आणि ज्याअर्थी, उक्त विकास योजनेत, मूल-चंद्रपूर-नागपूर ६०.०० मी. रुंदीचा व सुमारे ५.०० कि.मी. लांबीचा विकास योजना रस्ता मौजा वडगांव येथील सव्र्हे क्र. १६, १७, ४३, ४४, ४५, ४६, ४८, ४९, ५०, ५२, ५३, ५५ मौजा देवई गोविंदपुर रैय्यतवारी येथील सव्र्हे क्र. २०, २२, २३, ३४/१, ३०, ३२, ३१, ४१/१, ४६, ४५, ४७, ७६, ८२, ८३, ९०/१, ९१, ९२, ७९, ७८, ६९, ६८/३, ६७/३, १०७/१छ, १०७/१च, १०७/१ज, १०७/४६, १०७/४५, १०७/४४, १०७/४३, १०७/४२ व मौजा देवई गोविंदपूर तुकूम येथील सव्र्हे क्र. १४, १५, १६, १७ या जागेतून प्रस्तावित आहे (यापुढे "उक्त विकास योजना प्रस्ताव" असे संबोधले आहे) ;
आणि ज्याअर्थी, चंद्रपूर महानगरपालिकेने नियोजन प्राधिकरण या नात्याने (यापुढे " उक्त नियोजन प्राधिकरण " असे संबोधले आहे) त्यांच्या सर्वसाधारण सभेचा ठराव क्र. ६८, दिनांक २९ डिसेंबर, २०१८ नुसार, उक्त विकास योजना प्रस्तावाखालील रस्त्याची रुंदी ६०.०० मी. रुंदीचा व सुमारे ५.०० कि. मी. लांबीचा विकास योजना रस्ता वगळून रस्त्याखालील जागा रहिवास विभागात समाविष्ट करण्याचे ठरवून, त्याअनुषंगाने, उक्त अधिनियमाचे कलम ३७ चे उप कलम (१) मध्ये नमूद वैधानिक कार्यवाही पूर्ण करुन फेरबदल प्रस्ताव अंतिम मंजुरीसाठी शासनास सादर केलेला आहे (यापुढे " उक्त फेरबदल " असे संबोधले आहे) ;

२ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, डिसेंबर १२-१८, २०२४/अग्रहायण २१-२७, शके १९४६आणि ज्याअर्थी, आवश्यक त्या चौकशीनंतर व संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर उक्त प्रस्तावाखालील फेरबदल हा खालीलप्रमाणे दर्शविल्यानुसार काही बदलांसह मान्य करावा, असे राज्य शासनाचे मत झाले आहे;

२ B-C ६०.०० मी. ६०.०० मी. रुंदीचा रस्ता वगळून रस्त्याखालील वगळलेले क्षेत्र कृषी विभागात समाविष्ट
करण्याचे प्रस्तावित करण्यात येत आहे.
३ D-E ६०.०० मी. ६०.०० मी. रुंदीचा रस्ता वगळून रस्त्याखालील वगळलेले क्षेत्र लगतच्या वापरामध्ये
समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
४ E-F ६०.०० मी. ६०.०० मी. रस्ता वगळून रस्त्याखालील वगळलेले क्षेत्र रहिवास विभागात समाविष्ट करण्याचे
प्रस्तावित करण्यात येत आहे.
५ G-H ६०.०० मी. ६०.०० मी. ऐवजी १८.०० मी. रस्त्याची रुंदी उत्तर बाजुकडून दर्शवून रस्त्याखालील वगळलेले क्षेत्र लगतच्या रहिवास विभाग/वापरामध्ये समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
६ H-I ६०.०० मी. ६०.०० मी. ऐवजी २४.०० मी. रस्त्याची रुंदी कायम ठेवून रस्त्याखालील वगळलेले क्षेत्र
लगतच्या वापरामध्ये समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
आणि ज्याअर्थी, आता, उक्त मंजूर फेरबदल प्रस्तावाखालील एकूण क्षेत्रापैकी मौजा देवई गोविंदपूर रैयतवारी येथील भूमापन क्र. १०७/४३/ब च्या जमीन मालकानेच ४१०० चौ. मी. क्षेत्रापैकी बाधित ३४०० चौ. मी. क्षेत्रासाठी सन २०२४-२५ या वर्षातील बाजारमूल्यदर तक्त्यानुसार येणाया दराच्या ५% दराने येणाया अधिमूल्य रक्कमेपैकी शासनास देय असलेली अधिमूल्याची ५० % रक्कम रुपये ५,८५,६५०/- सहायक संचालक, नगर रचना, चंद्रपूर शाखा, चंद्रपूर यांचेकडील लेखाशिर्षामध्ये दिनांक २३ जानेवारी, २०२४ रोजी जमा केलेली आहे आणि नियोजन प्राधिकरणास देय असलेली ५० % अधिमूल्याची रक्कम रुपये ५,८५,६५०/- आयुक्त, चंद्रपूर महानगरपालिका, चंद्रपूर, जि. चंद्रपूर यांचेकडे दिनांक १५ जानेवारी, २०२४ रोजी जमा केलेली आहे;
आता, त्याअर्थी, उक्त अधिनियमाचे कलम ३७ (२) अन्वये व त्या अनुषंगाने असलेल्या इतर अधिकारांचा वापर करुन उक्त विकास योजनेतील, उक्त प्रस्तावाखालील उक्त फेरबदलास शासन पुढील प्रमाणे मान्यता देत आहे. आणि त्यासाठी उक्त विकास योजना मंजुरीची अधिसूचना दिनांक. ०२ जून, १९९७ सुधारित करण्यात येत आहे;
उक्त दिनांक ०२ जून, १९९७ रोजीच्या विकास योजना मंजुरीच्या अधिसूचनेच्या फेरबदल सुचीतील शेवटच्या नोंदीनंतर पुढील नव्या नोंदीचा समावेश करण्यात येत आहे.----

" विकास योजना चंद्रपूर (वाढीव क्षेत्र) यामधील मौजा देवई गोविंदपूर रैय्यतवारी येथील भूमापन क्र. १०७/४३/ब मधील विकास योजना रस्ता, सोबतच्या भाग नकाशात दर्शविल्यानुसार ६०.०० मी. ऐवजी १८.०० मी. रूंदीचा रस्ता उत्तर बाजुकडून कायम ठेवून जमीन मालकाचे ४१०० चौ. मी. क्षेत्रापैकी रस्त्याने बाधित ३४०० चौ. मी. रहिवास विभागामध्ये समाविष्ट करण्यात येत आहे."
उपरोक्त मंजूर फेरबदल दर्शविणाया विकास योजना भाग नकाशाची प्रत आयुक्त, चंद्रपूर महानगरपालिका, चंद्रपूर, जिल्हा चंद्रपूर यांच्या कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ एक महिन्याच्या कालावधीसाठी उपलब्ध राहील.
सदर अधिसूचना विभागाच्या www.maharashtra.gov.in या संकेतस्थळावर देखील उपलब्ध राहील.

NOTIFICATION
No. TPS-2220-C.R.-186-2020-UD-9.—
Whereas, Development Plan of Additional area of Chandrapur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2294-1315-CR-253-96-UD-9, dated 2nd June, 1997and has come into force with effect from the 15th August, 1997 (hereinafter referred to as "the said Development Plan") under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing Survey No. 16, 17, 43, 44, 45, 46, 48, 49, 50, 52, 53, 55 of Mouje Wadgaon, land bearing Survey No. 20, 22, 23, 34/1, 30, 32, 31, 41/1, 46, 45, 47, 76, 82, 83, 90/1, 91, 92, 79, 78, 69, 68/3, 67/3, 107/1Chh, 107/1Ch, 107/1J, 107/46, 107/45, 107/44, 107/43, 107/42 of Mouje Dewai Govindpur Raiyyatwari & land bearing Survey No. 14, 15, 16, 17 of Mouje Dewai Govindpur Tukum is reserved for Mul-Chandrapur- Nagpur 60.00 Mt. wide and 5.00 K.Mt. long Development Plan road (hereinafter referred to as "the said Development Plan Proposal");
And whereas, the Chandrapur Municipal Corporation being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution No. 68, the dated 29th December, 2018, has resolved to modify the said Development Plan proposal by deleting the Development Plan Road of 60.00 m. width and about 5.00 km. long and to include the land in the Residential Zone deleted from the said road and accordingly submitted to the Government, for its final sanction, a modification proposal as per the provisions of sub section (1) of section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed modification, under the said proposal should be sanctioned as detailed below with some modifications;

And whereas, in the above sanctioned modification only land owner of Survey No. 107/43/B of Mouje Dewai Govindpur Raiyyatwari admeasuring area of 3400 Sq. Mt. out of the total land admeasuring area 4100 Sq. Mt. under the modification have deposited Rs. 5,85,650/- towards the 50% Government share of 5% premium amount as per the value४ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, डिसेंबर १२-१८, २०२४/अग्रहायण २१-२७, शके १९४६ of the land as prescribed in the Annual Statement of Rates (ASR) for the year 2024-2025 in the Government Treasury on 23rd January, 2024 through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs. 5,85,650/- payable to the Planning Authority has been deposited with the Commissioner, Chandrapur Municipal Corporation, Chandrapur on 15th January 2024;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 2nd June, 1997 as follows.-
In the Schedule of Modifications appended to the Notification dated 02nd June, 1997 sanctioning the said Development Plan,the following new entry shall be added after the last entry.—
ENTRY
"The width of Development Plan Road under a land bearing Survey No. 107/43/B of Mouje Dewai Govindpur Raiyyatwari is kept 18.00 Mt. from North side instead of 60.00 Mt. in Development Plan of Chandrapur Town (Extended area) as shown on plan and the area of land owner, admeasuring 3400 Sq. Mt. under Development Plan Road out of total area 4100 Sq. Mt. is included in Residential Zone."
A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Commissioner, Chandrapur Municipal Corporation, Chandrapur, during office hours on all working days for a period of one month.
This Notification shall also be available on the Government web site-www.maharashtra.gov.in

महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, डिसेंबर १२-१८, २०२४/अग्रहायण २१-२७, शके १९४६ ५महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ चे कलम ३७ अन्वये असे उद्घोषित करण्यात येते की, सदरहू किरकोळ स्वरुपाच्या बदलासंबंधी ज्या कोणाला काही हरकती अगर सूचना असतील तर त्यांनी ही अधिसूचना प्रसिद्ध झाल्यापासून एक महिन्याचे आत त्या आयुक्त, चंद्रपूर शहर महानगरपालिका, चंद्रपूर यांचेकडे लेखी स्वरुपात सादर कराव्यात. अशा सूचना व हरकतींवर वैधानिक कार्यवाही पार पाडून सदरहू फेरबदलाचा प्रस्ताव शासनास गुणवत्तेनुसार निर्णय घेण्यास सादर करण्यात येईल.

Whereas, the Development Plan of Chandrapur Town (Extended Area) is sanctioned by the Urban Development Department, Govt. of Maharashtra vide Resolution No. TPS-2294-1315-CR-253-96-UD-9, dated 2nd June, 1997 which came into force from 15th August, 1997. Also, Commissioner, Chandrapur City Municipal Corporation, Chandrapur has been appointed as on the Administrative Post of Chandrapur Municipal Corporation by the Urban Development Depart- ment, Govt. of Maharashtra vide Order No. MCO-2020-C.R. 71 (Part-2)-UD-14, Dated 28th April, 2022.
And now, Municipal Corporation of the City of Chandrapur has proposed to make Minor Modification in the aforesaid Final Development Plan vide Government Resolution No. 171, dated 26th November, 2024 under section 37 of the Maharashtra Regional and Town Planning Act, 1966 as follows.—

Now, in persuance of section 37 of Maharashtra Regional and Town Planning Act, 1966 it is hereby notified that any person having any suggestion or objection to the proposed modification as mentioned above shall communicate the same in writing to the undersigned within one month from the date of publication of this notification in the official Gazette. The objections or suggestions, if any received within the above mentioned period of one month will be consid- ered for compliance of judicial procedure by the Commissioner, Municipal Corporation of the City of Chandrapur while submitting the proposal of Modification to the Govt. for decision on merit basis.
