क्र.एमपीआय-११२४/प्र.क्र.२९१/पीोला-११. - ज्याअर्थी मे. दिदु ए वानां इंदिया टूसग वा मे.वाैभावा इंटूरप्रायझेस (यापीुढे उक्ता दिवात्तीय संस्र्थीा असे संबोदिलाे आहुे) या दिवात्तीय संस्र्थीा आदि सदुर संस्र्थीेचाे अध्यक्ष, संचालाका, व्यवास्र्थीापीका आदि प्रवातागका दिकांवा कामगचारी यांनांी ग्राहुकांकाूनां ठेवाी स्विस्वाकारल्या हुोत्या ;
आदि ज्याअर्थी, उक्ता दिवात्तीय संस्र्थीा वा सदुर संस्र्थीेचाे अध्यक्ष, संचालाका, व्यवास्र्थीापीका आदि प्रवातागका यांनांी ठेवाीदुारांनांी स्विस्वाकारलाेल्या ठेवाी मुदुतापीूताीनांतार पीरता कारण्यास कासूर काेलाी असल्यानांे मे. दिदु ए वानां इंदिया टूसग यांच्यादिवारूध्दु सायनां पीोलाीस ठेाे येर्थीे गु.र.क्र. २५/२०१० (आदिर्थीगका गुन्हुे दिवाभाग गु. र. क्र. ०८/२०१०) नांुसार भारताीय दुं दिवानां (१८६० चा ४५) च्या कालाम ४६५, ४६७, ४६८, ४७१, ४१९, ४२०, १२० ब वा ३४ भां.दु.दिवा.सहु महुाराष्ट्र ठेवाीदुारांच्या (दिवात्तीय संस्र्थीामीला) दिहुतासंबंांचाे संरक्ष अदिदिनांयम, १९९९ (महुा. २००० चा १६) च्या कालाम ३, ४ वा ५ अन्वाये गुन्हुा दुाखला कारण्याता आला आहुे.तासेचा मे. वाैभावा इंटूरप्रायझेस यांच्यादिवारुध्दु सायनां पीोलाीस ठेाे येर्थीे गु.र.क्र. २०१/२०१० (आदिर्थीगका गुन्हुे दिवाभाग गु. र. क्र. ५४/२०१०) नांुसार भारताीय दुं दिवानां (१८६० चा ४५) च्या ४२०, ४०६ गलाेशनां बॅदिनांग ॲक्टू,१९७८(१९७८ चा ४३) चाे कालाम ३,४ वा ५ सहु महुाराष्ट्र ठेवाीदुारांच्या वा १२० ब, सहु प्राईज दिचाटू ॲण् मनांी सक्यु (दिवात्तीय संस्र्थीामीला) दिहुतासंबंांचाे संरक्ष अदिदिनांयम, १९९९ (महुा.२००० चा १६) च्या कालाम ३ आदि ४ अन्वाये गुन्हुा दुाखला कारण्याता आला आहुे;
आदि ज्याअर्थी, महुाराष्ट्र शासनांाचाी अशी खात्राी झेालाी आहुे काी, उक्ता दिवात्तीय संस्र्थीा आदि सदुर संस्र्थीेचाे अध्यक्ष, संचालाका, व्यवास्र्थीापीका आदि प्रवातागका हुे ठेवाीदुारांनांा त्यांच्या ठेवाी मुदुतापीूताीनांतार पीरता कारण्यास अपीयशी ठेरलाे असूनां उक्ता दिवात्तीय संस्र्थीाद्वारे ठेवाीदुारांच्या ठेवाी पीरता कारण्याचाी शक्यता दिदुसूनां येता नांाहुी ;
ंबई शहुर यांचाी सक्षम प्रादिकारी म्हुूनां दिनांयुक्ताी कारे आवाश्यका वाटूताे.
आदि ज्याअर्थी, महुाराष्ट्र शासनांाला, उक्ता दिवात्तीय संस्र्थीेनांे जमा काेलाेल्या ठेवांमूनां त्यांच्या स्वाता:च्या अर्थीवा अन्य व्यक्तांच्या नांावाे रक्काम वा अन्य मालामत्तीा संपीादिदुता कारण्याता आलाी असल्याचाे अदिभाकादिर्थीता असल्यानांे उक्ता दिवात्तीय संस्र्थीांमीला ठेवाीदुारांच्या दिहुताचाे संरक्ष कारण्यासाठेी अशी रक्काम दिकांवा अन्य मालामता जप्ता कारण्याचाे आदि अशा जप्ता रक्काम दिकांवा अन्य मालामत्तीा यांवार दिनांयंत्रा ठेवाण्याकारिरता उपी दिजल्हुादिकारी (एमपीआयी) तार्थीा सक्षम प्रादिकारी, मु भाग चार-ब-१९–१

(अ) दिदु ए वानां इंदिया टूुसग यांच्या कायागलायाचा पीत्तीा शॉपी नां. ३, पीुष्पीकां ंज काो.ऑ.हुौ. सोसायटूी, आंबेकार रो, जैनां ंबई - २२ तासेचा वाैभावा इंटूरप्रायझेस यांच्या कायागलायाचा पीत्तीा शॉपी क्र.१५, ताळमजला, ओम दिशवा साई हुौ. सोसायटूी, सायनां, मु ंबई या संस्र्थीेचाी आदि सदुर संस्र्थीेचाे अध्यक्ष, संचालाका, व्यवास्र्थीापीका, प्रवातागका आदि सोसायटूी, सायनां ट्रॉम्बे रो, सायनां पीूवाग, मु कामगचारी दिकांवा काोताीहुी अन्य व्यक्ताी यांच्या नांावाे असलाेलाी, सोबताच्या अनांुसूचाीता दिवादिनांदिदुगष्टू काेल्याप्रमाे रक्काम वा अन्य मालामत्तीा जप्ता कारीता आहुे, आदि

ORDER
Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.
No. MPI 1124/C.R.291/POL-11.- Whereas, M/s. The A One India Tours Pvt. Ltd. and M/s. Vaibhav Enterprises (hereinafter referred to as "the said Financial Establishments"), and its Chairman, Directors, Managers, Promoters, Partners and its employes responsible for its management have received deposits from depositors under the scheme to repay the deposits on maturity along with benefits promised thereof to the depositors ;
And whereas, an offence has been registered against M/s.The A One India Tours Pvt. Ltd. and its Chairman, Directors, Managers and Promotors at Sion Police Station vide Complaint Register No. 25/2010, (E.O.W No.08/2010) under sections 465,467,468,471,419,420,120 B and 34 of the Indian Penal Code (45 of 1860) read with sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000) and M/s. Vaibhav Enterprises and its Chairman, Directors, Managers and Promotors at Sion Police Station vide Complaint Register No. 201/2010, (E.O.W No. 08/2010) under sections 420, 406 and 120 B of the Indian Penal Code (45 of 1860) read with sections 3,4 and 5 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978 (43 of 1978) read with sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), that they have collected the deposits and have failed to repay the deposits to the depositors after maturity;
And whereas, the Government of Maharashtra is satisfied that the said Financial Establishments and its Chairman, Directors, Managers and Promoters has failed to repay the deposits and the said Financial Establishments is not likely to return the deposits to the depositors;
And whereas, the Government of Maharashtra considers it expedient to attach the monies or other properties believed to have been acquired by said Financial Establishments and its Chairman, Directors, Managers, Promoters and any other person, either in their own name or in the name of any other person from out of the deposits collected by the said Financial Establishments, in order to protect the interest of the depositors of the said Financial Establishments and to appoint the Deputy Collector (MPID) cum Competent Authority, Mumbai City as the Competent Authority to exercise control over the monies and the other properties attached.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 and sub-section (1) of section 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby,—
(a) attaches the monies or other properties in the name of M/s. The A One India Tours Pvt. Ltd., Shop No.3, Pushpakunja Co.Society, Ambedkar Road, Jain Society, Sion, Mumbai- 22 and M/s. Vaibhav Enterprises, Shop No.15, Om Shiv Sai Housing Society, Sion-Trombay Road, Sion (E), Mumbai and its Chairman, Directors, Manager and Promoters and its employees or any other person, as specified in the Schedule appended hereto; and
(b) appoints the Deputy Collector (MPID) cum Competent Authority, Mumbai City to be the Competent Authority to exercise control over the monies and other properties attached.
