क्रमाक. बीडी/भाूसंपुादन/माुमारी/एसंआरी/ ०३ /२०२४.— भाूविमासंपुादन, पुनवसंन पुनवसंाहत करीताना उवित भारीपुाई विमाळण्या आवि पुारीदर्शवकतेा हक्क अविविनयामा, २०१३ (२०१३ री ३०) माील कलमा ३ च्या खंडी (इ) च्याद्वारीे प्रदान करीण्यात आलेल्या अविकरीा ापुरी करून काढण्यात आलेली अविसंूना, माहसंूल न विभाग क्र. संकीव-११/२०१४/पु.क्र.७७/अ-२, विदनांक १९ जानेारी, २०१५ (यात यापुढे विजा विनदेर्श 'उक्त अविसंूना' असंा करीण्यात आला आहे.) याद्वारीे असंे अविसंूवित केले आहे, उक्त अविविनयामाच्या कलमा ३ च्या खंडी (झेडी अ) माध्याे व्याख्या केलेल्या संावजाविनक प्रयाोजानासंाठी, एखंाद्या विजाल्ह्यातील ५०० हेक्टरी अविक नसंेल इतक्या क्षेत्राकरिरीता जामाीन संपुादन करीण्याच्या संबींात अर्शा विजाल्ह्या अविकारी हा उक्त अविविनयामाच्या प्रयाोजानासंाठी संमाुवित र्शासंन असंलेल्या ठीाे विजाल्ह्याच्या विजाल्हाविकाऱ्यासं यासंोबीत जाोडीलेल्या अनुसंूी एकमाध्याे अविक तपुविर्शलारी वन केलेली जामाीन (यात यापुढे ज्या विनदेर्श 'उक्त जामाीन' असंा करीण्यात आला आहे.) संावजाविनक प्रयाोजानासंाठी (यात यापुढे ज्या विनदेर्श 'उक्त संावजाविनक प्रयाोजान' असंा करीण्यात आला आहे.) आश्याक आहे. अथा विती आश्याकता भासंण्याी र्शक्याता आहे असंे ाटते. ज्याे स्रूपुाे विरी यासंोबीत जाोडीलेल्या अनुसंूी दोनमाध्याे विदलेले आहे आवि म्हून उक्त अविविनयामाच्या कलमा ११ च्या पुोट-कलमा (१) च्या तरीतुदी अन्याे याद्वारीे असंे अविसंूवित करीण्यात याेते की, उक्त जाविमानी उक्त संावजाविनक प्रयाोजानासंाठी आश्याकता भासंण्याी र्शक्याता आहे ;

आवि ज्याअथी, प्रस्तावित भाूविमासंपुादनाच्या अनुषंगाने बीावित व्याक्तंे विस्थापुन करीण्यासं भाग पुडीारी कारीे, यासंोबीत जाोडीलेल्या अनुसंूी तीनमाध्याे विदलेली आहेत.

त्याअथी, असंे घोविषंत करीण्यात याेत आहे की, उक्त अविविनयामाच्या कलमा ११ ा पुोट-कलमा (४) नुसंारी कोतीही व्याक्ती ही अविसंूना प्रविसंद्ध झेाल्याच्या विदनांकापुासंून ते उक्त अविविनयामाच्या प्रकरी ारी खंालील कायावाही पुूव होईल त्या कालाी पुयांत उक्त जाविमानीा अथा वितच्या भागा कोताही व्याहारी करीारी नाही विकंा उक्त जाविमानीरी कोतेही भारी विनमाव करीारी नाही. पुरींतु उक्त जाविमानीच्या अथा वितच्या भागाच्या मालकाने अजाव केल्यारी विजाल्हाविकाऱ्यासं विर्शेषं पुरिरीस्थिस्थती कारीे लेखंी नमाूद करून अर्शा मालकासं उपुरीोक्त तरीतुदीच्या प्रतवनातून संूट देता याेईल :

पुरींतु आखंी असंे की, जारी कोत्याही व्याक्तीने या तरीतुदीे बीुद्धीपुरीस्संरी उल्लंघोन केल्यामाुळे तीला झेालेल्या कोत्याही हानी विकंा क्षेती विजाल्हाविकाऱ्याकडीून भारीपुाई विदली जारी नाही.

(१)भाग एक (को.वि.पु)-१८२–१ २ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, वसंबर ३, २०२४/अग्रहायण १२, शके १९४६ तसंे उक्त अविविनयामाच्या कलमा ११ च्या पुोट-विनयामा (५) नुसंारी विजाल्हाविकारी भाूविमासंपुादन पुनवसंन पुनवसंाहत करीताना उवित भारीपुाई विमाळण्या आवि पुारीदर्शवकतेा हक्क माहारीाष्ट्र विनयामा १४ (यापुढे ज्या विनदेर्श 'उक्त विनयामा' असंा करीण्यात आला आहे.) यांच्या विनयामा १० च्या उपु-विनयामा (३) द्वारीे विविहत केल्याप्रमाे भाूविमा अविभालेखंाच्या अद्यातीकरीाे कामा हाती घोेारी असंल्याे पुूव करीारी असंल्याे देखंील घोविषंत करीण्यात याेत आहे.

आवि ज्याअथी, उक्त अविविनयामाच्या कलमा ३ ा खंडी (छ) संमाुवित र्शासंन असंलेल्या विजाल्हाविकरी, उक्त अविविनयामा खंालील विजाल्हाविकाऱ्याी कायाव पुारी पुाडीण्यासंाठी उपु विभागीया अविकारी, विभांडी, विभाग विभांडी यांसं पुदविनदेविर्शत केले आहे.

माौजाे कोठीारीे, ता. र्शहापुूरी, विजा. ठीाे, क्षेत्रा २.८७.०० हे.आरी. जामाीन भातसंा प्रकल्पुांतगवत माुमारी रीासंाठी संपुाविदत होत आहे. माुमारी रीाच्या बीांकामामाुळे माौजाे कोठीारीे, या गातील १ घोरीातील ४ लोकसंख्या विस्थाविपुत होत आहे. त्यांे पुनवसंनासंाठी माौजाे खंरीे याेथील अनुसंूी ३ माध्याे नमाूद संे क्रमांकाच्या जाविमानीमाध्याे करीण्यांत याेारी आहे.

टीप.— उक्त जाविमानीच्या नकार्शाे उपुविभागीया अविकारी, विभांडी विनरिरीक्षे करीता याेऊ र्शकते.

NOTIFICATION

No.BD/Bhusampadan/Mumari/SR-03 /2024.— Whereas, the Government of Maharashtra vide Government Notification, Revenue and Forest Department, No. MIS-11/2014/C.R.77/A-2, dated the 19th January 2015 (hereinafter referred to as "the said notification" issued in exercise of the powers conferred by the proviso to clause (e) of section 3 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), has notified that in relation to acquisition of land in respect of a public purpose, as defined in clause (z a) of section 3 of the said Act, in a District for an area not exceeding 500 hectors, the Collector of such District shall be deemed to be the appropriate Government, for the purpose of the said act; And whereas, it appears to the Sub Divisional Officer, Bhiwandi Division, Bhiwandi, Thane District Being the appropriate Government in view of the said notification, that land more par- ticularly described in Scheduled I appended hereto (hereinafter referred to as "the said land"), is needed or likely to be needed for the public purpose, (a statement of the nature thereof is con- tained in schedule II appended hereto) and therefore, it is hereby notified under the provisions of sub-section (1) of section 11 of the said Act, that the land is likely to be needed for the said public purpose;

And whereas, the reasons necessitating the displacement of the affected persons in view of the purpose land acquisition are contained in Schedule III appended hereto (if there as any displace- ment then state the reasons in this Schedule);

And whereas, the particulars of an Administrator appointed for the purpose of rehabilitation and resettlement under sub-section (1) of section 43 contained in Schedule V appended hereto (if required to be appointed then state the particulars in this Schedule).

Now therefore, it is declared that as per sub-section (4) of section 11 of the said Act, no person shall make any transaction of land or part thereof or create any encumbrances on said land from the date of publication of this Notification till such time as the proceeding under Chapter IV of the said Act are completed:

Provided that, the Sub Divisional Officer may, on the application made by the owner of the said land or part thereof exempt in special circumstances to be recorded in writing, such owner from the operation of the above provision;

It is further declared that according to sub-section (5) of section 11 of the said Act, the Sub Divisional Officer is going to undertake and complete the exercise of updating of land records as prescribed by sub-rule (3) of rule 10 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Maharashtra) Rules, 2014 (hereinafter referred as the said Rules).

And whereas, under clause (g) of section 3 of the said Act, the Collector being the Appropri- ate Government Please to designate Sub-Divisional Officer, Bhiwandi Division, Dist. Thane (name and address of the officer to filled in before issue) to perform the function of a Collector under the said Act.

Details of Rehabilitation and Resettlement Scheme Total 2.87.00 H.R. Land will be acquired for Mumari Project from village Kothare, Tal. Shahapur, Dist. Thane. Due to construct of Mumari Dam, 1 House and 4 population from village Kothare will displace. Their Rehabilitation will be done in the Village Khaire mentioned is schedule III Survey Numbers.

N.B.— A plan of the said land can be inspected at the office of Sub Divisional Officer, Bhiwandi Division, Bhiwandi.
