MAHALAXMI RACECOURSE CLUB / GYMKHANA, PUBLIC PARK/THEME PARK AND

MAHALAXMI RACECOURSE STABLE AREA

Regulation 13(10): Special Regulations for Development or Redevelopment of

Mahalaxmi Racecourse Club/ Gymkhana, Public Park/Theme Park and Mahalaxmi

Racecourse Stable Area :

These regulations shall not be applicable to other existing Club/Gymkhana (EOS 2.1) or reservation of Club / Gymkhana (ROS-2.1) and stables in BMC area.

(A) Development Stipulations for existing Mahalaxmi Racecourse Club /Gymkhana Area :

1) The users permissible for development or redevelopment shall be as under ; club house, restaurants, stands, viewing decks, swimming pool, banquet, small departmental store, conference room, Gymnasium with indoor and outdoor sports like squash, badminton, billiards, table tennis, cricket nets, box cricket, football turf, pickleball and allied users such as security cabin, staff quarters etc and other compatible users as decided by the Municipal Commissioner.

2) The permissible FSI for development or redevelopment shall be zonal basic FSI i.e. 1.33 3) The other stipulations shall be as required under these regulations.

(B) Development Stipulations for existing Mahalaxmi Racecourse Stable Area :

1) The users permissible for development or redevelopment shall be as under; stables, equine pool, veterinary hospital, trainers office, quarters for staff, trainers and additional uses as requested by RWITC such as round pen, storage rooms, jockeys & veterinarians, estate office and allied users such as canteen, security cabin, etc and other compatible users as decided by the Municipal Commissioner. 2) The permissible FSI for development or redevelopment shall be zonal basic FSI i.e 1.33 3) The other stipulations shall be as required under these regulations.

(C) Development Stipulations for Public Park/Theme Park:

1) The users permiss ible for development or redevelopment shall be as under; Playground, Garden, Parks, Botanical Garden, Children Park with Waking Track, Wooded Areas Water Body Art and culture related uses, Vipassana/ yoga meditation, Watch man cabin, Gardener chowky, toilet block etc and other compatible users as decided by the Municipal Commissioner. 2) BMC will ensure that while planning Public Park /Theme Park at Mahalaxmi, the spectators from all levels of the stands will have unhindered and unobstructed view of the entire Mahalaxmi Racecourse Track.

3) The other stipulations shall be as required under these regulations.

BRIHANMUMBAI MUNICIPAL CORPORATION

NOTIFICATION

No. ChE/DP/10444/City dt. 21.08.2024.—Whereas, in exercise of the powers conferred by sub- section (1) and (2) of Section 37 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'MR&TP Act, 1966'), the Planning Authority may, or when so directed by the State Government shall within ninety days from date of such directions publish a notice inviting suggestions/ objections from any person, as mentioned therein and after giving hearing, submit the proposed modification to the State Government and the State Government subject to such condition as it may deem fit sanction the modification or refuse to accord sanction.

And whereas, as per circular u/no. BMC/ADMN/3 dt. 7th April 2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 all the powers of the Corporation are now vested with the Administrator.

And whereas, the plot bearing CS no. 47(Pt) of Lower Parel Division affected by Existing Amenity of 'Recreational Ground' (EOS2.6) as per sanctioned DP-2034 and it is proposed to initiate the process u/sec. 37(1) of MR&TP Act, 1966 for modification in sanctioned DP 2034 & DCPR 2034 incorporating modifications as per Schedule-A.

And whereas, as per the powers conferred by sub-section (1) of Section 31 of the MR&TP Act, 1966, State Government has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as 'the said Development Plan') vide Notification No. TPB-4317/629/ CR-118/2017/DP/UD-11 dtd. 8th May 2018 (hereinafter referred to as 'the said Notification') along with the Development Control and Promotion Regulations-2034 (hereinafter referred to as 'DCPR- 2034') for Greater Mumbai.

And whereas, Administrator (Improvement Committee) vide resolution no. 24 dtd. 20th August 2024 and Administrator (Corporation) vide resolution no. 394 dtd. 21st August 2024 have accorded sanction to (1) Change in nomenclature of Existing Amenity of Mahalaxmi Race Course as per the terms and conditions of the lease agreement dated 2nd July 2024 executed between the BMC and RWITC for permissible uses as proposed by the RWITC and (2) To add special Regulation no. 13(10) in DCPR 2034 for development/ redevelopment of Mahalaxmi Racecourse Club/Gymkhana, Public Park/Theme Park & Mahalaxmi Racecourse Stable area and to take further action to modify the plot bearing CS No. 47(Pt) of Lower Parel Division in Sanctioned DP-2034 of G/South ward to invite suggestions/ objections from general public u/sec. 37(1) of MR&TP Act, 1966 and approach State Govt. in Urban Development Department (hereinafter referred to as 'the UDD in GoM') for final sanction u/sec. 37(2) of MR&TP Act, 1966 for modification in Sanctioned DP-2034.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1) of Section 37 of the MR&TP Act, 1966; and of all other powers enabling it in this behalf, BMC hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by Section 37(1) of the said Act, for information of all persons likely to be affected thereby. BMC is further pleased to inform that any objections/ suggestions in respect of the proposed modification mentioned in the Schedule given below may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of-Chief Engineer (Development Plan), Brihanmumbai Municipal Corporation, 5th floor, Municipal Head office, Mahapalika Marg, Fort, Mumbai 400 001. Any objections or suggestions, which may be received within stipulated time period, will be dealt with in accordance with the provisions of Section 37(1) of the said Act by the Chief Engineer (Development Plan) BMC.

NEW CLAUSES INSERTED :

1. Clause 7.5 of Chapter – VII –Dealings by Clearing Members

INVIOLABILITY OF ADMITTED DEALS

1. All the transactions in repo made subject to the Bye-laws, Rules and Regulations of the Clearing Corporation shall be in- violable and shall be cleared and settled in accordance with the Bye-laws, Rules and Regulations of the Clearing Corporation.

2. Notwithstanding anything contained in clause (1) above, the Clearing Corporation may, to protect the interest of investors in this market and for proper regulation of the market, suo motu annul deal(s) at any time if the relevant authority is satisfied for reasons to be recorded in writing that such deal(s) is/ are vitiated by fraud, material mistake, misrepresentation or market or price manipulation and the like.

3. Any annulment made pursuant to clauses (1) and (2) above, shall be final and binding upon the parties to deal(s).

Existing clauses 7.5 and 7.6 will be re-numbered as 7.6 and 7.7.

2. 11.24 of Chapter – XI – Default

The provisions of this Chapter XI shall be applicable to the Participants as if they were the Clearing Members, if so notified by the Clearing Corporations.

Any person having any observations on the above document can send the same in writing to the undersigned at Unit No. 503, Windsor, Off CST Road, Kalina, Santacruz (East), Mumbai 400 098, within twenty-one days from the date of this publication in the Gazette of India.
