I

No. SPP. 2019/U.O.R. 58/D-XIV.—In view of recommendation received from Home Department regarding cancellation of appointment of Adv. Shri Raja Thakare as " Special Public Prosecutor " for the conducting case/s which is/are arising out of C.R. No. 78/2019 registered at Economic Offences Wing, Mumbai (M.R.A. Marg Police Station, Mumbai C.R. No. 224/2019), the Government of Maharashtra hereby cancels the appointment of Adv. Shri Raja Thakare as "Special Public Prosecutor" made vide Law and Judiciary Department, Government Notification No. SPP-2019/U.O.R.No.58/D-XIV, dated 10th December, 2020 with immediate effect.

No. SPP. 2019/U.O.R. 58/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No.2 of 1974), the Government of Maharashtra hereby appoints Adv. Girish Anant Kulkarni as " Special Public Prosecutor/Special Counsel " for conducting the case/s pending Hon 'ble Sessions (Special) Court, Mumbai and Hon'ble High Court, Bombay which is/are arising out of C.R. No. 78/2019 registered at Economic Offences Wing, Mumbai (M.R.A. Marg Police Station, Mumbai C.R. No. 224/2019).

2. The fees of Adv. Girish Anant Kulkarni as " Special Public Prosecutor/Special Counsel " shall be paid by Home Department.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Condition of Service and Remuneration) Rules, 1984 and The Rules For The Conduct Legal Affairs of Government, 1984.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

(३) सेंलाी अविकाराी यांनी मा. सेहेकारा आयांक्त विनबंक, सेहेकाराी सेंस्था, महेाराष्ट्र राज्या, पंणे यांचीेकडेीला परिरापक जा. क्र. पतसेंस्था /सेआ-५ ची/ सेंलाी आे / २०१८, विनांक ३१ ऑक्टोबरा २०१८ राोजी विनगविमत केलाेल्या परिरापकानंसेारा रामहेासेोबत जोडेलाेल्या विविहेत नमंन्यात प्रप १,२,३ ५ प्रमाणे कज सेंलाीची माविहेती या कायालायासे सेारा कराी.

(५) सेंलाी अविकाराी यांनी नमू केलाेल्या कालाीत सेंलाीचीे कामकाज सेमानकाराक केलाे नसेल्याचीे विननासे आल्यासे विकंा प्रान केलाेल्या अविकाराचीा गैरापरा कराीत असेल्याचीे विननासे आल्यासे, प्रान केलाेलाे अविकारा काढून घेतलाे जातीला भाविष्यात असे कोणतेहेी अविकारा अा व्याक्तीसे प्रान कराण्यात याेणारा नाहेी.

(६) ासेन विनणया क्रमांक सेंकीण-१५०४/प्र.क्र. २३१/१५-से, विनांक २३ नोव्हेंबरा २००६ अन्याे विेष सेंलाी अविकाऱ्यांना तीन विसेंहेाच्या राजमंद्रेचीा ापरा कराता याेणारा नाहेी.

(७) सुली अंविधकाऱ्यास त्याच्या नापुढे कोठेहाी " महाराष्ट्र शासन विनयुक्ते " आविणू विकंा " विसव्हाील कोर्ट " " एक्झीक्युर्टीव्हा कोर्ट " या ब्ांचीा अथा तत्सेम ब्ांचीा ापरा कराता याेणारा नाहेी. त्याऐजी सेंलाी अविकाऱ्यांनी त्यांच्या नापंढे " सेंलाी अविकाराी (महेाराष्ट्र सेहे. सेंस्था अविविनयाम, १९६० विनयाम, १९६१ चीे विनयाम १०७ अन्याे) " असे विलाहेाे.

(८) सेंलाी अविकाऱ्यासे सेंलाीसेाठाी ापरा कराण्यात याेणाऱ्या ाहेनारा " सेंलाी अविकाराी, स्.ांतीलालाजी सेोनी विनफाडे नागराी सेहेकाराी पतसेंस्था मया. विनफाडे " असेा फलाक लाता याेईला.

(९) सेंलाी अविकाऱ्याने पगारा जप्तीची कायाहेी कराताना कजाराच्या / जामीनाराच्या पगारा कपातीबाबत राष्ट्रीयाकृत बँका ा अन्या बँका यांचीेकडे परास्परा ेतन कपातीचीा आे ेऊन परास्परा पगारा कपात कराता याेणारा नाहेी. सेंबंवित कजारा/जामीनारा ज्या आस्थापनेरा काम कराीत आहे त्या आस्थापनेराीला आहेराण सेंवितराण अविकाराी / पगारा कराणारा अविकाराी यांचीेमाफफत पगारातून कज सेूला कराण्याची कायाहेी कराी.

(१०) सेंलाी अविकाऱ्यासे, थाकबाकीाराकडेून सेंलाी ाल्यानंसेारा सेंलापा राक्कम मा. सेहेकारा आयांक्त विनबंक, सेहेकाराी सेंस्था, महेाराष्ट्र राज्या, पंणे यांचीे विनांक ६ एविप्रला २०१८ राोजीचीे आेामध्याे विनश्चिश्चीत केलाेल्या राने सेूला करायाची राक्कम याविाया इतरा कोणतीहेी राक्कम कराता याेणारा नाहेी. सेरा चीाची आकाराणी विविनयाोग याबाबत प्रकराणविनहेाया विहेोब ठाेायाचीा असेून त्याची तपासेणी सेंस्थाेच्या ैाविनक लाेापरिराक्षाकांकडेून करून घ्यायाची आहे.

(११) सेंलाी अविकाऱ्याने मा. सेहेकारा आयांक्त विनबंक, सेहेकाराी सेंस्था, महेाराष्ट्र राज्या, पंणे यांचीे कायालायाच्या विनांक ३१ ऑक्टोबरा २०१८ विनांक ११ जंलाै २०१९ च्या परिरापकातीला सेूचीनांची काटेकोरापणे अंमलाबजाणी कराी. सेरा परिरापकातीला सेूचीनांचीे उल्लांघेन झाल्यासे सेंलाीचीे अविकारा काढून घेण्यात याेऊन भाविष्याकाळंात असे अविकारा प्रान केलाे जाणारा नाहेीत याची नं घ्याी. पतसेंस्थाेच्या चीेअरामन/व्यास्थापक / असेायाक यांनी रामहेा सेंलाी अविकाऱ्याच्या कामकाजाचीा कजाराविनहेाया आढा परिरापकातीला प्रप पाचीमध्याे नमू केल्याप्रमाणे घ्या.

(१२) सेंलाी अविकाराी यांनी विनगविमत करायाच्या नोटीसे/ आे/ घेोषणाप यामध्याे त्यांना अविकारा प्रान केलाेल्या या आेाचीा सेंभा नमू करा.
