महाराष्ट्र ठेवीदारांच्येा (किंवत्तीये संस्थांांमधील) किंहतसंबंधाचे संरक्षण अकिंधकिंनयेम, १९९९.

क्रमंांका एमंपीआयडी-१०२३/प्र.क्र.६०/पीोल-१५.—मंायक्रो फेायनांान्स प्रा. दिल. कांपीनांी, दिजल्हुा नांागपीूर(यापीुढे "उक्ता दिवात्तीय संस्था" असा उल्लेख कारण्याता आला आहुे) या दिवात्तीय संस्थाेनांे आदि सदार दिवात्तीय संस्थाेचाे प्रवातागका, भागीदार, संचालका, व्यवास्थापीका, कामंगचारी आदि सदास्य यांनांी ठेवाीदारांनांा मंुदाताीअंताी लाभासहु ठेवाी पीरता कारण्याचाे आश्वादिसता कारूनां ठेवाीदारांकाडीूनां ठेवाी स्वाीकारल्या हुोत्या ;

आदि ज्याअथाी, उक्ता दिवात्तीय संस्था आदि सदार संस्थाेचाे प्रवातागका, भागीदार, संचालका, व्यवास्थापीका,कामंगचारी आदि काोताीहुी अन्य व्यक्ताी सदास्य यांनांी ठेवाीदारांकाडीूनां स्वाीकारलेल्या ठेवाी मंुदातापीूताीनांतार ठेवाीदारांनांा पीरता कारण्यास कासूर काेला असल्यानांे त्यांचाेदिवारुद्ध लकाडीगंज पीोलीस ठेाे, दिजल्हुा नांागपीूर येथाे गु.र.नां. ४४५/२०२० नांुसार भारताीय दांडी संदिहुता (१८६० चा ४५) कालमं ४२०, ४०६, ४०९ आदि १२०ब सहु मंहुाराष्ट्र ठेवाीदारांच्या (दिवात्तीय संस्थामंधील) दिहुतासंबंधीाचाे संरक्ष अदिधीदिनांयमं, १९९९ (सनां २००० चा मंहुाराष्ट्र १६) कालमं ३ अन्वाये गुन्हुा दाखल कारण्याता आला आहुे ;

आदि ज्याअथाी, मंहुाराष्ट्र शासनांाचाी अशाी खात्राी झाली आहुे काी, उक्ता दिवात्तीय संस्था आदि सदार संस्थाेचाे प्रवातागका, भागीदार, संचालका, व्यवास्थापीका, कामंगचारी सदास्य आदि काोताीहुी अन्य व्यक्ताी हुे ठेवाीदारांच्या मंागीनांुसार ठेवाी पीरता कारण्याता अपीयशाी ठेरले असूनां उक्ता दिवात्तीय संस्थाेद्वारे ठेवाीदारांनांा ठेवाी पीरता कारण्याचाी शाक्यता दिदासूनां येता नांाहुी ;

आदि ज्याअथाी, मंहुाराष्ट्र शासनांाला, उक्ता दिवात्तीय संस्था आदि त्यांचाे प्रवातागका, भागीदार, संचालका, व्यवास्थापीका, कामंगचारी, सदास्य आदि इतार काोताीहुी अन्य व्यक्ताी यांनांी गोळा काेलेल्या ठेवांमंधीूनां त्यांच्या स्वाता:च्या अथावा अन्य काोत्याहुी व्यक्ताीच्या नांावाे रक्कामं वा अन्य मंालमंत्तीा संपीादिदाता काेली असल्याचाे अदिभाकादिथाता असल्यानांे, उक्ता दिवात्तीय संस्थांमंधील ठेवाीदारांच्या दिहुताचाे संरक्ष कारण्याकारिरता अशाी रक्कामं वा अन्य मंालमंत्तीा जप्ता कारे आदि जप्ता रक्कामं वा अन्य मंालमंत्तीा यावार दिनांयंत्रा ठेवाण्याकारिरता उपी(१) भाग चार-ब-६०–१ २ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, फेब्रुवारी १२, २०२५/माघ २३, शके १९४६ दिवाभागीय अदिधीकारी नांागपीूर शाहुर, दिजल्हुा नांागपीूर यांचाी सक्षमं प्रादिधीकारी म्हुूनां दिनांयुक्ताी कारे आवाश्यका वाटताे.

त्याअथाी आता, मंहुाराष्ट्र ठेवाीदारांच्या (दिवात्तीय संस्थांमंधील) दिहुतासंबंधीाचाे संरक्ष अदिधीदिनांयमं, १९९९ (सनां २००० चा मंहुाराष्ट्र १६) च्या कालमं ४ चाे पीोट-कालमं (१) वा कालमं ५ चाे पीोट-कालमं (१) याद्वारे प्रदानां कारण्याता आलेल्या अदिधीकारांचा वापीर कारूनां मंहुाराष्ट्र शासनां याद्वारे—

(अ) मंायक्रो फेायनांान्स प्रा.दिल. कांपीनांी, दिजल्हुा नांागपीूर या दिवात्तीय संस्थाेच्या आदि सदार संस्थाेचाे प्रवातागका, भागीदार, संचालका, व्यवास्थापीका,कामंगचारी, सदास्य आदि काोताीहुी अन्य व्यक्ताी यांच्या नांावाे असलेल्या सोबताच्या अनांुसूचाीता दिवादिनांदिदागष्ट काेल्याप्रमंाे रक्कामं वा अन्य मंालमंत्तीा जप्ता कारीता आहुे, आदि

(ब) सदार जप्ता रक्कामं वा अन्य मंालमंत्तीा यावार दिनांयंत्रा ठेवाण्यासाठेी उपी दिवाभागीय अदिधीकारी नांागपीूर शाहुर, दिजल्हुा नांागपीूर यांचाी सक्षमं प्रादिधीकारी म्हुूनां दिनांयुक्ताी कारीता आहुे.

Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No. MPID1023/C.R.No.60/Pol-15.—Whereas, Micro Finance Pvt. Ltd. Company, District Nagpur (hereinafter referred to as "the said Financial Establishment") and its Promoters, Partners, Directors, Manager, Employee and member have received deposits from depositors under the scheme to repay the deposits on maturity alongwith benefits promised thereof to the depositors ;

And whereas, an offence has been registered against the said Financial Establishment and its Promoters, Partners, Directors, Manager, Employee, member and other person at Lakadganj Police Station, District Nagpur vide Complaint Register No.445/2020 under sections 420,406,409 and 120 B of the Indian Penal Code (45 of 1860) and section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000) that they have collected the deposits and have failed to repay the deposits after maturity ;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishment and its Promoters, Partners, Directors, Manager,Employee, member and any other person have failed to return the deposits on demand by the depositors and the said Financial Establishment is not likely to return the deposits to the depositors ;

And whereas, the Government of Maharashtra considers it expedient to attach the monies or other properties believed to have been acquired by the said Financial Establishment and its Promoters, Partners, Directors, Manager, Employee and member and any other person, either in their own name or in the name of any other person from out of the deposits collected by the said Financial Establishment in order to protect the interest of the depositors of the said Financial Establishment and to appoint Sub-divisional Officer and Competent Authority, Nagpur City, District Nagpur as the Competent Authority to exercise control over the monies and other properties attached.

Now therefore, in exercise of the powers conferred by sub-section (1) of section 4 and sub-section (1) of section 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby,—

(a) attaches the monies and other properties of Micro Finance Pvt. Ltd. Company, District Nagpur and its Promoters, Partners, Directors, Manager, Employee, member and any other person as specified in the Schedule appended hereto; and

(b) appoints the Sub-divisional Officer and Competent Authority, Nagpur District Nagpur to be the Competent Authority to exercise control over the monies and other properties attached.

The list of the monies and other properties of the Micro Finance Ltd. Company, Nagpur and its Promoters, Partners, Directors, Manager, Employee, members and any other person, to be attached are as follows, namely :—
