क्रमांक रोपवे २०२४/प्र.क्र.०२/ रस्ताे-५ .–ज्याअर्थी, श्रीखंडोबादाेवेतादिलंग कडेपठार ट्रस्ट, जेजुरी, (याता यांनांतार ज्याचा " प्रवेताचक "असा दिनांदाेश करण्याता आलेला आहुे) यांनांी टेकडीच्या पायथ्या पासाूनां कडेपठार खंडोबा मांदिदारापयंता हुवेाई रज्जुमागच बांधण्यासाठाी कडेपठार, ता. पुरंदार, दिजल्हुा पुणे येर्थीे प्रार्थीदिमाक तापासा/ सांशोधनां केले आहुे ;

आदिणे ज्याअर्थी, प्रवेताचकानांे, प्रार्थीदिमाक तापासा/ सांशोधनां पूणेच केल्यानांतार, रोपवेच्या बांधकामासाठाी त्यांनांा (प्रवेताचकासा) प्रादिधकृता करण्यासाठाी उक्ता अदिधदिनांयमाच्या कलमा ९ अंतागचता दिदानांांक ६ साप्टंबर २०२१ आदिणे २७ जानांेवेारी २०२२ च्या पत्रांद्वारे राज्यशासानांाकडे अजच केला आहुे ;

आदिणे ज्याअर्थी, श्रीखंडोबादाेवेतादिलंग कडेपठार ट्रस्ट, जेजुरी, कडेपठार येर्थीे प्रवेासाी हुवेाई रज्जुमागच बांधण्यासाठाी त्यासा प्रादिधकृता करण्याकरिरता प्रवेताचकाच्या अजाचवेर माहुाराष्ट्र शासानां दिवेचार करीता आहुे. त्याअर्थी, आता उक्ता अदिधदिनांयमाच्या कलमा ९ द्वारे प्रदानां करण्याता आलेल्या प्रादिधकाराचा वेापर करूनां माहुाराष्ट्र शासानांानांे याद्वारे त्या प्रवेताचकासा पुढील शतांनांा अधीनां राहुूनां श्रीखंडोबादाेवेतादिलंग कडेपठार ट्रस्ट, जेजुरी, कडेपठार, येर्थीे प्रवेासाी हुवेाई रज्जुमागच बांधण्यासा प्रादिधकृता करीता आहुे.

(१) प्रवेताचक आवेश्यक ताी सावेच नांा हुरकता प्रमाणेपत्रा े प्राप्ता करेल आदिणे परवेानांगीचाे आदाेश दिनांगचदिमाता हुोण्यापूवेी शासानांासा (माुख्य अदिभायंता , सावेचजदिनांक बांधकामा प्रादाेदिशक दिवेभाग, माु ंबई) सादार करेल.

(२) प्रवेताचक सादार प्रकल्पाच्या भांडवेलाच्या २५% रक्कमा दिनांधाचरीता करेल आदिणे त्यानांे ताी रक्कमा उभारली असाे प्रमादिणेता करेल वे अंदितामा परवेानांगी दिमाळाल्याच्या तारखंेपासाूनां एक वेर्षाचच्या कालावेधीच्या आता उरलेली ७५% रक्कमा उभारील.

(१)

भाग चार-ब-८६–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, बुधवार माचष ५, २०२५/फाल्गुन १४, शके १९४६ (३) परवेानांगी दिमाळाल्यानांतार ८ मादिहुन्यांच्या आता प्रवेताचक बांधकामासा साुरुवेाता करील.

(४) वेरील अट क्रमांक ३ नांुसार बांधकामासा साुरुवेाता केल्याच्या तारखंेपासाूनां २४ मादिहुन्यांच्या आता प्रवेताचक प्रस्तादिवेता हुवेाई रज्जूमागाचचाे बांधकामा पूणेच करील.

(५) या प्रकल्पामाध्ये प्रवेताचकासा कंद्र शासानां, राज्य शासानांाकडूनां दिकंवेा एखंादाया स्र्थीादिनांक प्रादिधकरणेाकडूनां कोणेताीहुी सावेलता हुवेी असाल्यासा ताी दिमाळाण्याचा हुक्क नांसाेल.

(६) उक्ता अदिधदिनांयमाच्या कलमा २४ च्या तारताुदांनांा अधीनां राहुूनां प्रवेताचकाकडूनां हुवेाई रज्जूमागच बांधकामासाठाी वेापरलेली वे वेापरण्यायोग्य स्थिस्र्थीर वे अस्थिस्र्थीर मालमात्ता एकवेीसा (२१) वेर्षाच कालावेधीच्या आता खंरेदाी करण्याचा अदिधकार शासानां राखंूनां ठाेवेता आहुे.

(७) राज्य शासानांासा साक्षमा प्रादिधकरणेांकडूनां सांरचानांा, सांकल्पनांा, सामाग्रीचा दाजाच, साुरक्षा घटक, बांधकामाचाी आदिणे ताणे माोजण्याचाी पद्धताी आदिणे आवेश्यक वेाटताील असाे इतार तांदित्राक तापशील यर्थीोदिचातारीत्या तापासाूनां घेण्याचा वे प्रमादिणेता करण्याचा हुक्क असाेल यासाठाी प्रवेताचक सावेचजदिनांक बांधकामा दिनांयमावेलीताील अटी वे दिनांयमांच्या अनांुर्षांगानांे योग्य आकारणेी शासानांासा आगाऊ भारेल.

(८) सादार हुवेाई रज्जूमागच नांगरपादिलका क्षेत्राता नांसालेल्या कोणेत्याहुी माहुामागाचवेरूनां, रेल्वे मागाचवेरूनां आदिणे ट्रामा मागाचवेरूनां दिकंवेा खंाणेीच्या मालमात्ताेवेरूनां जाता कामा नांये आदिणे ताो दाळाणेवेळाणेाच्या सावेचजदिनांक मागाचवेरूनां जाता असाेल त्याबाबताीता माु ंबई हुवेाई रज्जूमागाचबाबता दिनांयमा, १९५९ (यासा यानांतार ज्यांचा " दिनांयमा " असा उल्लेखं करण्याता आलेला आहुे) ज्याच्या दिनांयमा ५ माधील उप दिनांयमा ३ अन्वेये दिवेदिनांदिदाचष्ट केल्याप्रमाणे पुरेसाे सांरक्षक उपाय योजण्याता येताील.

(९) उक्ता अदिधदिनांयमाताील वेर उल्लेदिखंलेल्या अट क्रमांक ६ माधील आदिणे कलमा २५ च्या तारताुदाीच्या अधीनांताेनांे प्रवेताचकासा योग्य वेाटेल अशा रीताीनांे उपक्रमाच्या मालकीच्या सावेच जदिमानांी, इमारताी, बांधकामाे, साधनांसामाग्री सायंत्रा आदिणे उपकरणे सांचा दिनांकालाता काढीण्याचा दिवेकल्प प्रवेताचकासा असाेल.

(१०) सावेचजदिनांक दिहुताच्या दाृष्टीनांे पुढीलपैकी कोणेत्याहुी बाबताीता, राज्य शासानांासा आवेश्यक वेाटेल तार ताो रज्जुमागच शासानांासा ताब्याता घेता येईल.

(अ) राज्य शासानांाच्या माताे, प्रवेताचकानांे उक्ता अदिधदिनांयमाद्वारे दिकंवेा तादान्वेये करणे आवेश्यक असालेली कोणेताीहुी गोष्ट करण्याता बुद्धीपरस्पर आदिणे गैरवेाजवेीरिरत्या दिदाघच वेगळाणेूक दिकंवेा कसाूर केलेली आहुे.

(ब) अंदितामा आदाेशाच्या कोणेत्याहुी अटीचाे आदिणे शताीचाे प्रवेताचकानांे उल्लघंनां केलेले आहुे.

(११) इतार दिवेद्युता आदिणे यांदित्राक उपकरणे खंालील प्रमाणे असाताील :–

(अ) माहुादिवेतारणेकडूनां पुरेसा वेीजपुरवेठा

(ब) पुरेश्या क्षमाताेचा अदितारिरक्ता दिडझेलजनांरेटर

(क) माोटर १६०KW AC (प्रार्थीदिमाक), VVVF ड्राइव्हु

(ड) आपत्कालीनां एसाी माोटर ४० दिकलोवेॅट (प्रार्थीदिमाक)

(ई) १० दिकलोवेॅट माोटरसाहु रेस्क्यूड्राइव्हु (प्रार्थीदिमाक)

(फ) आवेश्यक क्षमाताेचा ११ KV/४४० चा ट्रान्साफॉमाचर उपरोक्ता प्रेरक शक्ताीसाठाी खंालील अटी-शताीवेर वेापरला जाईल (i) स्टँडबाय दिडझेल जनांरेटर सांचा फक्ता माहुादिवेतारणेकडूनां वेीज उपलब्ध नांसातानांाचा वेापरला जाईल.

(ii) रोपवे चालू असातानांा आपत्कालीनां अे. साी. माोटर अद्युयावेता स्थिस्र्थीताीता ठाेवेली जाईल.

(ग) सादास्य सादिचावे, माहुाराष्ट्र हुवेाई रज्जुमागच साल्लागार मांडळा यांच्या सामावेता सामान्वेय ठाेऊनां ताे सांगताील त्याप्रमाणे साुरदिक्षताताेसाठाी लागणेारी इतार सावेच साधणे वे उपकरणे.

(१२) सांबंदिधता मानांकानांुसार हुवेाई रज्जुमागच प्रणेालीताील रज्जू मागाचता येणेाऱ्यासावेच दिठाकाणे वे त्याताील वेस्ताु वे रज्जुमागच याता साुरदिक्षता अंतार (headway) ठाेवेण्याता यावे.

(१३) प्रवेताचकाद्वारे रज्जुमागाचचाे दिकमाताीच्या ३% वेर बी.जी. दिकंवेा एफडीआरच्या स्वेरूपाता साुरूवेाताीला ५ वेर्षाचच्या कालावेधीसाठाी साुरक्षा अनांामाता जी हुवेाई रज्जुमागच चालवेायचा कालावेधी सांपेपयचता दार ५ वेर्षाचनांी ताीचाे नांुतानांीकरणे केले जाईल अशी साुरक्षा अनांामाता जमा केली जाईल.

(१४) रोपवेवेरील वेाहुताूक खंालील प्रकारे व्यवेस्र्थीादिपता केली जाईल.

(i) प्रत्येक डब्याताील प्रवेाशांचाी सांख्या साहुा ताे आठा माणेसाे यापेक्षा जास्ता नांसावेी वे दिडझेाइनांमाध्ये (सांकल्पनांाता) दिवेचाराता घेतालेल्या क्षमाताेनांुसार असाेल.

(ii) रोपवे चालू असातानांा प्रवेताचक प्रवेाशांनांा घेऊनां जाण्यासा नांकार दाेऊ शकणेार नांाहुीता.

(iii) प्रवेताचक खंालील प्रवेाशांनांा घेऊनां जाण्यासा नांकार दाेऊ शकताो.

(अ) आजारी प्रवेासाी

(ब) स्फोटके, शस्त्राे दिकंवेा अत्यंता ज्वेलनांशील पदार्थीच, सामानां वेाहुूनां नांेणेारे प्रवेासाी.

(क) कोणेत्याहुी प्रौढी व्यक्ताीचाी साोबता नांसाणेारा बारा वेर्षाचखंालील प्रवेासाी

(ग) माद्युधु ंदा अवेस्र्थीेता असालेला दिकंवेा माद्यु वेा मादाक पदार्थीच बाळागूनां असालेला प्रवेासाी.

(१५) दाुताफाच प्रवेासासाठाी प्रवेाशांचाे दार खंाली दिदालेल्या ताक्त्यानांुसार असाताील दाराता वेगच अ च्या प्रवेाशांसाठाी प्रताीप्रवेाशी रु.१०/- वे वेगच 'ब' च्या प्रवेाशांसाठाी प्रताी प्रवेासाी रु.५/- याप्रमाणे दार दाोनां वेर्षाचनांी भाडेवेाढी हुोईल तार मालवेाहुताुकीसाठाी दार दाोनां वेर्षाचनांी रु.१/- प्रताी दिकलो इताकी दारवेाढी हुोईल.

भाग चार-ब-८६–२४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, बुधवार माचष ५, २०२५/फाल्गुन १४, शके १९४६ (१) आपत्ताी दिनांवेारणे कायदा वे साुव्यवेस्र्थीा ढीासाळाणे (रोपवेच्या भाडेदारांमाुळाे दिनांमाचणे हुोऊ शकणेारी गंधळाचाी परिरस्थिस्र्थीताी धरूनां) अशा कमालीच्या /टोकाच्या परिरस्थिस्र्थीताीता राज्य शासानांासा बॉम्बे एरीअल रोपवे ॲक्ट, १९५५च्या कलमा ९ (उपकलमा १५) नांुसार उपरोक्ता भाडेदार साुधारिरता करावेयाचाे अदिधकार असाताील. अशा परिरस्थिस्र्थीताीता प्रवेताचकांनांा त्यांच्या रोपवे वेापरू दाेण्याच्या कालावेधीता योग्य ताी वेाढी दाेऊनां याचाी नांुकसानां भारपाई दाेण्याता येईल.

प्रवेताचकानांे खंालील अटंसाहु रोपवे उभारावेा :

(२) प्रवेाशांचाे वेगीकरणे खंालीलप्रमाणे आहुे :

(i) वेगच 'अ' प्रवेासाी – वेयोगट १२ ताे ७५ वेर्षाे

(ii) वेगच 'ब' प्रवेासाी – वेयोगट ३ ताे १२ वेर्षाे दिकंवेा ७५ वेर्षाचवेरील आदिणे चालण्याता अक्षमा असालेल्या कोणेत्याहुी वेयोगटाताील व्यक्ताी.

(iii) ३ वेर्षाचपेक्षा कमाी वेयाच्या प्रवेाशांनांा दितादिकटाचाी आवेश्यकता नांाहुी.

(१६) प्रवेताचकानांे खंालील अटंसाहु रोपवे उभारावेा :

(a) योग्य त्या सांदिहुता/ मानांकां नांुसार रेखंादिचात्राे आदिणे वेैदिशष्टयां नांुसार या हुवेाई रज्जुमागाचचाे योग्य आदिणे साुरदिक्षता पद्धताीनांे बांधकामा करणे.

(b) उक्ता हुवेाई रज्जुमागाचसा आधार दाेणेारे खंांब/सांगाडा केवेळा मांजूर नांकाशांता दाशचदिवेल्या प्रमाणेचा उभारले जाताील.

(c) प्रवेताचकासा प्रदानां केलेल्या स्वेातांत्र्याचा आदिणे अदिधकाराचा वेापर करतानांा, प्रवेताचकानांे उक्ता जदिमानांीचाे दिकंवेा लाकूड ंपणे इत्यादाी यांचाे कमाीता कमाी नांुकसानां केले पादिहुजे तासाेचा दिकंवेा इतार झेाडे, पीक दिकंवेा वेनांस्पताी, रस्ताे, इमारता, दारवेाजे/द्वार आदिणे कं रस्ताे, इमारतांचाे इत्यादाीचाे नांुकसानां झेाल्यासा ताे स्वेखंचाचनांे साुस्थिस्र्थीता आणेले पादिहुजे. रज्जुमागच कायाचस्थिन्वेता करतानांा सापडणेाऱ्यासावेच माौल्यवेानां धाताु, सादिहुत्य दिकंवेा वेस्ताू शासानांाकडे साुपूदाच केल्या पादिहुजेता.

(d) पयाचवेरणे, सांस्कृताी, लँडस्केप, वेनांस्पताी आदिणे जीवेजंताू आदिणे या दिठाकाणेचाी इतार कोणेताीहुी स्र्थीादिनांक वेैदिशष्टये बादिधता हुोणेार नांाहुीता याचाी काळाजी प्रवेचताकानांे घ्यावेी वे तासाेचा त्यांचाी दाेखंभाल करण्याता यावेी.

(e) हुवेाई रज्जुमागाचचाे कायच साुरू झेाल्यावेर, प्रवेताचकांनांी सावेच अदितारिरक्ता सादिहुत्य, प्लॉट, तात्पुरत्या इमारताी आदिणे इतार उपकरणे काढीूनां टाकाव्याता आदिणे सावेच कचानांा इत्यादाी काढीूनां टाकावेा आदिणे शासानांाचाे सामाधानां हुोईल या पद्धताीनांे साईट/ जागा साुस्र्थीताीता आणेूनां द्युावेी.

(f) सादार हुवेाई रज्जुमागच वे इतार कामाे वे सादार जदिमानांीवेर केलेले दिकंवेा उभारलेले बांधकामा, साुधारात्माक वे प्रदिताबंधात्माक दाेखंभालीद्वारे प्रदानां केलेले हुक्क वे स्वेातांत्र्यांचाे पालनां करूनां कायमास्वेरूपी चांगल्या स्थिस्र्थीताीता ठाेवेावेता.

(g) दाोनां स्र्थीानांकांदारम्यानां प्रवेासाी वेाहुताूक करण्यासाठाी साुरदिक्षता, कायचक्षमा आदिणे योग्यरिरत्या सामान्वेदियता अशी हुवेाई रज्जुमागच साेवेा प्रदानां करणे.

(h) कोणेत्याहुी व्यक्ताीच्या वेैयस्थिक्ताक दाुखंापताीच्या दिकंवेा माृत्युच्या सांदाभाचता सावेच कायचवेाहुी, दावे आदिणे मागण्या ज्याला, दिकंवेा कोणेत्याहुी जंगमा मालमात्ताेला कोणेताीहुी इजा झेाली आहुे दिकंवेा नांुकसानां झेाले आहुे. अशा कारणेांमाुळाे दिकंवेा कारणेांमाुळाे उद्भावेलेल्या अशा कोणेत्याहुी कृताी, कायचवेाहुी , दावे आदिणे मागण्या यासाठाी प्रवेताचकानांे नांुकसानां भारपाई द्युावेयाचाी आहुे वे यासाठाी शासानांासा आश्वेस्ता करण्याता यावे.

(i) प्रवेताचकाच्या नांावेावेर दिवेम्याचाी पॉदिलसाी लागू असावेी आदिणे कोणेत्याहुी नांुकसानांीच्या दादियत्वेादिवेरुद्ध, दावेा वेा कायचवेाहुी दिकंवेा सारकार आदिणे प्रवेताचक वेा त्यांपैकी कोणेत्याहुी व्यक्ताीच्या वेैयस्थिक्ताक दाुखंापताी दिकंवेा माृत्युच्या सांदाभाचता करण्याता आलेली कायचवेाहुी वे तासाेचा सादार रोपवेचाे बांधकामा, वेापर रोपवेचाी स्थिस्र्थीताी दिकंवेा अस्थिस्तात्वेामाुळाे दिकंवेा त्याअनांुर्षांगानांे उद्भावेलेली कोणेताीहुी इजा दिकंवेा नांुकसानां यासाठाी प्रवेताचकानांे दिवेमा पॉदिलसाी काढीावेीता. शासानांा ज्या-ज्या वेळाेसा त्याअनांुर्षांगानांे दिवेमा पॉदिलसाी प्रवेताचकानांे काढीली दिकंवेा कसाे? याचाी मागणेी करेल ताी त्यावेळाेसा शासानांाच्या प्रदितादिनांधीसा उपलब्ध करूनां दिदाली पादिहुजे.

(j) रज्जुमागाचचाे स्र्थीानांकावेर दिकंवेा इन्स्टॉलेशनांवेरील सावेच ज्वेलनांशील सामाग्री आदिणे त्याताील सामाग्रीच्या सांदाभाचता आगीमाुळाे हुोणेारे नांुकसानां दिकंवेा हुानांी यासाठाी दिवेम्याचाी पॉदिलसाी स्वेता:च्या नांावेानांे काढीावेी वे ताी जवेळा बाळागावेी.

(k) प्रवेाशांच्या साोयीसाठाी केटरिरंग हुॉटेल्सा, रेस्टॉरंट, स्वेच्छतागृहु आदिणे इतार साुदिवेधा दिकंवेा साुदिवेधा यांचाी पुरेशी व्यवेस्र्थीा करावेी.

(l) हुवेाई रज्जुमागच वेाहुताुकीशी सांबंदिधता प्रकरणेामाध्ये प्रवेताचकानांे दिनांयुक्ता केलेले अदिधकारी आदिणे इतार कमाचचाऱ्यांनांा प्रदिशक्षणे द्युावे जेणेकरूनां आपत्कालीनां परिरस्थिस्र्थीताीता, प्रवेताचक हुवेाई रज्जुमागाचचाी दाेखंभाल आदिणे सांचालनां करू शकेल.

(m) सांसादाेच्या आदिणे/दिकंवेा राज्य दिवेधानां मांडळाच्या कोणेत्याहुी कायद्युाच्या दिकंवेा कायद्युांद्वारे वेा त्यावेळाच्या कोणेत्याहुी दिनांयमा, दिवेदिनांयमा दिकंवेा उपदिवेधीद्वारे लादालेल्या सावेच जबाबदाऱ्यापूणेच कराव्याता आदिणे अशा सावेच गोष्टी करणे दिकंवेा अंमालाता आणेणे दिकंवेा कामाे, कृत्ये आदिणे गोष्टी, जसाे की अशा कोणेत्याहुी कृताीच्या अंतागचता उद्भाणेाऱ्यासावेच दाव्यांचाी मागणेी आदिणे त्यासांबंधाता उत्तारदादियत्वेाच्या दिवेरोधाता सारकारला नांुकानां भारपाई दिमाळावेूनां दाेण्यासाठाी शक्य त्या त्या सावेच दिठाकाणेी शासानांासा या अनांुर्षांगानांे उद्भावेणेाऱ्यादाव्यांसाठाी या दाव्यांचाी पुताचता प्रवेताचकानांे आपल्या खंचाचता वे स्तारावेर करावेी वे यासाठाी शासानांासा आश्वेस्र्थी करावे.

(n) रज्जुमागच स्र्थीानांकावेर जा-ये करण्यासाठाी आवेश्यक पोचामागच स्वेखंचाचनांे बांधणे आदिणे त्यांचा योग्य प्रकारे दाेखंभाल करणे.

(o) हुवेाई रज्जुमागाचच्या स्र्थीानांकाच्या परिरसाराता कार आदिणे बसाेसाच्या पादिकंगसाठाी, रहुदारीसाठाी योग्य ताो भाूखंड उपलब्ध करूनां दाेणे आदिणे पादिकिगच्या दिठाकाणेी जाण्यासाठाी स्वेखंचाचनांे योग्य ताो पोचामागच तायार करणे आदिणे असाे पोचामागच चांगल्या स्थिस्र्थीताीता ठाेवेणे.

(१८) उक्ता दिनांयमाच्या दिनांयमा ५, पोट दिनांयमा ३ अनांुसार रज्जुच्या वेगवेगळाया भागाखंाली दिकमानां माोकळाी जागा ठाेवेण्याता येईल.

(१९) साध्या अस्थिस्तात्वेाता असालेले मागच/बांधकामा दिकंवेा भादिवेष्याता दिनांयोजनांाद्वारे अस्थिस्तात्वेाता येणेारे कोणेताेहुी मागच/बांधकामा रज्जुमागाचच्या खंाली येता असाल्यासा त्या त्या दिठाकाणेी रज्जूमागाचच्या खंाली योग्य सांकल्पनांा असालेली पोलादाी/आर.साी.साी. रक्षकांचाी तारताूदा करण्याता येईल.

(२०) प्रवेताचकानांे प्रदिताभाूताी ठाेवे म्हुणेूनां रूपये ५०,००० (रूपये पन्नांासा हुजार) फक्ता एवेढी रक्कमा राज्य शासानांाकडे ठाेवेणे आवेश्यक असाेल, हुी प्रदिताभाूताी ठाेवे (Bank Guarantee) प्रवेताचकानांे रोखंीनांे अर्थीवेा शासानांाकडे मान्य केलेल्या रोखंपत्राच्या स्वेरूपाता अधीक्षक अदिभायंता (सावेचजदिनांक बांधकामा) दिवेद्युता मांडळा, माु ंबई अंतागचता उदावेाहुनां दिनांरीक्षकांकडे भारावेी.

(२१) रज्जुमागच दिनांव्वेळा प्रवेासाी वेाहुताूकीसाठाीचा वेापरण्याता येईल.

(२२) सादार हुवेाई रज्जुमागाचचाे बांधकामा साुरू हुोण्यापूवेी वे पूणेच झेाल्यानांतार तासाेचा अंदितामाता परवेनांगी दिमाळाल्यानांतार हुवेाई रज्जुमागच चालू असातानांा आवेश्यकताेनांुसार स्र्थीादिनांक प्रादिधकरणे राज्य शासानां आदिणे कंद्र शासानां यांच्या दिनांयमा, कायदाे यांचाी अंमालबजावेणेी नां केल्यासा त्याच्या परिरणेामांचाी सांपूणेच जाबाबदारी प्रवेताचकाचाी रादिहुल.

(२३) तासाेचा प्रवेताचकांनांी नांदा घ्यावेी की, उपरोक्ता १ ताे १४ अटी शताीचा भांग झेाल्यासा शासानांामाफिता/ या सादिमाताीमाफित् बॉम्बे एरीअल रोपवे ॲक्ट, १९५५ माधील कलमा ९ (उपकलमा-१) माधील तारताुदाीनांुसार उदिचाता कायचवेाहुी केली जाईल.

Maharashtra aerial ropeway act.

No. Ropeway 2024/CR 02/Roads-5.–Whereas, Shree. Khandoba Devataling Kadepathar Trust, Jejuri, Tal. Purandhar, District-Pune, Pin No.- 412303, Maharashtra (hereinafter referred to as "the Promoter") has made preliminary investigation at Kadepathar, Jejuri, Taluka Purandar, District- Pune for the construction of an Aerial Ropeway from the bottom of the hill to the Kadepathar Khandoba temple at the hill top at Jejuri, District Pune, Maharashtra ;

And whereas, the Promoter has, after completing the preliminary investigation applied to the State Government vide letters dated 6th September 2021 and 27th January 2022 under section 9 of the said Act to authorize the promoter for the Construction of the ropeway ;

And whereas, by the Government Notice, Public Works Department, No. Ropeway- 2024/C.R.02/ Road-5, dated the 7th June 2024, the Government of Maharashtra had announced its intention to make an order in exercise of the powers conferred by sub- section (1) of section 10 of the Maharashtra Aerial Ropeways Act (III of 1955) with a view to authorize the promoter to construct the said Aerial Ropeway ;

And whereas, no objections and suggestions have been received by the Government of Maharashtra pursuant to the said notice of draft order within the period prescribed therein;

And whereas, the Government of Maharashtra, after considering the application considers it expedient to grant the application of promoter to authorize the promoter for construction of Passenger Aerial Ropeway from the bottom of the hill to the Kadepathar Khandoba temple at the hill top at Jejuri, District Pune, Maharashtra.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 10 of the Maharashtra Aerial Ropeways Act (III of 1955), and of all other powers enabling it in this behalf, the Government of Maharashtra hereby authorizes the promoter to construct Passenger Aerial Ropeway from the bottom of the hill to the Kedepathar Khandoba Temple at the hill top at Jejuri, District Pune, Maharashtra, subject to the following conditions, namely:-

(1) The Promoter shall obtain all necessary No Objection Certificates and submit the same to the State Government before issue of the order.

(2) The Promoter shall assess and certify that he has raised twenty-five per cent. of the capital for the project and shall raise the balance seventy-five per cent. capital within a period of one year from the date of issue of final order.

(3) The Promoter shall commence the construction within a period of eight months from the date of issue of this order.

(4) The Promoter shall complete the construction of the proposed Aerial Ropeway within Twenty- four months from the date of commencement of the construction as per condition (3) hereinabove.

(5) The Promoter shall not be entitled to concessions if any from the Central Government, State Government or a local authority for this project.

(6) The State Government reserves the right to purchase all movable and immovable property of the Promoter suitable to and used by him for the purposes of an Aerial Ropeway from the Promoter after the period of twenty-one years, subject to the provision of section 24 of the said Act. (7) The Government has the right to get the structural design, quality of materials, factor of safety, method of construction and computing stresses and such other technical details, as may be considered necessary, duly checked and approved by the Competent Authority of the Stateबुधवार माचष ५, २०२५/फाल्गुन १४, शके १९४६ ७ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, Government. For this, the Promoter shall pay the necessary fee as per Appendix V of the Maharashtra Public Works Manual to Government in advance.

(8) The Aerial Ropeway shall not pass over any Highway, Railway and Tramway, within Municipal areas or over mining properties and where it is passing over public ways of communications, adequate protective measures shall be taken as specified in sub-rule (3) of rule 5 of the Maharashtra Arial Ropeways Rules,1959 (hereinafter referred to as "the said rules").

(9) The Promoter shall have an option to dispose of all lands, buildings, works, materials, plant and apparatus belonging to the undertakings in such manner as he may thinks fit, subject to the provisions of condition (6) hereinabove and section 25 of the said Act.

(10) The State Government may take over the ropeway in the public interest, if deems it necessary, in any of the following cases, namely:-

(a) Where the Promoter, in the opinion of the State Government, makes wilful and unreasonably prolonged omission or default in doing anything required by him or under the said Act.

(b) Where the Promoter violates any of the terms and conditions of this order.

(11) Other electrical and mechanical devices required would be as under :-

(a) Adequate power supply from the MSEDCL.

(b) Stand by Diesel Generator Set of adequate capacity.

(c) Motor 160 KW AC (preliminary), VVVF Drive.

(d) Emergency A.C. Motor 40 KW (preliminary).

(e) Rescue Drive with 10 KW Motor (preliminary).

(f) Transformer of 11 KV/440 of required capacity shall be used for aforesaid motive power shall be subject to the following condition :–

(i) Stand by diesel Generator Set shall be used only during non-availability of power from the MSEDCL.

(ii) Emergency A/c motor shall be kept in up-to-date condition during the hours when the ropeway is in operation.

(g) All other instruments, devices required for safety and security of the ropeway system in co-ordination with Member Secretary, Aerial Ropeway Advisory Board of the State of Maharashtra.

(12) The required Safe Head way shall be maintained under different parts of the rope as per the stipulation indicated in relevant Code or Standard.

(13) The Promoter shall deposit the amount of 3 per cent. of the cost of the ropeway as security deposit in the form of Bank Guarantee or Fixed Deposit Receipt for a period of five years, which shall be further extended every five years, till the operation period is over.

(14) The traffic on the ropeway shall be managed in the following manner :-

(i) The number of passengers to be carried on each carriage shall not exceed six to eight persons and will be as per the rated capacity considered in the design.

(ii) The promoter shall not refuse to carry the passengers when the ropeway is in operation.

(iii) The promoter may refuse to carry the passengers who is ,–

(a) Not well i.e., ill.

(b) Carrying explosives, arms or highly inflammable material or luggage.

(c) Below the age of twelve years and not accompanied by any adult person.

(e) Who has consumed or carrying alcohol or drugs.

(15) The rate for two-way journey shall be as per the table given below. The rates will be increased by Rs.10/- for Class A passengers Rs.5/- for Class B passengers for every 2 years and Rs.1.00 / kg. for goods every 2 years :–

(1) In the extreme situation like disaster relief and instigation, disturbance in law and order (due to any reason including commotion of public on the ticket of the ropeway facility) the State Government may revise the already decided ticket rates as per clause (xv) of subsection (4) of section 9 of the Maharashtra Aerial Ropeways. In such events, promoter may be duly compensated by increasing the operationalization of the Aerial Ropeway than the agreed time period.

(2) Classification of Passengers is as below :–

(i) Class-A passenger – age group between 12 to 75 years

(ii) Class-B passenger – age group between 3 to 12 years or beyond 75 years and persons of any age with walking disability.

(iii) Passenger below the age of 3 years do not require ticket.

(16) The promoter shall erect the ropeway with the following conditions :-

(a) The said Aerial Ropeway shall be constructed with proper and safe workmanship in accordance with the Approved drawings and specifications conforming to the relevant Codes / Standards.

as shown in the approved drawing.

(c) While exercising the liberty and power hereby granted, the Promoter shall do as little damage as possible to the said lands or the timber or other trees under wood, crop or vegetation, roads, building, gates and fences, etc. thereon and shall repair any damage to roads and building etc and will hand over to the Government all precious metal, material, items or articles, that may be found during the course of the execution of the ropeway.

(d) To ensure that the environment, culture, landscape flora and fauna and any other local features of the place are not disturbed and are maintained.

(e) Upon commencement of operations of the aerial ropeway, the Promoter shall clear away all surplus material, plant, temporary buildings and other Equipments and shall remove all rubbish etc; and leave the site in good order to the satisfaction of Government.

(f) To keep the said ropeway and other works erected on the said land, in good condition at all times through corrective and preventive maintenance.

(g) To provide safe, efficient and properly co-ordinated Aerial Ropeway service for carriage of passenger between two stations.

(h) To keep the Government at all times indemnified for all action proceedings, claims and demands in respect of any personal injury or the death of any person whomsoever or any injury or damage whatsoever to any property movable or immovable, arising out of or in the course of or by reasons of the construction, on-going use conditions or existence incidental to any such action, proceeding, claims and demands.

(i) To effect and maintain a policy of insurance in the name of the promoter against any loss liability, claim or proceeding incurred by or made or brought against the Government and promoter or either of them in respect of any personal injury or death of any person whomsoever or any injury or damage whatsoever arising out of or in the course of or by reason of the construction, working use, condition or existence of the said ropeway and reproduce the policy and receipt for the current premium thereon to the Government or the person authorized by the Government upon demand.

(j) To effect and maintain in its own name a policy of insurance against loss or damage by fire in respect or of all combustible material and the contents thereof on the stations or on the installation.

(k) To make adequate arrangement of catering hotels, restaurant, Rest room and other amenity or facility for the benefits of Passenger. All statutory permission from the Government and Local Authority shall be taken by the Promoter and all conditions, terms mentioned in these permissions shall be adhered to.

(l) To train officers and other staff employed by the promoter in the matter connected with the Aerial Ropeway transport, so that in a situation of emergency, the promoter can maintain and operate the aerial ropeways.

(m) To comply with all obligations imposed under or by virtue of any Act or Acts of the Parliament and State Legislature or by any rules, regulations or bye-laws of the time being in force and do and executed or cause to be done or executed all such works, acts, deeds, matters and things as under or by virtue of any such act or acts are or shall be properly directed or necessary to be done or executed in respect of the said land or which it shall use or occupy under the liberty in that behalf herein before granted and at all times to keep the Government Indemnified against all claims demand and liability in respect thereof.

(n) To construct at its own cost all approach roads to landing from ropeway stations and maintain the said roads in good conditions.

(o) To make available to the traffic suitable plots of land for parking of cars and buses in the१० महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, बुधवार माचष ५, २०२५/फाल्गुन १४, शके १९४६ vicinity of the station of the said aerial ropeway and construct at its own cost suitable approach road for access to the parking place and maintain such roads in good condition.

(17) The total length of Ropeway shall be approximately 1026 meters, height approximately 200.5 meters and the capacity of each cabin shall be to accommodate 4 to 6 passengers with handlings capacity of maximum upto 600 to 1000 passengers per hour. The Speed of Ropeway shall be approximately 3 meters per second. The construction of the Ropeway will be done as per the provisions of the said Act and the said rules and as per the relevant and applicable IS codes. The Ropeway shall be driven by electric power with stand- by power arrangement by diesel generating set and in case of failure of both, there shall be built-in arrangement by a Diesel Engine to rescue the stranded passengers. The minimum distance between the successive cars shall be 75 meters.

(18) The minimum headway shall be maintained under different parts of the rope as per sub- rule (3) of rule 5 of the said rules.

(19) Adequately designed steel or R.C.C. guards shall be provided below the Ropeway, wherever it is passing over any other road or structure to be planned and constructed in future.

(20) The Promoter shall deposit an amount of rupees fifty thousand in the form of Bank Guarantee or Fixed Deposit Receipt, as Security Deposit for inspection of Lifts, with the Inspector of Lifts under the jurisdiction of Superintending Engineer (Electrical) Mumbai.

(21) The Ropeway shall be used exclusively for passenger traffic.

(22) The Promoter shall comply with all the rules, regulations, of the local authorities, State Government and Central Government wherever necessary before and after the commencement and completion of construction of the said Ropeway and during the operation, after the final permission granted by the Government in this regard and the promoter shall always be responsible for the consequences of non-compliance thereof.

(23) Also, the promoter shall take note that any breach of the above conditions from 1 to 14 may lead for taking action against him as per clause (ix) of sub-section (4) of section 9 of the Maharashtra Aerial Ropeways Act.
