आतिणे ज्योाअंर्थी, राज्यो ासनाने उक् अंतितिनयोमाच्योा कलम ८६(१) अंनुसार, अंतिसूचना क्र टीपीएस/१२२४/०५/प्रा. क्र. २२/२४/ नतिवा -१२ तिदोनांक १ माचद २०२४ अंन्वायोे प्रार्थीतिमक नगररचना परिरयोजना क्र. ०६ [ (तिचखले (भाग), मोहाो (भाग), पाली खुदोद (भाग), तिवाकर (भाग), ा. पनवाेल, तिजल्हा रायोगडा ], हाी अंतिसूचनेसोब जोडालेल्योा परिरतिष्टी क्र. १, २, आतिणे ३ मध्योे नमूदो केल्योानुसार काहाी बदोलांसहा मंजूर केलेली आहाे. सदोर अंतिसूचना हाी महाराष्ट्र शासन राजपत्रात तिदोनांक २६ सप्टींबर २०२४ रोजी प्रातिसद्ध झालेली आहाे;

PUBLIC NOTICE

No. ARB/TPS- 6/Final Award/2024/549

[ Under Section 72(7) of the Maharashtra Regional and Town Planning Act, 1966 read with Rule 13(9) of the Maharashtra Town Planning Schemes Rules. 1974 ] Whereas, the Draft Town Planning Scheme, No. 6 (TPS- 6) [Chikhale (pt), Moho (pt), Pali Khurd (pt), Shivkar(pt) of Tahsil Panvel, Dist. Raigad], was sanctioned by the Vice Chairman and Managing Director, CIDCO under sub-section (2) of section 68 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter, referred to as the 'said Act') vide Notification No. CIDCO/ NAINA/ TPS-6/ Draft Scheme/ 2022/ 565 ; dated 21st October 2022, in exercise of the powers delegated to him by the Urban Development Department vide its Notification No.TPS-1817/973/CR-103/17/UD-13, dated 13th September, 2017. The said Notification was published in Maharashtra Government Gazette, Extraordinary; Part-II, dated 4th November 2022 on pages No. 1 to 6 ;

And whereas, the Government of Maharashtra in Urban Development Department had appointed Shri Abhiraj Girkar, retired Joint Director of Town Planning as the Arbitrator for the said sanctioned Draft Scheme vide Notification No. TPS-1222/2152/C.R.148/22/UD-12 Dated 2nd December 2022, which was published in Maharashtra Government Gazette Part – I dated 23-29 March 2023 under sub-section (1) of Section 72 of the said Act;

And whereas, the Arbitrator, in accordance with Rule No. 13 (1) of Maharashtra Town Planning Schemes Rules, 1974 (hereinafter referred to as the 'said Rules'), has declared under his notice dated 5th April 2023 that, he has commenced the duties as Arbitrator in respect of the NAINA Town Planning Scheme, No. 6 [Chikhale (pt), Moho (pt), Pali Khurd (pt), Shivkar(pt) of Tahsil Panvel, Dist. Raigad], with effect from 5th April 2023;

And whereas, the NAINA Town Planning Scheme, No. 6 [Chikhale (pt), Moho (pt), Pali Khurd (pt), Shivkar (pt) of Tahsil Panvel, Dist. Raigad], was sub-divided by the Arbitrator under his notice bearing No. ARB/TPS-6/GEN/2023/488/1, dated 29th August 2023 into Preliminary Scheme and Final Scheme as provided under sub-section (3) of section 72 of the said Act;

And whereas, the Arbitrator after following the prescribed legal procedure had drawn up the Preliminary NAINA Town Planning Scheme No. 6 [Chikhale (pt), Moho (pt), Pali Khurd (pt), Shivkar(pt) of Tahsil Panvel, Dist. Raigad], on 29th December 2023 and submitted to the Government for sanction under Section 72(5) of the said Act;

And whereas, the State Government under Section 86(1) of the said Act, vide Notification No. TPS/1224/05/CR/22/24/UD-12 dated 1st March 2024 has sanctioned the Preliminary Town Planning Scheme NAINA No 06. [Chikhale (pt), Moho (pt), Pali Khurd (pt), Shivkar(pt), Taluka Panvel, Dist. Raigad] with some changes as described in Schedules I, II and III of the Notification.

The said Notification was published in Maharashtra Government Gazette dated 26th September 2024.

And whereas, the Arbitrator has followed the procedure, prescribed in Rule No. 13 of the said Rules, and has carried out the duties laid down in sub-section (6) of section 72 of the said Act; Now, therefore, the undersigned as Arbitrator hereby declares that the Final NAINA Town Planning Scheme, No. 6 [Chikhale (pt), Moho (pt), Pali Khurd (pt), Shivkar(pt) of Tahsil Panvel, Dist. Raigad], has been drawn up by him on 27th September 2024 as provided under sub-section (7) of Section 72 of the said Act read with rule 13 (9) of the said Rules.

been kept open for the inspection of the land owners and of the public during office hours at the office of the Arbitrator and of the Special Planning authority, NAINA, at 7th floor, Tower No. 10, Belapur Railway Station Complex, CBD, Belapur, Navi Mumbai. This shall also be made available on website of CIDCO (https://cidco.maharashtra.gov.in).
