BY DIRECTOR OF TOWN PLANNING

THE MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1966.

ORDER

No.D.T.P-D.P. Umarkhed (R)-Sec-127(2)-Order-TPV-VI-5910 .–

Whereas, the Revised Development Plan of Umarkhed Municipal Council has been sanctioned as per the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No.TPS-2798-1026-CR- 55-98-UD-13, dated 27th January, 1999 (hereinafter referred to as "the said Notification") & came into force with effect from dated 15th April, 1999 (hereinafter referred to as the "said Sanctioned Revised Development Plan") ;

And whereas, in the said Revised Sanctioned Development Plan, admeasuring approximate areas of 1.8762 H. A. of the land bearing S.No. 331 of Mouza Umarkhed are affected by the Reservation No. 18 "Garden" (hereinafter referred to as "the said Reservations") for which Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Umarkhed (hereinafter referred to as "the said Appropriate Au- thority") ;

And whereas, the land under said Reservations have not been acquired by the said Appropriate Authority within 10 (Ten) years from the date on which the said sanctioned Revised Development Plan come into force ;

And whereas, the concerned land owners (hereinafter referred to as "the said Land Owners") of the land bearing S. No. 331/3/2 area admeasuring1.21 H. A. of Mouza Umarkhed, Tal. Umarkhed, Dist. Yavatmal (hereinafter referred to as "the said Land") had served a notice Dated 2nd August, 2019 throuh Adv. Shri. J. R. Pawar as per the provisions of Section 127(1) of the said Act in respect of the area affected by the said Reserva- tion (hereinafter referred to as "the said Notice") on the said Appropriate Authority and the same has received to Appropriate Authority on Dated 5th August, 2019 ;

And whereas, the said land under the said Reservations is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said Notice by the said land owners ;

And whereas, in Writ Petition No. 3188/2022 filed by the said Land owners in the Hon'ble High Court of Judicature at Mumbai, Nagpur Bench, the Hon'ble High Court has directed to the Respondents vide decision Dated 12th September, 2023 (hereinafter referred to as "the said Judgement") that, to notify the lapsing of the said Reservations on the area affected of the said Land by an order to be published in the Official Gazzete;

And whereas, the Chief Officer, Municipal Council, Umarkhed has submitted the proposal vide letter No. 352/2023-24, Dated 4th October, 2023 to issue an order in respect of lapsing of the said Reservations on the said Land under the provisions of Section 127(2) of the said Act as per the said Judgement of the Hon'ble High Court ;

And whereas, the Joint Director of Town Planning, Amravati Division, Amravati has submitted report vide it's letter No. 1584, Dated 13th December, 2023; mainly that, it is necessary to issue order under the provisions of Section 127(2) of the said Act as directed by the Hon'ble High Court in respect of lapsing of the said Reservations on the area affected of the said Land ;

And whereas, as per the Measurement Plan (M. R. NO. 44/2019, Dated 16th February,2019) of the said Land, it is clear that, out of area admeasuring 1.21 Ha. of the said Land excluding area under 9.0 Mt.

Development Plan Road adjacent to the north boundary, area affected by the said Reservations is 1.1317 Ha;

And whereas, after considering the above facts in respect of the said Reservations on the said Land in the said Sanctioned Revised Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the said Reservations partly on the area admeasuring approximately 1.1317 Ha. (11317 Sq. Mt.) of the said land ;

And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No.TPS-1813/3211/CR-508/UD-13, Dated 01st December, 2016, has delegated the powers exercisable by it under the provisions of Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservations partly in respect of the said land as per the provisions of Section 127 (2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows.–

After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added:–

The said Land so released from the said Reservations shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adjacent lands under the said Sanctioned Revised Development Plan.

2. A copy of the part plan of the said Sanctioned Revised Development Plan showing the part area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Umarkhed, District Yavatmal during office hours on all working days for inspection to public upto one month.

3. This Order shall also be published on be published on the Directorate's official website www.dtp.
