महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५.
क्रमांक एमयुएन-२०२०/प्र.क्र.८०/नवि-१८.----महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा. ४०) (यात यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे) याच्या कलम ३४१ अ चे पोट-कलम (१) आणि कलम ३ चे पोट-कलम (३) मधील तरतुदीनुसार, महाराष्ट्र शासन याद्वारे गोंदिया जिल्ह्यतील फुलचूर व फुलचूरटोला या ग्रामपंचायतींचे स्थानिक क्षेत्र, ग्रामीण क्षेत्रातून नागरी क्षेत्रामध्ये संक्रमित होणारे संक्रमणात्मक क्षेत्र म्हणून विर्िनदिष्ट करण्याच्या आणि उक्त स्थानिक क्षेत्रासाठी " फुलचूर नगर पंचायत " या नावाने नगरपंचायत घटीत करण्याच्या दृष्टीने, उक्त अधिनियमाचे कलम ३४१ अ चे पोट-कलम (१), (१ब) आणि (२) मधील प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, अधिसूचना काढण्याचा आपला हेतू घोषित करीत आहे.
२. उक्त उद्घोषणेला आक्षेप घेणाया कोणत्याही व्यक्तीने, ही उद्घोषणा महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून तीस दिवसांच्या कालावधीत जिल्हाधिकारी कार्यालय, गोंदिया, आमगाव रोड, फुलचूर टोला, गोंदिया-४४१ ६०१ यांच्याकडे त्याची लेखी कारणे सादर करणे आवश्यक असेल.
३. उक्त कालावधीमध्ये मिळालेल्या अशा कोणत्याही आक्षेपावर शासनाकडून विचार करण्यात येईल.

भाग एक-अ (म.उ.वि.)-१३—१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ---मध्य उप-विभाग, फेब्रुवारी २८, २०२५/फाल्गुन ९, शके १९४६ प्र.क्र.८०/नवि-१८, दिनांक २८ फेब्रुवारी, २०२५ याद्वारे महाराष्ट्र शासन असाधारण राजपत्र भाग १-अ, मध्य उप विभाग, दिनांक २८ फेब्रुवारी, २०२५ यामध्ये उद्घोषणा प्रसिद्ध केली असून, महाराष्ट्र शासनाने गोंदिया जिल्ह्यतील फुलचूर व फुलचूरटोला या ग्रामपंचायतींचे स्थानिक क्षेत्र, ग्रामीण क्षेत्रातून नागरी क्षेत्रामध्ये संक्रमित होणारे संक्रमणात्मक क्षेत्र म्हणून विर्िनदिष्ट करण्यासाठी व उक्त संक्रमणात्मक क्षेत्रासाठी " फुलचूर नगरपंचायत " या नावाने नगरपंचायत घटीत करण्यासाठी, उक्त अधिनियमाचे कलम ३४१ अ चे पोट-कलम (१), (१ब) आणि (२) या अन्वये अधिसूचना काढण्याच्या आपल्या प्रस्तावावर ती महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून तीस दिवसाच्या आत आक्षेप मागविण्यात आले ;
आणि ज्याअर्थी, प्राथमिक उद्घोषणा, नगरविकास विभाग, क्रमांक एमयुएन-२०२०/प्र.क्र.८०/नवि-१८, दिनांक मार्च, २०२५ स्थानिक वर्तमानपत्रात प्रसिद्ध करण्यात आली ;
आणि ज्याअर्थी, अधिसूचनेत नमूद कालावधीत जिल्हाधिकारी, गोंदिया यांच्याकडे प्राप्त होणाया आक्षेपांचा शासनाकडून विचार करण्यात आला ;
आणि ज्याअर्थी, भारताचे संविधानाच्या अनुच्छेद २४३-थ च्या खंड (२) मध्ये नमूद केलेल्या बाबी विचारात घेऊन महाराष्ट्र शासनाला, यासोबत जोडलेल्या अनुसूची " अ " मध्ये अधिक तपशीलवारपणे वर्णन केलेले उक्त स्थानिक क्षेत्र हे, संक्रमणात्मक क्षेत्र म्हणून विर्िनदिष्ट करणे इष्ट वाटते.
त्याअर्थी आता, उक्त अधिनियमाचे कलम ३४१ अ चे पोट-कलम (१), (१ब) आणि (२) अन्वये प्रदान केलेल्या अधिकारांचा वापर करून व त्याबाबतीत समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे उक्त स्थानिक क्षेत्र हे, संक्रमणात्मक क्षेत्र म्हणून विर्िनदिष्ट करीत असून, त्यासाठी उक्त अधिनियमाच्या कलम ३४१ अ चे पोट-कलम (२) मध्ये तरतूद केल्याप्रमाणे, " फुलचूर नगरपंचायत " या नावाने एक नगरपंचायत घटीत करण्यात येत आहे. उक्त संक्रमणात्मक क्षेत्राच्या हद्दी यासोबत जोडलेल्या अनुसूची "ब" मध्ये विर्िनदिष्ट केल्याप्रमाणे असतील.

महाराष्ट्र ग्रामपंचायत अधिनियम (सन १९५९ चा क्रमांक तीन) अन्वये, स्थापन केलेल्या ग्रामपंचायत फुलचूर व ग्रामपंचायत फुलचूरटोला ता. जि. गोंदिया या ग्रामपंचायत क्षेत्राची हद्द.

PROCLAMATION
MAHARASHTRA MUNICIPAL COUNCILS, NAGAR PANCHAYATS AND INDUSTRIAL TOWNSHIPS ACT, 1965.
No. MUN-2020/C.R.80/UD-18.—In pursuance of the provisions of sub-section (1B) of section 341A read with sub-section (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as " the said Act "), the Government of Maharashtra hereby announces its intention to issue a notification in exercise of the powers conferred by sub-sections (1), (1B) and (2) of section 341A of the said Act, with a view to specify the local area of the village panchayats Fulchur and Fulchurtola in Gondia District, being an area in transition from a rural area to an urban area and to constitute a Nagar Panchayat by the name of " the Fulchur Nagar Panchayat " for the said transitional area.
2. Any person who entertains any objections to the said Proclamation is hereby required to submit the same in writing with the reasons therefor, to the Collectorate, Adminstrative Building, Amgaon Road, Fulchurtola, Maharashtra 441 601, within a period of thirty days from the date of publication of this Proclamation in the Maharashtra Government Gazette.
3. Any such objection which may be received during the said period will be considered by the Government.
DRAFT NOTIFICATION
No. MUN-2020/C.R.80/UD-18.—Whereas, by the Government Proclamation, Urban Development Department, No. MUN-2020/C.R.80/UD-18, dated the 28th February 2025 published in the Maharashtra Government Gazette, Part-I-A, Extraordinary, Central Division Supplement, dated the 28th February 2025, issued in pursuance of the provisions of sub-section (1B) of section 341A read with sub-section (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as " the said Act "), the Government of Maharashtra had invited objections within a period of thirty days, from the date of publication thereof in the Maharashtra Government Gazette, to its proposal to issue a notification under sub-sections (1), (1B) and (2) of section 341A of the said Act, to specify the local area of the village panchayat Fulchur and Fulchurtola in Gondia District, being an area in transition from a rural area to an urban area and to be a transitional area and to constitute a Nagar Panchayat by the name of " the Fulchur Nagar Panchayat " for the said transitional area ;
And whereas, the Government Proclamation, Urban Development Department, No. MUN-2020/ C.R.80/UD-18, dated the March 2025 was published in the local newspaper ;
And whereas, the objections received in pursuant to the said Proclamation by the Collector of Gondia District, within the specified period, have been considered by the Government ;
And whereas, having regard to the factors mentioned in clause (2) of article 243-Q of the Constitution of India, the Government of Maharashtra considers it expedient to specify the said local area, more particularly described in the Schedule "A" appended hereto, to be a transitional area.
Now, therefore, in exercise of the powers conferred by sub-sections (1), (1B) and (2) of section 341A of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby, specifies the said local area to be a transitional area, for which there shall४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ---मध्य उप-विभाग, फेब्रुवारी २८, २०२५/फाल्गुन ९, शके १९४६ be constituted a Nagar Panchayat, as provided in sub-section (2) of said section 341 A of the said Act, by the name the Fulchur Nagar Panchayat. The boundaries of the said transitional area shall be such as are specified in Schedule " B " appended hereto.
