Notification u/s 20(4) of Maharashtra Regional and Town Planning Act, 1966

Whereas, the Revised Regional Plan of Wardha Region (hereinafter referred to as " the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-1815-994-CR-516-16-UD-13, Dated 1st January, 2018 under section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and came into force with effect from 2nd March, 2018;
And whereas, in exercise of the powers of Government under section 15(1) & 15(2) of the said Act delegated to the Hon'ble Director of Town Planning, Maharashtra State, Pune vide above Notification dated 1st January, 2018, Peripherial Plan of Higanghat was sanctioned by the Hon'ble Director of Town Planning, Maharashtra State, Pune vide its Notification No. D.T.P.R.P.-Wardha-Wardha Zone Plan-TPV- 2-6000, dated 6th December, 2019 and it came into force from dated 24th February, 2020;
And whereas, the Government vide Resolution No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015 issued directives u/s 154 of the said Act regarding the procedure to be followed under section 20 of the said Act for making changes in the use of land in the areas of sanctioned Regional Plan under the said Act and issued order to follow revised procedure related to above directives vide Govt. Resolution No. TPS-1815-CR-49-15-UD-13; Dated 4th January, 2016; and in exercise of the powers conferred by sub-section (1) of section 151 of the said Act, the Government, vide its Notification No. TPS-1815-CR-49- 15-UD-13, Dated 6th March, 2015, delegated the powers exercisable by it under the provisions of section 20(3) & 20(4) of the said Act, (subject to conditions mentioned therein) to the Divisional Joint Director of Town Planning for Nagpur Administrative Division ;
And whereas, land bearing Survey No. 7/1A (Area 1.58 Hectare) & Survey No. 7/1B (Area 1.57 Hectare) & Survey No. 10/1 (Area 0.96 Hectare) of Mouza-Rimdoh, Tah. Hinganghat, District-Wardha total land admeasuring approx. 4.11 hectares (hereinafter referred to as " the said Area") is included in 'Residential Zone' of proposed Land Use Plan in the sanctioned Regional Plan of Wardha Region;
And whereas, the "Proposal Scrutiny Committee" established under the above mentioned Government Resolution, is of the opinion that the said area should be deleted from " Residential Zone & to be included in Industrial Zone" in accordance with the provision of sub-section (2) of section 20 of said Act subject to compliance of conditions laid down in the above said Government Resolution and payment of requisite premium ;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the " Proposal Scrutiny Committee " is of opinion that proposed modification should be sanctioned with some conditions ;

Hinganghat-Survey No. 7/1A, 7/2B & 10/1/JDTPDN/419, Dated 6th March, 2024 regarding the proposed modification under sub-section (3) of the section 20 of the said Act, was published by Joint Director of Town Planning, Nagpur Division, Nagpur which appeared in the Maharashtra Government Official Gazette, Part-I-A Nagpur Division dated 11th March, 2024 on Page No. 1 to 4 and the same was also published in the Marathi Newspaper ' Dainik Jan-Sangram' dated 12th March 2024 & English Newspaper ' Nagpur Post ' dated 12th March, 2024 for inviting suggestions and/or objections from the general public and the Assistant Director of Town Planning, Wardha Branch, Wardha, was appointed as an ' Officer ' (hereinafter referred to as the " said Officer ") to hear suggestions and/or objections and submit his report to the undersigned ;
And whereas, no suggestions and/or objections are received within prescribed time limit as per the report submitted by the said Officer, And whereas " Proposal Scrutiny Committee " vide its Resolution dated 25th July, 2024 is of the opinion that the said land, should be deleted from " Residential Zone " and be included in " Industrial Zone " subject to certain terms and conditions;
And whereas, the owner of land bearing Survey No. 7/1A (Area 1.58 hectare) & Survey No. 7/2 B (Area 1.57 hectare) & Survey No. 10/1 (Area 0.96 hectare) of Mouza-Rimdoh, Tah. Hinganghat, District- Wardha total area 4.11 hectare has deposited necessary premium in the Government Treasury in this regard;
Now, therefore, in exercise of the powers delegated by the Government the Joint Director of Town Planning, Nagpur Division, Nagpur hereby sanctions the proposed modification under sub-section (4) of section 20 of the said Act & for that purpose directs that in the Schedule of Modifications appended to the Notification dated 1st January, 2018 sanctioning the said Regional Plan, after the last entry, the following new entry shall be added;

" The land bearing Survey No. 7/1 A (Area 1.58 hectare) & Survey No. 7/1B (Area 1.57 hectare) & Survey No. 10/1 (Area 0.96 hectare) of Mouza-Rimdoh, Tah. Hinganghat, District-Wardha total Area 4.11 hectare is deleted from " Residential Zone " and included in " Industrial Zone " more specifically shown on Plan, subject to certain terms and conditions."
Terms & Conditions :—
i. Applicant is adhere to comply with all the terms & conditions mentioned in the no-objection certificate, issued by the Maharashtra Pollution Control Board and all other relevant depart- ments in accordance with the proposed industrial use of the land under subject modification proposal.
ii. In accordance with the proposed Residential Zone adjacent to land under modification proposal, considering provisions of Regulation No. 4.8 (ii) applicable to the area, it will be mandatory to plan minimum 23 m. wide buffer zone in the land under proposal and the same to be kept open permanently.
iii. Applicant will required to submit the permanent registered written consent for approach Road.
The copy of part plan showing the above sanctioned modification shall be kept open for inspection by general public during office hours on all working days for a period of one month at the following offices;
(1) The Collector, Wardha.
(2) The Joint Director of Town Planning, Nagpur Division, Nagpur.
(3) The Assistant Director of Town Planning, Wardha Branch, Wardha.
The above modification will come into force after the date of publication of this Notification in the Maharashtra Govt. Gazette.

NOTIFICATION
No.-MCM-Planning Dep.-203-2024.—
Government of Maharashtra, Urban Development Department vide their Notification No. TPS-2298- 443-CR-102-98-UD-09, dated 25th October, 2001 sanctioned, part of the Development Plan of Mul, has come into force from dated 15th December, 2001 and Excluded Parts of the said Development Plan sanctioned vide Government Notification No. TPS-2414-99-CR-58-2014-UD-09, dated 10th March, 2015.
The Municipal Council, Mul proposed to make minor modification in the aforesaid sanctioned Development Plan under section 37 (1) of the Maharashtra Regional And Town Planning Act, 1966. The Details about Proposed minor modification are as below.—

The plan showing the above proposed modification is kept open in the office of Municipal Council, Mul during the office time for perusal of public.
Now, in pursuance of section 37 (1) of the Maharashtra Regional And Town Planning Act, 1966. It is hereby notified that any suggestion or objection to the proposed modification as details above shall communicate the same in writing to the Chief Officer, Municipal Council, Mul within period of the month (30 days) from the date of Notification published in the Gazette Government of Maharashtra.
The objection or suggestion if any received within above period will be considered before submitting to the proposal to the Government for Sanction.
