क्रमंांका आरजीएनां-२०२४/अनांौ.२०/प्र.क्र.१०६/मं-१(धोरण).- ज्याअर्थी, मंहुाराष्ट्र शासनांानांे, शासनां दिनांणगय, उद्योग, ऊजाग, कामंगार व खदिनांकामंग दिवभाग, क्रमंांका सौरप्र-२०२३/प्र.क्र.९५/ऊजाग-७, दिदानांांका ८ मंे २०२३ (याता यापुढे ज्याचा दिनांदाेशा, "उक्ता दिनांणगय" असा काेला आहुे) याद्वारे, काृदिदिवयका ग्राहुकांनांा, दिवकांदिता सौर ऊजाग प्रकाल्पुाद्वारे दिदावसा वीज पुरवठा कारण्यासाठाी मंुख्यमंत्राी सौर काृी वादिहुनांी योजनांा २.० (याता यापुढे दिजचा दिनांदाेशा, "उक्ता योजनांा" असा काेला आहुे) घोदिता काेली आहुे आदिण उक्ता योजनांेच्या काृदिदिवयका ग्राहुकांनांा वीज पुरदिवण्यासाठाी मंहुाराष्ट्र शासनांाद्वारे अन्य काोणत्याहुी अदिभाकारणास (याता यापुढे दिजचा दिनांदाेशा, "अंमंलबजावणी अदिभाकारण" असा काेला आहुे) नांामंदिनांदाेदिशाता कारण्याता येईपुयंता दिकांवा मंहुाराष्ट्र शासनांाद्वारे इतार काोणताीहुी स्वतांत्रा कांपुनांी स्र्थीापुनां कारण्याता येईपुयंता, एमंएसईबी सोलर पुॉवर मंयागदिदाता (एमंएसएपुीएल) यासहु मंहुाराष्ट्र राज्य दिवद्योुता दिवतारण कांपुनांी मंयागदिदाता (एमंएसईडीसीएल) यांस नांामंदिनांदाेदिशाता कारण्याचा दिनांणगय घोेताला आहुे.

त्याअर्थी, आता, नांदाणी अदिधोदिनांयमं, १९०८ (१९०८ चा १६) (याता यापुढे ज्याचा दिनांदाेशा, "उक्ता अदिधोदिनांयमं" असा काेला आहुे) मंहुाराष्ट्र राज्याता लागू असतानांा, त्याच्या कालमं ७८ च्या खंडी (अ) द्वारे प्रदानां काेलेल्या अदिधोकारांचा वापुर कारूनां, आदिण याबाबताीता समंर्थीग कारणाऱ्या इतार सवग अदिधोकारांचा वापुर कारूनां, मंहुाराष्ट्र शासनां, याद्वारे, कालमं ७८ अन्वये तायार काेलेल्या आदिण संलेखांच्या नांदाणीसाठाी शासकाीय अदिधोसूचानांा, मंहुसूल व वनां दिवभाग, क्रमंांका आरजीएनां-१५५८/६७७३१-एनां, दिदानांांका १७ जुलै १९६१ (याता यापुढे ज्याचा दिनांदाेशा, "उक्ता अदिधोसूचानांा" असा काेला आहुे) या अन्वये प्रदिसद्ध काेलेल्या शाुल्काच्या ताक्त्यामंध्ये सुधोारणा कारीता आहुे आदिण उक्ता अदिधोदिनांयमंाच्या कालमं ७९ द्वारे आवश्यका असल्याप्रमंाणे ताो पुढेीलप्रमंाणे प्रदिसद्ध कारीता आहुे :-

(१)

भाग चार-अ-१७०–१२ महाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-अ, सप्टेंबुरा ११, २०२४/भाद्रपद्र २०, शाके १९४६ उक्ता अदिधोसूचानांेमंध्ये, शाुल्काच्या ताक्त्यामंधोील, अनांुच्छेदा - एका मंध्ये, नांदा ७० नांतार, पुढेील नांदा जादा दाखल कारण्याता येईल :-

"नांदा ७१.- संबंदिधोता दिजल्ह्याचाे दिजल्हुादिधोकारी दिकांवा संबंदिधोता ताहुसीलदार व अंमंलबजावणी अदिभाकारण यांच्यामंध्ये दिनांष्पुादिदाता काेलेल्या भाडीेपुट्ट्याच्या संलेखावर आदिण अंमंलबजावणी अदिभाकारण व दिवकासका दिकांवा/आदिण उक्ता योजनांेखालील सौर ऊजाग प्रकाल्पुाच्या प्रयोजनांासाठाीचा काेवळ दिवकासकानांे स्र्थीापुनां काेलेली एसपुीव्हुी यांच्यामंध्ये दिनांष्पुादिदाता काेलेल्या पुोटेंभाडीेपुट्ट्याच्या संलेखावर, पुढेील शातांस अधोीनां राहुूनां, काोणताेहुी नांदाणी शाुल्का आकारण्यायोग्य असणार नांाहुी.

शाती :-

(१) अंमंलबजावणी अदिभाकारणानांे दिकांवा उद्योग, ऊजाग, कामंगार व खदिनांकामंग दिवभागानांे याबाबताीता प्रादिधोकाृता काेलेल्या इतार काोणत्याहुी सक्षमं प्रादिधोकारणानांे, "पुात्राता प्रमंाणपुत्रा" दाेऊनां, उक्ता योजनांेखालील दिवकासकाचाी पुात्राता प्रमंादिणता काेली पुादिहुजे.

(२) या अदिधोसूचानांेखाली, ज्यानांे लाभा घोेतालेला आहुे दिकांवा सूटें दिमंळदिवलेली आहुे असा दिवकासका दिकांवा अंमंलबजावणी अदिभाकारण, इतार काोणत्याहुी आदाेशानांुसार दिकांवा धोरणानांुसार त्याचा व्यवहुारासाठाी नांदाणी शाुल्काताील मंाफीसाठाी हुक्कादार असणार नांाहुीता.

(३) हुी अदिधोसूचानांा, महाराष्ट्र शासनाच्येा राजपत्रात प्रदिसद्ध हुोण्याच्या तारखेपुूवी, जेव्हुा सौर ऊजाग प्रकाल्पुाच्या काोणत्याहुी दिवकासकानांे दिकांवा अंमंलबजावणी अदिभाकारणानांे आधोीचा नांदाणी शाुल्का प्रदानां काेलेले असेल त्या बाबताीता, काोणताहुी पुरतावा दाेण्याता येणार नांाहुी.

(४) या अदिधोसूचानांेअन्वये नांदाणी शाुल्काचाी मंाफी उपुलब्धो असणारा सौरऊजाग प्रकाल्पुाचा काोणताहुी दिवकासका दिकांवा अंमंलबजावणी अदिभाकारण, उक्ता योजनांेचाी प्रयोजनांे दिकांवा उदिष्टेंे याचाी पुूतागता कारण्याता दिनांष्फीळ ठारले असेल दिकांवा या अदिधोसूचानांेच्या दिकांवा उक्ता योजनांेच्या काोणत्याहुी शातांचा भांग काेला असेल तार, ताो, जणू काहुी सुरुवाताीपुासूनांचा नांदाणी शाुल्काचाी काोणताीहुी मंाफी नांव्हुताी असे समंजूनां, संपुूणग नांदाणी शाुल्का व शास्ताी, काोणताीहुी असल्यास, प्रदानां कारण्यास पुात्रा असेल.

स्पष्टेंीकराण -

(१) हुी अदिधोसूचानांा, उक्ता योजनांेखालील सौर प्रकाल्पुाचा दिवकासका आदिण सौर प्रकाल्पुाचा त्यानांतारचा भाडीेपुट्टा, दिकांवा पुोटें- भाडीेपुट्टाधोारका / पुोटें-भाडीेपुट्टाेधोारका अर्थीवा सहु-दिवकासका यांच्यामंध्ये दिनांष्पुादिदाता काेलेल्या भाडीेपुट्ट्याच्या हुस्तांतारणाच्या संलेखास दिकांवा दास्ताऐवजास लागू असणार नांाहुी.

(२) उक्ता योजनांेखालील सौर प्रकाल्पुाचा दिवकासका आदिण सौर प्रकाल्पुाचाे पुढेील भाडीेपुट्टाधोारका / पुोटें-भाडीेपुट्टाेधोारका अर्थीवा सहु-दिवकासका यांच्यामंधोील दाुसरा दिकांवा पुढेील व्यवहुार या अदिधोसूचानांेखालील नांदाणी शाुल्काताील मंाफीसाठाी पुात्रा असणार नांाहुीता.

NOTIFICATION

RegistRation act, 1908.

No. RGN-2024/UOR.20/C.R.106/M-1(Policy).– Whereas, the Government of Maharashtra has vide Government Resolution, Industries, Energy, Labour and Mining Department, No. Saurpra.2023/ C.R.95/Energy-7, dated the 8th May 2023 (hereafter referred to as "the said Resolution"); declared the Mukhyamantri Saur Krushi Vahini Yojana-2.0 (hereinafter referred to as "the said Yojana") to provide daytime electricity to agricultural consumers through decentralised solar power project and decided to appoint the Maharashtra State Electricity Distribution Company Limited (MSEDCL) alongwith the MSEB Solar Agro Power Limited (MSAPL) as an Implementing Agency, till any other agency is nominated by the Government of Maharashtra or any other independent company is formed by the Government of Maharashtra, to provide electricity to agricultural consumers (hereinafter referred to as "the Implementing Agency ") of the said Yojana;

Now, therefore, in exercise of the powers conferred by clause (a) of section 78 of the Registration Act, 1908 (XVI of 1908) (hereinafter referred to as "the said Act"), in its application to the State of Maharashtra and of all other powers enabling it in this behalf, the Government of Maharashtra hereby amends the Table of Fees prepared under section 78 and published under the Government Notification, Revenue and Forests Department, No. RGN. 1558/67731-N, dated 17th July 1961 (hereinafter referred to as "the said Notification") for registration of instrument and publishes the same as required by section 79 of the said Act, as follows :-

In the said Notification, in the Table of Fees, in Article-I, after Note 70, the following shall be added, namely :-

"Note 71.- No Registration fee shall be chargeable on the instrument of lease executed between the Collector of the respective District or the concerned Tahsildar and the Implementing Agency and on the instrument of sub-lease executed between the Implementing Agency and the developer or/and the SPV formed by the developer solely for the purpose of the solar energy project under the said Yojana, as the case may be, subject to the following conditions, namely:-

Conditions :-

(1) The Implementing Agency or any other Competent Authority authorized by the Industries, Energy, Labour and Mining Department in this behalf, must certify the eligibility of the Developer under the said Yojana, by providing an "Eligibility Certificate".

(2) The Developer or the Implementing Agency which has availed of the benefit or remission under this notification shall not be entitled for remission in registration fee for the same transaction as per any other Order or policy.

(3) No refund shall be granted where the registration fee has already been paid by any Developer of the solar energy project or the Implementing Agency, prior to the date of publication of this notification in the Maharashtra Government Gazette.

(4) If any Developer of the solar energy project or the Implementing Agency availing remission of the registration fee under this notification fails to fulfil the purpose or objectives of the said Yojana or committing breach of any of the conditions of this notification or the said Yojana, he shall be liable to pay the whole registration fee and penalty, if any, as if there was no remission of the registration fee from the beginning.

Explanation–

(1) This notification shall not apply to the instrument or document of transfer of lease executed between the Developer of the solar project and the subsequent lease or sub-lease holder/s or co-developer of the solar project under the said Yojana.

(2) Second or further transactions between the Developer of the solar project and the next lease or sub-lease holder/s or co-developer of the solar project under the said Yojana shall not be eligible for the remission in the registration fee under this notification.
