क्रमंांका एमंपीआयडी-०६२४/प्र.क्र.५७/पीोल-१५.–ज्याअर्थी, " मंे. श्रीरामंनांजेदिनांया दिलजंग अँडी फायनांान्स प्रा.दिल." ११ गोदिवांदा भावानां, दिचांचाोली नांाका, मंालाडी (पीश्चिचामं), मंु ंबई (यापीुढे उक्ता दिवात्तीय संस्र्थीा असा उल्लेख कारण्याता आला आहुे) आदि सदार दिवात्तीय संस्र्थींचाे अध्यक्ष, संचालका, व्यवास्र्थीापीका, प्रवातागका, भागीदार आदि कामंगचारी यांनांी ठेवाीदारांनांा मंुदाताीअंताी लाभासहु ठेवाी पीरता कारण्याचाे आवादिसता कारूनां ठेवाीदारांकाडीूनां ठेवाी श्चिस्वाकारल्या हुोत्या;

आदि ज्याअर्थी, उक्ता दिवात्तीय संस्र्थीा आदि सदार दिवात्तीय संस्र्थीेचाे अध्यक्ष, संचालका, व्यवास्र्थीापीका, प्रवातागका, भागीदार आदि कामंगचारी यांनांी ठेवाीदारांकाडीूनां स्वाीकारलेल्या ठेवाी मंुदातापीूताीनांतार ठेवाीदारांनांा पीरता कारण्यास कासूर काेला असल्यानांे त्यांचाेदिवारुध्दा मंालाडी पीोलीस स्टेशनां, येर्थीे गु.र.नां. ०५/२०२० (गु.र.क्र. ०२/२०२०) भा.दां.दिवा. कालमं ४०६, ४०९, ४२०,१२०ब सहु मंहुाराष्ट्र ठेवाीदारांच्या (दिवात्तीय संस्र्थीामंधील) दिहुतासंबंधीाचाे संरक्ष अदिधीदिनांयमं, १९९९ (सनां २००० चा मंहुाराष्ट्र १६) कालमं ३ वा ४ अन्वाये गुन्हुा दाखल कारण्याता आला आहुे;

आदि ज्याअर्थी, मंहुाराष्ट्र शासनांाचाी अशी खात्राी झाली आहुे काी, उक्ता दिवात्तीय संस्र्थीा आदि सदार दिवात्तीय संस्र्थीेचाे अध्यक्ष, संचालका, व्यवास्र्थीापीका, प्रवातागका, भागीदार आदि कामंगचारी हुे ठेवाीदारांच्या मंागीनांुसार ठेवाी पीरता कारण्याता अपीयशी ठेरले असूनां उक्ता दिवात्तीय संस्र्थीेद्वारे ठेवाीदारांनांा ठेवाी पीरता कारण्याचाी शक्यता दिदासूनां येता नांाहुी ;

आदि ज्याअर्थी, मंहुाराष्ट्र शासनांाला, उक्ता दिवात्तीय संस्र्थीा आदि सदार दिवात्तीय संस्र्थीेचाे अध्यक्ष, संचालका, व्यवास्र्थीापीका, प्रवातागका, भागीदार आदि कामंगचारी यांनांी गोळा काेलेल्या ठेवांमंधीूनां त्यांच्या स्वाता:च्या अर्थीवा अन्य काोत्याहुी व्यक्ताीच्या नांावाे रक्कामं वा अन्य मंालमंत्तीा संपीादिदाता काेली असल्याचाे अदिभाकादिर्थीता असल्यानांे, उक्ता दिवात्तीय संस्र्थीांमंधील ठेवाीदारांच्या दिहुताचाे संरक्ष कारण्याकारिरता अशी रक्कामं वा अन्य मंालमंत्तीा जप्ता कारे आदि जप्ता रक्कामं वा अन्य मंालमंत्तीा यावार दिनांयंत्रा ठेवाण्याकारिरता उपी दिजल्हुादिधीकारी, (अदिता/दिनांष्का), भांडीुपी-१, मंु ंबई यांचाी सक्षमं प्रादिधीकारी म्हुूनां दिनांयुक्ताी कारे आवायका वाटेताे.

त्याअर्थी, आता, मंहुाराष्ट्र ठेवाीदारांच्या (दिवात्तीय संस्र्थीांमंधील) दिहुतासंबंधीाचाे संरक्ष अदिधीदिनांयमं, १९९९ (सनां २००० चा मंहुाराष्ट्र १६) च्या कालमं ४ चाे पीोटे-कालमं (१) वा कालमं ५ चाे पीोटे-कालमं (१) याद्वारे प्रदानां कारण्याता आलेल्या अदिधीकारांचा वापीर कारूनां मंहुाराष्ट्र शासनां याद्वारे,—

(अ) "मंे. श्रीरामंनांजेदिनांया दिलजंग अँडी फायनांान्स प्रा.दिल," या दिवात्तीय संस्र्थीेचाी आदि सदार दिवात्तीय संस्र्थीेचाे अध्यक्ष, संचालका, व्यवास्र्थीापीका, प्रवातागका, भागीदार आदि कामंगचारी यांच्या नांावाे असलेल्या, सोबताच्या अनांुसूदिचाता दिवादिनांदिदागष्टे काेल्याप्रमंाे रक्कामं वा अन्य मंालमंत्तीा जप्ता कारीता आहुे, आदि

(ब) सदार जप्ता रक्कामं वा अन्य मंालमंत्तीा यावार दिनांयंत्रा ठेवाण्यासाठेी उपी दिजल्हुादिधीकारी, (अदिता/दिनांष्का), भांडीुपी,मंु ंबई यांचाी सक्षमं प्रादिधीकारी म्हुूनां दिनांयुक्ताी कारीता आहुे.

ORDER

Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No.MPID-0624/C.R.No.57/Pol-15.- Whereas, Shreeramanjaneya Leasing and Finance Pvt. Ltd.,11 Govind Bhavan Chicholi Naka Malad (West ), Mumbai (hereinafter referred to as "the said Financial Establishment") and its Chairman, Directors, Managers, Promoters, Partners and its employees, responsible for its management has received deposits from depositors under the scheme to repay the deposits on maturity alongwith benefits promised thereof to the depositors;

And whereas, an offence has been registered against the said Financial Establishment and its Chairman, Directors, Partners, Managers, Promoters, employees and other persons at Malad Police Station, Mumbai vide Complaint Register ( No.05/2020 E.O.W.C.R. No.02/2020) under sections 406, 409,420,120 B and 34 of the Indian Penal Code (45 of 1860) and sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), that they have collected the deposits and have failed to repay the deposits after maturity;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishment and its Chairman, Directors, Partners and others have failed to return the deposits on demand by the depositors and the said Financial Establishment is not likely to return the deposits to the depositors;

And whereas, the Government of Maharashtra considers it expedient to attach the monies or other properties believed to have been acquired by the said Financial Establishment and its Chairman, Directors, Partners, Managers, Promoters, employees and any other person either in their own name or in the name of any other person, from out of the deposits collected by the said Financial Establishment in order to protect the interest of the depositors of the said Financial Establishment and to appoint Duputy Collector (Encroachment/Removal) Bhandup-1 as the Competent Authority to exercise control over the monies and other properties attached.

Now therefore, in exercise of the powers conferred by sub-section (1) of section 4 and sub-section (1) of section 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby,—

(a) attaches the monies and other properties of Shreeramanjaneya Leasing And Finance Pvt.Ltd, Mumbai and its Chairman, Directors, Partners, Managers, Promoters, employee and any other person, as specified in the Schedule appended hereto; and

(b) appoints the Duputy Collector( Encroachment/Removal ) Bhandup-1, to be the Competent Authority to exercise control over the monies and other properties attached.
