अधिसूचना
भारताचे संविधान.
क्रमांक १४२३/प्र.क्र. १८३/राशि-३.------भारताच्या संविधानाच्या अनुच्छेद ३०९ खालील परंतुकान्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करून, महाराष्ट्राचे राज्यपाल याद्वारे महाराष्ट्र शासनाच्या सामान्य प्रशासन विभागाच्या अधिपत्याखालील उपाहारगृहातील वरिष्ठ व्यवस्थापक गट-ब (राजपत्रित) या पदाचे सेवा प्रवेशाचे विनियमन करणारे पुढील नियम करीत आहे, जसे :
१. (१) संक्षिप्त नाव.----या नियमांना उपाहारगृहांतील वरिष्ठ व्यस्थापक गट-ब (राजपत्रित) (सेवा प्रवेश) नियम, २०२३ असे संबोधण्यात यावे.
(२) सदर सेवाप्रवेश नियम अधिसूचना निर्गमित झाल्याच्या दिनांकापासून अंमलात आली असल्याचे मानण्यात येईल.
२. या नियमामध्ये, संदर्भानुसार दुसरा अर्थ अभिप्रेत नसले तर.----
(क) " उपाहारगृह " याचा अर्थ शासनाच्या सामान्य प्रशासन विभागाच्या अधिपत्याखालील सर्व आहार/उपाहारगृहे.
(ख) " आयोग " याचा अर्थ महाराष्ट्र लोकसेवा आयोग
(ग) " सामान्य प्रशासन विभाग " म्हणजे भारताच्या संविधानातील अनुच्छेद १६६ अन्वये केलेल्या महाराष्ट्र शासन कार्यनियमावलीच्या नियम ४ अनुसार र्िनदिष्ट शासनाचा विभाग.
(घ) " शासन " याचा अर्थ महाराष्ट्र शासन.
३. उपाहारगृहातील वरिष्ठ व्यवस्थापक, गट-ब (राजपत्रित) या पदावरील नेमणूक व्यवस्थापक, उपाहारगृह, गट-ब (अराजपत्रित) या पदावर किमान तीन वर्षाची नियमित सेवा झाली आहे, अशा व्यक्तींमधून ज्येष्ठता अधिन पात्रता या आधारावर पात्र ठरलेल्या योग्य व्यक्तींच्या पदोन्नतीने करता येईल.
४. हिंदी व मराठी भाषा परीक्षेबाबतची तरतूद.-----नियम ३ येथे नमूद केल्या पदावर पदोन्नतीने नियुक्त होणाया व्यक्तीने, पदोन्नतीपुर्वी हिंदी भाषा परीक्षा व मराठी भाषा परीक्षा या दोन्ही परीक्षांसंदर्भात मराठी भाषा विभागाने वेळोवेळी केलेल्या नियमांनुसार, हिंदी भाषा परीक्षा व मराठी भाषा परीक्षा अगोदरच उत्तीर्ण केलेली असणे अथवा उत्तीर्ण होण्यापासून सूट मिळविलेली असणे आवश्यक राहील. अन्यथा नियम ३ येथील पदावर पदोन्नती अनुज्ञेय ठरणार नाही.

भाग चार-अ--१२ महाराष्ट्र शासन राजपत्र, भाग चार-अ, गुरुवार ते बुधवार, फेब्रुवारी २७-मार्च ५, २०२५/फाल्गुन ८-१४, शके १९४६ ५. संगणक अर्हता प्रमाणपत्राबाबतची तरतूद.----नियम ३ येथील पदावर पदोन्नतीने नियुक्त होणाया व्यक्तीने, पदोन्नतीपुर्वी संगणक अर्हता प्रमाणपत्रासंदर्भात शासनाने वेळोवेळी केलेल्या नियमांनुसार, संगणक अर्हता प्रमाणपत्र धारण करणे अथवा सामान्य प्रशासन विभाग (माहिती व तंत्रज्ञान) यांनी वेळोवेळी शासन आदेशाद्वारे नमूद केलेल्या संगणक/माहिती तंत्रज्ञान विषयक परीक्षा उत्तीर्ण होणे अथवा सामान्य प्रशासन विभागाने वेळोवेळी शासन आदेशानुसार निश्चित केलेल्या वयोमर्यादेनुसार संगमक अर्हता प्रमाणपत्र सादर करण्यापासून सूट मिळविलेली असणे आवश्यक राहील. अन्यथा नियम ३ येथील पदावर पदोन्नती अनुज्ञेय ठरणार नाही.
६. शासकीय सेवेते प्रवेश केल्यानंतर सेवाविषयक अन्य आदेश/नियम लागू होतील.
शासकीय सेवेतील नियुक्तीसाठी या नियमांद्वारे विहित करण्यात आलेल्या अटी व शतर्ींची पूर्तता करणे आवश्यक आहे. सदर नियमांनुसार शासकीय सेवेत नियुक्ती झाल्यानंतर, संबंधित शासकीय कर्मचायास, शासकीय सेवेच्या कालावधीत, महाराष्ट्र नागरी सेवा नियम, तसेच सेवाविषये बाबीसंदर्भात राज्य शासनाने वेळोवेळी अधिनियम/अधिसूचना/शासन निर्णय/शासन आदेशाद्वारे निर्गमित केलेले अन्य नियम लागू राहतील.

NOTIFICATION
CONSTITUTION OF INDIA.
No. MIS-1423/CR-183/PROTO-3.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Maharashtra is hereby pleased to make the rules regulating recruitment to the posts of Senior Manager, Group B (Gazetted) in Canteen under the General Administration Department of Government of Maharashtra namely :—
1. (1) Short Title.—These rules may be called the Senior Manager, Group B (Gazetted) in Canteen (Recruitment Rules 2023).
(2) They shall be deemed to have come into force from the issue of these notification.
2. Definition.—In these rules unless the context requires otherwise,
(a) " Canteen " means all Canteens under the administrative control of the General Administrative Department of the Government of Maharashtra ;
(b) " Commission" means Maharashtra Public Service Commission ;
(c) " General Administrative Department " means the Department specified in the First Schedule appended to the Maharashtra Government Rules of Business made under article 166 of the Constitution of India ;
(d) " Government " means the Governor of Maharashtra.
3. Appointment to the post of.—Senior Manager, Group B (Gazetted) in canteen shall be made by promotion of a suitable person, on the basis of seniority subject to fitness, from amongst the person holding the post of Manager canteen having not less than three years regular service in that post.
4. The Provision regarding Hindi and Marathi language Examination.—It shall be mandatory for the person who has been appointed by promotion to the posts mentioned in rule 3, either to pass Hindi and Marathi language examinations as regulated by the Government (Marathi Language Department) from time to time regarding passing of these examination or to get exemption from passing of these examination before getting promoted to the said posts. Otherwise, such person shall not be eligible for promotion to the post mentioned at rule 3.
5. The Provision regarding possessing Certificate in Computer Operation.— It shall be mandatory for the person who has been appointed by promotion to the posts mentioned in rule 3, either to possess the Computer Operation Certificate as regulated by the Government (General Administration Department/Information Technology) from time to time or to obtain exemption from of age criteria prescribed by orders issued by the General Administration Department/ Information Technology, from time to time, before being promoted to the said posts.
6. The terms and conditions prescribed in these Rules shall be compiled with for appointment in the Government Service. Subsequent to appointment in Government Service, the Maharashtra Civil Services Rules and other prevailing enactments/ Government Resolutions/ Government Orders with regard to service matters as prescribed from time to time, shall be applicable to the concerned Government Servant.
