Maharashtra Regional Planning and Town Planning Act, 1966
Notification
No. TPS- Shahada/Sanction/Section 68 (2)/TPV-4/167/2025.– Whereas, the Shahada Municipal Council (hereinafter referred to as 'the said Municipal Council') in exercise of the powers vested in it under the provisions of sub-section (1) of Section 60 of the Maharashtra Regional Planning and Town Planning Act, 1966 (hereinafter referred to as 'the said Act') by its Resolution No. 1, dated 20th November 2023, declared it's intention to make the Draft Town Planning Scheme, Shahada for the area comprised in that scheme and published the declaration so made in accordance with the provisions of sub-section (2) of Section 60 of the said Act in the Maharashtra Government Gazette, on dated 23rd-29th November 2023;
and whereas, the said Municipal Council, after consultation with the Joint Director of Town Planning, Nashik Division, Nashik made a draft Town Planning Scheme, Shahada (hereinafter referred to as 'the said Draft Scheme') for the area in respect of which the declaration was made as aforesaid and published the said draft scheme in the Maharashtra Government Gazette, dated 26th September- 2nd October, 2024 and in the other prescribed manner as required under the provisions of sub-section (1) of Section 61 of the said Act;
and whereas, the Government in Urban Development Department vide Notifi cation No. TPS- 1813/3211/CR-508/UD-13, dated 1st December 2016 has delegated the powers exercisable by it, under the provisions of section 68 (2) of the said Act, in respect of all Municipal Councils and Nagarpanchayats, to the Director of Town Planning, Maharashtra State, Pune under the provisions of Section 151 (1) of the said Act;
and whereas, the said Municipal Council, after considering the suggestions/objections relating to the Draft Town Planning Scheme from the persons affected thereby, as required by the provisions of sub-section (1) of Section 68 of the said Act has submitted the Draft Scheme together with the copies of the suggestions/objections received by it to the Director of Town Planning, Maharashtra State, Pune and has applied for sanction vide it's letter dated 30th December 2024;
and whereas, it is necessary for the Director of Town Planning to accord sanction to or refuse to accord sanction to the said Draft Town Planning Scheme within a period of three months from the date of submission of the said scheme to the Director of Town Planning, Maharashtra State, Pune by the said Municipal Council;
and whereas, as directed under the provisons of the said notifi cation, the Director of Town Planning, Maharashtra State, Pune has delegated the powers of consultation as laid down in Section 68 (2) of the said Act to the concerned Divisional Joint Director of Town Planning, under his Order No. DTP/Power Delegation/Section 151 (2)/TPV-7/3483, dated 6th June 2018;
and whereas, the Divisional Joint Director, Nashik Division vide letter No. 1, dated 7th January 2025 has offered consultation on the said Draft Town Planning Scheme No. 1, Shahada;
and whereas, the Director of Town Planning, Maharashtra State, Pune after making such inquiry as thought fi t and after consulting the Joint Director of Town Planning, Nashik Division proposes to sanction the said Draft Scheme, subject to certain modifi cations and conditions.
Now, therefore, in exercise of the powers conferred by the provisions of sub-section (2) of Section 68 of the said Act, the Director of Town Planning, Maharashtra State, Pune hereby– (a) Sanctions the said Draft Town Planning Scheme No. 1, Shahada in accordance to the modifi cations as shown on the attached plan. As per the modifi cations shown on the attached plan, Chief Offi cer, Municipal Council, Shahada and Assistant Director of Town Planning, Nandurbar Branch, Nandurbar are required to make necessary changes in Form No. 1 and 2 as well as in the report copy.
(b) Fixes date of publication of this notifi cation in the Maharashtra Government Gazette as the date of coming into force of the said Scheme, which shall have effect as provided in the provisions of section 68- A of vesting of such plots;
(c) Directs that the lands thereunder shall be taken into possession by the Shahada Municipal Council as stipulated under the provisions of Section 68-A;
(d) Directs that the said Town Planning Scheme No. 1, Shahada as sanctioned shall be kept open for inspection by the public during offi ce hours on all working days in the head offi ce of the Shahada Municipal Council;
(e) and directs that the copies of the said Draft Scheme or extracts there from certifi ed to be correct shall be available for sale to the public on application at a reasonable price at the offi ce of the Shahada Municipal Council.
This notifi cation is also made available on the website www.dtp.maharashtra.gov.in of the Directorate.
