क्र. मकिंवकिंनआ/तांकिंत्रक/किंवकिंनयेम/०३१४.—विद्युत अविवियम, २००३ (२००३ चा ३६) मील कलम १८१ च्या उप-कलम (आर) आवि (एस) सहकलम ४२ च्या उप-कलम (५) ते (७) े प्रदा करण्यात आलेल्या अविकाराचा तसेचा या सदाभात समर्थ कराऱ्या इतर स अविकाराचा ापर करू पू-प्रविसध्दाीतर, महाराष्ट्र विद्युत वियामक आयोग याद्वारे, महाराष्ट्र विद्युत वियामक आयोग (ग्राहक गाऱ्हाे विार मचा आवि विद्युत लोकपाल) विवियम, २०२० ('मुख्ये किंवकिंनयेम') या विवियमामध्ये सुारा करण्यासाठी खालील विवियम करीत आहे :
१. संकिंप्त शाीर्षक आकिंण प्रारांभा
१.१ या विवियमा महाराष्ट्र विद्युत वियामक आयोग (ग्राहक गाऱ्हाे विार मचा विद्युत लोकपाल) (पविहली सुारा) विवियम, २०२४, असे म्हाे.
१.२ हे विवियम ते ज्या तारखाेस शासकीये राजपत्रात अविसूविचात करण्यात येतील त्या तारखाेपासू अमलात येतील.
२ मुख्ये किंवकिंनयेमांच्येा किंवकिंनयेम ३ मध्ये
े सुधाराणा:—
२.१ मुख्य विवियमाचाे विवियम ३.३ खालीलप्रमाे बदालण्यात येतील:
"३.३ वितर परारक त्याच्या ीज पुरठ्याच्या क्षेत्रातील प्रत्येक वितर मडलात एक (१) मचा स्र्थाप करील.
परतु असे की, जर वितर परारकाच्या ीज पुरठ्याचाे क्षेत्रा बृहन्मु बई त्याच्याशी सलग् क्षेत्रा असेल तर प्रत्येक वितर परारक ीज पुरठ्याच्या अशीा क्षेत्रासाठी विकमा एक (१) तरी मचा स्र्थाप करील.

भाग चार-क-३८–१२ महाराष्ट्रट शासन राजपत्र असाधाराण भाग चारा-क, मे २२, २०२४/ज्येष्ठ १, शाके १९४६ परतु आखाी असे की, आयोग ेळोेळोी ज्या मागदाशीक सूचा विकंा विदाेशी जारी करेल त्याच्या अी राहू, मचाचाे अविकारक्षेत्रा हे वितर परारकाकडू ठीरविण्यात येईल.
परतु आखाी असेही की, मुख्य विवियमातगत एकापेक्षेा जास्त मडलाच्या अविकारक्षेत्रासाठी स्र्थाविपत करण्यात आलेला मचा येर्थू पुढे तो ज्या मडलामध्ये स्थिस्र्थत आहे त्या मडलासाठी मचा म्हू काय करेल. तर्थाविप, या विवियमाच्या अविसूचाेच्या विदाकापयंत प्रलविबत असलेल्या स गाऱ्हाण्याचा विय, सबवित मडलासाठी स्र्थाप करायाच्या मचाकडे हस्तातरिरत करता, केळो अशीा मचाकडूचा घेण्यात येईल.
स्पष्टीकराण - या विवियम ३.३ च्या प्रयोजासाठी, अशीा रिरतीे, "वितर मडळो" या शीब्दाचा अर्थ मडळोाच्या उत्तराविकारी व्यक्ती/सस्र्थेच्या (एन्टीटी) मडल कायालयाच्या अविकार क्षेत्रातील विस्थिचात केलेले भाौगोविलक क्षेत्रा, जे मडळोाच्या पुसंघेटीेच्या अुषंगाे विजेच्या वितराच्या कायांच्या सबात असेल, असा राहील."
२.२ मुख्य विवियमातील विवियम ३.४ गळोण्यात येतात.
३ मुख्ये किंवकिंनयेमांच्येा किंवकिंनयेम ४ मध्ये सुधाराणा
३.१ मुख्य विवियमाचा विवियम ४.१ चा उप-खाड (ए) खालीलप्रमाे बदालण्यात येईल:
"(ए) या मचाचा अध्यक्षे हा सेाविृत्त ज्येष्ठी न्यावियक अविकारी; विकंा सेाविृत्त शीासकीय अविकारी जो अवितरिरक्त विजल्हाविकारी विकंा समकक्षे पदापेक्षेा खालील दाजाचा सेल; विकंा एखाद्युा ामाविकत अविभाया वित्राकी महाविद्युालयाचा सेाविृत्त प्राचाय; विकंा एखाद्युा ामाविकत सस्र्थेतील विद्युत अविभायावित्राकी विभागाचा सेाविृत्त प्राध्यापक असेल; विकंा शीासाचा सेाविृत्त ज्येष्ठी विद्युत अविभायता असेल.
परतु असे की, अध्यक्षेा महाराष्ट्र राज्याच्या स्र्थाविक भाषंेचाे कामापुरते ज्ञा असेल.
परतु आखाी असे की, इच्छुक व्यस्थिक्तकडू अज मागविण्यात आल्यातर आवि उमेदाराच्या सविक्षेप्त यादाीमू विड करू आयोगाकडू अध्यक्षेाचाी वियुक्ती करण्यात येईल.
परतु आखाी असेही की, आयोग परारकाला अशी विड प्रविया आयोगाच्या मागदाशीा अतगत करण्याचाे विविदाेशीपूक विदाेशी दाेऊ शीकेल. अशीा प्रकरी आयोग विड सविमती ामविदाेविशीत करेल.
परतु असेही की, आयोग अशीा अजदाराच्या सचाोटी आवि पूविपठीकेचाी पडताळोी करील."
४ मुख्ये किंवकिंनयेमांच्येा किंवकिंनयेम ५ मध्ये सुधाराणा
४.१ मुख्य विवियमातील विवियम ५.३ चाे परतुक गळोण्यात येते.
४.२ मुख्य विवियमातील विवियम ५.४ चाे दाुसरे आवि वितसरे परतुक गळोण्यात येते.
५ मुख्ये किंवकिंनयेमांच्येा किंवकिंनयेम १६ मध्ये सुधाराणा
५.१ मुख्य विवियमाचा विवियम १६.१ खालीलप्रमाे बदालण्यात येतील:
"१६.१ विद्युत लोकपाल हे उच्चा न्यायालयाचाे सेाविृत्त न्यायमूती विकंा सेाविृत्त विजल्हा न्यायाीशी, शीासाचाे सेाविृत्त सविचा विकंा समकक्षे अविकारी याच्यामू गठीत करण्यात येतील."
६ परिराकिंशाष्टीमध्ये सुधाराणा
६.१ मुख्य विवियमाचाे परिरविशीष्टी १ गळोण्यात येते.

NOTIFICATION
The elecTriciTy AcT, 2003.
No. MERC/Tech/Regulation/0314.—In exercise of the powers conferred on it by sub-sections (r) and (s) of Section 181 read with sub-sections (5) to (7) of Section 42 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling it in this behalf and after previous publication, the Maharashtra Electricity Regulatory Commission hereby makes the following Regulations, to amend Maharashtra Electricity Regulatory Commission (Consumer Grievance Redressal Forum & Electricity Ombudsman) Regulations, 2020 ('the Principal Regulations'), namely:
1. Short title and commencement
1.1 These Regulations may be called the Maharashtra Electricity Regulatory Commission (Consumer Grievance Redressal Forum & Electricity Ombudsman) (First Amendment) Regulations, 2024.
1.2 These Regulations shall come into force from the date of their publication in the Official Gazette.
2. Amendment to Regulation 3 of the Principal Regulations: -
2.1 Regulation 3.3 of the Principal Regulation shall be substituted by the following:
"3.3 A Distribution Licensee shall establish one (1) Forum in each distribution Circle falling within its area of supply:
Provided that where the area of supply is the city of Greater Mumbai and adjoining areas, each Distribution Licensee shall have at least one (1) Forum for such area of supply:
Provided further that the area of jurisdiction of the Forum shall be decided by the Distribution Licensee subject to any guidelines or directions that may be issued by the Commission, from time to time:
Provided also that Forum established under Principal Regulations with jurisdiction of more than one Circle shall henceforth function as Forum for the Circle in which it is located. However, all pending grievances as on date of notification of these Regulations before such Forum shall be decided by such Forum only without transferring it to Forum to be setup for respective Circle.
Explanation.—for the purpose of this Regulation 3.3, the term "distribution Circle" shall mean the geographical area falling within the jurisdiction of a Circle office of the successor entities of the Board as may be vested with the functions of distributing electricity pursuant to re-organisation of the Board."
2.2 Regulation 3.4 of the Principal Regulations stands deleted.
3. Amendment to Regulation 4 of the Principal Regulations:
3.1 Sub-clause (a) of Regulation 4.1 of the Principal Regulation shall be substituted by the following:
"(a) The Chairperson of the Forum shall be a retired senior judicial officer; or a retired civil servant not below the rank of an Additional Collector or equivalent; or a retired Principal of a reputed Engineering college; or a retired Professor of the Electrical Engineering Department४ महाराष्ट्रट शासन राजपत्र असाधाराण भाग चारा-क, मे २२, २०२४/ज्येष्ठ १, शाके १९४६ of a reputed institute; or a retired senior electrical engineer of the Government:
Provided that the Chairperson shall preferably have working knowledge of the vernacular language of the State of Maharashtra:
Provided further that the Chairperson shall be nominated by the Commission after inviting applications from interested persons and selecting from shortlisted candidates:
Provided also that the Commission may specifically direct the Licensee to conduct such selection process under the guidance of the Commission. In such case, the Commission shall nominate the selection committee:
Provided also that the Commission shall verify the integrity and background of such applicants;"
4. Amendment to Regulation 5 of the Principal Regulations:
4.1 Proviso to Regulation 5.3 of the Principal Regulations stands deleted.
4.2 Second and Third proviso to Regulation 5.4 of the Principal Regulations stands deleted.
5. Amendment to Regulation 16 of the Principal Regulations: -
5.1 Regulation 16.1 of the principal Regulations shall be substituted by the following:
"16.1 The Electricity Ombudsman shall be constituted from amongst a retired judge of a High Court or District Court, a retired Secretary to the Government or equivalent officer."
6. Amendment to Appendix
6.1 Appendix 1 of the Principal Regulations stands deleted.
