NOTIFICATION

No. TPS-2824-718-CR-158-2024-UD-30.–

Whereas, the Revised Development Plan of Anjangaon Surji City, Dist.Amravati has been sanctioned by the Government under section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification No.TPS-2814-CR-81-2014/UD-30, dated 21st March, 2016 and has come into force with effect from the 09th July, 2016 (hereinafter referred to as "the said Development Plan");

And whereas, in the said Development Plan, the land admeasuring 1.56 Hect. bearing Survey No.8/1/K of Mauje Aiwajpur (hereinafter referred to as "the said Land") is included in "Agriculture Zone";

And whereas, as per the provisions of section 37(1) of the said Act, the Chief Officer, Anjangaon Surji Municipal Council, Amravati vide Administrative Resolution No.192, dated 09th October, 2023, has resolved to make modification in the said Development Plan, so as to delete the said Land from Agriculture Zone and to include the same in Residential Zone (hereinafter referred to as "the said Proposed Modification") and accordingly submitted the proposal to the Government for sanction vide its Marathi letter No.693/2023, dated 18th December, 2024;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that, the said Proposed Modification should be sanctioned by deleting the said Land from Agriculture Zone and including the land so released in Residential Zone, with certain conditions;

And whereas, the land owner of the said Land, has deposited 50% the Government share of 5% premium amount of Rs.72,930/-, as per the rate of said Land as prescribed in the Annual Statement of Rates (ASR) for the pre- vailing year, in the Government Treasury vide challan, dated 4th December, 2024, through the Assistant Director of Town Planning, Amravati Branch, Amravati and the remaining 50% of the 5% premium amount of Rs.72,930/- has been deposited with the Chief officer, Anjangaon Surji Municipal Council, dated 27th November, 2024;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of section 37 of the said Act, the Government of Maharashtra hereby sanctions the said Proposed Modification by deleting the said Land from Agriculture Zone and including the land so released in Residential Zone, with certain conditions, for 1.56 Hect. land bearing Survey No.8/1/K of Mauje Aiwajpur, as shown on plan and for that purpose amends the above said Notifica- tion dated 21st March, 2016 as follows:–

" In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry.":–

ENTRY

"The land admeasuring 1.56 Hect. bearing Survey No.8/1/K of Mauje Aiwajpur, is deleted from Agriculture Zone and the land so released is included in Residential Zone as shown on plan, subject to following conditions– Condition No.1 - While developing the land under proposal, in addition to 10% compulsory open space, it is mandatory to provide additional 10% amenity space.

Condition No. 2 - It is compulsory to develop the above said amenity space as per the provisions of the Unified Development Control & Promotion Regulations.

Condition No. 3 - It is compulsory for the Land Owner/ Developer to develop all infrastructure services/ amenities at his own cost.

Condition No. 4 - In respect of development permission on the land under modification, a decision will have to be taken at the level of Anjangaon Surji Municipal Council after a detailed examination as per the provisions of Regulation No.3.1.3 of the Unified Development Control and Promotion Regulations.

Condition No. 5 - If the aforesaid infrastructure amenities are proposed to be developed in stages, then sale of plots shall be controlled by the Chief Officer, Anjangaon Surji Municipal Council, Dist. Amravati, in relation to expected development of civic amenities as per the stages given below.– A. After final approval of layout sale of 25% of total plots shall be permissible.

B. After completion of 40% of civic sale of 50% of total plots shall be permissible. Amenities.

C. After completion of 60% of civic sale of 75% of total plots shall be permissible. Amenities.

D. After completion of 80% of civic sale of 90% of total plots shall be permissible. Amenities.

E. After completion of 100% of civic sale of 100% of total plots shall be permissible. Amenities.

In case of violation of the above, the layout and non-agriculture permission will be eligible for revocation.

If group housing is to be developed in the layout, occupation certificate should not be issued by Chief Officer, Anjangaon Surji Municipal Council, Dist. Amravati, unless all the infrastructure facilities are developed." A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Anjangaon Surji Municipal Council, Dist.Amravati during office hours on all working days for inspec- tion of public for a period of one month.

This Notification shall also be published on the Govt. website www.maharashtra.gov.in /Acts & Rules.

Publication of Draft Development Plan of Kalamb under section 26(1) of Maharashtra Regional &

Town Planning Act, 1966

NOTICE

No. DDP-Kalamb- ADTPY-39-2025 .–

Whereas the Kalamb Nagar Panchayat, (hereinafter referred to as "the said Planning Authority",) are vide Resolution No. 04 dated 26th April, 2018 has declared its intention to prepare a Draft Development Plan of Kalamb (hereinafter referred to as the "said Draft Development Plan") for the area under its jurisdiction, (hereinafter referred to as the said "area") as per the provision of section 23(1) read with section 21(2) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as the "said Act") and notice to that effect is published in Maharashtra Government Gazette Amravati Division Supplement Part 1-A on 30th May, 2018 ;

And whereas, as per the provision in section 24 of the said Act, the Nagar Panchayat vide Order No. 69, dated 02nd May, 2018 has appointed Assistant Director, Town Planning, Branch Yavatmal as " Town Planning Officer " to prepare the said draft Development Plan for the said area ;

And whereas, the Town Planning Officer and Assistant Director, Town Planning, Branch Yavatmal has prepared the said Draft Development Plan of the said area and has handed it over to the said Planning Authority on dated 22nd November, 2022 for publication under section 26(1) of the said act, for inviting suggestions/objections from the public ;

And whereas, the said Planning Authority has failed to publish the said Draft Development Plan under section 26(1) of the said Act within the time limit up to dated 06th January, 2023 ;

And whereas, the Joint Director of Town Planning, Amravati Division, Amravati by his Order No.1071, dated 21st August, 2023 has appointed Assistant Director, Town Planning, Branch Yavatmal as an "Officer" as per the provisions of Section 21(4A) of the said Act, to exercise the powers of the said Planning Authority and complete the legal procedure required under section 26 & upto section 30 of the said Act ;

And whereas, the said Officer, being Planning Authority has passed Resolution No. 1, Dated 09th January, 2025 to publish the said Draft Development Plan under section 26 (1) of the said Act,

Therefore, the said Draft Development Plan is being published under section 26 (1) of the said Act, for inviting suggestions/objections from public. The copy of the said Draft Development Plan & report thereof are kept open for inspection of the public at the following offices on all working days during office hours.

The suggestions/objections, if any, in writing from public in this regard with reasons, shall be submitted to the said Officer having his office at Assistant Director, Town Planning, Yavatmal Branch, Administrative Building, Room No.103, Ground Floor, Collector Office Campus, Yavatmal, a period of 30 days from the date of publication of this notice in the Maharashtra Government Gazette.

The copies of the said Draft Development Plan and particulars shall be available to the public at reasonable price in the office of the said officer.

Under Section 37 of the Maharashtra Regional Planning And Town Planning Act, 1966

OBVIOUS INSTRUCTIONS

No. MCA-TP-106-2024-25 .–

Whereas, under Section 31(1) of the Maharashtra Regional Planning and Town Planning Act, 1966 of Arni City, Urban Development Department of the Government of Maharashtra Notification No. TPS- 2718- 1837-P.No.167-2018-Partial Approval-Navi-30, dated 02nd December, 2021 Arni City Development Plan has been partially approved and the notification has come into effect after 30 days from the date of publication in the Government Gazette.

Whereas, Arni Municipal Council Arni has passed Administrative Resolution No. 1, Date 14th January, 2025. It is decided to make the following changes in the approved Development Plan under section 37 of the Maharashtra Regional Planning and Town Planning Act, 1966.

Purpose As Per Approved Development Plan

0.41 H.A.in Survey No.6/2 A of Arni City Approved Development Plan. Reservation No. 32 is reserved for Parking Zone on plot (as shown in sectional map).

Proposed Modifications

0.41 H.A. in Survey No.6/2 A plot as per Approved Development Plan of Arni City. Reservation is shown on plot (as shown in sectional map).

The parts of the above change Development Plan are shown in gry color on the map. In this case, on verification of the document, Hon'ble Additional Tehsildar, Yavatmal's Order No. R.K.No. 123-8081- K.No. 182-NAA.-48-1980, dated 19th March, 1980 vide non-agricultural order has been passed, for cancellation of the reservation indicated should be proposed as per the original order.

In this sense, a notice is being published under Section 37 (1) of the said Act to invite suggestions and objections from the public regarding the said amendment. Accordingly, those citizens who submit their suggestions and objections in written form to the Municipal Council, Arni office within 30 days from the date of publication of this proposal in the Maharashtra Government Gazette, will be considered by the Arni Munic- ipal Council before submitting the said proposal to the Government for final approval.

The area map showing the proposed alterations in the said Development Plan shall be available for public inspection at the office of the Municipal Council during office hours on all working days.
