ORDER
No. TPS-2824-57-C.R.27-2024-UD-30.—
Whereas, the Revised Development Plan of Amravati, has been sanctioned by the Government under section 31 of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") vide Notification No. TPS-2892-1180-CR-90-92(B)-UD-13, dated 4th December, 1992 and has come into force with effect from dated 25th February, 1993 (hereinafter referred to as " the said Development Plan ") ;
द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन् १९-२५, २०२४/ २८-+ह्य ३, ॅ १९४६ ३And whereas, in the said Development Plan, the land bearing Survey No. 22 and 23 of Mauje Mhasla, Tal. and District Amravati, (hereinafter referred to as " the said Reserved Land ") is reserved for Site No. 130-' Primary School ' (hereinafter referred to as " the said Reservations ") ;
And whereas, the Amravati Municipal Corporation, Amravati is " Appropriate Authority " for the said Reservations.
(hereinafter referred to as " the said Appropriate Authority ") ;
And whereas, the said Reserved Land has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force ;
And whereas, the Owners of the land bearing Plot No. 15, 16, 17, 18 and 19 of Survey No. 22 and 23 of Mauje Mhasla, Tal. and Dist. Amravati, area admeasuring 0.12 Hect. Are (hereinafter referred to as " the said Land ") of the said Reserved Land, in reference to the Said Reservations, had served a notice dated 2nd December, 2020 under section 127(1) of the said Act to the said Appropriate Authority, being the Planning Authority (hereinafter referred to as " the said Notice ") ;
And whereas, even after service of the said Notice as aforesaid, the said Land had neither been acquired, within prescribed time period nor the Notification of land acquisition required under section 126 (4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, has been published by the said Appropriate Authority within prescribed time period from the date of the service of said Notice under sub-section (1) of section 127 of the said Act;
And whereas, the owners of the said Land have filed Writ Petition No. 4544/2022 before the Hon'ble Bombay High Court, Nagpur Bench, and the final order is passed dated 23rd March, 2023 by the Hon'ble High Court;
And whereas, it is observed that, the said Land had neither been acquired, within prescribed time period from the date of service of Notices, nor Notification of land acquisition required under section 126(4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been published within prescribed time period by the said Appropriate Authority. And, in consequence thereof, the Government of Maharashtra is of opinion that, the said Reservation on the said Land stands lapsed as per the provisions of section 127(1) of the said Act ;
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the table below, hereby notifies that, the said Reservations i. e. Site No. 130-' Primary School ' (Partly), as specified in the Revised Development Plan of Amravati, stands lapsed to the extent of area admeasuring 0.12 Hect. Area bearing Plot No. 15, 16, 17, 18 and 19 of Survey No. 22 and 23 of Mauje Mhasla, Tal. and Dist. Amravati and the area so released will be available to the owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

PUBLICATION OF DRAFT DEVELOPMENT PLAN OF UNDER SECTION 26(1) OF MAHARASHTRA
REGIONAL & TOWN PLANNING ACT, 1966
NOTICE

Whereas, the Darwha Municipal Council (herein after referred to as the " said Planning Authority, ") vide Reso. No. 01, Dated 11th September, 2019 Darwha Municipal Council (herein after referred to as the " said Draft Development Plan ") for the area under its jurisdiction. (hereinafter referred to the " said area ") as per the provision of section 23(1) read with section 21(2) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as the " said Act ") and notice that effect is published in Maharashtra Government Gazette Amravati on Division, Supplement Part 1-A on 26th December, 2019 to 1st January, 2020 ;
And whereas, as per the provision in section 24 of the said Act, the Municipal Council vide Order No. 662 Dated 23rd September, 2020 has appointed Assistant Director, Town Planning/Town Planner, Yavatmal Branch as " Town Planning officer " to prepare the said Draft Development Plan for the said area ;
And whereas, the Town Planning Officer and Assistant Director, Town Planning/Town Planner, Yavatmal Branch after having prepared Existing Land Use Map as per section 25 of the said Act, has prepared the said Draft Development Plan of the said area and has handed it over to the said Planning Authority on 26(1) of the said Act ;
And whereas, the said Planning Authority has passed Resolution No. 1, dated 09th September, 2024 to publish the said Draft Development Plan under section 26(1) of the said Act, for inviting suggestions/ objections from the public ;
Therefore, Darwha Municipal Council hereby publishes the said Draft Development Plan along with the Report under section 26(1) of the said Act for inviting suggestions/objections from the public. The copy of the said Draft Development Plan and Report thereof are kept open for inspection of the public at the following offices on all working days during office hours.

(2) Assistant Director, Town Planning/Town Planner, Yavatmal Branch.
The suggestions/objections if any, in writing from the public in this regard with reasons, shall be submitted to the Chief Officer, Darwha Municipal Council within the period of 30 days from the date of publication of the Notice in Maharashtra Govt. Gazette. Suggestions/objections received by the Municipal Council within the period of the 30 days from the date of publication of this Notice in Maharashtra Government Gazette shall only be considered.
The Copies of the said Draft Development Plan and particulars shall be available to the public at reasonable price in the office of the Darwha Municipal Council.
