क्रमांक टीपीबी-४३२४/५७२/प्र.क्र. १०५/२०२४/नवि-११.----ज्याअर्थी, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आलेला आहे.) च्या तरतुदींनुसार बृहन्मुंबई महानगरपालिका त्यांचे अधिकार क्षेत्राकरीता (यापुढे ज्याचा उल्लेख " उक्त महानगरपालिका " असा करण्यात आलेला आहे.) नियोजन प्राधिकरण आहे ;
ज्याअर्थी, उक्त अधिनियमाचे कलम ३१ पोट-कलम (१) अन्वये प्राप्त अधिकारांचा वापर करून राज्य शासनाने अधिसूचना क्रमांक टीपीबी- ४३१७/६२९/प्र.क्र.१९८/२०१७/वियो/नवि-११, दिनांक ८ मे २०१८ (यापुढे याचा उल्लेख"उक्त अधिसूचना "असा करणेत आलेला आहे) द्वारे बृहन्मुंबर्ई प्रारूप विकास योजना, २०३४ (यापुढे याचा उल्लेख" उक्त विकास योजना "असा करणेत आलेला आहे) सह विकास नियंत्रण व प्रोत्साहन नियमावली, २०३४ ला (यापुढे याचा उल्लेख" उक्त नियमावली "असा करणेत आलेला आहे) उक्त अधिसूचनेसोबतचे परिशिष्ट-ब मध्ये दर्शविलेले सारभूत स्वरूपाचे फेरबदल (ई.पी.) वगळून उक्त अधिसूचनेत परिशिष्ट-अ मध्ये दर्शविलेल्या सुधारणेसह मंजुरी दिली आहे ; आणि ज्याअर्थी शासनाने उक्त अधिसूचनेस सम क्रमांकाचे शुद्धीपत्रक दिनांक २२ जून २०१८ रोजी निर्गमित केले आहे ; आणि ज्याअर्थी, त्यानंतर उक्त अधिसूचनेस शासनाने समक्रमांकाचे शद्धीपत्रक व पुरकपत्र दिनांक २९ जून २०१८ रोजी पारित केले असून सदर शुद्धीपत्रक व पुुरकपत्र महाराष्ट्र शासनाच्या राजपत्रात दिनांक ३० जून २०१८ रोजी प्रसिद्ध करण्यात आले आहे ; आणि ज्याअर्थी, उक्त नियमावली दिनांक १ सप्टेंबर २०१८ पासून अंमलात आली आहे ;
आणि ज्याअर्थी, उक्त विकास योजनेनुसार, न.भू.क्र.३१९(फ), मौज दहिसर, मुंबई (यापुढे याचा उल्लेख " उक्त जमीन " असा करणेत आलेला आहे.) ही जमीन मनोरंजन मैदानाचे (EOS2.6) नामनिर्देशन/अस्तित्वातील सुविधा (मोठया नामनिर्देशनाचा भाग), खेळाचे मैदानाचे आरक्षण (ROS1.4) (मोठया आरक्षणाचा भाग), अस्तित्वातील रस्ता व ९.१५ मी. रूंद रस्ता रेषेने बाधित होत आहे ;
आणि ज्याअर्थी, उक्त महानगरपालिकेकडील दिनांक ६ मार्च २०२४ रोजीचे पत्रान्वये प्रस्ताव शासन नगरविकास विभागास प्राप्त झाला असून सदर पत्रात असे नमूद आहे कि, उक्त जमीन उक्त महानगरपालिकेच्या मालकीची आहे ; आणि ज्याअर्थी, दहिसर विभागातील आगरी-कोळी बांधवांकरिता सामाजिक भवन अस्तित्वात नसल्यामुळे उक्त जमिनीवर आगरी-कोळी बांधणे शक्य होण्याकरिता उक्त विकास योजनेमध्ये सुधारणा करणेबाबत लोक प्रतिनिधींनी उक्त महानगरपालिकेस शिफारस केली आहे ;
भाग एक (को.वि.पु.)--१०१---१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, ऑक्टोबर १, २०२४/आश्िवन ९, शके १९४६ spillover ची दुरूस्ती करून जागेवरील स्थितीनुसार अस्तित्वातील रस्त्याची आखणी सुधारीत करणेबाबत व उक्त जमिनीवरील अंशत: भागावर दर्शविण्यात आलेले खेळाचे मैदानाचे (ROS1.4) आरक्षण अंशत: बदलून त्याऐवजी मनोरंजन मैदानाचे (EOS 2.6) नामनिर्देशन दर्शविणेबाबत फेरबदल प्रस्ताव कार्यान्वित केला आहे (यापुढे याचा उल्लेख" प्रस्तावित फेरबदल "असा करणेत आलेला आहे) ; आणि ज्याअर्थी, उक्त महानगरपालिकेने सदर प्रस्तावित फेरबदलाची सूचना सामान्य जनतेच्या सूचना/हरकतीकरिता महाराष्ट्र शासन राजपत्रात दिनांक २८ डिसेंबर २०२३ ते ३ जानेवारी २०२४ रोजी प्रसिद्ध केली आहे ; आणि ज्याअर्थी, उक्त महानगरपालिकेने उक्त अधिनियमाचे कलम ३७(१) अन्वये प्रस्तावित फेरबदलाची वैधानिक कार्यवाही पूर्ण करुन उक्त पत्रान्वये फेरबदल प्रस्ताव शासनाचे मान्यतेसाठी सादर केला आहे ;
आणि ज्याअर्थी, संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांनी त्यांचेकडील दिनांक १० जुलै २०२४ रोजीचे पत्राद्वारे सदर प्रस्तावित फेरबदलावर अहवाल सादर केला आहे ;
आणि ज्याअर्थी, उक्त महानगरपालिकेची विनंती विचारात घेऊन व संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्लामसलत केल्यानंतर प्रस्तावित फेरबदल मंजूर करणे आवश्यक असल्याचे शासनाचे मत झालेले आहे.
आता त्याअर्थी, उक्त अधिनियमाच्या कलम ३७(२) अन्वये प्राप्त अधिकारात आणि त्या संदर्भातील सर्व शक्तींचा वापर करुन शासन याद्वारे :-------
(अ) उक्त प्रस्तावित फेरबदलाचे प्रस्तावास खालील परिशिष्टामध्ये नमूद केलेप्रमाणे मंजूरी देत आहे.
(ब) सदरची अधिसूचना शासकीय राजपत्रामध्ये प्रसिद्ध झाल्याचा दिनांक हा उक्त फेरबदल अंमलात आलेचा दिनांक असेल.
(क) बृहन्मुंबई महानगरपालिकेच्या उक्त विकास योजनेच्या मंजूरी सोबतच्या फेरबदलाचे परिशिष्टामध्ये शेवटच्या नोंदीनंतर खालील परिशिष्ट समाविष्ट करणेचे निर्देश देत आहे.

i. " The designation of Recreation Ground (EOS2.6) shown on the land bearing C.T.S. No.319F(pt), Village Dahisar, Mumbai is changed partly for the area admeasuring approx.1500 sq.m. from Recreation Ground (EOS2.6) to the reservation of Multipurpose Community Centre (RSA2.1) as shown on plan.
ii. The alignment of Existing Road is corrected as per side condition by rectifying the spillover of designation of Recreation Ground (EOS2.6) as shown on plan.

ग़्क्ष्क़क्ष्क्ॠक्ष्ग़्
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-4324/572/C.R.-105/2024/UD-11.—Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as " the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") ;
Whereas, in exercise of the powers conferred by sub-section (१) of section 31 of the said Act, the State Government ध्त्ड्डड्ढ Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as " the said Notification ") has accorded sanction to the Draft Development Plan, 2034 of Greater Mumbai (hereinafter referred to as " the said Development Plan ") alongwith the Development Control and Promotion Regulations, 2034 (hereinafter referred to as " the said Regulations ") for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification ; And whereas, Government has issued corrigendum of even number dated 22nd June 2018 ; and whereas, thereafter Government has issued a Corrigendum and Addendum of even number dated 29th June 2018 to the said Notification, which is published in क्रदृध्ड्ढद्धदड्ढदद्य क्रठ्ठड्ढद्यद्यड्ढ dated 30th June 2018 ; and whereas, the said Regulations have come into force from 1st September 2018 ;
And whereas, as per the said Development Plan, the land bearing C.T.S. No. 319F (pt), Village- Dahisar, Mumbai (hereinafter referred to as " the said Land ") is affected by the designation/ existing amenity of Recreation Ground (EOS2.6) (Part of larger Designation/existing amenity), a reservation of Playground (ROS1.4) (Part of larger Reservation), Existing Road and 9.10 mtr.
wide Regular line of street (RL) ;
And whereas, Government in Urban Development Department has received a proposal ध्त्ड्डड्ढ letter dated 6th March 2024 from the said Corporation wherein it is stated that, the said land is owned by the said Corporation; And whereas there is no Community Centre for Agari-Koli community from Dahisar area, the Public Representatives have recommended to modify the said Development Plan so as to construct the 'Agari-Koli Bhavan' on the said Land ;
And whereas, considering the abovesaid request, in exercise of the powers conferred under sub-section (१) of section 37 of the said Act, the said Corporation has initiated modification proposal to change the designation shown on the said land partly for the area admeasuring approx.1500 sq.m. from Recreation Ground (EOS2.6) to the reservation of Multipurpose Community Centre (RSA2.1), to rectify the alignment of Existing Road as per site condition by correcting the spillover of designation of Recreation Ground (EOS2.6) and to change the part portion of reservation of Playground (ROS1.4) shown on part of the said land to the designation of Recreation Ground (EOS2.6) (hereinafter referred to as ' the proposed modification ') ; And whereas accordingly, the said Corporation had issued Notice for inviting suggestions/objections from the general public with regard to the proposed modification which is published in ग्ठ्ठण्ठ्ठद्धठ्ठद्मण्द्यद्धठ्ठ क्रदृध्ड्ढद्धदड्ढदद्य क्रठ्ठड्ढद्यद्यड्ढ on 28th December 2023-3rd January 2024 ; And whereas, the said Corporation after completing all the legal procedure regarding the proposed modification as stipulated under section 37(१) of४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, ऑक्टोबर १, २०२४/आश्िवन ९, शके १९४६ the said Act, has submitted the modification proposal ध्त्ड्डड्ढ letter dated 6th March 2024 to the Government for sanction ;
And whereas, Director of Town Planning, Maharashtra State, Pune ध्त्ड्डड्ढ his letter dated 10th July 2024 has submitted his report to the Government on the proposed modification ;
And whereas, after considering the request of the said Corporation and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanctioned ;
Now, therefore, in exercise of the powers conferred upon it under section 37(२) of the said Act, the Government hereby :—
(A) Sanctions the proposed modification as described more specifically in the Schedule hereinunder.
(B) Fixes the date of publication of this Notification in the ढढत्ड़त्ठ्ठथ् क्रठ्ठड्ढद्यद्यड्ढ as the date of coming into force of this modification.
(C) Directs the Municipal Corporation of Greater Mumbai that in the Schedule of Modifications sanctioning the said Development Plan, after the last entry, the Schedule referred to at (A) above shall be added.
च्ड़ण्ड्ढड्डद्वथ्ड्ढ
(त्) " The designation of Recreation Ground (EOS2.6) shown on the land bearing C.T.S. No.319F(pt), Village- Dahisar, Mumbai is changed partly for the area admeasuring approx.1500 sq.m. from Recreation Ground (EOS2.6) to the reservation of Multipurpose Community Centre (RSA2.1) as shown on plan.
