क्रमांक टोीपुीएस-१२२४/७८१/प्र. क्र.३८/२४/नांवि-१२.–ज्याअथाी, ंगुला शहराची सुधारीत विकास योजनांा (यापुढे विजचीा उल्लाेख " उक्त विकास योजनांा " असा करण्यात आला आहे ) महाराष्ट्र प्राेविशक नांगररचीनांा अविधाविनांयम, १९६६ (यापुढे विजचीा उल्लाेख " उक्त अविधाविनांयम " असा करण्यात आला आहे) चीे कलाम ३१(१) मधाीला तरतुीनांुसार शासनां नांगरविकास विभागाकडीला अविधासूचीनांा क्रमांक विटोपुीएस-१९०९/६०६/प्र.क्र.३७३/०९/नांवि-१२, विनांांक ३ एविप्रला २०१२ अन्य े भागश: मंजूर झालाी असूनां ती विनांांक १ जूनां २०१२ पुासूनां अंमलात आलाी आहे आवि उक्त विकास योजनांेच्या गळलाेल्या भागाची विकास योजनांा उक्त अविधाविनांयमाच्या कलाम ३१(१) मधाीला तरतुीनांुसार शासनां नांगरविकास विभागाकडीला अविधासूचीनांा क्रमांक टोीपुीएस- १९१२/६०१/ प्र. क्र.१०६/१३/नांवि-१२, विनांांक १२ जानांेारी २०१६ अन्ये मंजूर करण्यात आलाी असूनां ती विनांांक १७ जूनां २०१६ पुासूनां अंमलात आलाी आहे. (यापुढे विजचीा एकवित्रात उल्लाेख " उक्त मंजूर विकास योजनांा "असा करण्यात आला आहे) ;
आवि ज्याअथाी, उक्त विकास योजनांेमध्ये स. नां. ९६, विह. नां. ३/१अ, विह. नां. ३/२ई सं. नां.१०१,विह. नां. १/४अ+१/३ब, क्षेत्रा सुमारे ०-४२-३० हे.आर. या जविमनांी आरक्षे क्र.१५"पुाटोकर हायस्कूला विस्तार विक्रडीांग" यासाठी आरविक्षेत आहे. (यापुढे ज्याचीा उल्लाेख " उक्त जमीनां "असा करण्यात आला आहे.);
आवि ज्याअथाी, ंगुला नांगरपुरिरषेनांे (यापुढे ज्याचीा उल्लाेख " उक्त नांगरपुरिरष " असा करण्यात आला आहे) उक्त अविधाविनांयमातीला कलाम ३७(१) अन्येची स ैधाविनांक कायाही पु करूनां उक्त जमीनां आरक्षे क्रमांक १५- " पुाटोकर हायस्कूला विस्तार विक्रडीांग " या आरक्षेामधाूनां गळूनां रविहास विभागात समाविष्टो करण्याचीा प्रस्ता विनांांक १२ फेब्रुारी २०२४ च्या पुत्रान्ये शासनांास मंजुरीकरिरता सार केला आहे (यापुढे ज्याचीा उल्लाेख " उक्त फेरबला प्रस्ता " असा करण्यात आला आहे) ;

भाग एक-(को.वि.पु.)-१६०–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, ऑक्टोबर १४, २०२४/आश्विन २२, शके १९४६ आवि ज्याअथाी, आश्यक ती चीौकशी केल्यानांतर संचीालाक, नांगररचीनांा, महाराष्ट्र राज्य, पुे यांचीा सल्ला घेतल्यानांतर उक्त फेरबला प्रस्ता मंजूर करे आश्यक आहे, असे शासनांाचीे मत झालाे आहे ;
आवि ज्याअथाी, शासनां विनांय विनांांक २० एविप्रला २०१६ नांुसार स. नां. ९६, विह.नां. ३/१अ, विह.नां. ३/२ई सं. नां. १०१,विह. नां. १/४अ+ १/३ ब च्या जमीनां धारकांनांी त्यांचीे मालाकीच्या क्षेत्रासाठी प्रचीविलात ाविषक मुल्यर तक्त्यानांुसार येाऱ्या जमीनां मुल्याच्या ५% रानांे येाऱ्या रकमेपुैकी शासनां ेय असलाेल्या ५०% अविधामूल्याची रक्कम रुपुये २,८१,४३० सहाय्यक संचीालाक, नांगररचीनांा शाखा कायालाय, विसंधाुग यांचीेमाफेफत शासकीय कोषागारात चीलानां क्र. MH००९५०४३७६२०२४२५M, विनांांक ९ ऑक्टोबर २०२४ रोजी आवि विनांयोजनां प्राविधाकरास ेय असलाेलाी रक्कम रुपुये २,८१,४३० ंगुला नांगरपुरिरष यांचीेकडीे पुाती क्र. २२७२, विनांांक ८ ऑक्टोबर २०२४ रोजी भारा केला आहे ;
त्याअथाी, आता उक्त अविधाविनांयमाच्या कलाम ३७ चीे पुोटो-कलाम (२) अन्ये शासनांास प्रत्त असलाेल्या शक्तंचीा ापुर करूनां शासनां उक्त फेरबला प्रस्त ा मंजूर करीत आहे आवि त्यासाठी उक्त विकास योजनांा मंजुरीच्या अविधासूचीनांेतीला फेरबलाच्य ा अनांुसूचीमध्ये शेटोच्या नांीनांतर पुढेीला नांीनां नां समाविष्टो करण्यात येत आहे ;

" विकास योजनांा भाग नांकाशार शविल्याप्रमाे मौ. ंगुला, विज. विसंधाुग येथाीला स. नां.९६, विह. नां. ३/१अ, विह. नां. ३/२ ई सं.नां.१०१, विह. नां. १/४अ+१/३ब, क्षेत्रा सुमारे ०-४२-३० हे.आर. या जविमनांी आरक्षे क्र.१५-'पुाटोकर हायस्कुला विस्तार विक्रडीांग ' (एकू क्षेत्रा १-२८-०० हे.आर.) या आरक्षेामधाूनां गळूनां रविहास विभागात समाविष्टो करण्यात येत आहे." ०२. सरच्या मंजूर फेरबलाची अविधासूचीनांा शासन राजपत्रात प्रविसद्ध झाल्याच्या विनांांकापुासूनां अंमलात येईला.
०३. उक्त मंजूर फेरबला शविारा भाग नांकाशा नांागरीकांच्या अलाोकनांाथा कायालायीनां ेळेमध्ये कामकाजाच्या विशी खालाी नांमू कायालायामध्ये एक मविहन्याच्या कालाधाीकरिरता उपुलाब्धा राहीला.

०४. सर फेरबलाची अविधासूचीनांा ही महाराष्ट्र शासनांाच्या www.maharashtra. gov.in या ेबसाईटोर ेखीला उपुलाब्धा करण्यात याी.

NOTIFICATION
Maharashtra regional and town Planning act, 1966.
No. TPS-1224/781/C.R.38/24/UD-12.—Whereas, the revised Development Plan of City Vengurla (hereinafter referred to as " the said Development Plan ") has been sanctioned partly by the Government in Urban Development Department under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") vide Notification No.TPS-1909/606/C.R.373/09/UD-12, dated 3rd April 2012 and has came into force with effect from 1st June 2012 and the Excluded part of the said Development Plan has been sanctioned by the Government in Urban Development Department under section 31(1) of the said Act, vide Notification No.TPS-1912/601/C.R.106/13/UD-12, dated 12th January 2016 and has came into force with effect from 17th June 2016 (hereinafter jointly referred to as " the said Sanctioned Development Plan") ;
And whereas, in the said Development Plan, an area admeasuring about 0-42-30 Ha. Area of the bearing S. No. 96, Hissa No. 3/1A, Hissa No. 3/2E and S. No. 101, Hissa No. 1/4A+1/3B of Village Vengurla, Dist. Sindhudurg is reserved for Site No. 15- " Extension to Patkar High School and Playground " (hereinafter referred to as " the said Land ") ;
And whereas, Vengurla Municipal Council (hereinafter referred to as " the said Municipal Council "), after following the legal procedure under sub-section (1) of section 37 of the said Act, has submitted a proposal for modification in the said Development Plan so as to delete the said land from the Site No.15- " Extension to Patkar High School and Playground " and to include the same in Residential Zone vide letter dated 12th February 2024 for final sanction to Government (hereinafter referred to as " the said Modification ") ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that it is necessary to sanction the said Modification ;
And whereas, as per Government Resolution dated 20th April 2016 the owner of the land bearing S. No. 96, Hissa No. 3/1A, Hissa No. 3/2E and S. No.101, Hissa No.1/4A+1/3B has deposited the premium amount of Rs. 2,81,430 towards 50% share payble to Government in the Government treasury through Assistant Director of Town Planning, Sindhudurg Branch vide challan No. MH009504376202425M, dated 9th October 2024 and deposited the premium amount Rs. 2,81,430 towards 50% share payble to Planning Authority in the office of Vengurla Municipal Council, vide Receipt No. 2272, dated 8th October 2024 out of the total premium amount of the rate of 5% land value as per the Prescribed in the current Annual Statement of Rate ;
Now therefore, in exercise of the powers conferred under sub section (2) of section 37 of the said Act, the State Government hereby sanctions the said Modification as described below :–४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, ऑक्टोबर १४, २०२४/आश्विन २२, शके १९४६ " In the Schedule of modifications appended with the said Notification, after the last entry, the following new entry shall be inserted. "
viz. :–

" An area admeasuring about 0-42-30 Ha.bearing S. No. 96, Hissa No.3/1A, Hissa No. 3/2E and S. No.101, Hissa No.1/4A+1/3B of village Vengurla, Dist.Sindhudurg is deleted from Site No.15- " Extension to Patkar High School and Playground " (total area 1-28-00 Ha.) and the land so deleted from the reservation is included in " Residential Zone "as shown on the part plan of the Development plan."
02. The date of publication of this Notification in the Maharashtra Government Gazette is fixed as the date of coming into force of this sanctioned modification.
03. The part plan of aforesaid sanctioned modification shall be made available for inspection by the general public during office hours on all working days at the following offices for a period of one month:-
(i) The Joint Director of Town Planning, Konkan Division, Konkan Bhavan, Navi Mumbai.
(ii) The Assistant Director of Town Planning, Sindhudurg, Dist. Sindhudurg.
(iii) The Chief Officer Vengurla Municipal Council, Vengurla.
04. This Notification shall also be made available on the Government Website at www.maharashtra.gov.in
