NOTIFICATION

No.-TPS-2823-1020-C.R.81-2023-UD-30 .–

Whereas, the Development Plan of Umarkhed (Extended Limits) Umarkhed City, Dist. Yavatmal has been sanctioned by the Government under section 31 of the Maharashtra Regional and Town Planning Act. 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification No. TPS-2718-1763-CR-165- 2018-UD-30, dated the 02nd December, 2021 and has come into force with effect from the 30th April, 2022 (herein- after referred to as "the said Development Plan");

And whereas, in the said Development Plan, the land admeasuring 2.00 Hector bearing Survey No.26/1 of Mauje Umarkhed (hereinafter referred to as "the said Land") is included in Hilly Area;

And whereas, as per the provisions of section 37(1) of the said Act. the Chief Officer. Umarkhed Municipal Council, Umarkhed, Dist. Yavatmal vide Administrative Resolution No. -रूॅ द्धहान््र-१०२-२०२२-२३, dated the 20th February, 2023, has resolved to make modification in the said Development Plan, so as to delete the said Land from Hilly Area and to reserve the land so released for "Additional District & Session Court" (hereinafter referred to as "the said Proposed Modification") and accordingly submitted the proposal to the Government for sanction vide its Marathi letter No. -ह्यह्यम्-३८/२०२३-२४, dated the 20th April, 2023;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that, the said Proposed Modification should be sanctioned with certain changes;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of section 37 of the said Act, the Government of Maharashtra hereby sanctions the said Proposed Mdification by deleting 2.00 Hector area from the land bearing Survey No. 26/1 of Mauje Umarkhed and including the land so released in Public Semi-Public Zone, with certain changes. and for that purpose amends the above said Notification dated the 02nd December, 2021 as follows:–

"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry."–

ENTRY

"The land admeasuring 2.00 Hector, bearing Survey No.26/1 of Mauje Umarkhed, Taluka Umarkhed, is deleted from Hilly Area Zone and the land so released is included in Public Semi-Public Zone, as shown on plan." A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Umarkhed Municipal Council, Dist. Yavatmal, during office hours on all working days for inspection of general public for a period of one month.

BY DIRECTOR OF TOWN PLANNING

THE MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1966.

ORDER

No.D.T.P-D.P. Umarkhed (R)-Sec-127(2)-Order-TPV-VI-4388 .–

Whereas, the Revised Development Plan of Umarkhed Municipal Council has been sanctioned as per the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (here- inafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No.TPS-2798-1026-CR- 55-98-UD-13, dated 27th January, 1999 (hereinafter referred to as "the said Notification") & came into force with effect from dated 15th April, 1999 (hereinafter referred to as the "said Sanctioned Revised Development Plan") ;

And whereas, in the said Revised Sanctioned Development Plan, admeasuring approximate areas of 0.9256 Ha. & 1.8762 Ha. of the land bearing S.No. 331 of Mouza Umarkhed are affected by the Reservation No.27 "Play Ground" & Reservation No. 18 "Garden" respectively (hereinafter referred to as "the said Reservations") for which Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Uma- rkhed (hereinafter referred to as "the said Appropriate Authority") ;

And whereas, the land under said Reservations have not been acquired by the said Appropriate Authority within 10 (Ten) years from the date on which the said sanctioned Revised Development Plan come into force ;

And whereas, the concerned land owners (hereinafter referred to as "the said Land Owners") of the land bearing S. No. 331/3 (part), area admeasuring 0.81 Ha. of Mouza Umarkhed, Tal. Umarkhed, Dist. Yavatmal (hereinafter referred to as "the said Land") had served a notice Dated 31st January, 2020 as per the provisions of Section 127(1) of the said Act in respect of the area affected by the said Reservation (hereinafter referred to as "the said Notice") on the said Appropriate Authority and the same has received to Appropriate Authority on Dated 1st February, 2020 ;

And whereas, the said land under the said Reservations is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said Notice by the said land owners ;

And whereas, in Writ Petition No. 5026/2022 filed by the said Land owners in the Hon'ble High Court of Judicature at Mumbai, Nagpur Bench, the Hon'ble High Court has directed to the Respondents vide decision Dated 17th March, 2023 (hereinafter referred to as "the said Judgement") that, to notify the lapsing of the said reservations having areas 0.65 Ha. & 0.16 Ha. respectively on the said Land by an order to be published in the Official Gazzete;

And whereas, the Chief Officer, Municipal Council, Umarkhed has submitted the proposal vide letter No. 277/2023-24, Dated 11th July, 2023 to issue an order in respect of lapsing of the said Reservations on the said Land under the provisions of Section 127(2) of the said Act as per the said Judgement of the Hon'ble High Court ;

And whereas, the Joint Director of Town planning, Amravati Division, Amravati has submitted report vide it's letter No. 1133, Dated 08th September, 2023; mainly that, it is necessary to issue order under the provisions of Section 127(2) of the said Act as directed by the Hon'ble High Court in respect of lapsing of the said Reservations on the said Land ;

And whereas, as per the Measurement Plan (M. R. NO. 44/2019, Dated 16th February,2019) of the said Land, it is clear that, out of area admeasuring 0.81 Ha. of the said Land excluding area under 9.0 Mt. Development Plan Road adjacent to the north boundary, area affected by the said Reservations are 0.6019 Ha.& 0.1465 Ha.

respectively ;

And whereas, after considering the above facts in respect of the said Reservations on the said Land in the said Sanctioned Revised Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the said Reservations partly on the area admeasuring approximately 0.6019 Ha. (6019 Sq. Mt.) & 0.1465 Ha.

(1465 Sq. Mt.) respectively of the said land ;

And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No.TPS-1813/3211/CR-508/UD-13, Dated 01st December, 2016, has delegated the powers exercisable by it under the provisions of Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservations partly in respect of the said land as per the provisions of Section 127 (2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows–

After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added:–

A copy of the part plan of the said Sanctioned Revised Development Plan showing the part area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Umarkhed, District Yavatmal during office hours on all working days for inspection to public upto one month.

3. This Order shall also be published on be published on the Directorate's official website www.dtp.

In the said Development Plan, S.No 409/1/K (Area of 1.01 Ha.) is included as Green Zone & Municipal Council, Washim vide Administrator Resolution dated 28th February, 2024 has decided to make Modification in Development Plan and proposed that the above said land of S.No. 409/1/K (Area of 1.01 Ha.) shall deleted from Green Zon and to be included in Residential Zone .
