ज्याअर्थी, नागपूर महानगर प्रदेशाची विकास योजना महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ (१९६६ चा महा. ३७ वा) (यापुढे " उक्त अधिनियम " असे संबोधले आहे) चे कलम ३१(१) नुसार शासन अधिसूचना, नगर विकास विभाग क्र. टिपीएस-२४१६-प्र.क्र.१२२(अ)- २०१६-एस.एम-नवि-९, दिनांक ०५ जानेवारी, २०१८ अन्वये मंजूर झाली असून ती दिनांक ०९ फेब्रुवारी, २०१८ पासून अंमलात आलेली आहे. तसेच सारभूत स्वरुपांच्या बदलांच्या वगळलेल्या क्षेत्राची पुनर्प्रसिद्ध विकास योजना शासन अधिसूचना क्र. टिपीएस-२४१६-प्र.क्र.१२२(ब)-२०१६-ई.पी.- नवि-९, दिनांक २१ फेब्रुवारी, २०१९ अन्वये मंजूर झालेली आहे. (यापुढे " उक्त विकास योजना " असे संबोधले आहे);
आणि ज्याअर्थी, उक्त विकास योजनेत, मौजा गवसी मानापूर, ता. नागपूर (ग्रा.) येथील खसरा क्र. ५१-२ (क्षेत्र ३.४८ हेक्टर), खसरा क्र. ५४-२ (क्षेत्र १.३७ हेक्टर), खसरा क्र. ४५-१-अ-१ (क्षेत्र १.३३ हेक्टर) व खसरा क्र. ४५-१-ब (क्षेत्र १.१० हेक्टर) असे एकूण क्षेत्र ७.२८ हेक्टर जागा (यापुढे " उक्त जागा " असे संबोधले आहे) वाहतूक विभागात (Transportation Zone) दर्शविलेली आहे;
आणि ज्याअर्थी, महानगर आयुक्त, नागपूर महानगर प्रदेश विकास प्राधिकरण, नागपूर यांनी नियोजन प्राधिकरण (यापुढे " उक्त नियोजन प्राधिकरण " असे संबोधले आहे) म्हणून, त्यांच्या सर्वसाधारण सभेचा ठराव क्र. ८/८, दिनांक १५ फेब्रुवारी, २०२४ नुसार, उक्त जागा वाहतूक विभागातून वगळून रहिवास विभागात समाविष्ट करण्याचे ठरवून, त्याअनुषंगाने, उक्त अधिनियमाचे कलम ३७ चे उप कलम (१) मध्ये नमूद वैधानिक कार्यवाही पूर्ण करुन फेरबदल प्रस्ताव मंजुरीसाठी शासनास सादर केलेला आहे (यापुढे " उक्त प्रस्तावित फेरबदल " असे संबोधले आहे);

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ नागपूर विभागीय पुरवणी, मंगळवार, एप्रिल ८, २०२५/चैत्र १८, शके १९४७ आणि ज्याअर्थी, आवश्यक त्या चौकशीनंतर व संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर उक्त प्रस्तावित फेरबदल काही अटींसह मान्य करावा, असे राज्य शासनाचे मत झाले आहे ;
आणि ज्याअर्थी, उक्त जमिनीच्या मालकानी सन २०२४- २५ या साठीच्या बाजारमूल्यदर तक्त्यानुसार येणाया रक्कमेच्या ५% दराने परिगणित होणाया अधिमूल्य रक्कमेपैकी शासनास देय असलेली अधिमुल्याची ५०% रक्कम रुपये ७८,०७,८००/- सहायक संचालक, नगर रचना, नागपूर शाखा, नागपूर यांचेकडील लेखाशिर्षामध्ये दिनांक २० डिसेंबर, २०२४ रोजी जमा केलेली आहे आणि नियोजन प्राधिकरणास देय असलेली ५०% अधिमूल्याची रक्कम रुपये ७८,०७,८००/- नागपूर महानगर प्रदेश विकास प्राधिकरण, नागपूर यांचेकडे दिनांक २६ डिसेंबर, २०२४ रोजी जमा केलेली आहे.
आता, त्याअर्थी, उक्त अधिनियमाचे कलम ३७ चे उप कलम (२) अन्वये व त्या अनुषंगाने असलेल्या इतर अधिकारांचा वापर करुन उक्त विकास योजनेतील प्रस्तावित फेरबदलास शासन पुढील प्रमाणे मान्यता देत आहे आणि त्यासाठी उपरोल्लिखित दिनांक ०५ जानेवारी, २०१८ ची विकास योजना मंजुरीची अधिसूचना सुधारित करण्यात येत आहे;
" उक्त विकास योजना मंजुरीच्या दिनांक ०५ जानेवारी, २०१८ च्या अधिसूचनेच्या फेरबदल सुचितील शेवटच्या नोंदीनंतर पुढील नव्या नोंदीचा समावेश करण्यात येत आहे. "----

" मौजा गवसी मानापूर, ता. नागपूर (ग्रा.) येथील खसरा क्र. ५१-२ (पै) (क्षेत्र ३.४८ हेक्टर), खसरा क्र. ५४-२ (पै) (क्षेत्र १.३७ हेक्टर), खसरा क्र. ४५-१-अ-१ (क्षेत्र १.३३ हेक्टर) व खसरा क्र. ४५-१-ब (क्षेत्र १.१० हेक्टर) असे एकूण क्षेत्र ७.२८ हेक्टर जागा वाहतूक विभागातून (Transportation Zone) वगळून मुक्त झालेले क्षेत्र, विकास योजना भाग नकाशात दर्शविल्यानुसार खालील अटींच्या अधिन राहून रहिवास विभागात समाविष्ट करण्यात येत आहे. "----
अट क्र. १ नागपूर महानगर प्रदेशासाठी लागू असलेल्या विकास नियंत्रण नियमावलीनुसार, जागेच्या रेखांकनात आवश्यक १०% खुल्या जागेव्यतिरिक्त, १०% सुविधा क्षेत्र सोडणे बंधनकारक राहील.
अट क्र.२ खुल्या जागेसभोवताली कुंपण करणे आवश्यक राहील.
अट क्र. ३ उक्त जमिनीसाठी आवश्यक त्या सर्व मूलभूत सेवा-सुविधा जमीन मालकांनी/विकसनकत्यार्ंनी स्वखर्चाने विकसित करुन पुरविणे बंधनकारक राहील. मूलभूत सुविधांमध्ये रस्ते, पाणी पुरवठा, मलनिःसारण व ड्रेनेज इ. यांचा समावेश आहे.
अट क्र. ४ उपरोक्त मूलभूत सुविधांचा विकास क्रमाने करताना एकूण अपेक्षित सुविधांचा विकास टप्प्याने होत असताना अर्जदारांवर, एकूण जागेच्या भूखंड विक्रीवर खालीलप्रमाणे बंधन राहील. महानगर आयुक्त, नागपूर महानगर प्रदेश विकास प्राधिकरण, नागपूर यांनी सदर बाबीवर नियंत्रण ठेवावे.------
(क) अभिन्यास अंतिमत: मंजूर झाल्यानंतर एकूण २५% भूखंड विक्री अनुज्ञेय राहील.
(ख) सुमारे ४०% मूलभूत सुविधा पूर्ण झाल्यावर एकूण ५०% भूखंड विक्री अनुज्ञेय राहील.
(ग) सुमारे ६०% मूलभूत सुविधा पूर्र्ण झाल्यावर एकूण ७५% भूखंड विक्री अनुज्ञेय राहील.
(घ) सुमारे ८०% मूलभूत सुविधा पूर्ण झाल्यावर एकूण ९०% भूखंड विक्री अनुज्ञेय राहील.
(ड) सुमारे १००% मूलभूत सुविधा पूर्ण झाल्यावर एकूण १००% भूखंड विक्री अनुज्ञेय राहील.
जर अभिन्यासात समुह गृहबांधणी योजना विकसित करावयाची असेल तर महानगर आयुक्त, नागपूर महानगर प्रदेश विकास प्राधिकरण, नागपूर यांनी विहित केल्यानुसार सर्व मूलभूत सुविधा विकसित झाल्याशिवाय भोगवटा प्रमाणपत्र देण्यात येणार नाही.
उक्त मंजूर फेरबदल दर्शविणारी प्रस्तुत अधिसूचना / भाग नकाशा महानगर आयुक्त, नागपूर महानगर प्रदेश विकास प्राधिकरण, नागपूर यांच्या कार्यालयात, नागरिकांच्या अवलोकनार्थ एक महिन्याच्या कालावधीसाठी ठेवण्यात येत आहे.
सदर अधिसूचना शासनाच्या www.maharashtra.gov.in या संकेतस्थळावर देखील उपलब्ध आहे.

THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
NOTIFICATION
No.TPS-2422-1513-CR-68-2023-UD-9.------
Whereas, the Development Plan of Nagpur Metropolitan Region has been sanctioned by the Government vide Urban Development Department's Notification No.TPS-2416-C.R.122(A)-SM-2016-UD-9, dated the 05th January, 2018 & has come into force with effect from the 09th February, 2018 and the Excluded parts of the substantial nature modifica- tion has been sanctioned by the Government vide Urban Development Department's Notification No.TPS-2416-C.R.122(B)- 2016-E.P.-UD-9, dated the 21st February, 2019 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, the lands bearing Khasara No.51-2(Pt.) (Area 3.48 Hectare), Khasara No.54-2(Pt.) (Area 1.37 Hectare), Khasara No.45-1-A-1 (Area 1.33 Hectare) & Khasara No.45-1-B (Area 1.10 Hectare) totally admeasuring 7.28 Hectare, of Mouja Gawasi Manapur (hereinafter referred to as "the said Land") are included in Transportation Zone;
And whereas, the Nagpur Metropolitan Region Development Authority, Nagpur (hereinafter referred to as 'the said Planning Authority"), vide its General Body Resolution No. 8/8, dated the 15th February, 2024 has resolved to delete the said Lands from Transportation Zone and to include the land so released in Residential Zone and accordingly submitted a modification proposal to the Government, for its sanction, as per the provisions of sub-section (1) of Section 37 of the said Act, (hereinafter referred to as "the said Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that, the said Proposed Modification should be sanctioned with some condi- tions;
And whereas, the Land Owners of the said Land have deposited Rs. 78,07,800/- towards the 50% Government share of 5% premium amount as per the value of the said Lands as prescribed in the Annual Statement of Rates (ASR) for the year 2024-25 in the Government Treasury on 20th December, 2024 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs.78,07,800/- payable to the Planning Authority has been deposited with the Nagpur Metropolitan Region Development Authority, Nagpur on 26th December, 2024;
Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 05th January, 2018 as follows.----
"In the Schedule of Modifications appended to the Notification dated the 05th January, 2018 sanctioning the said Development Plan, the following new entry shall be added after the last entry -
ENTRY
The lands bearing Khasara No.51-2(Pt.) (Area 3.48 Hectare), Khasara No.54-2(Pt.) (Area 1.37 Hectare), Khasara No.45-1-A-1 (Area 1.33 Hectare) & Khasara No.45-1-B (Area 1.10 Hectare) totally admeasuring area 7.28 Hectare of Mouja Gavasi Manapur, are deleted from Transportation Zone and the lands so released are included in Residential Zone, as shown on the plan, subject to the conditions specified below—
Condition No.1 - 10% Amenity Space shall be provided in the layout in addition to 10% compulsory open space, as per the prevailing Development Control Regulations of the Nagpur Metropolitan Region.
Condition No.2 - It is necessary to construct compound around the open space.
Condition No.3 - It is compulsory for the land owner / developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewerage & drainage etc.
४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ नागपूर विभागीय पुरवणी, मंगळवार, एप्रिल ८, २०२५/चैत्र १८, शके १९४७Condition No.4 - If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Metropolitan Commissioner, Nagpur Metropolitan Development, Authority, Nagpur in relation to development of basic amenities as per the stages given below.------
(a) After final approval of layout sale of 25% of the total plots shall be permissible.
(b) After completion of 40% basic Amenities. sale of 50% of the total plots shall be permissible.
(c) After completion of 60% basic Amenities. sale of 75% of the total plots shall be permissible.
(d) After completion of 80% basic Amenities. sale of 90% of the total plots shall be permissible.
(e) After completion of 100% basic Amenities. sale of 100% of the total plots shall be permissible.
If Group Housing Scheme is proposed in the layout, then occupation certificate shall not be given by the Metropolitan Commissioner, Nagpur Metropolitan Region Development, Authority, Nagpur, unless all the basic ameni- ties are fully developed;
A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification shall be available for public inspection of the general public, in the office of the Metropolitan Commissioner, Nagpur Metropolitan Region Development, Authority, Nagpur during office hours on all working days for a period of one month.
This Notification shall also be available on the Government web site www.maharashtra.gov.in
