आदेश
क्रमांक-टिपीएस-२२२२-३४०-प्र.क्र. २५-२०२२-नवि-९.---
ज्याअर्थी, चंद्रपूर महानगरपालिकेच्या (यापुढे "उक्त नियोजन प्राधिकरण" असे संबोधले आहे) वाढीव क्षेत्राची विकास योजना, महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (१९६६ चा महा.३७ वा) (यापुढे "उक्त अधिनियम" असे संबोधले आहे) चे कलम ३१ (१) अन्वये शासन, नगर विकास विभागं अधिसूचना क्रमांक टिपीएस-२२९४-१३१५-प्र.क्र.२५३-९६-नवि- ९, दिनांक ०२ जून, १९९७ अन्वये मंजूर झाली असून ती दिनांक १५ ऑगस्ट, १९९७ पासून अंमलात आली आहे (यापुढे "उक्त विकास योजना" असे संबोधले आहे);
आणि ज्याअर्थी, उक्त विकास योजनेमध्ये, मौजे वडगांव येथील सव्र्हे क्रमांक १२३/१ड पैकी ०.१३ हेक्टर ही जमीन (यापुढे "उक्त जागा" असे संबोधिले आहे) आरक्षण क्रमांक २६ "दवाखाना व प्रसुतीगृह" करीता (यापुढे "उक्त आरक्षण" असे संबोधिले आहे) आरक्षित आहे. उक्त आरक्षणाचे समुचित प्राधिकरण चंद्रपूर महानगरपालिका आहे (यापुढे "उक्त समुचित प्राधिकरण" असे संबोधिले आहे);
आणि ज्याअर्थी, उक्त जागेच्या मालकांनी उक्त अधिनियमाचे कलम १२७ चे उप कलम (१) नुसार, नियोजन प्राधिकरण यांचेवर दिनांक २४ फेब्रुवारी, २०१४ रोजी सूचना (यापुढे "उक्त सूचना" असे संबोधिले आहे) बजावलेली आहे;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम १२७ चे उप कलम (२) नुसार, उक्त विकास योजनेमधील उक्त आरक्षणापैकी, उक्त जागेपुरते आरक्षण व्यपगत झाल्याबाबत आदेश निर्गमित करणे आवश्यक आहे; ना. एक-अ-१ (१७०४).
(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ नागपूर विभागीय पुरवणी, डिसेंबर १२, २०२४/अग्रहायण २१, शके १९४६ आता, त्याअर्थी उक्त अधिनियमाचे कलम १२७ चे उप कलम (२) नुसार प्राप्त अधिकारात राज्य शासन, उक्त विकास योजनेमधील उक्त आरक्षणामधील उक्त जागेपुरते आरक्षण व्यपगत झाल्याचे अधिसूचित करीत आहे व अशा प्रकारे मुक्त झालेली जागा उक्त विकास योजनेतील लगतच्या अनुज्ञेय भूवापरा प्रमाणे जमीन मालकास विकासाकरीता उपलब्ध होईल.

(१) प्रस्तुत आदेशान्वये, आरक्षणातून व्यपगत झालेली जागा दर्शविणाया विकास योजना भाग नकाशाची प्रत आयुक्त, चंद्रपूर महानगरपालिका, चंद्रपूर यांच्या कार्यालयात कार्यालयीन वेळेत नागरीकांच्या अवलोकनार्थ एक महिन्यापयर्ंत ठेवण्यात आली आहे.

NOTIFICATION
The MaharashTra regional and Town Planning acT, 1966
No.TPS-2222-340-CR-25-2022-UD-9.–
Whereas, Development Plan of Additional area of Chandrapur Municipal Corporation (here- inafter referred to as "the said Planning Authority")has been sanctioned by the Government vide Urban Development Department's Notification No.TPS-2294-1315-CR-253-96-UD-9, dated the 2nd June, 1997 and has come into force with effect from the 15th August, 1997 (hereinafter referred to as "the said Development Plan") under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act"); And whereas, in the said Development Plan, the land bearing Survey No.123/1D area admea- suring about 0.13 hector of Mouja Wadgaon (hereinafter referred to as "the said Land") is reserved for "Site No.26-Dispensary & Maternity Home" (hereinafter referred to as "the said Reservation"). The appropriate authority for the said Reservation is the Chandrapur Municipal Corporation (here- inafter referred to as "the said Appropriate Authority");
And whereas, the owner of the said Land had issued a notice dated 24th February, 2014 under section 127(1) of the said Act (hereinafter referred to as "the said Notice") to the said Planning authority;
And whereas, it is accordingly expedient to notify that the said Reservation on the said Land, has lapsed under sub section (2) of section 127 of the said Act, from the said Development Plan;
३ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ नागपूर विभागीय पुरवणी, डिसेंबर १२, २०२४/अग्रहायण २१, शके १९४६Now, therefore, in exercise of the powers conferred by sub section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby, notifies that, the said Reservation on the said Land stands lapsed and the land so released shall be available to the landowner for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan;
