क्रमांक टीपीबी-४३१८/४८४/प्र.क्र.४४/२०२२/नवि-११.------ ज्याअर्थी, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यापुढे याचा उल्लेख " उक्त अधिनियम " असा करणेत आलेला आहे.) च्या तरतुदींनुसार बृहन्मुंबई महानगरपालिकेच्या अधिकार क्षेत्राकरिता बृहन्मुंबई महानगरपालिका (यापुढे याचा उल्लेख " उक्त महानगरपालिका " असा करणेत आलेला आहे.) हे नियोजन प्राधिकरण आहे ;
आणि ज्याअर्थी, मुंबई महानगर प्रदेश विकास प्राधिकरण या विशेष नियोजन प्राधिकरणाच्या अधिकार क्षेत्रातील (i) बांद्रा-कुर्ला संकुलाच्या अधिसूचित क्षेत्रातील मिठी नदी आणि लालबहादूर शास्त्री मार्ग यामधील क्षेत्र, (ii) बांद्रा-कुर्ला संकुलाच्या अधिसूचित क्षेत्रातील ए ब्लॉकचे क्षेत्र आणि (iii) ओशिवरा जिल्हा केंद्राच्या अधिसूचित क्षेत्रातील स्वामी विवेकानंद रस्त्यांच्या पश्चिमेकडील क्षेत्र, ही तीन क्षेत्रे (यापुढे याचा उल्लेख " उक्त क्षेत्रे " असा करणेत आलेला आहे) शासनाच्या नगरविकास विभागाकडील अधिसूचना अनुक्रमे (i) क्रमांक CMS/TPB-४३१४/१३०/ C.R. No.-४२/२०१४/UD--११, दिनांक ३० ऑगस्ट २०१४ (ii) क्रमांक TPB -४३१४/१४६८/C.R.-30/२०१५/UD--११, दिनांक १८ नोव्हेंबर २०१५ आणि (iii) क्रमांक CMS/TPB -४३१३/६५८/C.R.११६/२०१४/UD--११, दिनांक १८ नोव्हेंबर २०१५ अन्वये संबंधित अधिसूचित क्षेत्रामधून वगळून नियोजन प्राधिकरण म्हणून बृहन्मुंबई महानगरपालिकेच्या अधिकार क्षेत्रामध्ये समाविष्ट केली आहेत ;
आणि ज्याअर्थी, उक्त अधिनियमाचे कलम २३ ते कलम ३० मधील तरतुदीनुसार, उक्त क्षेत्रांसाठी नियोजन प्राधिकरण या नात्याने बृहन्मुंबई महानगरपालिकेने उक्त क्षेत्रासाठी प्रारूप विकास योजना (यापुढे याचा उल्लेख " उक्त प्रारूप विकास योजना " असा करणेत आलेला आहे) तयार केली असून ती दिनांक ३१ जुलै २०१९ रोजीचे पत्रान्वये शासनास मंजुरीकरिता सादर केली आहे ; आणि ज्याअर्थी, उक्त अधिनियमाचे कलम ३१ चे पोट-कलम (१) अन्वये योग्य ती चौकशी करून तसेच संचालक, नगगरचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्लामसलत केल्यानंतर शासन अधिसूचना क्रमांक टीपीबी-४३१८/४८४/प्र.क्र. ४४/२०२२/नवि-११, दिनांक २९ सप्टेंबर २०२२ अन्वये उक्त अधिसूचनेसोबतचे परिशिष्ट-अ मध्ये दर्शविल्याप्रमाणे व उक्त अधिसूचनेसोबतचे परिशिष्ट-ब मधील सारभूत स्वरुपाचे फेरबदल वगळता सदर प्रारूप विकास योजनेस भागश:मंजुरी देण्यात आली आहे. आणि ज्याअर्थी, सदर प्रारूप विकास योजनेतील वगळलेला भाग (ई-पी-१) ला शासन सम क्रमांकाची अधिसूचना दिनांक २८ एप्रिल २०२३ अन्वये मंजुरी देण्यात आली आहे ; आणि ज्याअर्थी, सदर प्रारूप विकास योजनेतील वगळलेला भाग (ई.पी.-२) सोडून उर्वरित भागास शासन समक्रमांकाची अधिसूचना दिनांक २२ मे २०२३ अन्वये मंजुरी देण्यात आली आहे ;
आणि ज्याअर्थी, उक्त अधिनियमाचे कलम ३१(१) मधील तरतुदीनुसार उक्त प्रारूप विकास योजनेस उक्त अधिसूचनेद्वारे मंजुरी देताना सदर मंजूरीतून वगळण्यात आलेल्या सारभूत स्वरुपाचे फेरबदल ईपी-०२ संदर्भात सर्वसाधारण जनतेकडून हरकती आणि / वा सूचना मागविण्यासाठी समक्रमांकाची सूचना दिनांक २३ मे २०२३ द्वारे प्रसिद्ध करण्यात आली आहे (यापुढे याचा उल्लेख " उक्त सूचना " असा करण्यात आलेला आहे) आणि ज्याअर्थी उक्त सूचना महाराष्ट्र शासनाचे राजपत्र (असाधारण भाग-१), कोकण विभाग पुरवणीमध्ये दिनांक १३ जून २०२३ रोजी प्रसिद्ध करण्यात आली आहे ;

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, ऑक्टोबर १०, २०२४/आश्िवन १८, शके १९४६ आणि ज्याअर्थी, उप संचालक, नगररचना, बृहन्मुंबई यांना उक्त सूचनेनुसार प्राप्त होणा-या हरकती/सूचनांना सुनावणी देऊन अहवाल सादर करणेसाठी अधिकारी म्हणून नियुक्त केले आहे ;
आणि ज्याअर्थी, उक्त अधिकारी यांनी उक्त प्रारूप विकास योजनेचे मंजुरीतून वगळलेल्या सारभूत स्वरुपाचे फेरबदल ई.पी.-०२ संबंधी जनतेकडून प्राप्त हरकती आणि / वा सूचनादारांना सुनावणी देऊन सदर ई.पी. संदर्भात त्यांचेकडील दिनांक २६ फेब्रुवारी २०२४ रोजीचे पत्राद्वारे नगररचना संचालनालयामार्फत अहवाल सादर केला आहे. तसेच संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांनी त्यांचेकडील दिनांक १३ ऑगस्ट २०२४ रोजीची पत्राद्वारे सदर ईपी संदर्भात अभिप्राय सदर केले आहेत ;
आणि ज्याअर्थी, सोबतचे परिशिष्टामध्ये नमूद ई.पी. संदर्भात मंजुरी देणे आवश्यक आहे, असे शासनाचे मत झाले आहे.
आता, त्याअर्थी, उक्त अधिनियमाचे कलम ३१ चे पोट-कलम (१) अन्वये प्राप्त अधिकारात आणि त्या अनुषंगाने असलेल्या अधिकारांचा वापर करून तसेच संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्लामसलत करून शासन याद्वारे,-----
(अ) सोबतचे परिशिष्टामध्ये नमूद केलेल्या उक्त क्षेत्रासाठीचे विकास योजनेतील सारभूत स्वरुपाचे फेरबदल क्र. ई.पी.-०२ ला मान्यता देण्यात येत आहे.
(ब) उक्त परिशिष्ट नुसार मंजुरी दिलेल्या सारंभूत स्वरुपाचे बदल (ई.पी.) सदरहू अधिसूचना महाराष्ट्र शासनाचे राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून ३० दिवसानंतर अंमलात येतील.
(क) विकास योजना-२०३४ मधील शासनाने मंजूर केलेले सारभूत स्वरुपाचे बदल (ई.पी.) मंजुरीची प्रत सर्वसाधारण जनतेच्या निरिक्षणासाठी प्रमुख अभियंता (विकास नियोजन), बृहन्मुंबई महानगरपालिका, महापालिका मार्ग, फोर्ट, मुंबई ४०० ००१ यांचे कार्यालयात सर्व कामकाजाच्या दिवशी कार्यालयीन वेळेत उपलब्ध राहील.
सदर अधिसूचना महाराष्ट्र शासनाच्या www.maharashtra.gov.in (कायदे/नियम) या वेबसाइटवर देखील प्रसिद्ध करण्यात आली आहे.

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPB-4318/484/C.R.-44/2022/UD-11.—Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as " the said Corporation ") as per the provision of Maharashtra Regional and Town Planning Act. 1966 (hereinafter referred to as " the said Act ") :
And Whereas, the jurisdiction of Mumbai Metropolitan Region Development Authority as a Special Planning Authority over the 3 Areas namely, (i) area between Mithi river & L.B.S. Marg from the notified area of Bandra-Kurla Complex, (ii) area of 'A' Block from the notified area of Bandra-Kurla Complex and. (iii) area on the west side of S. V. Road from the notified area of Oshiwara District Centre (hereinafter referred as " the said areas "), has been withdrawn from respective notified areas and these areas have been included in the area of jurisdiction of the said Corporation, vide Government in Urban Development Department's Notification (i) No.CMS/ TPB-4314/130/CR.No.-42/2014/UD-11, dated 30th August 2014. (ii) No. TPB-4314/1468/C.R.-30/2015/ UD-11, dated 18th November 2015 and (iii) No.CMS/TPB-4313/658/C.R.-116/2014/UD-11, dated 18th November 2015 repectively ;
And whereas, in accordance with provision of section 23 to section 30 of the said Act. the said Corporation being a Planning Authority for the said areas has prepared the Draft Development Plan for the said areas (hereinafter referred as " the said Draft Development Plam " and submitted it to the Government for sanction vide its letter dated 31st July 2019 ; and whereas, in accordance with provisions of sub-section (1) of Section 31 of the Said Act, after making, necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government vide Notification No. TPB-4318/484/CR-44/2022/UD-11, dated 29th September 2022 has sanctioned the part of the said Draft Development Plan as shown in SCHEDULE-A appended to the said Notification excluding the substantial Modification as shown in SCHEDULE-B appended to the said Notification ;
And whereas, excluded part i.e. EP-01 of the said draft development plan has been sanctioned by the Government vide Notification of even number dated 28th April 2023 : and Whereas, the remaining part of said development plan excluding EP-02 has been sanctioned by the Governed vide Notification of even number dated 22nd May 2023 :
And whereas, in accordance with provisions of sub-section (1) of Section 31 of the Said Act. the substantial modification excluded from sanction of the part of the said Draft Development Plan vide said Notification was published as EP-02 (hereinafter referred as " the said Exclude part ") for inviting objections and or suggestions from the general public vide notice of even number dated 23rd May 2023 (hereinafter referred as " the said Notice") ; and whereas said Notice was published in the Maharashtra Government Gazette (Extra Ordinary Part-I). Kokan Division Supplement dated 13th June 2023 ;
And whereas, the Deputy Director of Town Planning, Greater Mumbai is appointed as an " Officer " to give hearings and submit his report to the Government on the obiections/suggcstions received by him as per the said Notice ;
And whereas, the said officer after giving hearing in respect of the objections and / or suggestions received from the general public on the said Excluded Part, has submitted his report to the Government vide his letter dated 26th February 2024 for the said Excluded Part through Directorate of Town Planning ; and whereas, the Director of Town Planning. Maharashtra State, Pune vide his letter dated 13th August 2024 has also submitted his report on the said Excluded Part ;
५ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, ऑक्टोबर १०, २०२४/आश्िवन १८, शके १९४६And whereas, the State Government is of the opinion that, the said Excluded part shown in SCHEDULE appended hereto needs to be sanctioned.
Now therefore, in exercise of the powers conferred by sub-section (1) of section 31 of the said Act and all other powers enabling it in that behalf, the Government of Maharashtra. after consulting the Director of Town Planning, Maharashtra State. Pune hereby :—
(1) (a) Sanctions the said Excluded Part No:- E.P.-02 of the said Development Plan for the said areas, as more precisely specified in Schedule appended hereto.
(b) fixes the date after one month of the publication of this Notificatiom in the Maharashtra Government Gazette to be the date on which the said Excluded Parts as described in the Schedule shall come into force.
(2) Copy of the Plan showing the aforesaid Excluded Part as sanctioned by the State Government shall be kept open for inspection by the general public, during working hours for a period of one year in the Office of the Chief Engineer (Development Plan), Municipal Corporation of Greater Mumbai on all working days.
