीनां वाहुूनां कामाी नांसेल इताकाी सलग दिनांयदिमाता सेवा झालेल्या व्यक्तांमाधाूनां एकादित्राता सेवाज्येष्ठता यादाीनांुसार ज्येष्ठताअधाीनां पात्राता या दिनांकावर योग्य व्यक्ताीची पदाोन्नांताीनांे कारण्याता येईल.

४. लघुलेखाका (दिनांम्नांश्रेणी), गट-ब (अराजपदित्राता) पदावरील दिनांयुक्ताी खालील दिनांका पूणग कारणाऱ्या योग्य व्यक्तांमाधाूनां नांामादिनांदाेशनांाद्वारे दिनांवडू सदिमाताीच्या दिशफारशीनांुसार कारण्याता येईल :-

(१) वयोमायागदा.—

(अ) दिकामानां वयोमायागदा.- पदा भरताीच्या जादिहुराताीमाध्ये नांमाूदा काेलेल्या अजग स्वीकाृताीच्या अंदितामा दिदानांांकास वयाची अठरा वे पूणग झालेली असावीता;

(ब) कामाल वयोमायागदा.- पदा भरताीच्या जादिहुराताीमाध्ये नांमाूदा काेलेल्या अजग स्वीकाृताीच्या अंदितामा दिदानांांकास खाुल्या वगागताील व्यक्तांसाठी अडूताीस वे व मागासवगीय व्यक्तांसाठी वयाची त्राेचाळीस वे पूणग झालेले.

(२) शैक्षदिणका अहुगता.—

(अ) पदावी धारण काेलेला; आदिण

(ब) ज्यांनांी १०० शब्दा प्रदितादिमादिनांट यापेक्षा कामाी नांाहुी इताक्या गताीचे लघुलेखानांाचे आदिण माराठी टंकालेखानांाचे दिकामानां ३० शब्दा प्रदितादिमादिनांट वेगमायागदाेचे दिकांवा इंग्रजी टंकालेखानांाचे दिकामानां ४० शब्दा प्रदितादिमादिनांट वेगमायागदाेचे शासकाीय वादिणज्य प्रमाणपत्रा दिकांवा संगणका टंकालेखानांाचे प्रमाणपत्रा धारण काेलेले आहुे.

५. वरिरष्ठ दिलदिपका, गट-का पदावरील दिनांयुक्ताी पुढील मागागनांे कारण्याता येईल,-

(अ) दिलदिपका-टंकालेखाका, गट-का / बेलीफ, गट-का हुे पदा धारण कारणाऱ्या तासेच सदार पदावर ताीनां वाहुूनां कामाी नांसेल इताकाी सलग दिनांयदिमाता सेवा झालेल्या आदिण या दिनांयमाच्या उप-खांडू ब माध्ये नांमाूदा काेलेली अहुगता धारण काेलेल्या व्यक्तांमाधाूनां एकादित्राता सेवाज्येष्ठता यादाीनांुसार ज्येष्ठताअधाीनां पात्राता या दिनांकावर योग्य व्यक्ताीच्या पदाोन्नांताीनांे; दिकांवा

(ब) स्पधागत्माका परीक्षेच्या दिनांकालाच्या आधारे दिनांवडू सदिमाताीनांे दिशफारशी काेलेल्या खालील दिनांका पूणग कारणाऱ्या उमाेदावारांमाधाूनां नांामादिनांदाेशनांाद्वारे:-

(१) वयोमायागदा :-

(२) शैक्षदिणका अहुगता :-

(अ) पदावी धारण काेलेला; आदिण

(ब) ज्यांनांी माराठी टंकालेखानांाचे दिकामानां ३० शब्दा प्रदितादिमादिनांट वेगमायागदाेचे दिकांवा इंग्रजी टंकालेखानांाचे दिकामानां ४० शब्दा प्रदितादिमादिनांट वेगमायागदाेचे शासकाीय वादिणज्य प्रमाणपत्रा दिकांवा संगणका टंकालेखानांाचे प्रमाणपत्रा धारण काेलेले आहुे.

६. लेखापाल (दिलदिपका), गट-का या पदावरील दिनांयुक्ताी खालील दिनांका पूणग कारणाऱ्या योग्य व्यक्तांमाधाूनां नांामादिनांदाेशनांाद्वारे दिनांवडू सदिमाताीच्या दिशफारशंनांुसार कारण्याता येईल :-

(१) वयोमायागदा :-

(२) शैक्षदिणका अहुगता :-

(अ) खालीलपैकाी दिकामानां एका शैक्षदिणका अहुगता धारण असणे आवश्यका आहुे:—

(एका) वादिणज्य शाखाेची पदावी ; दिकांवा

(दाोनां) सांख्यिख्यकाी, गदिणता असा माुख्य दिवय घुेऊनां काला शाखाेची पदावी; दिकांवा

(ताीनां) अथागशास्त्रा असा माुख्य दिवय घुेऊनां काला शाखाेची पदावी ;

दिकांवा

(चार) सांख्यिख्यकाी दिकांवा गदिणता असा माुख्य दिवय घुेऊनां दिवज्ञानां शाखाेची पदावी; दिकांवा

(पाच) व्यवसाय प्रशासनांाची पदावी ; दिकांवा

(सहुा) काोणताीहुी पदावी आदिण सनांदाी लेखापालाची माध्यमा स्तारीय परीक्षा उत्तीणग.

७. बेलीफ, गट-का या पदावरील दिनांयुक्ताी खालील दिनांका पूणग कारणाऱ्या योग्य व्यक्तांमाधाूनां नांामादिनांदाेशनांाद्वारे दिनांवडू सदिमाताीच्या दिशफारशीनांुसार कारण्याता येईल :-

(१) वयोमायागदा :-

भाग चार-अ-८७–१अ४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मे २१, २०२४/वैशाख ३१, शके १९४६ (२) शैक्षदिणका अहुगता :-

पदावी धारण काेलेला.

८. दिनांयमा ५ माध्ये नांमाूदा पदाकारिरता दिनांयुक्ताीसाठी पदाोन्नांताीनांे व नांामादिनांदाेशनांाद्वारे दिनांयुक्ताीचे प्रमाण हुे ५०:५० टक्काे असे राहुील.

९. (अ) दिनांयमा क्रमांका ३ आदिण ५ येथाे नांमाूदा काेलेल्या पदांवर पदाोन्नांताीद्वारे दिनांयुक्ता हुोणाऱ्या व्यक्ताीनांे, पदाोन्नांताीपूवी दिहुंदाी भा परीक्षा व माराठी भा परीक्षा या दाोन्हुी परीक्षांसंदाभागता शासनांानांे वेळोवेळी काेलेल्या दिनांयमांनांुसार, दिहुंदाी भा व माराठी भा परीक्षा अगोदारच उत्तीणग काेलेली असणे अथावा उत्तीणग हुोण्यापासूनां सूट दिमाळदिवलेली असणे आवश्यका राहुील;

(ब) दिनांयमा ४,५, ६ आदिण ७ येथाे नांमाूदा काेलेल्या पदांवर नांामादिनांदाेशनांाद्वारे दिनांयुक्ता हुोणाऱ्या व्यक्ताीनांे, दिहुंदाी भा परीक्षा व माराठी भा परीक्षा या दाोन्हुी परीक्षांसंदाभागता शासनांानांे वेळोवेळी काेलेल्या दिनांयमांनांुसार, दिहुंदाी भा व माराठी भा परीक्षा उत्तीणग काेलेली नांसेल अथावा उत्तीणग हुोण्यापासूनां सूट दिमाळदिवलेली नांसेल तार, दिनांयुक्ताीनांतार संबंदिधाता दिनांयमाता नांमाूदा काेलेल्या दिवदिहुता माुदाताीता दिहुंदाी भा व माराठी भा परीक्षा उत्तीणग हुोणे आवश्यका राहुील. त्याचप्रमाणे दिवदिहुता माुदाताीता दिहुंदाी भा व माराठी भा परीक्षा उत्तीणग नां झाल्यास सदार परीक्षा उत्तीणग हुोईपयता वादिगका वेतानांवाढी अनांुज्ञाेय राहुणार नांाहुी. तासेच वरिरष्ठ पदावर पदाोन्नांताी अनांुज्ञाेय राहुणार नांाहुी.

१०. (अ) दिनांयमा ३ व ५ येथाे नांमाूदा काेलेल्या पदांवर पदाोन्नांताीनांे दिनांयुक्ताी हुोणाऱ्या व्यक्ताीनांे पदाोन्नांताीपूवी संगणका अहुगता प्रमाणपत्रासंदाभागता शासनांानांे वेळोवेळी काेलेल्या दिनांयमांनांुसार, संगणका अहुगता प्रमाणपत्रा धारण कारणे अथावा सामान्य प्रशासनां दिवभाग (मादिहुताी व तांत्राज्ञानां) यांनांी वेळोवेळी शासनां आदाेशाद्वारे नांमाूदा काेलेल्या संगणका/मादिहुताी तांत्राज्ञानां दिवयका परीक्षा उत्तीणग हुोणे अथावा सामान्य प्रशासनां दिवभागानांे वेळोवेळी शासनां आदाेशानांुसार दिनांख्यिश्चता काेलेल्या वयोमायागदाेनांुसार संगणका अहुगता प्रमाणपत्रा सादार कारण्यापासूनां सूट दिमाळदिवलेली असणे आवश्यका राहुील;

(ब) दिनांयमा ४,५,६ आदिण ७ येथाील पदांवर नांामादिनांदाेशनांाद्वारे दिनांयुक्ता हुोणाऱ्या व्यक्ताीनांे, संगणका अहुगता प्रमाणपत्रासंदाभागता शासनांानांे वेळोवेळी काेलेल्या दिनांयमांनांुसार, दिनांयुक्ताीपूवी संगणका अहुगता प्रमाणपत्रा धारण काेलेले नांसल्यास, त्याबाबताच्या दिनांयमाता नांमाूदा काेलेल्या दिवदिहुता माुदाताीता सदार प्रमाणपत्रा धारण कारणे आवश्यका राहुील. त्याचप्रमाणे दिवदिहुता माुदाताीता प्रमाणपत्रा धारण नां काेल्यास, सदार संगणका प्रमाणपत्रा धारण कारेपयता वादिगका वेतानांवाढी अनांुज्ञाेय राहुणार नांाहुी. तासेच सदार अहुगता धारण कारेपयता पदाोन्नांताीस पात्रा असणार नांाहुी.

ंबाचे ंबाचे ंबाचे प्रदिताज्ञापनां सादार कारतानांा त्यामाध्ये दाोनांपेक्षा अदिधाका अपत्ये दिनांयुक्ताीच्या ११. (१) दिनांयमा ४, ५, ६ आदिण ७ येथाील पदांवर नांामादिनांदाेशनांाद्वारे दिनांयुक्ता हुोणाऱ्या व्यक्ताीनांे, माहुाराष्ट्रा नांागरी सेवा (लहुानां काुटं प्रदिताज्ञापनां) दिनांयमा, २००५ माधाील तारताुदाीनांुसार व त्याबाबता वेळोवेळी कारण्याता येणाऱ्या दिनांयमांनांुसार, दिनांयुक्ताीच्या वेळी लहुानां काुटं प्रदिताज्ञापनां सादार कारणे आवश्यका राहुील. तासेच लहुानां काुटं वेळेस हुयाता असल्यास संबंदिधाता उमाेदावारांची पात्राता/अपात्राता त्या दिनांयमाताील तारताुदाीनांुसार दिनांधागरिरता कारण्याता येईल;

(२) लहुानां काुटं ंबाचे प्रदिताज्ञापनां सादार कारण्याच्या दिदानांांकास एखाद्या व्यक्ताीस दाोनांपेक्षा जास्ता अपत्ये असल्यास अशी व्यक्ताी शासनांाच्या सेवेता नांेमाणुकाीसाठी अपात्रा ठरेल;

(३) शासकाीय सेवेता एखाद्या व्यक्ताीची दिनांयुक्ताी झाल्यानांतार, दिनांयुक्ताीच्या वेळी अथावा ताद्नांतार त्याला दाोनांपेक्षा जास्ता अपत्ये असल्याचे दिसद्ध झाल्यास, अशी व्यक्ताी त्या पदावरील शासकाीय सेवा सुरू ठेवल्यास अपात्रा राहुील.

१२. दिनांयमा ४,५,६ आदिण ७ येथाील पदावर दिनांयुक्ता झालेली व्यक्ताी हुी माहुाराष्ट्राता राज्यस्तारावर बदालीसाठी पात्रा राहुील.

१३. संबंदिधाता शासकाीय कामागचाऱ्यास, शासकाीय सेवेच्या कालावधाीता, माहुाराष्ट्रा नांागरी सेवा दिनांयमा, तासेच सेवादिवयका बाबंसंदाभागता राज्य शासनांानांे वेळोवेळी अदिधादिनांयमा/ अदिधासूचनांा/शासनां दिनांणगय/शासनां आदाेशाव्दारे दिनांगगदिमाता काेलेले अन्य दिनांयमा लागू राहुताील .

Constitution of india.

No. Waqf 2022/C.R. 54/Desk-4.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of the Assistant Superintendent, Stenographer (Lower Grade), Group 'B' (Non-Gazetted) Senior Clerk, Accounts-Clerk and Bailiff, Group 'C' in the office of the Maharashtra State Wakf Tribunal, Chhatrapati Sambhajinagar under the administrative control of the Minorities Development Department, namely :—

1. (1) These rules may be called the Assistant Superintendent, Stenographer (Lower Grade), Group 'B' (Non-Gazetted), Senior Clerk, Accounts-Clerk and Bailiff, Group 'C' in the office of the Maharashtra State Wakf Tribunal, Chhatrapati Sambhajinagar (Recruitment) Rules, 2024.

(2) These rules shall come into force on the date of its publication in the Maharashtra Government Gazette.

2. In these rules unless the context requires otherwise,—

(a) "Appointing Authority" means the Government who is competent to appoint a candidate to the post of Assistant Superintendent Group-B (Non-Gazetted) and Clerk-Typist and the Chairman, Maharashtra State Waqf Tribunal who is competent to appoint a candidate to the post of Stenographer (Lower Grade), Group 'B' (Non-Gazetted), Senior Clerk, Accounts-Clerk, and Bailiff, Group 'C';

(b) "Commission" means Maharashtra Public Service Commission;

(c) "degree" means a degree of any discipline of a statutory university or any other qualification declared by the Government to be equivalent thereto;

(d) "Eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department, from time to time;

(e) "Government" means the Government of Maharashtra;

(f) "Government Commercial Certificate" means a certificate in typing or computer typing awarded by the Maharashtra State Council of Examination or the Bureau of Government Examination Board, Department of Education, Government of Maharashtra and includes a certificate issued by any other institution as may be specially approved by the Government for this purpose;

(g) "Department" means the Minorities Development Department specified in the First Schedule appended to the Maharashtra Government Rules of Business made under article 166 of the Constitution of India;

(h) "Tribunal" means Maharashtra State Wakf Tribunal, Chhatrapati Sambhajinagar under the administrative control of the Minorities Development Department;

(i) "Selection Committee" means the Committee constituted, from time to time by the Government for the purpose of selection of candidates for direct recruitment to the post of Group B (Non-Gazetted), Group 'C' and Group 'D' in the Government Service.

3. The appointment to the post of Assistant Superintendent Group 'B' (Non-Gazetted) shall be made, by promotion of a suitable person having eligibility for promotion on the basis of combined seniority list from amongst the persons holding the post of Senior Clerk, Group 'C' and Accounts Clerk, Group 'C' having not less than three years of regular and continuous service on that post.

4. The appointment to the post of Stenographer (Lower Grade), Group 'B' (Non-Gazetted) shall be made, made by nomination from amongst the candidates recommended by the Selection Committee who fulfils the following criteria, namely:—

(1) Age Limit.-

(a) Lower Age Limit.—Not less than eighteen years as on the last date of receipt of applications as per advertisement for recruitment to the said post.

(b) Upper Age Limit.—Not more than thirty-eight years of age for the persons not belonging to reserved categories and forty-three years of age for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(2) Education Qualification –

(a) Possess a degree and

(b) Possess the Government Commercial Certificate with a speed of not less than 100 words per minute in English shorthand and the Government Commercial Certificate or Computer Typing Certificate with a speed of not less than 30 words per minute in Marathi Typewriting or 40 words per minute in English Typewriting.

5. The appointment to the post of Senior Clerk, Group 'C' shall be made,—

(a) by promotion of a suitable person having eligibility for promotion on the basis of seniority, as per combined seniority list subject to fitness from amongst the persons holding the post of Clerk Typist, Group 'C' and Bailiff, Group 'C' having not less than three years regular and continuous service on that post and possesses the qualification mentioned in clause of sub-rule or

(b) by Nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfils the following criteria, namely:—

(1) Age limit :—

(a) Lower Age Limit.—Not less than eighteen years as on the last date of receipt of applications as per advertisement for recruitment to the said post.

(2) Educational Qualification :—

(a) Possess a degree and

(b) Possess the Government Commercial Certificate or Computer Typing Certificate with a speed of not less than 30 words per minute in Marathi Typewriting or 40 words per minute in English Typewriting.

6. The appointment to the post of "Accounts-Clerk-", Group 'C' shall be made by nomination from amongst the candidates recommended by the Selection Committee who fulfils the following criteria, namely :—

(1) Age limit :—

(a) Lower Age Limit.—Not less than eighteen years as on the last date of receipt of applications as per advertisement for recruitment to the said post.

(2) Educational Qualification :—

(a) Should possess at least one qualification from the below :—

(i) a degree in commerce, or

(ii) a degree in Arts with Statistics, Mathematics, or

(iii) Economics as the principal subject, or

(iv) a degree in Science with Statistics or Mathematics as the principal subject, or (v) a degree of Business Administration, or

(vi) any degree and has passed intermediate examination for Chartered Account (b) Possess the Government Commercial Certificate or Computer Typing Certificate with a speed of not less than 30 words per minute in Marathi Typewriting or 40 words per minute in English Typewriting.

7. The appointment to the post of Bailiff, Group 'C' shall be made by nomination from amongst the candidates recommended by the Selection Committee who fulfils the following criteria, namely:—

(1) Age limit :—

(a) Lower Age Limit.—Not less than eighteen years as on the last date of receipt of applications as per advertisement for recruitment to the said post.

(2) Educational Qualification :—

Possess a degree.

8. Appointment to the post mentioned in rule 5 by promotion and nomination shall be made in the ratio of 50:50, respectively, for the total number of sanctioned posts to be filled under rule 5.

9. (a) A person to be appointed to the post mentioned in rules 3 and 5 by promotion shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.

(b) A person appointed to the post mentioned in rules 4,5,6 and 7 by nomination, shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

10. (a) A person to be appointed to the post mentioned in rules 3 and 5 by promotion shall possess a Certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

(b) A person to be appointed to the post mentioned in rules 4, 5, 6 and 7 by nomination, shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

11. (1) A person recommended for appointment by nomination to the post mentioned in rules 4, 5, 6 and 7 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments८ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मे २१, २०२४/वैशाख ३१, शके १९४६ issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government Service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in Government Service.

12. A person appointed to the post mentioned in rule 3, 4, 5, 6 and 7 shall be liable to be transferred anywhere in Maharashtra.

13. The terms and conditions specified by the Government, subsequent to the appointment of any Government Servant in any rules, orders or resolutions issued by the Government, from time to time, shall also be applicable to the Government Servant.
