आवि ज्याअर्थी, मंहाराष्ट्र मंहानांगरापुाविलका अविविनांयमं, १९४९ च्या कलमं ३ मंील खंडा (अ) उपुकलमं (३) द्वाराे प्रानां केलेल्या अविकारांचा आवि त्या अनांुषंगानांे इतरा साव अविकारांचा ापुरा करूनां ासानां नांगराविकासा विभागाकडाील अविसाूचनांा क्रमंांक एनांएनांएमंसाी-१२१५/प्र.क्र.१४/१५(भाग-१) / नांवि-२८, विनांांक ७ मंाचव २०२४ द्वाराे (यापुढे ज्याचा उल्लेख " उक्त अविसाूचनांा " असा कराेत आलेला आहाे) उक्त १४ गांचा सामंाे नांी मंु ंबई मंहानांगरापुाविलका हाविमंध्ये (यापुढे ज्याचा उल्लेख "उक्त मंहानांगराहा- पुाविलका" असा कराेत आलेला आहाे) कराण्यात आला आहाे ;

आवि ज्याअर्थी, उक्त १४ गांचा उक्त मंहानांगरापुाविलकेच्या अविकारा क्षेत्रात सामंाे कराण्यात आला असाल्यानांे उक्त अविविनांयमंाच्या कलमं २(१५)(अ) अंतगवत स्र्थीाविनांक प्राविकराच्या अविकारांचा ापुरा उक्त मंहानांगरापुाविलका करात आहाे ; आवि म्हाूनां उक्त मंहानांगरापुाविलकेनांे विनांांक १५ मंाचव २०२४ च्या पुत्राद्वाराे उक्त १४ गाे उक्त अविसाूविचत क्षेत्रातूनां गळूनां उक्त १४

भाग एक (को.वि.पु.) ९४-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, ऑगस्ट २९, २०२४ / भाद्रपद ७, शके १९४६ गांकरिराता एमंएमंआराडाीए ची विेष विनांयोजनां प्राविकरा म्हाूनां असालेली विनांयुक्ती रा कराेबाबत उक्त अविविनांयमंाच्या कलमं २(१९) अंतगवत विनांयोजनां प्राविकरा म्हाूनां नांी मंु ंबई मंहानांगरापुाविलकेची विनांयुक्ती कराेबाबत विनांती केली आहाे ;

आवि ज्याअर्थी, उक्त अविसाूचनांा विनांांक ७ मंाचव २०२४ उक्त मंहानांगरापुाविलकेनांे केलेली विनांती विचारात घूेता, उक्त अविसाूविचत क्षेत्रातूनां उक्त १४ गाे अविसाूविचत क्षेत्रा म्हाूनां रा करूनां एमंएमंआराडाीएची उक्त १४ गांसाठी उक्त विेष विनांयोजनां प्राविकरा म्हाूनां केलेली विनांयुक्ती मंागे घूे उक्त अविविनांयमंाच्या कलमं २(१९) अन्ये उक्त मंहानांगरापुाविलकेची उक्त १४ गांसाठी विनांयोजनां प्राविकरा म्हाूनां विनांयुक्ती कराे आश्यक आहाे, असाे ासानांाचे असाे मंत झाले आहाे ;

आवि त्याअर्थी, ासानां याद्वाराे,

(अ) उक्त १४ गांचे क्षेत्रा उक्त अविसाूविचत क्षेत्रामंूनां गळण्यासा मंजुराी ेण्यात येत आहाे ; तसाेच, (ब) उक्त अविसाूविचत क्षेत्रातील उक्त १४ गांकरिराता एमंएमंआराडाीएची 'विेष विनांयोजनां प्राविकरा' म्हाूनां केलेली विनांयुक्ती मंागे घूेण्यात येत आहाे. तसाेच,

(क) स्पुष्टता कराण्यात येते की, उक्त अविविनांयमंाचे कलमं २(१५)(a) नांुसारा उक्त १४ गाे स्र्थीाविनांक प्राविकरा म्हाूनां ंबई मंहानांगरापुाविलकेच्या अविकाराक्षेत्रात सामंाविष्ट असाल्यानांे, उक्त अविविनांयमंाच्या कलमं २(१९) नांुसारा यापुढे उक्त नांी मंु मंहानांगरापुाविलका, उक्त १४ गांचे क्षेत्रासाठी विनांयोजनां प्राविकरा म्हाूनां कामं पुाविहाल. तसाेच,

(डा) स्पुष्टता कराण्यात येते की, उक्त १४ गांचा विकासा आराखडा अंमंलात येईपुयंत, उक्त १४ गांसाठी एमंएमंआराडाीए ची मंजूरा असालेली आवि विनांांक २०जूनां २०२१ पुासाूनां अंमंलात असालेली प्राेविक योजनांा विनांांक ३ विडासांबरा २०२० पुासाूनां लागू असालेली एकवित्राकृत विकासा विनांयंत्रा आवि प्रोत्साहानां विनांयमंाली लागू राहाील. एमंएमंआराडाीएनांे पुीच विकासा पुरानांगी विलेल्या तर्थीाविपु, विकासा अद्यापु पुूव नां झालेल्या प्रकरांमंध्ये उक्त मंहानांगरापुाविलकेनांे एमंएमंआराडाीएी साल्लामंसालत करूनां कायवाहाी कराी ;

या अविसाूचनांेची प्रत नांकासाहा एका मंविहान्याच्या कालाीसाठी खालील कायावलयांमंध्ये पुाहाीसाठी उपुलब् करूनां ेण्यात याी :-

NOTIFICATION

Maharashtra regional and town Planning act, 1966.

No. TPB 4324/699/CR-83/2024/UD-11.— And whereas, the Mumbai Metropolitan Region Development Authority (MMRDA) had been appointed as a Special Planning Authority (hereinafter referred to as " the said Special Planning Authority ") under the provisions of sub-section (1) (c) of section 40 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") for the Ambernath, Kulgaon-Badlapur and Surrounding Notified Area (hereinafter referred to as " the said Notified Area ") by including 14 villages (Dahisar, Mokashi, Walivali, Pimpri, Nighu, Navali, Waklan, Bamarli, Narivali, Bale, Nagaon, Bhandarli, Uttar Shiv, Goteghar) from the Thane Tahsil (hereinafter referred to as " the said 14 villages ") by the Government in Urban Development Department vide Notification No. TPS-1717/2750/CR 91/19/AKBNA/UD-12 dated 19th September 2019 ;

And whereas, in exercise of the powers conferred by clause (a) sub-section (3) of section 3 of the Maharashtra Municipal Corporations Act, 1949, and of all other powers enabling it in that behalf, the Government in Urban Development Department of Maharashtra altered the limits of Navi Mumbai Municipal Corporation (NMMC) (hereinafter referred to as "the said Corporation") by including the said 14 villages vide Notification No. NMMC-1215/C.R.14/15 (Part-1)/UD-28, dated 7th March 2024 ;

And whereas, since the said 14 villages are included in said Corporation's jurisdiction thereby the said Corporation exercises the powers of a Local Authority under section 2(15) (a) of the said Act; and therefore the said Corporation vide its letter dated 15th March 2024 has requested the Government to exclude the said 14 villages from the said Notified Area from jurisdiction of the MMRDA as a Special Planning Authority and to appoint the said Corporation as Planning Authority under section 2(19) of the said Act ;

And whereas, considering the notification dated 7th March 2024 and the request of the said Corporation, the State Government is of the opinion that it is necessary to exclude the said 14 villages from the said Notified Area and to withdraw the appointment of the MMRDA as a Special Planning Authority for the said 14 villages within Notified Area; and to appoint said Corporation as the Planning Authority for the said 14 villages under section 2(19) of the said Act ;

Now, therefore, the Government hereby,

(a) Sanctions to exclude the said 14 villages from the said Notified Area ;

(b) Withdraws the appointment of the MMRDA as a Special Planning Authority for the said 14 villages within the said Notified area ;

(c) Clarifies that, since the said 14 villages are falling within the jurisdiction of the said Corporation and the said Corporation is the Local Authority within the meaning of section 2(15) (a) of the said Act, henceforth for the said 14 villages the said Corporation shall act as a Planning Authority u/s 2 (19) of the said Act.

(d) Clarifies that, till Development Plan for the said 14 villages included in said Corporation's jurisdiction comes in force, Regional Plan of MMRDA sanctioned by government and in force from 20th June 2021 and Unified Development Control and Promotion Regulation in force from 3rd December 2020 will be applicable for the said 14 villages. The cases wherein development permission has already been granted by MMRDA but development is not completed,४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, ऑगस्ट २९, २०२४ / भाद्रपद ७, शके १९४६ such cases shall be dealt with in consultation with MMRDA by the said Corporation ; A copy of this Notification along with plan shall be made available for inspection for a period of one month at the following offices :–

(i) Assistant Director of Town Planning, Navi Mumbai Municipal Corporation, Head office, Plot No.1, Near Killegaothan, Palmbeach Junction, Sector 15A, C.B.D. Belapur, Navi Mumbai 400 614.

(ii) Chief, Town and Country Planning Division, Mumbai Metropolitan Region Development Authority, Bandra-Kurla Complex, Bandra (East), Mumbai 400 051.
