ORDER
No. D.T.P-D.P. Umarkhed (R)-Sec-127(2)-Order-TPV-VI-4180.—
Whereas, the Revised Development Plan of Umarkhed Municipal Council has been sanctioned as per the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") by the Government in Urban Development Department vide its Notification No. TPS-2798- 1026-CR-55-98-UD-13, dated 27th January, 1999 (hereinafter referred to as " the said Notification ") & came into force with effect from dated 15th April, 1999 (hereinafter referred to as the " said Sanctioned Revised Development Plan ") ;
And whereas, in the said Sanctioned Revised Development Plan, the land bearing S. No. 331 an area admeasur- ing 0.9256 HA. approximately of Mouza Umarkhed, Taluka Umarkhed is affected by Reservation No. 27 " Play Ground " (hereinafter referred to as " the said Reservation ") for which Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Umarkhed (hereinafter referred to as " the said Appropriate Authority ");
And whereas, the land under said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Revised Development Plan come into force ;
And whereas, the concerned land owner (hereinafter referred to as " the said land Owners "), of the land bearing S. No. 331/3, area admeasuring 0.27 HA. of Mouza Umarkhed, Part 2, Tal. Umarkhed, Dist. Yavatmal (hereinafter refferred to as " the said Land ") had served a notice dated 17th September, 2019 through Adv. J. R. Pawar as per the provisions of Section 127(1) of the said Act in respect of the area affected by the said Reservation (hereinafter referred to as " the said Notice ") on the said Appropriate Authority and the same has received to Appropriate Authority on 18th September, 2019;
And whereas, the said land under the said Reservation is not acquired or no steps as required as per the provisions of Section 127(1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said Notice by the said land owner ;
And whereas, in Write Petiion No. 3536/2022 filed by the said Land owner in the Hon'ble High Court of Judicature at Mumbai, Nagpur Bench, the Hon'ble High Court has directed to the State Government vide decision dated 21st August, 2023 (hereinafter referred to as " the said Judgement ") that, to notify the lapsing of the said reserva- tion on the said Land by an order to be published in the Official Gazzete ;
And whereas, the Chief Officer, Municipal Council, Umarkhed has submitted the proposal vide it's letter No. 353/ 2023-24, dated 4th October, 2023, to issue an order in respect of lapsing of the said Reservations under the provisions of Section 127(2) of the said Act as per the said Judgement of the Hon'ble High Court ;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati has submitted report vide it's letter No. 1583, dated 13th December, 2023; mentioned mainly therein that, it is necessary to issue an order under the provisions of Section 127(2) of the said Act as directed by the Hon'ble High Court in respect of lapsing of the said Reservation on the said Land ;
And whereas, as per the Measurement Plan (M. R. No. 44/2019, dated 16th February, 2019) of the said Land, it is clear that, out of area admeasuring 0.27 HA. of the said land excluding area under 9.0 mt. Development Plan Road adjacent to the north boundary, area affected by the said Reservation is 0.2475 HA.;
And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Revised Development Plan of the Director of Town Planning, Maharashtra State, Pune is of the opinion that,४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, +रू]क्ष् २२-२८, २०२४/रम् ३१- ६, ॅ १९४६ it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the said reservation partly on the area admeasuring approximately 0.2475 Ha. (2475 Sq. mt.) of the said land ;
And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December, 2016, has delegated the powers exercisable by it under the provisions of Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation partly in respect of the said land as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows—
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added :—

Regarding minor modification under section 37(1) of Maharashtra Regional and Town Planning Act, 1966
to the Sanctioned Development Plan of Ner-Nababpur Municipal Council.
NOTICE
No. MCN-N-TPD-605-2024.—
The Development Plan of Ner-Nababpur town has been prepared by Municipal Council, Ner-Nababpur with refer- ence to provisions of Maharashtra Regional and Town Planning Act, 1966 has sanctioned by Urban Development Department Government of Maharashtra vide Resolution No. TPS-2718-1393-CR-117-2018-UD-30, Dated 5th August, 2019 to come into force with effective from 4th September, 2019.
The minor modification is necessary for Development of Ner Town. The minor modification is as Under :—
As Per sanction Development Plan the proposed Gat No. 333, 315, 316 situated along Ner-Bypass road is reserved for agriculture purpose area 1.32 Hec. under Gat No. 333, area 1.32 Hec. under Gat No. 315, area 2.02 Hec.
under Gat No. 316. Should be converted to Residential Zone.
६ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, +रू]क्ष् २२-२८, २०२४/रम् ३१- ६, ॅ १९४६The Municipal Council vide Administrative Meeting Resolution No. 10, Dated 7th November, 2023 has therefore decided to make the aforesaid minor modification shown in Development Plan under Section 37 of Maharashtra Regional and Town Planning Act, 1966.
Whereas, in pursuance of Section 37(1) of Maharashtra Regional and Town Planning Act, 1966 is hereby notified that any person having objection and suggestion in regarding to proposed modification may communicate in writing to the Administrator or Chief Officer, Municipal Council, Ner-Nababpur within 30 (Thirty) days from the date of Publication of Notice in Maharashtra Government Official Gazette.
The suggestions, objections received within the above period shall be considered by the council before submitting the proposal of final minor modification to Government for sanction. The part plan of Development under modification and report there of duly signed and dated by Administrator and Chief Officer is kept ready for public inspection during office hours in the office of Municipal Council, Ner-Nababpur on all working days.

Publicatiohn of Draft Development Plan of Chikhli Under Section 26 (1) of
Maharashtra Regional & Town Planning Act, 1966
NOTICE
No. MCC-864-2024.—
Whereas, the Chikhli Municipal Council (hereinafter referred to as "the said Planning Authority"), vide Resolution No. 1, dated 18th April, 2022 had declared its intention to prepare a Draft Development Plan of Chikhli (hereinafter referred to as the "said Draft Development Plan") for the area under its jurisdication (hereinafter referred to as the said "area") as per the provision of Section 23(1) read with Section 21(2) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as the "said Act") and Notice to that effect is published in Maharashtra Government Gazette, Amravati Division, Supplement Part-1A on 1st September, 2022;
And whereas, as per the provision in Section 24 of the "said Act" the Chikhli Municipal Council vide Order No. 3347, dated 8th September, 2022 has appointed Assistant Director, Town Planning, Buldhana Branch, Buldhana, as "Town Planning Officer" to prepare the said Draft Development Plan for the said area;
And whereas, the Town Planning Officer and Assistant Director, Town Planning, Buldhana Branch, Buldhana, after having prepared Existring Land Use Map as per Section 25 of the said Act, has prepared the said Draft Development Plan of the said area and has handed it over to the said Planning Authority for publication under Section 26(1) of the said Act;
And whereas, the said Planning Authority has passed Resolution No. 1, dated 13th August, 2024 to publish the said Draft Development Plan under Section 26 (1) of the said Act for inviting suggestions/objections from the public;
द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, +रू]क्ष् २२-२८, २०२४/रम् ३१- ६, ॅ १९४६ ९Now therefore, Chikhli Municipal Council hereby publishes the said Draft Development Plan along with the Report under Section 26 (1) of the said Act for invisting suggestions/objections from the public. The copy of the said Draft Development Plan and Report thereof are kept open for inspection of the public at the following offices on all working days during office hours.
(1) The Chief Officer, Chikhli Municipal Council.
(2) Assistant Director, Town Planning, Buldhana Branch, Buldhana.
The suggestions/objections if any, in writing from the public in this regard with reasons, shall be submitted to the Chief Officer, Chikhli Municipal Council, within the period of 30 days from the date of publication of the Notice in Maharashtra Govt. Gazettee. Suggestions/objections received by the Municipal Council within the period of the 30 days from the date of publication of this Notice in Maharashtra Government Gazette shall only be considered.
The copies of the said Draft Development Plan and particulars shall be available to the public at reasonable price in the office of the Chikhli Municipal Council.
