क्रमुंांक मुंहारेरा/फिवफिनयमुं/२०२५.—स्थावर संपूा (फिवफिनयमुं व फिवकास) अफिफिनयमुं, २०१६ च्या कलॉमुं ८५ मुंीलॉ उपू-कलॉमुं (१) व उपू-कलॉमुं (२) चाे खंड (i) अंतगत प्रान केलॉेल्या अफिकाराचा तसेचा याबांाबांतीत समुंथा करणाऱ्या सव अफिकारांचा वापूर करून मुंहाराष्ट्र स्थावर संपूा फिनयामुंक प्राफिकरणा हाे मुंहाराष्ट्र स्थावर संपूा फिनयामुंक प्राफिकरणा (सवसारणा) फिवफिनयमुं, २०१७ यामुंध्ये संारणा करण्यासाठी खंालॉीलॉ फिवफिनयमुं करीत आहाेत :—

१. शीर्षक व प्ारंभ

(१) या फिवफिनयमुंांना मुंहाराष्ट्र स्थावर संपूा फिनयामुंक प्राफिकरणा (सवसारणा) (संारणा) फिवफिनयमुं, २०२५ असे संबांोलॉे जाईलॉ.

(२) हाे फिवफिनयमुं शासकीये राजपत्रात प्रफिसद्ध झाल्यापूासून अंमुंलॉात येतीलॉ.

२. मुख्ये किंवकिंनयेम : हाे फिवफिनयमुं मुंहाराष्ट्र स्थावर संपूा फिनयामुंक प्राफिकरणा (सवसारणा) फिवफिनयमुं, २०१७ (ज्यालॉा यापूंढे मुंख्य फिवफिनयमुं संबांोलॉे आहाे) यामुंध्ये संारणा करतीलॉ.

३. मुंख्य फिवफिनयमुंांच्या फिनयमुंन ३ मुंीलॉ, "स्थावर संपूा प्रकल्पूाचाी प्रत्येक इमुंारत / फिवंग पूणा केल्यावर प्रकल्पू वास्तंशास्त्रज्ञ यांचाे प्रमुंाणापूत्र नमुंूना ४ मुंध्ये असेलॉ " हाे वाक्य वगळण्यात येईलॉ.

४. मुख्ये किंवकिंनयेम ३ब ऐवजी खालील किंवकिंनयेम दाखाल करण्येात येतील

"३बां. रेखंांफिकत फिवकास (प्लॉटेड डेव्हालॉपूमुंट) प्रकल्पूांसाठी, ॉमुं १, २, २अ आफिणा ३ मुंीलॉ क्त संबांफित बांाबांी लॉागू असतीलॉ. रेखंांफिकत फिवकास, (प्लॉटेड डेव्हालॉपूमुंट) प्रकल्पूांसाठी फिनश्चिचात केलॉेल्या नमुंना करारनामुंा मुंहाराष्ट्र स्थावर संपूा (फिवफिनयमुं आफिणा फिवकास) (स्थावर संपूा प्रकल्पूांचाी नंणाी, स्थावर संपूा एजांटचाी नंणाी, व्याजा र आफिणा संकेतस्थाळावर त्याचाे प्रकटन) फिवफिनयमुं, २०१७ च्या फिनयमुं १० अंतगत पूरिरफिशाष्ट – बां मुंध्ये ेण्यात आलॉेलॉा आहाे."

५. मुख्ये किंवकिंनयेम ३ब नंतर खालील किंवकिंनयेम दाखाल करण्येात येतील,

"३क. रेखांकिंकत किंवकास प्कल्पांबाबत (प्लॉटेडा डाेव्हलपमंटे) प्कल्प प्ारंभ प्माणपत्र आकिंण/किंकंवा

ताबा प्माणपत्र/पुणषत्व दाखाला :

जाेव्हा सक्षमुं प्राफिकरणा/फिनयोजान प्राफिकरणा संबांफित क्षेत्रातीलॉ फिवकास फिनयंत्रणा फिवफिनयमुं (Development Control Regulations) प्रारंभा प्रमुंाणापूत्र फिकंवा ताबांा प्रमुंाणापूत्र/ पूंणात्व ाखंलॉा याचाी व्याख्या करत नाहाीत, तेव्हा त्याचा अथा पूंढेीलॉप्रमुंाणाे घेण्यात येईलॉ :

(१) यंडीसीपूीआरच्या नमुंना डी-३ प्रमुंाणाे जामुंीन फिवभागणाीसाठी ेण्यात आलॉेलॉी अंफितमुं मुंजांरी फिकंवा अकृषीक पूरवानगीसहा (जाेथाे आवयक आहाे तेथाे) अशा स्वरुपूाचाी ेण्यात आलॉेलॉी मुंजांरी यास रेखंांकीत फिवकास प्रकल्पूाचाे (प्लॉटेड डेव्हालॉपूमुंट) प्रारंभा प्रमुंाणापूत्र गृहाीत रलॉे जाईलॉ.

(२) (i) संबांफित सक्षमुं प्राफिकरणा/फिनयोजान प्राफिकरणा यांचाे रेखंांफिकत प्रकल्पूांमुंीलॉ प्रवतक आफिणा/फिकंवा पूरवानारक अफिभायंता/संरचाना अफिभायंता/पूयवेक्षक यांना तसे कळफिवणारे प्रमुंाणापूत्र; फिकंवा

(ii) यंडीसीपूीआरच्या ॉमुं डी-३ (फिकंवा तशा स्वरूपूाचाी मुंान्यता) मुंीलॉ, जाफिमुंन फिवभाजान आराखंड्याच्या अंफितमुं मुंजांरीवेळी लॉालॉेल्या अटंनंसार, प्रवतकाने स्व-प्रमुंाणाीत केलॉेल्या पूत्राचाी प्रत जाी संबांफित सक्षमुं प्राफिकरणा/ फिनयोजान प्राफिकरणास सार केलॉी आहाे; फिकंवा

(iii) ज्या प्रकरणाी अकृषीक पूरवानगी आवयक आहाे, तेथाे संबांफित प्राफिकरणाने/फिनयोजान प्राफिकरणाने लॉालॉेल्या व अंमुंलॉबांजावणाी झालॉेल्या सव अटंचाी पूतता केल्याबांाबांत तहासीलॉार यांना फिलॉेल्या संचानेच्या पूोचा पूावतीवरीलॉ तारीखं हाी रेखंांफिकत स्थावर संपूा प्रकल्पूांकरिरता ताबांा प्रमुंाणापूत्र/पूणात्वाचा ाखंलॉा म्हाणाून संचाीत करेलॉ.

Maharashtra real estate regulatory authority (general) (aMendMent) regulations, 2025.

No. MahaRERA/Regulation/2025.— In exercise of the powers conferred on it under sub- section (1) and clause (i) of sub-section (2) of section 85 of the Real Estate (Regulations and Development) Act, 2016 and of all other powers enabling it in that behalf, the Maharashtra Real Estate Regulatory Authority, hereby makes the following regulations to amend the Maharashtra Real Estate Regulatory Authority (General) Regulations, 2017 namely :—

1. Title and commencement :

(i) These regulations shall be called the Maharashtra Real Estate Regulatory Authority (General) ( Amendment) Regulations, 2025.

(ii) These regulations shall come into force on the date of their publication in the Official Gazette.

2. Principal Regulations: These regulations amend the Maharashtra Real Estate Regulatory Authority (General) Regulations, 2017 (hereinafter referred to as "the principal regulations").

3. In regulation 3 of the principal regulations, the sentence "The certificate issued by the project architect on completion of each of the building/wing of the real estate project shall be in Form 4" shall be deleted.

4. Regulation 3B of the principal regulations, shall be substituted by the following regulations, namely—

"3B. For plotted development projects, in Forms 1, 2, 2A and 3 only the relevant sections shall be applicable. The model form of agreement for plotted Development projects, under Rule 10 of Maharashtra Real Estate (Regulation and Development) (Registration of real estate projects, Registration of real estate agents, rates of interest and disclosures on website) Rules, 2017 is provided as Annexure-B."

5. After regulation 3B the following regulation shall be added, namely—

3C. Commencement Certificate and/or Occupancy Certificate / Completion

Certificate in case of plotted development projects :

When the Development Control Regulations of the particular area of competent authority /planning authority does not define Commencement Certificate or Occupancy Certificate / Completion Certificate, then the same shall be construed as under :

(1) The final approval accorded to the land sub-division layout in Form D-3 of UDCPR ; or the approval of similar nature with non- agriculture permission (wherever necessary) shall be considered as a Commencement Certificate for plotted real estate projects.

(2) (i) The certificate issued by the concerned competent authority/planning authority informing the promoter and/or the licensed engineer/structural engineer/ supervisor of the plotted real estate project; or

(ii) the copy of the acknowledgement of the letter submitted to the concerned competent authority/ planning authority on self-certification of promoter, that the conditions imposed in the final approval accorded to the land sub-division layout in Form D-3 of UDCPR (or in the approval of similar nature) are complied; or४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-क, जानेवारी १४, २०२५/पौर्ष २४, शके १९४६ (iii) in cases wherever non-agricultural permission is necessary, the receipt of the intimation to the Tahsildar given as an acknowledgement of having received the intimation of the date of commencement of the non-agricultural use after completion and execution of all the conditions as may have been imposed by the concerned competent authority/planning authority shall denote Occupation Certificate/ Completion Certificate for plotted real estate projects.
