Notice

Read.—(1) Proposal by Executive Engineer /'A' Division Mumbai Building Repairs & Reconstruction Board, vide No./ 118/2025 dated- 16/01/2025.

(2) Department of Housing, Government of Maharashtra, Government Decision Vimanka-2019/ P. No.148 (Part-1)/ RR-1 dated -22/08/2023.

(3) Govt. Resolution No. Land Acq. 2024/ P. No.38 /RR-1 dated-02/12/2024.

No/SLAO/MBRRB/ 46/2025.— The property situated at C.S. /F.P. No.1235 of Fort Divn, Bldg No. 221, bearing Cess no. A-2008, 2012, 2627 Bldg No. 221 Mint Road (11-13) "Modi street" Mumbai-01 for which NOC for redevelopment granted vide letter No. R/NOC/F 1510/3685/MBR&R Board Dated 08/08/2017 by Chief Officer/ MBR&R Board.

And whereas Vice President and CEO MHADA in respect of the said land submitted proposal to the department of Housing, of Maharashtra dated 30/04/2024 and 12/09/2024 for approval of land acquisition of said land as per 91A section of MHAD Act, 1976 for issue of clearance and compulsory acquisition order to clear and acquire the said land and whereas the Govt. of Maharashtra approved the said acquisition proposal under MHAD Act, 1976 section 91(A) and 93(1) for area 209.50 Sq.m. of said property vide Govt. Resolution No. Land Acq. 2024/ P. No.38/RR-1 dated-02/12/2024 ;

And in exercise of the powers conferred under section 93(3) & 93(4) of the said act, I undersigned Rupali Bhalke, Special Land Acquisition Officer, Mumbai Building Repair and Reconstruction Board give notice that the Govt. of Maharashtra has approved the said acquisition proposal vide Govt. Resolution No. Land Acq. 2024/ P. No.38 /RR-1 dated- 02/12/2024 and that the said land must be vacated within 15 days from the date on which the clearance and compulsory acquisition order which may be issued by Special Land Acquisition Officer, Mumbai Building Repair and Reconstruction Board, Mumbai under sub-section (5) of section 93 of the said act become operative. The alternate accommodation shall be provided as per the availability and only after receiving application from the Tenants / Occupants.

The Occupiers, Owner, Developer, Lessee and Mortgagors (if any) of the said land are hereby called upon to submit objections and suggestions in duplicate, if any, to the acquisition proposal and why the said land with the existing building thereon, (if any) should not be acquired, so as to reach at the office of the Executive Engineer/A Division at First floor, Colaba Transit Camp, Mumbai 5 or Special Land Acquisition Officer/RR Board, Room No 337, Second Floor, Gruhnirman Bhavan, Bandra East, Mumbai -51 on or before 15/04/2025.

Note - The acquisition proposal as approved by Govt. is kept open for inspection to the public in the office of Executive Engineer, A Divn., Mumbai Repair and Reconstruction Board, First floor, Colaba Transit Camp, Mumbai 05 during office hours except Saturday, Sunday and other Public holidays.

No.865 of Girgaon Divn., Bldg No. 68-72, bearing Cess No. D-2112 Third cross lane, Khetwadi Back Road, Girgaon Mumbai-4 known as "Rupawala Building" for which NOC. for, redevelopment granted vide Letter No. F/1958/4595/ MBR&R Board Dated 14/09/2011 by Chief Officer/ MBR&R Board;

And whereas, Vice President and CEO. MHADA in respect of the said land submitted proposal to the Department of Housing of Maharashtra Dated 08/05/2024 and 05/06/2024 for approval of land acquisition of said land as per 91A section of MHAD Act, 1976 for issue of clearance and compulsory acquisition order to clear and acquire the said land and where as the Government of Maharashtra approved the said acquisition proposal under MHAD Act, 1976 section 91(A) and 93(1) for area 147.16 Sq.m. of said property vide Government Resolution No. Land Acq. 2024/ P. No.41/RR-1 dated-11/10/2024.

And in exercise of the powers conferred under section 93(3) & 93(4) of the said act, I undersigned Rupali Bhalke, Special Land Acquisition Officer, Mumbai Building Repair and Reconstruction Board give notice that the Govt. of Maharashtra has approved the said acquisition proposal vide Govt. Resolution No. Land Acq. 2024/ Prop. No.41 /RR-1 dated- 11/10/2024 and that the said land must be vacated within 15 days from the date on which the clearance and compulsory acquisition order which may be issued by Special Land Acquisition Officer, Mumbai Building Repair and Reconstruction Board, Mumbai under sub-section (5) of section 93 of the said Act become operative. The alternate accommodation shall be provided as per the availability and only after receiving application from the Tenants / Occupants.

The Occupiers, Owner, Developer, Lessee and Mortgagors (if any) of the said land are hereby called upon to submit objections and suggestions in duplicate, if any, to the acquisition proposal and why the said land with the existing building thereon, (if any) should not be acquired, so as to reach at the office of the Executive Engineer/D-2 Division at 89-95 Rajni Mahal, Tardeo Road, Mumbai -34 or Special Land Acquisition Officer/R R Board, Room No. 337, Second Floor, Gruhnirman Bhavan, Bandra East, Mumbai -51 on or before 15/04/2025.

Note .—The acquisition proposal as approved by Govt. is kept open for inspection to the public in the office of Executive Engineer, D-2 Divn., Mumbai Repair and Reconstruction Board, 89-95 Rajni Mahal, Tardeo Road, Mumbai -34 during office hours except Saturday, Sunday and other Public holidays.

NOTIFICATION

क्रमुंांक प्र.अभिभ./भिभिन/२७२०६ / सारीर्.—Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation ")as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act");

Whereas, as per the powers conferred by sub section (1) of Section 31 of the MR & TP Act, 1966 (hereinafter referred to as "the said Act"), State Government has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, Dt. 08.05.2018 (Schedule-'A') (hereinafter referred to as "the said Notification") along with the Development Control and Promotion Regulations-2034 for Greater Mumbai excluding the substantial Modification as shown in Schedule- 'B' appended thereto and the same have already come into force from 01.09.2018. And whereas, thereafter Government has issued a Corrigendum and Addendum of even number dtd. 29th June, 2018 to the said notification, which is published in Govt. Gazette dtd. 30th June, 2018 ;

And whereas, the Government of Maharashtra vide Notification dt. 21/09/2018 has sanctioned EP-1 to EP-168 (Excluding certain EP and provisions which were kept in abeyance) in the said Regulations;

And whereas, the Government of Maharashtra vide Notification dt. 12/11/2018 has issued corrigendum in respect of some typographical errors and mistakes and also to clarify and co-relate certain provisions of said Regulations for its proper interpretation;

Regulation 33(20)(B) of Development Control and Promotion Regulations-2034 stipulate about "Development of AH/R&R on private plot or plot of authority other than Govt./MCGM/Appropriate Authority."

And whereas, State Govt. vide Notification u/no. TPB-4323/287/C.R.35/2024/UD- 11 dtd. 15.10.2024 has sanctioned the modification to Regulation 33(20)B of Development Control and Promotion Regulations-2034 under section 37(2) of the said Act ;

And whereas, Under Secretary, UD-11 vide letter dtd. 31.12.2024 has informed to scrutinise regarding inclusion of additional clause in Regulation 33(20)B of Development Control and Promotion Regulations-2034 and submit the proposal to State Govt. after carrying out procedure u/s 37(1) of MR&TP Act, 1966 ;

And whereas, considering above stated facts, BMC finds it necessary for modification in sanctioned Regulation 33(20) (B) of Development Control and Promotion Regulations-2034 under section 37(1) of MR&TP Act, 1966 ;

And whereas, as per circular u/no. BMC/ADMN/3 dt. 07.04.2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 (hereinafter referred as 'MMC Act, 1888') all the powers of the Corporation are now vested with the Administrator;

And whereas, Administrator (Improvement Committee) accorded sanction u/no 93 dtd: 27.03.2025 & Administrator (Corporation) has accorded sanction to the said proposal vide resolution u/no. 1346 dtd. 27.03.2025, to process the proposal and for inviting suggestions/objections under section 37(1) of MR & TP Act, 1966 & to make correspondence with the UD Department, Govt. of Maharashtra for final sanction u/s. 37(2) of MRTP Act, 1966 for the proposed modification in Sanctioned DP 2034.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1) of Section 37 of the MR & TP Act, 1966; and of all other powers enabling it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by Section 37(1) of the said Act, for information of all persons likely to beमहाराष्ट्र शासन राजपत्र, भाग दोन-संकीर्ण सूचना व जाहहराती, ३९ गुरुवार ते बुधवार, एहल ३-९, २०२५/चैत्र १३-१९, शके १९४७ affected thereby. BMC is further pleased to inform that any objections/ suggestions in respect of the proposed modification mentioned above may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of
