As per the requirements of Rule 18 of Securities Contracts (Regulations) Rules, 1957, the proposed amendments to the Byelaws of the National Stock Exchange of India Limited (NSEIL) as given hereunder are published for criticism in accordance with the provisions of Section 23 of General Clauses Act, 1897 in the Gazette of India. Any person having any observations on the proposed amendments to Byelaws can send the same in writing to the undersigned at Gen_gaztpublication@ nse.co.in or at Exchange Plaza, Sixth Floor, 'A' wing, Plot C-1, Block G, Bandra – Kurla Complex, Bandra (East), Mumbai 400 051 within fifteen days from the date of this publication in the Gazette. The observations received after the aforementioned date will not be considered when the proposed amendments will be taken for consideration.

1. In Chapter XI of NSE Byelaws, Clause 20(a) shall be inserted as :

(20) The Byelaws contained in this Chapter shall be read in conjunction with the provisions of any Circular, guideline, norm, instruction (by whatsoever name they may be called) issued by SEBI in this regard, as well as any other law in force.

(a) All claims, differences, or disputes under consideration of the GRC or in relation

to which arbitration / appellate arbitration proceedings have been commenced

before August 16, 2023, shall be resolved as per the applicable framework

Whereas, as per the powers conferred by sub-section (1) of Section31 of the MR & TP Act, 1966, State Government has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") vide Notification No. TPB-4317/629/CR- 118/2017/DP/UD-11, Dt. 08.05.2018 (Schedule A) (hereinafter referred to as "the said Notification") along with the Development Control and Promotion Regulations-2034 for Greater Mumbai. And whereas, the Govt. of Maharashtra has accorded sanction to the Development Plan-2034 (Schedule 'A') (excluding the EP portion mentioned in 'Schedule B' of the Notification) and the same have already came into force from 01.09.2018. The EP portion mentioned in 'Schedule B' of the Notification are subsequently sanctioned by the GoM vide various notifications in due course.

And whereas, as per sanctioned DP-2034 for Brihanmumbai area, the plot bearing CTS Nos. 1(pt), 2(pt), 3(pt), 4, 5(pt), 6(pt) of village Oshiwara, K/W ward are affected by 9.15 m. wide D.P. road situated in Residential Zone. The said plots are part of MHADA Layout.

And whereas, Vice President & Chief Executive Officer, MHADA vide his representation dtd.

28.04.2022 addressed to Hon. Municipal Commissioner, BMC has requested for deletion of 9.15m wide D.P. Road for the proposed MHADA Layout on plots bearing CTS Nos. 1(pt), 2(pt), 3(pt), 4, 5(pt), 6(pt) of village Oshiwara. The concern Architect Shri P.G. Redekar for the said MHADA Layout has informed that CTS No. 1(pt) of village Oshiwara admeasuring approx. 3001.86 Sq.M. is allotted for Housing Scheme for High Court Judges by MHADA and for the security purpose, it is required to delete the said 9.15m wide DP Road.

And whereas, BMC had submitted the representation received from Vice President & Chief Executive Officer, MHADA to Urban Development Department, Govt. of Maharashtra vide No.Ch.E/ DP/5745/WS/H&K, DT. 21.06.2022 for taking suitable decision on their request regarding deletion of 9.15m wide DP road.

And whereas, the road u/r. was placed under schedule-"B" i.e. under EP vide notification under no. TPB-4317/629/CR-118/2017/DP/UD-11, dt.08.05.2018 & was not sanctioned till 21.06.2022, for which the Under Secretary,UD-11 was intimated by BMC. The said EP was sanctioned by the State Government vide Notification No. TPB-4320/CR-l15/2020/UD-11, dt.12.09.2022.

And whereas, Under Secretary, GoM vide letter dated 19.06.2024 intimated Commissioner, BMC that the request of MHADA for deletion of 9.15m wide D.P. Road needs to be considered as mentioned in the letter of BMC and if BMC completes the legal process for modification proposal under section 37(1) of MR&TP Act,1966 & submit the same to Government, the same may be considered by Government on merits.

And whereas, the road under reference is part of MHADA Layout having approx. length of 50 meters only and is not having any connection with other public road. The layout under reference is abutting to 27.45 mtr wide existing road & having direct access. The said road portion shall be part of layout and accessible only for residents within the layout.

Vice President & Chief Executive Officer, MHADA vide letter dtd.28.04.2022 has informed that the D.P.Road proposed in DP-2034 is shown within the proposed layout of MHADA and it will be a layout road only. There is no need to show the same as D.P.Road and hence it shall be deleted.

And whereas, The Brihanmumbai Municipal Corporation (hereinafter referred as BMC) is of the opinion that since the said road portion shall be part of layout and accessible only for residents within the layout, there is no need to show the same as D. P. Road and hence it shall be deleted from safety point of view and effective implementation of Housing Scheme for High Court Judges by MHADA .

And whereas, as per circular u/no. BMC/ADMN/3 dt. 07.04.2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 (hereinafter referred as 'MMC Act,1888') all the powers of the Corporation are now vested with the Administrator.

And therefore, the proposal for above modification is approved by Administrator (Improvement Committee) vide no. 34 of 30.09.2024 and further approved by Administrator (Corporation) vide resolution no. 626 of 08.10.2024, to take further action to modify DP-2034 of K/W ward by deleting 9.15 mtr.wide DP Road affecting the said CTS Nos. 1(pt), 2(pt), 3(pt), 4, 5(pt), 6(pt) of village Oshiwara & to invite suggestions/ objections from general public u/s. 37(1) of MRTP Act, 1966 and to approach/ make correspondence with State Govt. in Urban Development Dept. for final sanction u/s. 37(2) of MRTP Act, 1966 for the proposed modification in Sanctioned DP 2034.

And therefore, it is proposed to delete the 9.15 mtr.wide DP Road affecting CTS Nos.1(pt), 2(pt), 3(pt), 4, 5(pt), 6(pt) of village Oshiwara in sanctioned D.P. 2034 of K/west, as shown on proposed modification plan, specifically as described in the table mentioned below :

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1) of Section 37 of the MR & TP Act, 1966; and of all other powers enabling it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by Section 37(1) of the said Act, for information of all persons likely to be affected thereby. BMC is further pleased to inform that any objections/ suggestions in respect of the proposed modification mentioned above may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of

(cid:249)याअथ(cid:559), MMRDA (cid:247)या ODC क(cid:555)रता(cid:247)या मंजूर िनयोजन (cid:332)(cid:274)तावातील कलम ६.५ (६.५.१ & ६.५.२) मधील "जमीन मालकां(cid:247)या सहभागाबाबत" (cid:247)या तरतुद(cid:558)नुसार सदर भूखंड MMRDA ने (cid:543).१/- (cid:247)या नाममा(cid:327) िकमतीवर संपािदत क(cid:577)ले होते आिण संपािदत क(cid:577)लेले भूखंड ६० वषा(cid:597)(cid:247)या कालावधीसाठी (cid:257)याच मालकांना भाड(cid:578)त(cid:346)वावर दे(cid:256)यात आले होते. सदर िवकास िनयोजन आराख(cid:454)ानुसार संदिभ(cid:593)त भूखंडावर शाळ(cid:578)चे आर(cid:550)ण न(cid:271)हते ;

(cid:249)याअथ(cid:559), ओिशवरा महानगरपािलका शाळा (cid:312)मांक १ ही सात (७) वग(cid:593)खो(cid:269)या आिण एक (१) शेड वग(cid:593)खोली असलेली शाळा भाड(cid:578) त(cid:346)वावर १९६६ पासून अ(cid:556)(cid:274)त(cid:257)वात होती. सदर इमारत जीण(cid:593) घोिषत कर(cid:256)यात आली आिण िदनांक ८ ऑग(cid:274)ट २००२ पासून शाळा इतर जवळ(cid:247)या शाळ(cid:578)त (cid:274)थलांतरीत कर(cid:256)यात आली. (cid:257)यानंतर, सहायक आयु(cid:242)त K/W वॉड(cid:595) यां(cid:247)या काया(cid:593)लया(cid:247)या िदनांक ३१ जानेवारी २०१५ रोजी(cid:247)या प(cid:327)ा(cid:465)ारे MMRDA ला ((cid:257)यावेळी िनयोजन (cid:332)ािधकरण अस(cid:269)याने) पूव(cid:559)(cid:247)या शाळ(cid:578)(cid:247)या प(cid:555)रसरा(cid:247)या (cid:550)े(cid:327)ा(cid:247)या समतु(cid:269)य शाळ(cid:578)ची पुनबा(cid:597)धणी होईपय(cid:597)त संदभा(cid:593)तील भूखंडावर कोणतीही िवकास परवानगी देऊ नये असे कळवले होते ;

(cid:249)याअथ(cid:559), ओिशवरा िज(cid:269)हा क(cid:607)(cid:329)ातील (cid:550)े(cid:327)ा(cid:247)या िव(cid:464)मान जमीन वापर (E.L.U.) नकाशांनुसार, न.भू.(cid:312). ४३७, ४३८, ४३९ चे पूण(cid:593) (cid:550)े(cid:327) व न.भू.(cid:312). ४४२ चे अंदाजे १०-१५% (cid:550)े(cid:327) SC (cid:266)हणजेच झोपडप(cid:446)ी/(cid:242)ल(cid:274)टर (Slum/Cluster) (cid:266)हणून दश(cid:593)िवले गेले आहे. तसेच न.भू.(cid:312). ४४२ चा उव(cid:593)(cid:555)रत अंदाजे ८५% (cid:550)े(cid:327) हे VL (cid:266)हणजेच (cid:555)रकामी जमीन (Vacant Land) (cid:266)हणून दाखवले आहे. (cid:249)याअथ(cid:559), ए. एच. व एस.एच. दलवाई यांनी (cid:257)यां(cid:247)या प(cid:327)ात नमूद क(cid:577)(cid:269)या(cid:332)माणे व(cid:274)तु(cid:556)(cid:274)थतीचा दाखला देत 'RE1.1- महानगरपािलका शाळा' या (cid:332)योजनासाठी जमीन आरि(cid:550)त कर(cid:256)या(cid:247)या वरील (cid:332)(cid:274)तावावर ती(cid:341) आ(cid:550)ेप घेतला. िशवाय, (cid:257)या भूखंडावरील पूव(cid:559) वा(cid:274)त(cid:271)यास असले(cid:269)या भाड(cid:578)क(cid:544)(cid:573)नीदेखील या आर(cid:550)णावर आ(cid:550)ेप घेतला. तसेच, MMRDA (पूव(cid:559)चे िनयोजन (cid:332)ािधकरण), या स(cid:260)या(cid:247)या (cid:332)करणात िवशेष िनयोजन (cid:332)ािधकरण अस(cid:269)याने, (cid:257)यांनी िदनांक २४ नो(cid:271)ह(cid:606)बर २०१७ रोजी बृह(cid:261)मुबंई महानगरपािलक(cid:577)ला सादर क(cid:577)ले(cid:269)या आ(cid:550)ेप प(cid:327)ात (cid:332)(cid:274)तुत भूखंड हा शॉिपंग कम रेिसड(cid:578)(cid:556)(cid:261)शयल झोन ने बािधत असून भाड(cid:578)प(cid:446)ीनुसार दे(cid:256)यात आ(cid:269)याचे व (cid:257)यां(cid:247)या भाड(cid:578)करारानुसार म(cid:242)तेदाराने (cid:257)यां(cid:247)या खचा(cid:593)ने भाड(cid:578)क(cid:544)(cid:573)चे पुनव(cid:593)सन करणे आव(cid:272)यक अस(cid:269)याचे (cid:266)हटले आहे. पुढ(cid:578) असे नमूद कर(cid:256)यात आले आहे की, बृ.मु ं.म.न.पा. चे भूवापर (cid:332)(cid:274)ताव MMRDA (cid:247)या जमीन वापरा(cid:247)या (cid:332)(cid:274)तावांनुसार नाहीत आिण (cid:257)यामुळ(cid:578) हे (cid:332)(cid:274)ताव MMRDA ने (cid:262)लॉट मालकांना िदले(cid:269)या वचनब(cid:460)तेशी संल(cid:244)न नाहीत. (cid:257)यामुळ(cid:578) MMRDA ने सदर भूखंडावरील (cid:332)(cid:274)तािवत शाळ(cid:578)चे आर(cid:550)ण इतर िठकाणी दाखिव(cid:256)याची िशफारस क(cid:577)ली होती ;

(cid:249)याअथ(cid:559), महारा(cid:273)(cid:322) (cid:332)ादेिशक व नगररचना अिधिनयम, १९६६ (cid:247)या कलम २८ नुसार (cid:274)थापन कर(cid:256)यात आले(cid:269)या िनयोजन सिमतीने, मसुदा िवकास आराख(cid:454)ावरील सूचना आिण हरकती िवचारात घेऊन (cid:257)यांचा अहवाल (cid:257)यां(cid:247)या िशफारश(cid:558)सह िदनांक १५ मे २०१९ रोजी महानगरपािलक(cid:577)स सादर क(cid:577)ला. िनयोजन सिमतीने RE1.1- महानगरपािलका शाळ(cid:578)चे आर(cid:550)ण वगळ(cid:256)याची िशफारस अहवालातील (cid:312). १२ म(cid:260)ये क(cid:577)ली आहे. हा भूखंड MMRDA ने भाड(cid:578)त(cid:346)वावर िद(cid:269)याचे आिण इमारतीचा पुनिव(cid:593)कास (cid:332)(cid:274)ताव महानगरपािलक(cid:577)ला सादर क(cid:577)(cid:269)याचे िनयोजन सिमतीचे िनरी(cid:550)ण आहे. िनयोजन सिमती(cid:247)या िशफारशीत असेही नमूद क(cid:577)ले आहे की, शासनाने जारी क(cid:577)ले(cid:269)या (cid:312). सीएमएस/टीपीबी–४३१४/१६५८/सीआर-११६/२०१४/ निव-११ िदनांक १८ नो(cid:271)ह(cid:606)बर २०१५ अ(cid:261)वये(cid:247)या अिधसूचनेनुसार असे नमूद क(cid:577)ले आहे की (cid:249)या जिमनी संपािदत क(cid:577)(cid:269)या आहेत िक(cid:573)वा (cid:249)यासाठी MMRDA (cid:465)ारे संपादनाची काय(cid:593)वाही सु(cid:544) आहे (cid:257)या MMRDA (cid:247)या मंजूर िनयोजन (cid:332)(cid:274)तावांनुसार िवकिसत क(cid:577)(cid:269)या जातील. पुढ(cid:578) असे नमूद क(cid:577)ले आहे की, या अिधसूचने(cid:247)या तारखेपूव(cid:559) MMRDA (cid:465)ारे मंजूर क(cid:577)ले(cid:269)या िवकास (cid:332)(cid:274)तावांस िनयोजन (cid:332)(cid:274)ताव आिण ओिशवरा िज(cid:269)हा क(cid:607)(cid:329)ा(cid:247)या िवकास िनयं(cid:327)ण िनयमावली(cid:247)या तरतुदी लागू होतील. संदिभ(cid:593)त भूखंड हा अज(cid:593)दाराला ३० वषा(cid:597)(cid:247)या कालावधीसाठी भाड(cid:578)त(cid:346)वावर िदला आहे. वरील बाब(cid:558)चा िवचार क(cid:544)न िनयोजन सिमतीने िनण(cid:593)य घेतला की बृ.मु ं.म.न.पा. (cid:247)या अटी व शत(cid:560)नुसार िव(cid:464)मान महापािलका शाळ(cid:578)(cid:247)या समतु(cid:269)य बांधीव (cid:550)े(cid:327)ास सुपूद(cid:593) कर(cid:256)या(cid:247)या अधीन राहून RE1.1- महानगरपािलका शाळ(cid:578)चे संपूण(cid:593) आर(cid:550)ण वगळ(cid:256)यात यावे. िव(cid:464)मान शाळ(cid:578)चे (cid:550)े(cid:327) (cid:332)चिलत िनयमांनुसार समतु(cid:269)य बांधीव (cid:550)े(cid:327)ासह िव(cid:464)मान सदिनका (cid:266)हणून पुनव(cid:593)सन कर(cid:256)यास पा(cid:327) आहे ;

(cid:249)याअथ(cid:559), िनयोजन (cid:332)ािधकरणाने महानगरपािलका ठराव (cid:312). १६४ िदनांक २४ जून २०१८ (cid:247)या मंजु ुरीने महारा(cid:273)(cid:322) (cid:332)ादेिशक व नगररचना अिधिनयम, १९६६ (cid:247)या कलम ३० अ(cid:261)वये िनयोजन सिमती(cid:247)या वरील सुधारणा व इतर सुधारणांसह (cid:332)ा(cid:544)प िवकास आराख(cid:454)ाक(cid:555)रता िदनांक ३१ जुलै २०१९ रोजी रा(cid:249)य सरकार(cid:247)या मंजुरीसाठी िशफारस क(cid:577)ली. महानगरपािलक(cid:577)(cid:247)या िशफारसीनुसार (cid:332)(cid:274)तुत भूखंड 'RE1.1- महानगरपािलका शाळा' याक(cid:555)रता आरि(cid:550)त न(cid:271)हता ;

(cid:249)याअथ(cid:559), MMRDA ने (cid:312). TCP (P-2)/ ODC/ Misc/ 6.214/ 2607/ 2017 िदनांक २४ नो(cid:271)ह(cid:606)बर २०१७ अ(cid:261)वये (cid:332)ा(cid:544)प िवकास िनयोजन आराख(cid:454)ासाठी िदनांक १८ऑ(cid:242)टोबर २०१७ रोजी(cid:247)या अिधसूचनेत नमूद क(cid:577)ले(cid:269)या तरतुदी लागू हो(cid:256)याबाबत नगरिवकास िवभागाकड(cid:564)न (cid:274)प(cid:273)टीकरण मागवले होते. सदर प(cid:327)ास नगर िवकास िवभागामाफ(cid:594)त (cid:312). टीपीबी-४३१९/१०३/सीआर १५२/२०१९/ निव- ११ िदनांक १५ फ(cid:577)(cid:334)ुवारी २०२० अ(cid:261)वये आयु(cid:242)त, MMRDA यांना पुढील(cid:332)माणे कळिवले :–

"या (cid:550)े(cid:327)ासाठी कलम २६ अ(cid:261)वये (cid:332)िस(cid:460) (cid:332)ा(cid:544)प िवकास योजनेत िवषयांिकत जिमनीवर महानगरपािलका शाळा (RE1.1) चे आर(cid:550)ण दश(cid:593)िवले होते. तथािप, िनयोजन सिमतीने सदर आर(cid:550)ण वगळणेबाबत क(cid:577)लेली िशफारस फ(cid:577)रबदल (M-12) महानगरपािलक(cid:577)ने कायम ठ(cid:578)वून कलम ३०(१) अ(cid:261)वये (cid:332)(cid:274)ताव सादर करताना सदर जिमनीवर आर(cid:550)ण सदर (cid:332)करणातील पूव(cid:593) बांिधलकी िवचारात घेऊन वगळलेले आहे. वरील बाबी ल(cid:550)ात घेता आिण वरील प(cid:555)र(cid:247)छ(cid:578)दाम(cid:260)ये नमूद क(cid:577)ले(cid:269)या व(cid:274)तु(cid:556)(cid:274)थती(cid:247)या आधारे, बृह(cid:261)मु ंबई महानगरपािलक(cid:577)चे असे मत आहे की, िनयोजन सिमतीने िशफारस क(cid:577)ले(cid:269)या आिण िनयोजन (cid:332)ािधकरणाने महारा(cid:273)(cid:322) (cid:332)ादेिशक व नगर रचना अिधिनयम, १९६६ (cid:247)या ३०(१) अ(cid:261)वये शासनाला सादर कर(cid:256)यात आले(cid:269)या (cid:332)ा(cid:544)प िवकास आराख(cid:454)ात 'RE1.1 (महानगरपािलका शाळा)' हे आर(cid:550)ण वगळ(cid:256)यात आले होते. सदर आर(cid:550)ण वगळताना िनयोजन (cid:332)ािधकरणाने संबंिधत भूतकाळातील न(cid:635)दी िवचारात घेत(cid:269)या हो(cid:257)या. तसेच महानगरपािलक(cid:577)(cid:247)या पूव(cid:559)(cid:247)या भाड(cid:578)त(cid:257)वावरील शाळ(cid:578)चे पुनव(cid:593)सन करताना मूळ शाळ(cid:578)चे (cid:550)े(cid:327)फळ अबािधत राहील याची (cid:244)वाही अज(cid:593)दाराने िदली आहे. अज(cid:593)दारा(cid:247)या िनवेदनात नमूद क(cid:577)(cid:269)यानुसार, नगर िवकास िवभागाने िदनांक १५ फ(cid:577)(cid:334)ुवारी २०२० रोजी महानगर आयु(cid:242)त, MMRDA यांना िनद(cid:616)िशत क(cid:577)ले(cid:269)या (cid:274)प(cid:273)टीकरणा(cid:257)मक प(cid:327)ानुसार 'RE1.1 (महानगरपािलका शाळा)'चे आर(cid:550)ण आव(cid:272)यक नाही ;

(cid:249)याअथ(cid:559), महानगरपािलक(cid:577)चे प(cid:555)रप(cid:327)क (cid:312). बीएमसी/ एडीएमएन/ ३ िदनांक ७ एि(cid:332)ल २०२२ नुसार अ(cid:464)ावत सुधा(cid:555)रत मु ंबई महानगरपािलका अिधिनयम, १८८८ (cid:247)या कलम ६क(१) अ(cid:261)वये महानगरपािलका आिण महानगरपािलक(cid:577)(cid:247)या इतर (cid:332)ािधकरणांचे सव(cid:593) अिधकार आता (cid:332)शासकांकड(cid:578) िनिहत आहेत. (cid:550)े(cid:327)ाक(cid:555)रता खालील त(cid:242)(cid:257)यांत नमूद क(cid:577)(cid:269)यानुसार फ(cid:577)रबदल करणे (cid:332)(cid:274)तािवत आहे;

Whereas, as per the powers conferred by sub-section (1) of Section31 of the MR & TP Act, 1966, State Government has accorded sanction to the Draft Development Plan, 2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") vide Notification No. TPB-4317/629/CR- 118/2017/DP/UD-11, Dt. 08.05.2018 (Schedule A) (hereinafter referred to as "the said Notification") along with the Development Control and Promotion Regulations, 2034 for Greater Mumbai. And whereas, the Government of Maharashtra has accorded sanction to the Development Plan, 2034 (Schedule 'A') (excluding the EP portion mentioned in 'Schedule B' of the Notification) and the same have already come into force from 01.09.2018. The EP portion mentioned in 'Schedule B' of the Notification are subsequently sanctioned by the GoM vide various notifications in due course.

And whereas, as per sanctioned DP-2034 for Brihanmumbai area, the plot bearing CTS No. 437, 438, 439 and 442 of Village Oshiwara are affected by the reservation of RE1.1 (Municipal School), abuts the reservation of RH1.1 (Municipal Dispensary/Health Post) & affected by existing road proposed to be widened to 12.20m. & 20m. & their junction and existing road (S. V. Road). The plots under reference are situated partly in Commercial Zone (C), partly in Industrial Zone(I) and partly in Residential Zone (R). And whereas.

And whereas, as per Government of Maharashtra (U.D.D.& Public Health Dept.) Notification u/r. no TPB 4382/26/UD-5 did 18/06/1982, as per cl (c) of sub sec. (1) of Sec. 40 of MRTP Act, 1966, the Government of Maharashtra had appointed MMRDA as the Special Planning Authority (S.P.A.) for the notified area of the Oshiwara District Centre (ODC) and the plot under report bearing C.T.S. Nos. 437, 437/1 to 5, 438, 442, 442/1 to 24 and 439, 439/1 to 8, of village Oshiwara, was earlier falling in ODC (Oshiwara District Centre) wherein the developments therein were permissible in accordance to the sanctioned planning Proposal of ODC approved u/r. Government Notification No. TPB/4391/2885/UD-11 dtd. 16/01/1992. Originally, the said plots were not reserved for any public purpose in the sanctioned DP of MMRDA ODC (Special Planning Authority) but was allocated for the purpose of "Residential-cum-Shopping Zone" in the sanctioned DP of MMRDA-ODC. There was no reservation of School on the said plot.

And whereas, as per Sec. 6.5 (6.5.1 & 6.5.2) of Planning Proposals of MMRDA ODC area regarding "Participation of Landowners" the Plots/lands were acquired by MMRDA for "a nominal acquisition price of Re. 1/- and the acquired lands were leased to the same owners for a period of 60 years. There was reservation for School as per this proposal.

And whereas, The Oshiwara Municipal School No.1 was in existence since 1966 on the plot under reference on rental basis having 7 classrooms & 01 shed classroom. The said building was declared dilapidated & the school was shifted to other nearby school from 08.08.2002. Subsequently, the office of Assist. Commissioner K/W ward vide their letter dated 31.01.2015 had informed MMRDA (being Planning Authority at that relevant time) not to grant any development permission on the plot under reference till reconstruction of school equivalent to the area of earlier school premises.

And whereas, The U.D. Department in GoM vide Notification No. CMS/TPB-4314/1658/CR- 116/2014/UD-11 dated 18.11.2015 included the area on the west side of S.V. Road from the notified area of Oshiwara District Centre in the area of jurisdiction of the BMC. BMC being the planning Authority for the said area, vide Resolution No. 894, dated 30.08.2016 declared its intention to prepare the Development Plan for the said areas as per Sec 23(1) of MR&TP, Act, 1966. Accordingly, notice to that effect was published on the Official Gazette on 29.09.2016 and survey of Existing Land Use was carried out. As per the E.L.U maps of O.D.C area, the entire plot areas of CTS Nos. 437, 438, 439 & minor portion of approx. 10-15% of CTS 442 shown as SC as Slum/Cluster and remaining major portion approx 85% of CTS 442 shown as (VL) as Vacant Land. From ELU it can be seen that there was no existing school building on the plot u/r.

And whereas, the Draft Development Plan for the notified area under O.D.C.was published in Government Gazette on 18.10.2017 under sec. 26(1) of M.R. & T.P. Act, 1966. As per the said Draft D.P., the plot u/r were reserved as 'RE1.1- Municipal School'.

And whereas, Applicant, A.H. & S.H. Dalwai raised the strong objection to the above proposal of reserving the land for the purpose of RE1.1 Municipal school by bringing out the facts as mentioned in their letter. Moreover, the tenants of the said plot had also objected against the above reservation. Also, MMRDA, the earlier Planning Authority, being the Special Planning Authority in this present case, had submitted an objection letter dated 24.11.2017 to BMC stating that the plot is reserved for the purpose of Residential-cum-shopping and as per the lease deed, lessee is required to rehabilitate the tenants at his cost. It is further stated that the land use proposals of BMC are not as per the land use proposals of MMRDA and hence these proposals are in contradiction to the commitments already given by MMRDA to the plot owners. MMRDA hence, recommended to shift reservation at some other location.

And whereas, The Planning Committee constituted u/s. 28 of M.R. & T.P. Act, 1966, after considering the suggestions and objections to the Draft Development Plan submitted their report alongwith their recommendations to the Corporation on 15.05.2019. The Planning Committee vide Sr. No. 12 of the report recommended to delete the reservation of RE1.1- Municipal School. The Planning Committee has observed that, since the plot was leased by MMRDA and a Building Proposal was submitted to BMC. It is also mentioned in the recommendation of the Planning Committee that as per the notification issued by the Government u/no. CMS/TPB-4313/658/CR- 116/2014/UD-11 dt. 18.11.2015 it is mentioned that lands which are acquired or for which acquisition proceedings is started by MMRDA shall be developed as per the sanctioned planning proposals of MMRDA. Further it is mentioned that the development proposals which have been approved by MMRDA before the date of this notification shall be dealt with the provision of planning proposals and DCRs of ODC. The plot is leased to the applicant for the period of 30 years. Considering the above, Planning Committee has decided that the entire reservation of RE1.1- Municipal School is deleted subject to handing over of built-up area equivalent to existing Municipal School as per the MCGM's terms and conditions. The existing school area is eligible to be rehabilitated as existing tenement with equivalent area as per prevailing norms.

And whereas, The Planning Authority vide the Corporation Resolution No. 164 of dt. 24.06.2018 recommended the above modification including the other modifications for the sanction of State Government on 31.7.2019 u/s. 30 of the M.R.&T.P Act, 1966. The plot u/r was not reserved for RE1.1 Municipal School as per said recommendation.

And whereas, MMRDA vie letter u/no. TCP(P-2)/ODC/Misc/6.214/2607/2017 dated 24.11.2017 had sought clarification from U.D.D regarding the applicability of the provisions mentioned in the notification dated 18.10.2017 for Draft D.P. Further, vide letter u/no. TPB-4319/103/CR 152/2019/ UD-11 dt. 15.02.2020, UDD informed Metropolitan Commissioner, MMRDA that,

"या (cid:550)े(cid:327)ासाठी कलम २६ अ(cid:261)वये (cid:332)िस(cid:460) (cid:332)ा(cid:544)प िवकास योजनेत िवषयांिकत जिमनीवर महानगरपािलका शाळा (RE1.1) चे आर(cid:550)ण दश(cid:593)िवले होते. तथािप, िनयोजन सिमतीने सदर आर(cid:550)ण वगळणेबाबत क(cid:577)लेली िशफारस फ(cid:577)रबदल (M-12) महानगरपािलक(cid:577)ने कायम ठ(cid:578)वून कलम ३०(१) अ(cid:261)वये (cid:332)(cid:274)ताव सादर करताना सदर जिमनीवर आर(cid:550)ण सदर (cid:332)करणातील पूव(cid:593) बांिधलकी िवचारात घेऊन वगळलेले आहे. (cid:257)यामुळ(cid:578) कलम ४६ (cid:332)माणे िवकास (cid:332)(cid:274)ताव िवचारात घेता स(cid:464):(cid:556)(cid:274)थतीत सदर जिमनीवर आर(cid:550)ण ठ(cid:578)वणे यो(cid:244)य होणार नाही. "

However, the Government vide its Notification No. TPB 4318/484/CR-44/2022/UD- 11, dtd. 22.05.2023 has sanctioned the Draft Development Plan, 2034 of three areas i.e. Bandra 'A' Block, Parighkhadi & Oshiwara District Centre (ODC), which are transferred from MMRDA to BMC, as per the provisions u/s. 31(1) of MR&TP Act, 1966. As per the Sanctioned Development Plan ,2034 of Village Oshiwara u/s. 31(1) of MR&TP Act, 1966 the plot bearing CTS No. 437, 438, 439 and 442 of Village Oshiwara are affected by the reservation of RE1.1 (Municipal School).

And therefore, in view of the above & based on the facts and conditions enumerated in the above paragraphs, BMC is of the opinion that, the recommendations made by the Planning Committee and conveyed to Gover ment by Planning Authority u/s. 30 of M.R. & T.P. Act to delete the reservation of RE1.1- Municipal School, were considering the past record related to the plot u/r. and since the then existing area under the leased Municipal School is proposed to be protected in the redevelopment, as mentioned in the representation of the applicant, the reservation of RE1.1 is no longer required which is upheld by the Urban Development Department vide clarification letter dated 15.02.2020 addressed to the Metropolitan Commissioner, MMRDA.

And whereas, as per circular u/no. BMC/ADMN/3 dt. 07.04.2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 (hereinafter referred as 'MMC Act,1888') all the powers of the Corporation are now vested with the Administrator.

And therefore, the proposal for above modification is approved by Administrator (Improvement Committee) vide No. 48 of 12.10.2024 and further approved by Administrator (Corporation) vide resolution No. 733 of 14.10.2024, to take further action to modify DP-2034 of K/W ward by deleting the reservation of RE1.1 (Municipal School) at plot bearing C.T.S. No. 437, 437/1 to 5, 438, 442, 442/1 to 44 and 439, 439/1 to 8 of Village Oshiwara & to invite suggestions/ objections from general public u/s. 37(1) of MRTP Act, 1966 and to approach State Government in Urban Development Dept .for final sanction u/s. 37(2) of MRTP Act, 1966 for the proposed modification in Sanctioned DP, 2034.

And therefore, it is proposed to delete the reservation RE1.1 (Municipal School) at plot bearing C.T.S. No. . 437, 437/1 to 5, 438, 442, 442/1 to 44 and 439, 439/1 to 8 of Village Oshiwara in sanctioned D.P. 2034 of K/west admeasuring approx. 6060 Sq.M., as shown bounded blue and marked with A-B-C-D-E-F-G-H-I-A on proposed modification plan, specifically as described in the table mentioned below:

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1) of Section 37 of the MR & TP Act, 1966; and of all other powers enabling it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by Section 37(1) of the said Act, for information of all persons likely to be affected thereby. BMC is further pleased to inform that any objections/ suggestions in respect of the proposed modification mentioned above may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of

Chief Engineer (Development Plan) Brihanmumbai Municipal Corporation, 5th Floor, Municipal Head Office, Mahapalika Marg, Fort, Mumbai 400 001.

Any objections or suggestions, which may be received within the said period will be dealt with in accordance with the provisions of Section 37(1) of the said Act by the Chief Engineer (Development Plan) BMC. The Suggestions/Objections received after expiry period of one month will not be considered.
