ज्याअर्थी, चंद्रपूर शहराच्या वाढीव क्षेत्राची विकास योजना महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ ( १९६६ चा महा. ३७ वा) (यापुढे " उक्त अधिनियम" असे संबोधले आहे) चे कलम ३१ (१) अन्वये शासन नगर विकास अधिसूचना क्र. टिपीएस-२२९४-१३१५-प्र. क्र. २५३-९६-नवि-९, दि. २ जून, १९९७ अन्वये मंजूर झाली असून ती दि. १५ ऑगस्ट १९९७ पासून अंमलात आलेली आहे. (यापुढे " उक्त विकास योजना" असे संबोधले आहे);
आणि ज्याअर्थी, उक्त विकास योजनेत, मूल-चंद्रपुर-नागपूर ६०.०० मी. रुंदीचा व सुमारे ५.०० कि. मी. लांबीचा विकास योजना रस्ता मौजा वडगांव येथील सव्र्हे क्र. १६, १७, ४३, ४४, ४५, ४६, ४८, ४९, ५०, ५२, ५३, ५५ मौजा देवई गोंविदपुर रैय्यतवारी येथील सव्र्हे क्र. २०, २२, २३, ३४/१, ३०, ३२, ३१, ४१/१, ४६, ४५, ४७, ७६, ८२, ८३, ९०/१, ९१, ९२, ७९, ७८, ६९, ६८/३, ६७/३, १०७/१छ, १०७/१च, १०७/१ज, १०७/४६, १०७/४५, १०७/४४, १०७/४३, १०७/४२ व मौजा देवई गोंविंदपूर तुकूम येथील सव्र्हे क्र. १४, १५, १६ १७ या जागेतून प्रस्तावित आहे (यापुढे " उक्त विकास योजना प्रस्ताव" असे संबोधले आहे) प्रस्तावित आहे;
आणि ज्याअर्थी, चंद्रपूर महानगरपालिकेने, नियोजन प्राधिकरण या नात्याने (यापुढे " उक्त नियोजन प्राधिकरण" असे संबोधले आहे) त्यांच्या सर्वसाधारण सभेचा ठराव क्र. ६८, दि. २९ डिसेंबर २०१८ नुसार उक्त विकास योजना प्रस्तावाखालील रस्त्याची रुंदी ६०.०० मी. रुंदीचा व सुमारे ५.०० कि. मी. लांबीचा विकास योजना रस्ता वगळून रस्त्याखालील जागा रहिवास विभागात समाविष्ट करण्याचे ठरवून, त्याअनुषंगाने, उक्त अधिनियमाचे कलम ३७ चे उप-कलम (१) मध्ये नमुद वैधानिक कार्यवाही पूर्ण करून फेरबदल प्रस्ताव अंतिम मंजुरीसाठी शासनास सादर केलेला आहे (यापुढे " उक्त प्रस्तावित फेरबदल" असे संबोधले आहे) ;
आणि ज्याअर्थी, आवश्यक त्या चौकशीनंतर व संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर उक्त प्रस्तावित फेरबदल हा खालीलप्रमाणे दर्शविल्यानुसार काही बदलासह मान्य करावा, असे राज्य शासनाचे मत झाले आहे;

१. A-B ६०.०० मी. ६०.०० मी. ऐवजी २४.०० मी. रस्त्याची रुंदी कायम ठेवून रस्त्याखालील वगळलेले
क्षेत्र कृषी विभागात समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
२. B-C ६०.०० मी. ६०.०० मी. रुंदीचा रस्ता वगळून रस्त्याखालील वगळलेले क्षेत्र कृषी विभागात
समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
३. D-E ६०.०० मी. ६०.०० मी. रुंदीचा रस्ता वगळून रस्त्याखालील वगळलेले क्षेत्र लगतच्या वापरामध्ये
समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
४. E-F ६०.०० मी. ६०.०० मी. रुंदीचा रस्ता वगळून रस्त्याखालील वगळलेले क्षेत्र रहिवास विभागात
समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
५. G-H ६०.०० मी. ६०.०० मी. ऐवजी १८.०० मी रस्त्याची रुंदी उत्तर बाजुकडून दर्शवून रस्त्याखालील वगळलेले क्षेत्र लगतच्या रहिवास विभाग/वापरामध्ये समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
६. H-I ६०.०० मी. ६०.०० मी. ऐवजी २४.०० मी. रस्त्याची रुंदी कायम ठेवून रस्त्याखालील वगळलेले
क्षेत्र लगतच्या वापरामध्ये समाविष्ट करण्याचे प्रस्तावित करण्यात येत आहे.
आणि ज्याअर्थी, आता मंजूर फेरबदल प्रस्तावाखालील एकूण क्षेत्रापैकी मौजा देवई गोंविंदपूर रैयतवारी येथील केवळ भूमापन क्र. १०७-४२-अ-१ च्या जमीन मालकानेच ७६०० चौ. मी. क्षेत्रापैकी बाधित ६५४४.१३ चौ. मी. क्षेत्रासाठी सन २०२४-२५ या वर्षातील बाजारमूल्यदर तक्त्यानुसार येणाया दराच्या ५ % दराने येणाया अधिमूल्य रक्कमेपैकी शासनास देय असलेली अधिमूल्याची ५० % रक्कम रुपये १,८१,८७४ सहायक संचालक, नगर रचना, चंद्रपूर शाखा, चंद्रपूर यांचेकडील लेखाशिर्षामध्ये दिनांक १४ ऑगस्ट २०२४ रोजी जमा केलेली आहे. आणि नियोजन प्राधिकरणास देय असलेली ५० % अधिमूल्याची रक्कम रुपये १,८१,८७४ आयुक्त, चंद्रपूर महानगरपालिका, चंद्रपूर, जि. चंद्रपूर यांचेकडे दि. ३१ जुलै २०२४ रोजी जमा केलेली आहे;
त्याअर्थी, आता, उक्त अधिनियमाचे कलम ३७(२) अन्वये व त्या अनुषंगाने असलेल्या इतर अधिकारांचा वापर करून उक्त विकास योजनेतील, उक्त प्रस्तावाखालील उक्त फेरबदलास शासन पुढील प्रमाणे मान्यता देत आहे आणि त्यासाठी उक्त विकास योजना मंजुरीची अधिसूचना दिनांक २ जून, १९९७ सुधारित करण्यात येत आहे.
उक्त दि. २ जून १९९७ रोजीच्या विकास योजना मंजुरीच्या अधिसूचनेच्या फेरबदल सूचितील शेवटच्या नोंदीनंतर पुढील नव्या नोंदीचा समावेश करण्यात येत आहे.----

" विकास योजना चंद्रपूर (वाढीव क्षेत्र) यामधील मौजा देवई गोविंदपूर रैय्यतवारी येथील भूमापन क्र १०७-४२-अ-१ मधील विकास योजना रस्ता, सोबतच्या विकास योजना भाग नकाशात दर्शविल्यानुसार ६०.०० मी. ऐवजी १८.०० मी. रुंदीचा रस्ता उत्तर बाजूकडून कायम ठेवून जमीन मालकाचे ७६०० चौ. मी. क्षेत्रापैकी रस्त्याने बाधित ६५४४.१३ चौ. मी. रहिवास विभागामध्ये समाविष्ट करण्यात येत आहे."
उपरोक्त मंजूर फेरबदल दर्शविणाया विकास योजना भाग नकाशाची प्रत आयुक्त, चंद्रपूर महानगरपालिका, चंद्रपूर यांच्या कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत नागरीकांच्या अवलोकनार्थ एक महिन्याच्या कालावधीसाठी उपलब्ध राहील.
सदर अधिसूचना शासनाच्या www.maharashtra.gov.in या संकेतस्थळावर देखील उपलब्ध राहील.

THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT. 1966.—
NOTIFICATION
No.TPS-2220-C.R.186-2020-UD-9 :—
Whereas, Development Plan of Additional area of Chandrapur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2294-1315-CR-253-96-UD-9, dated the 2nd June, 1997 and has come into force with effect from the 15th August, 1997 (hereinafter referred to as "the said Development Plan") under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing Survey Nos. 16, 17, 43, 44, 45, 46, 48, 49, 50, 52, 53, 55 of Mouje Wadgaon, land bearing Survey Nos. 20, 22, 23, 34/1, 30, 32, 31, 41/1, 46, 45, 47, 76, 82, 83, 90/1, 91, 92, 79, 78, 69, 68/3, 67/3, 107/1Chh, 107/1Ch, 107/1J, 107/46, 107/45, 107/44, 107/43, 107/42 of Mouje Dewai Govindpur Raiyyatwari & land bearing Survey Nos. 14, 15, 16, 17 of Mouje Dewai Govindpur Tukum is reserved for Mul-Chandrapur-Nagpur 60.00 Mt. wide and 5.00 K. Mt. long Development Plan road (hereinafter referred to as "the said Development Plan Proposal");
And whereas, the Chandrapur Municipal Corporation being the Planning Authority (hereinafter re- ferred to as "the said Planning Authority") vide its General Body Resolution No. 68, dated the 29th Decem- ber 2018, has resolved to modify the said Development Plan proposal by deleting the Development Plan road of 60.00 m. width and about 5.00 km. long and to include the land so released in Residential Zone and accordingly submitted a modification proposal to the Government, for its final sanction, as per the provisions of sub-section (1) of section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that, the Proposed Modification under the said Development Plan Proposal should be sanctioned as detailed below with some modifications;

And whereas, in the above sanctioned modification only land owner of Survey No. 107-42-A-1 of Mouje Dewai Govindpur Raiyyatwari admeasuring area of 6544.13 Sq. Mt. out of the total land admeasur- ing area 7600 Sq. Mt. under the modification, have deposited Rs. 1,81,874/- towards the 50% Government share of 5% premium amount as per the value of the land as prescribed in the Annual Statement of Rates (ASR) for the year 2024-2025 in the Government Treasury on 14.08.2024 through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs. 1,81,874/- payable to the Planning Authority has been deposited with the Commissioner, Chandrapur Municipal Corporation, Chandrapur on 31st July, 2024;
Now, therefore, in exercise of the powers conferred on it under sub section (2) of section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 2nd June, 1997 as follows.
"In the Schedule of Modifications appended to the Notification dated the 2nd June, 1997 sanctioning the said Development Plan, the following new entry shall be added after the last entry".-
ENTRY
"The width of Development Plan Road under a land bearing Survey No.107-42-A-1 of Mouje Dewai Govindpur Raiyyatwari, is kept 18.00 Mt. from North side instead of 60.00 Mt. in Development Plan of Chandrapur Town (Extended area) as shown on the plan and the area of land owner, admeasuring 6544.13 Sq. Mt. under the Development Plan Road out of total area 7600 Sq.Mt. is included in Residential Zone." A copy of this Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Commissioner, Chandrapur Municipal Corporation, Chandrapur, during office hours on all working days for a period of one month.
