आदिण ज्याअर्थी, उक्त संरा रकांनांा दिमंळत असणारे लाभा हे उक्त अदिधदिनांयमंाद्वारे वे त्या अदिधदिनांयमंान्वेये आदिण उक्त योजीनांेद्वारे वे त्याअन्वेये तरतू केलेल्या लाभांपुेा एकंरीत पुाहेता कमंी फायेशाीर नांाहेीत असे मंहेाराष्ट्र शासनांाचीे मंत झालेले आहे.

त्याअर्थी, आता मंहेाराष्ट्र खाजीगी संरा रक (नांोकरीचीे दिनांयमंनां वे कल्याण) अदिधदिनांयमं, १९८१, याच्या कलमं २३ अन्वेये प्रानां केलेल्या अदिधकारांचीा वेापुर करूनां, मंहेाराष्ट्र शासनां याद्वारे उक्त अदिधदिनांयमंाच्या वे उक्त योजीनांेच्या सवेव तरतंच्या अंमंलबजीावेणीतूनां उक्त खाजीगी संरा रकांनांा, यासोबत जीोडलेल्या अनांसूची ोनांमंध्ये दिवेदिनांदिवष्टें केलेल्या शातंच्या अधीनां राहेूनां, दिनांयोक्ता अदिभाकरण एजीन्सीनांे मंख्य मंालकासोबत केलेल्या करारपुत्राच्या दिनांांकापुासूनां कलमं २३ अंतगवत सरहेू अदिधसूचीनांा राजपत्रात प्रदिसद्ध झाल्याचीे दिनांांकापुयंत तसेची हेी अदिधसूचीनांा राजपत्रात प्रदिसध् केल्याच्या दिनांांकापुासूनां पुंढेील तीनां वेर्षांांच्या कालावेधीसाठेी सूटें ेत आहे.

अनुसूचाी-२

मालक एजन्सीने व मुख्ये मालकांनी पाळावयेाच्येा शती

(१) पोलीस तपासणी : खाजीगी संरा एजीन्सी (दिनांयमंनां) काया, २००५ अंतगवत संरा रकांच्या तसेची एजीन्सीच्या मंालकांच्या पुूवेवइंदितहेासाबाबत पुोलीस पुडताळणी ाखला तसेची सरहेू पुरवेान्यामंधील अटेंी वे शातंची पुूतवता करणे आवेश्यक असेल.

(२) प्राकिंशक्षाण : खाजीगी संरा एजीन्सी (दिनांयमंनां) काया, २००५ अन्वेये संरा रकांनांा दिनांयंक्त करण्यापुंवेी पुंरेसे प्रदिशाण ेणे आवेश्यक असेल.

(३) शैक्षाकिंणक, शारीरिरे

ेक आकिंण इंतर पात्रता : खाजीगी संरा एजीन्सी अदिधदिनांयमं (दिनांयमंनां) अदिधदिनांयमं, २००५ नांसार संरा रकांची शाैदिणक वे शारीरिरक पुात्राता पुंढेील प्रमंाणे असेल :–

किंकमान शैक्षाकिंणक पात्रता : इंयत्ता ८वेी उत्ताीणव

शारीरिरेक पात्रता : (अ) १ उची - १६२ सं.मंी.

२ वेजीनां - ५० दिकलो

३ छाती - नां फाुगवेता - ७९ संमंी फाुगवेूनां - ८४ सं.मंी.

४ नांजीर - ृष्टेंी चीष्मंा असल्यास नांबर जीास्त नांसावेा

(ब)आदिवेासी उमंेवेारांनांा उचीमंध्ये ५ सं.मंी. वे छातीमंध्ये २ सं.मंी. ची सवेलत ेण्यात यावेी.

(४) लाभ : संरा रकांनांा पुंढेील लाभा दिमंळतील -

(क) पुावेसाळी वे दिहेवेाळी गणवेशा - (२ वेर्षांावतूनां एका) रेनांकोटें, ट्राऊझार, टेंोपुी, वेंलनां कोटें वे पुँटें (५) वेतन व इंतर कायेदेशीर सवलती : सूटें दिलेल्या संरा रकानांे राष्ट्रीयकृत बँकेमंध्ये आपुले खाते उघुडावे वे मंालक एजीन्सीनांे मंख्य मंालकाकडे तैनांात केलेल्या संरा रकांच्या ेय वेतनांाच्या रकमंेइंतका रेखांदिकत धनांाेशा संरा रकास द्यावेा दिकंवेा ेय वेतनांाची रक्कमं सरळ संरा रकांचीे बँक खात्यात प्रत्येक मंदिहेन्याच्या ७ तारखेच्या आत जीमंा करावेी. संरा रकास दिलेल्या वेतनांाबाबतचीे सदिवेस्तर तपुशाील नांमंनांा "क" मंधील दिवेवेरणपुत्रामंध्ये भारूनां संरा रक मंडळास र मंदिहेन्याच्या १० तारखेपुयंत पुाठेवेावे. मंालक एजीन्सीनांे खाली शावदिवेल्याप्रमंाणे लाभा संरा रकांनांा द्यावेत -

सानांग्रहे अनांानां : वेतनांाच्या १० टेंक्के

उपुानां : वेतनांाच्या ४ टेंक्के

भारपुगारी रजीा : वेतनांाच्या ६ टेंक्के

भारपुगारी संट्टी : वेतनांाच्या १ टेंक्का

संरा रकांनांा लागू असलेल्या भादिवेष्य दिनांवेावहे दिनांधी वे कामंगार राज्य दिवेमंा योजीनांा यांच्या वेजीाती मंालक एजीन्सीनांे पुरस्पुर संबंदिधत प्रादिधकरणाकडे जीमंा कराव्यात आदिण त्यांचीे चीलनां मंादिहेतीसाठेी मंडळास सार करावे. मंालक एजीन्सीनांे भारणा केलेल्या भादिवेष्य दिनांवेावहे दिनांधी वे कामंगार राज्य दिवेमंा योजीनांेच्या वेजीातीबाबतच्या पुावेत्या/चीलनां संरा रकांनांा दिनांयदिमंतपुणे ेऊनां त्या संभावतील एकदित्रात तपुशाील संबंदिधत संरा रक मंडळास प्रत्येक ६ मंदिहेन्यांनांी सार करावेा, असे नां केल्यास मंालक एजीन्सीला जीबाबार धरूनां दिलेली सूटें रद्द करण्यात येईल.

(६) अकिंतकाकिंलक भत्ता : संरा रकांनांा दिमंळणारा अदितकादिलक भात्ता हेा मंडळानांे नांदित संरा रकांसाठेी दिनांल्डिंश्चीत केलेल्या वेतनां राच्या ंप्पुटें रापुेा कमंी नांसावेा, याबाबत संबंदिधत मंख्य मंालकाची अंदितमं जीबाबारी राहेील संरा रकांनांा ेय वेतनां वे लाभा ेणे मंख्य मंालकांची जीबाबारी असूनां मंख्य मंालकानांे त्यांच्याकडे तैनांात करण्यात आलेल्या संरा रकांनांा अदिधदिनांयमं आदिण योजीनांेतील तरतंीनांसार वेतनां वे लाभा दिमंळत आहेत याची खात्राी करूनां घुेणे बंधनांकारक असेल.

(७) किंववरणपत्र सादर करणे :

(अ) त्रैमाकिंसक किंववरणपत्र : मंालक एजीन्सीजीनांे संरा रकांच्या दिनांयंक्तीबाबतचीे त्राैमंादिसक दिवेवेरणपुत्रा प्रत्येक त्राैमंादिसकाच्या (जीानांेवेारी, एदिप्रल, जींलै वे ऑक्टेंोबर मंदिहेन्याच्या ) पुदिहेल्या आठेवेड्यात सोबत जीोडलेल्या नमुना अ संबंदिधत संरा रक मंडळास सार करावे.

(ब) सहामाही किंववरणपत्र :

(१) दिनांयंक्त केलेल्या, नांोकरी सोडूनां गेलेल्या आदिण नांव्यानांे भारती केलेल्या संरा रकांबाबतचीे दिवेवेरणपुत्रा र ६ मंदिहेन्यांनांी सोबत जीोडलेल्या नमुना ब संबंदिधत संरा रक मंडळ यांनांा एजीन्सीनांे सार करावे.

(२) भादिवेष्य दिनांवेावहे दिनांधी वे राज्य कामंगार दिवेमंा योजीनांेची वेगवणी एजीन्सीनांे दिनांयदिमंत भारूनां संबंदिधत संरा रकांनांा त्यासंबंधी वेळोवेळी पुावेत्या द्याव्यात वे र सहेा मंदिहेन्यात तसे केल्याबाबतचीा अहेवेाल संरा रक मंडळास द्यावेा.

(३) यापुूवेीच्या भादिवेष्य दिनांवेावहे दिनांधीच्या रकमंा वे राज्य कामंगार दिवेमंा योजीनांेची वेगवणी भारल्याबाबतचीा पुंरावेा सर अदिधसूचीनांा दिनांगवदिमंत झाल्यापुासूनां तीनां मंदिहेन्यांच्या आत सार करावेा. अन्यर्थीा संबंदिधत संरा रकांनांा ेण्यात आलेली सूटें रद्द करण्यात येईल.

(४) सवेव संबंदिधत संरा रक मंडळाचीे अध्य यांनांी सवेव दिवेवेरणपुत्रा वे प्रपुत्राे दिनांयदिमंतपुणे वे अचीूक प्राप्त हेोत आहेत दिकंवेा नांाहेी याची खात्राी करावेी जीर असे हेोत नांसेल तर अटेंी नांसार संबंदिधतांदिवेरुद्ध त्वेरीत आवेश्यक कारवेाई करण्यात यावेी.

(क) वाकिंर्षक किंववरणपत्र : प्रत्येक मंालक एजीन्सीनांे, सनांी लेखापुाल यांनांी प्रमंादिणत केलेले वेादिर्षांवक दिवेवेरणपुत्रा सोबत जीोडलेल्या नमुना -डे मंध्ये रवेर्षांी ३० जीूनांपुयंत मंडळास सार करावे, ज्यात एजीन्सीनांे भारलेला आयकर, संरा रकांचीा जीमंा केलेला भादिवेष्य दिनांवेावहे दिनांधी वे कामंगार राज्य दिवेमंा याबाबतच्या चीलनांाच्या प्रती वे इंतर तपुशाील असेल.

(८) एजन्सीचाी व सुटें प्राप्त सुरक्षा रक्षाकांचाी मंडेळाकडे नंदणी : अदिधसूचीनांेच्या दिनांांकापुासूनां एक मंदिहेन्याच्या कालावेधीत उक्त मंडळाकडे मंहेाराष्ट्र खाजीगी संरा रक (नांोकरीचीे दिनांयमंनां वे कल्याण) योजीनांा, २००२ च्या खंड १३ (२) वे १४ (३) मंधील तरतंीनांसार एजीन्सीजीनांे स्वेत:ची मंालक म्हेणूनां आदिण त्यांच्याकडील सूटें प्राप्त संरा रकांची दिवेदिहेत नांमंन्यातील अजीव वे शांल्क भारूनां मंडळात नांणी करूनां घ्यावेी.

(९) एजन्सीच्येा मुख्ये मालकांचाी मंडेळाकडे नंदणी : सूटें प्राप्त संरा रकांच्या एजीन्सीमंाफाकत संरा रक दिनांयंक्त करणाऱ्या मंख्य मंालकानांे अदिधसूचीनांेच्या दिनांांकापुासूनां १५ दिवेसांचीे आत योजीनांेच्या खंड १३(१) (अ) अन्वेये स्वेत:ची मंडळात दिवेदिहेत नांमंन्यातील अजीव वे शांल्क भारूनां नांणी करूनां घ्यावेी.

(१०) नंदणी शुल्क : एजीन्सीनांे तसेची सूटें प्राप्त संरा रकानांे मंडळाकडे नांणी करतेवेळी मंहेाराष्ट्र खाजीगी संरा रक (नांोकरीचीे दिनांयमंनां वे कल्याण) योजीनांा, २००२ च्या खंड १७ मंधील तरतंीनांसार मंडळाकडे दिवेदिहेत कालावेधीत आवेश्यक ते नांणी शांल्क भारले पुादिहेजीे.

(११) नंदणीकृत कायेाषलये : एजीन्सीचीे नांणीकृत कायावलय असावे आदिण त्याबाबतची मंादिहेती एजीन्सीनांे शासनां, कामंगार आयंक्त वे मंडळास द्यावेी नांणीकृत कायावलयाचीा पुत्ता बलल्यास अर्थीवेा एजीन्सीच्या नांावेात बल झाल्यास १५ दिवेसांचीे आत बलाबाबतच्या आवेश्यक त्या कागोपुत्राी पुंराव्यासहे शासनांास वे मंडळास कळवेावे, जीेणेकरूनां शासनां संधारीत अदिधसूचीनांा जीारी करील संधारिरत अदिधसूचीनांा जीारी झाल्यानांतर मंडळ झालेल्या बलांची नां घुेईल.

(१२) सुरक्षा रक्षाकांचाी किंनयेुक्ती : उक्त मंडळाकडे ज्या मंख्य मंालकांची नांणी झाली आहे आदिण/दिकंवेा जीे उक्त मंख्य मंालक मंडळाच्या संरा रकांच्या सेवेचीा लाभा घुेत आहेत अशा मंख्य मंालकांकडे एजीन्सी त्यांचीेकडील संरा रक नांेमंणार नांाहेी अशाप्रकारे संरा रक नांेमंल्यास मंालक एजीन्सीला जीबाबार धरूनां दिलेली सूटें रद्द करण्यात येईल.

(१३) ओळाखापत्र व हजेरी काडेड देणे : खाजीगी संरा रक एजीन्सी त्यांचीेकडील संरा रकांनांा वे अदिधकाऱ्यांनांा दिनांयंक्त केल्यापुासूनां ३० दिवेसांच्या आत ओळखपुत्रा वे हेजीेरीकाडड ेईल.

(१४) कायेदेशीर देणी अदा करणे : संरा रक ज्यावेळी एजीन्सीची नांोकरी सोडतील, त्यावेळी त्यांनांा ेय असलेली सवेव कायेशाीर ेणी (उपुानां वे इंतर कायेशाीर ेणी) एजीन्सीनांे अा करूनां त्याबाबत झालेल्या व्यवेहेारांच्या प्रती मंडळाकडे सार करणे एजीन्सीला बंधनांकारक राहेील.

(१५) एकावेळाी एकाचा मुख्ये मालकाकडे नोकरी : संरा रक एकावेळी एकापुेा अदिधक मंख्य मंालकाकडे कामं करणार नांाहेी याबाबत प्रत्येक संरा रक एजीन्सीनांे खात्राी करूनां घुेतली पुादिहेजीे.

(१६) एखाद्या संरा रकास त्याच्या दिनांवेासस्र्थीानांापुासूनां ५०दिकमंीपुेा अदिधक अंतरावेर कामं करण्यासाठेी पुाठेदिवेल्यास मंालक एजीन्सीनांे त्याच्या एकूण वेतनांाच्या २०% रक्कमं त्याला भात्ता म्हेणूनां द्यावेी.

(१७) संरा रकांच्या फायद्यांसंभावत शासनांानांे दिकंवेा मंडळानांे भादिवेष्यकाळात घुातलेल्या अटेंी वे शातंचीे पुालनां करणे एजीन्सीला, तसेची मंख्य मंालकाला बंधनांकारक राहेील.

(१८) मंालक एजीन्सीनांे मंख्य मंालकासोबत केलेल्या कराराच्या दिनांांकापुासूनां ते कलमं २३ अंतगवत संटें ेण्याच्या अदिधसूचीनांेपुयंत वे या संरा रकांनांा सूटें ेण्यासंभावतील अदिधसूचीनांेमंध्ये े दिवेदिनांदिवष्टें केलेल्या कालावेधीपुयंत संरा रकांच्या वेतनांाच्या ३ टेंक्के एवेढेी लेव्हेी रमंहेा १० तारखेपुयंत मंडळास ेय राहेील. सर लेव्हेी अदिधसूचीनांा दिनांगवदिमंत झाल्याच्या दिनांांकापुासूनां १ मंदिहेन्याच्या आत मंडळाकडे जीमंा करणे अदिनांवेायव राहेील.

मंडळानांे दिवेदिनांदिवष्टें केलेल्या कालमंयावेत लेव्हेीची रक्कमं भारण्यात जीे दिनांयोक्ता अदिभाकरण कसूर करील ते दिनांयोक्ता अदिभाकरण मंडळानांे भारणा करण्यास दिनांधावरिरत केलेल्या रकमंेच्या १०% या रानांे अदिधभार ंडाच्या रुपुानांे मंडळाकडे भारील.

(१९) मंालक एजीन्सीमंाफाकत संरा रक दिनांयंक्त करणाऱ्या मंख्य मंालकानांे करार संपुंष्टेंात आल्यानांतर वेा इंतर कोणत्याहेी कारणामंळे संरा रकांची सेवेा घुेणे बं केले असल्यास सेवेा खंडीत केल्याच्या दिनांांकापुासूनां ७ दिवेसांच्या आत अशा मंख्य मंालकाची वे तेर्थीूनां कमंी केलेल्या संरा रकांची नांावे वे तपुशाील मंालक एजीन्सी मंडळास सार करील. अशा मंख्य मंालकाची अदिधसूचीनांेनांसार घुेतलेली मंडळातील नांणी रद्द हेोईल. तसेची मंालक एजीन्सीकडूनां नांोकरी सोडूनां गेलेल्या संरा रकांची नांावे वे तपुशाील मंालक एजीन्सी मंडळास वे नांजीकच्या पुोलीस ठेाण्यास ७ दिवेसाच्या आत सार करील. अशाप्रकारे नांोकरी सोडूनां गेलेल्या संरा रकांची नांणी मंडळ रद्द करील.

(२०) मंख्य मंालकाकडूनां संरा रकांच्या कामंाच्या मंोबल्यापुोटेंी एजीन्सीकडे जीमंा हेोणाऱ्या रकमंेपुैकी, मंडळानांे संरा रकांच्या वेतनांापुोटेंी दिनांल्डिंश्चीत केलेली रक्कमं तसेची सवेव वेैधादिनांक रकमंा जीसे भादिवेष्य दिनांवेावहे दिनांधी, कामंगार राज्य दिवेमंा योजीनांा, बोनांस प्रानां, रजीा वेतनां, राष्ट्रीय संट्ट्यांांचीे वेतनां यासाठेी दिवेदिनांयदिमंत केले जीाईल दिनांानां इंतकी रक्कमं दिकंवेा मंख्य मंालकानांे एजीन्सीला अा केलेल्या रकमंेच्या ५६ टेंक्के इंतकी रक्कमं दिकंवेा यापुैकी जी अदिधक असेल ती संरा रक एजीन्सीनांी संरा रकांनांा अा करणे आवेश्यक आहे.

(२१) संरा रकांनांा साप्तादिहेक संट्टी उपुभाोगण्याकरिरता कायवमंक्त करणाऱ्या संरा रकांचीे वेतनां मंख्य मंालक एजीन्सीला अा करील हे वेतनां यर्थीा प्रमंाण पुद्धतीवेर आधारिरत असेल वे हेी रक्कमं मंळ वेतनांाच्या १०% अर्थीवेा जी अदिधक असेल इंतकी असेल.

(२२) संरा रक मंडळामंध्ये जीमंा करावेयाची लेव्हेी, संरा रकांच्या प्रदिशाणासाठेीचीा खचीव, ेखरेखीवेरील खचीव, तसेची एजीन्सीचीा प्रशासकीय खचीव वे नांफा या सवेव गोष्टेंचीा खचीव हेा मंख्य मंालकानांे एजीन्सीकडे जीमंा केलेल्या एकूण रकमंेच्या ३०% रकमंेपुेा जीास्त नांसावेा.

(२३) उपुरोक्त अदिनांवेायव लालेल्या खचीाववेर दिनांयमंानांसार सेवेाकर / वेस्तं वे सेवेा कर GST आकारला जीाईल वे सेवेाकर / वेस्तं वे सेवेा कर GST त्या त्या वेळी अंमंलात असलेल्या रानांसार असेल.

(२४) या व्यदितरिरक्त संरा रकांनांा गणवेशा दिला जीाईल वे त्यासाठेी ४% रक्कमं रवेर्षांी राखीवे ठेवेण्यात येईल.

(२५) संरा रकांनांा त्यांचीे वेतनां पुंढेील मंदिहेन्याच्या सात तारखेपुयंत ेण्यात यावे.

NOTIFICATION

Maharashtra Private security Guards (reGulation of eMPloyMent and Welfare) act, 1981.

No. SGA 2024/ C.R.101/ LAB-5.–Whereas certain Security Guards whose names are mentioned in Column (2) of Schedule I appended hereto (hereinafter referred to as "the said Security Guards"), employed at Chhatrapati Sambhajinagar with the Different Principal Employer mentioned in Column (4) of the said Schedule I, employed by Ms. Modern Veer Rays Security Force (India) Pvt. Ltd., 6th Floor, Atlanta Centre, Sonawala Road, Goregaon East, Mumbai 400 063 Owner Mr. Amit Kumar Gyanprakash Singh have applied for grant of exemption, under section 23 of the Maharashtra Private Security Guards (Regulation of Employment & Welfare) Act, 1981 (Mah. LVIII of 1981) from the operation of all provisions of the said Act and the Maharashtra Private Security Guards (Regulation of Employment and Welfare) Scheme, 2002 (hereinafter referred to as "the said Scheme") ;

And Whereas, the Government of Maharashtra is of the opinion that the enjoyment of benefits by the Security Guard which are on the whole not less favorable to them than the benefits provided by and under the said Act and the said Scheme.

Now, therefore, in exercise of powers conferred by Section 23 of the Maharashtra Private Security Guards (Regulation of Employment and Welfare) Act, 1981, the Government of Maharashtra hereby exempts the said Security Guards from operations of all provisions of the said Act and the said Scheme, from the date of agreement between the Employer Agency and the Principal Employer till the date of publication of this notifications in the Official Gazette and further for a period of 3 years from the date of publication of this notification in the Official Gazette, subject to conditions specified in Schedule -II appended hereto.

NOTE .– Government of Maharashtra does not take any guarantee of any sort as regards to the Security Guards. Principal Employers can employ these Private Security Guards at their own risk.

Schedule-II

Conditions to be followed by the Employer Agency and Principal Employer

1. Police Verification : Police Verification Certificates regarding antecedent of the guards as well as the Employer Agency of such guard is necessary as per the Licence provided under the Private Security Agency (Regulation) Act, 2005 is compulsory along with the compliance of all terms and conditions of this Licence on the part of Employer Agency.

2. Training : Adequate training shall be imparted to the Security Guards before they are deployed as Private Security Agency (Regulation) Act, 2005 ( PASARA 2005).

3. Educational Qualifications, Physical Fitness and other requirements : Educational Qualification, Physical fitness standard and other requirements for the Security Guards shall be as Follows :

Minimum Educational Qualification : 8th Standard Passed.

Physical Requirements : (A) 1. Height – 162 cm

2. Weight – 50 kg

3. Chest – 79 cm (Without Expansion) and

84 cm (On Expansion)

4. Sight –If wearing glasses, the glass should

not have excess number.

(B) In case of tribal candidates, there will relaxation

of 5 cm in height and 2 cm in chest.

4. Benefits : Benefits for Security Guards shall be as follows :

(a) Uniform : Two pairs in a year.

(b) Shoes : One pair of leather shoes in a year.

(c) Rainy and Winter Uniform : (Once in two years) Raincoat, Trousers and Cap, Woollen Coat and Pant.

5. Wages and other statutory Benefits : Exempted Security Guard shall open his Account in a Nationalised Bank and Employer Agency shall make the Payment of Salary directly to his Bank Account, or shall give Account Payee Cheque to each Security Guard equivalent to his earned wages by 7th of every month Statement showing details of wages paid in Form "C" shall be submitted to the Security Guards Board by 10th of every month.

The Agency shall give the following benefits to the Security Guards.

Ex-Gratia : 10% of wages

Gratuity : 4% of wages

Leave with wages : 6% of wages

Paid Holidays : 1% of wages

Contribution to be deposited with the Competent Authorities in respect of various statues such as Provident Fund, E.S.I. etc applicable to the Principal Employer, shall be deposited by the Agency with such authority & challan thereof be submitted to the Board for information. The Security Guards Agency should give regular receipt to the Guard and submit a consolidated report of the above said transactions to the concerned the Security Guards Board every six months. In case of default, the Agency shall be held responsible and shall be liable for cancellation of exemption.

6. Overtime Allowance : Overtime Allowance should not be less than double the rates of wages existing at that time to the Security Guards deployed by the Security Guards Board. The ultimate responsibility in this respect lies on the concerned Principal Employer. It is the responsibility of the Principal Employer to pay wages and provide benefits to the Security Guards. The Principal Employer, in turn, shall ensure that the guards deployed at his establishment are getting wages and benefits not less favourable than those available under the Scheme.

7. Filling of Returns :

(a) Quarterly Return :

Agency to submit quarterly return to the concerned Security Guard Board in the first week of first month of the quarter (January, April, July and October) in respect of employment of Security Guards in Form "A" appended hereto.

(b) Half Yearly Return :

(1) Half Yearly Return in Form "B" appended hereto shall be submitted by the Agency in respect of Guards engaged, who have left and newly recruited to the concerned Security Guard Board.

(2) The Security Guard Agency should make regular contribution of employees' Provident Fund and ESIC of the concerned Security Guards and give regular Receipts to the Security Guard and submit a consolidated report of the above said transaction to the concerned Security Guards Board every six months.

(3) The Security Guard Agency should submit proof of the previous contributions of employees' Provident Fund and ESIC within a period of three months from the date of publication of this Notification to the concerned Security Guard Board Otherwise, the exemption given to the concerned Security Guards will be cancelled.

(4) All concerned Chairman of the Security Guard Board shall ensured that all above returns and statements are regularly received or not and also ensure the correctness of it. If it is not as per the conditions the appropriate action shall be taken immediately.

(c) Annual Return : Every Agency shall submit at Annual Return of Income Tax, P.F., E.S.I. duly certified by Chartered Accountant, in Form-D on or before 30th of June of every year to the concerned Security Guard Board, alongwith copies of challans and other details.

8. Enrolment of the Agency with the Board : The Agency should get itself enrolled with the Board according to the provisions of Clause 13 (2) of the Maharashtra Private Security Guards (Regulation of Employment & Welfare) Scheme, 2002, as an employer agency and shall register exempted Security Guards under Clause 14(3) of the Scheme applying in the Form devised by the Board by paying prescribed registration fee within a period of one month from the date of issuance of this Notification.

9. Registration of Principal Employer of Employer Agency : The Principal Employer who is engaging exempted Security Guards of the Agency shall get registered with the Board as provided under Clause 13 (1) (a) of the Scheme within 15 days from date of exempted Notification, applying in the Form devised by the Board by paying prescribed registration fee.

10. Enrolment Fees : While getting itself registered with the Board, the Agency should pay Registration Fee to the Board as per Clause 17 of Maharashtra Private Security Guards (Regulation of Employment & Welfare) Scheme, 2002 within stipulated time.

Registered Office : Every Agency shall have registered office which shall be notified to the Government, Commissioner of Labour and the Board. In case of change in address or change in names, the same shall be informed to the Government and to the Board alongwith documentary proof thereof within a period of 15 days from such change, so as to issue revised Notification by the Government in respect thereof. Board shall take note of such changes after issuance of the Notification.

12. Allotment of Guards : The Agency shall not allot their Security Guards to such Principal Employers who are registered with the Board. If agency deploys its Security Guards to such Principal Employer in that case exemption will be cancelled.

13. Issue of Identity Cards/Attendance Card : Every Agency shall issue identity card, attendance card to Security Guards and Officers engaged and deployed by them.

14. Payment of Legal Dues : Whenever a Security Guard leaves his job, it is obligatory on the part of the agency to pay all the legal dues to him and copy of the records thereof shall be submitted to the Board including gratuity and other legal dues.

15. Employment with one Principal Employer at a time : Every Agency shall also ensure that its Security Guards shall not work for more than one Principal Employer at a time.

16. If any Security Guard is asked to work beyond the radius of 50 kms from his place of residence, the Employer Agency shall pay an allowance @ 20% of total emoluments payable to such Security Guard.

17. The Agency and Principal Employer is liable to abide with any other terms and conditions, which may be imposed in favour of Security Guard by the Government of Maharashtra or Board in future.

18. The exempted Security Guard Agency should pay levy @ 3% to the Board per month, on the wages paid to the Security Guards from the date of agreement made by Agency with the principal employer till the date of issuing notification under Sec. 23 and till the period mentioned in the exemption notification. The exempted Security Guard Agency should pay levy @ 3% to the Board per month on wages paid to the Security Guards on or before 10th of every month. The agency should start paying such levy within the period of 1 month from the date of exemption Notification. The employer agency who makes default in remitting the amount of 3% levy within the time limit specified as above, shall further pay by way of penalty, surcharge @10% of the amount to be remitted.

19. In case, the Principal Employer discontinues the exempted Security Guards due to expiry of agreement or due to any reason, in that case, the agency shall submit the details of such Principal Employers and the Security Guards to the Board within 7 days from such discontinuation. In such case the registration of the said Principal Employer shall stand cancelled. The agency shall also submit the details of Security Guards who have left the services due to any reason alongwith details of the Principal Employers to the Board and concerned Police Station within 7 (Seven) days. On receipt of the above details Board will cancel the registration of such exempted guards.

20. From the amount of the payment made by the Principal Employer to the Security Agency, the Security Guards will be paid at least an amount which has been fixed by the Board towards the wages and all the statutory benefits towards Provident Fund, E.S.I.C., Payment of Bonus, leave with wages, leave on national holidays etc. or the same shall be the amount equivalent to 56% of the gross payment made by the Principal Employer to the Security Agency, whichever is higher.

21. The Principal Employer will pay to the agency on a prorata basis for the reliever who would be relieving the Security Guard in case of his weekly off or the amount paid to the reliever shall be 10% of the basic wages, or whichever is higher.

22. The amount of levy to be deposited to the Security Guards Board, the cost of Training of the Security Guards, the cost of supervision, administration and profits of the agency the total cost of which will not exceed more than 30% of the total amount paid by the Principal Employer to the agency.

23. The Service Tax / GST will be levied on the total mandatory cost mentioned herein above at the rate which is in force at any given point of time.

24. In addition to this uniform will be provided to the Security Guards. For this purpose an amount of 4% per annum should be delineate.

25. Wages of the Security Guards will be paid not later than 7th of every next month.

26. It shall also be the responsibility of the Security Guard Board to ensure that whether all these terms and conditions mentioned in the Notification and scheduled -II attach with are followed scrupulously or not by the Agency or the Principal Employer as the case may be and failure to which appropriate action should be taken against the concerned as per the Rules.

27. This notification is issued on the basis of documents, records submitted by the Agency Owner, Principle Employer, Security Guards & Recommendation of the Chairman of concerned Security Guards Board and if it is found that this information, Documents are false or forged the concerned Agency Owner, Principle Employer, Security Guard and the Security Guard Board will be held responsible for any legal consequences arises in future in this regard.

28. This notification is issued subject to the conditions that all the terms and conditions of the licence issued by the concerned police authority under the provision of Private Security Agencies ( Regulation) Act, 2005 ( PASARA) and rules there under are compiled scrupulously.

29. Breach of any of above conditions by the employer agency shall make employer agency liable for cancellation or revocation of the exemption granted under this notification and subsequent action as per rules.
