ORDER
No.D.T.P-D.P.Anjangaon Surji-Sec-127(2)-Order-TPV-VI-1806.–
Whereas, the Development Plan of Anjangaon Surji Municipal Council has been sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Director of Town Planning, Maharashtra State, Pune vide its Notification No. TPV-6/7427, dated 18th December, 1992 (herein- after referred to as "the said Notification") & came into force with effect from dated 1st March,1993 (hereinafter referred to as the "said Sanctioned Revised Development Plan")
And whereas, in the said Sanctioned Revised Development Plan, the land bearing S.No. 32 (Part) of Mouza Khel Hadol, Taluka Anjanagaon Surji is affected by Reservation Site No. 42 "Play Ground" (hereinafter referred to as "the said Reservation") for which Appropriate Authority for acquisition and development of the said Reservation is Municipal Council, Anjangaon Surji (herein- after referred to as "the said Appropriate Authority");
And whereas, the land under said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Development Plan of Additional Limit come into force;
And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") in respect of the area admeasuring 0.48 HA. affected by the said Reservation of the land bearing S. No. 32, of Mouza Khel Hadol, Taluka Anjanagaon Surji, District Amravati (hereinafter referred to as "the said Land") had served a notice dated 05th August, 2022 as per the provisions of section 127(1) of the said Act (hereinafter referred to as "the said Notice") on the said Appropriate Authority and the same has received to Appropriate Authority on same day;
And whereas, the said land under the said Reservation is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice by the said land owner;
And whereas, the Chief Officer, Municipal Council, Anjangaon Surji has submitted the proposal vide it's letter No. 335/2025; dated 13th February, 2025 in respect of issuance of the order lapsing of the said Reservation on the said Land under the provisions of section 127(2) of the said Act; And whereas, the Joint Director of Town planning, Amravati Division, Amravati has submit- ted report vide it's letter No. 188, dated 06th March, 2025 that, it is necessary to issue an order for४ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विभागीय पुरवणी, एप्रिल १७-२३, २०२५/चैत्र २७ - वैशाख ३, शके १९४७ lapsing of the said Reservation on area admeasuring 4736 Sq. mt. of the said Land as the land acquisition procedure has not done by the said Appropriate Authority in stipulated period;
And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Revised Development Plan, the Director of Town Planning, Maharash- tra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said Reservation partly on area admeasuring approximately 4736 Sq. mt. (0.4736 HA.) of the said land;
And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813-3211-CR-508-UD-13, dated 01 st December, 2016, has delegated the powers exercisable by it under the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation partly in respect of the said land as per the provisions of section 127 (2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows- After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added:-

ORDER
No.D.T.P-V.Y.Achalpur(Su)-Section-127(2)-Order-TPV-6-1807.–
Whereas, the Revised Development Plan of Achalpur Municipal Council has been partly sanc- tioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Ur- ban Development Department vide Notification No. TPS-2899-7639-CR-123 (A)-99-UD-30, dated 15th January, 2003 (hereinafter referred to as "the said Notification") & came into force with effect from 01st March, 2003 (hereinafter referred to as "the said Sanctioned Revised Development Plan");
And whereas, in the said Sanctioned Revised Development Plan, the land bearingu S. No. 121 (pt) & 122 (pt.) of Mouza Khel Tryambak Narayan are affected by the Site No. 53 "Post Office and Quar- ters" admeasuring an area approximately 1 Ha. (hereinafter referred to as "the said Reservation"); and the Appropriate Authority for the acquisition and development of the said Reservation is the Superintendent of Post Office (hereinafter referred to as "the said Appropriate Authorityu);
And whereas, the Lands under the said Reservation have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Revised Republished Development Plan came into force;
And whereas, in respect of the land bearing S.No. 121 (pt) admeasuring area 3484.78 sq.mt. of Mouza Khel Trimbak Narayan is affected by the said Reservation, the concerned Land Owner (here- inafter referred to as "the said Land Owner") has issued a notice (hereinafter referred to as "the said notice") dated 05th August, 2022 to the said Appropriate Authority under the provisions of section 127(1) of the said Act and the same was received by the said Appropriate Authority on the same day;
And whereas, the said Land under the said Reservation is not acquired or no steps for acquisi- tion of the said Land as required under the provisions of section 127(1) of the said Act10 have been taken by the said Appropriate Authority, within a stipulated period after the date of service of the said Notice;
And whereas, as per the meeting held in the Directorate on 27th December, 2024 in pursuance of the said notice, the said appropriate authority has informed vide English letter No. Memo No. D-20 / Achalpur City / 19-20, dated 10th January, 2025 that, the said Notice has been sent to their higher authority for further guidance vide letter dt. 03rd February, 2022, but the decision in this matter still awaited ;
And whereas, the Chief Officer, Municipal Council, Achalpur has informed vide letter No. 698/2025, dated 10th February,2025 that, the period of two years has completed in this case, hence it is necessary to take further action / order on the Govt. level;
And whereas, the Joint Director, Town Planning, Amravati Division, Amravati has submitted a report to the Directorate vide letter No. 184, dated 6th March, 2025 that, out of total area admeasur- ing 1 Ha. of the said Reservation, 3484.78 Sq.mt. is affected by the said Reservation & the process of acquisition of the said Land has not been completed in stipulaed period as per the provisions of the said Act, it is necessary to issue an order under the provisions of section 127(2) of the said Act; And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Revised Republished Development Plan, the Director of Town Plan- ning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under the provisions of section 127(2) of the said Act, regarding the lapsing of the said Reservation partly on area admeasuring 3484.78 Sq.mt. (approx.0.3485 Ha.) of the said Land;
८ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विभागीय पुरवणी, एप्रिल १७-२३, २०२५/चैत्र २७ - वैशाख ३, शके १९४७And whereas, the Government in Urban Development Department under the provisions of section 151 of the said Act, vide Resolution No.TPS-1813/3211-CR-508-UD-13. dated 01st Decem- ber, 2016, has delegated the powers exercisable by it under the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation partly in respect of the said Land under the provisions of section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Republished Development Plan, as follows-
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be added:-

Note :- 1. The said Land so released from the said Reservation shall become available to the said Land owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Revised Development Plan.
2. A copy of the part plan of the said Sanctioned Revised Development Plan showing the area of the said Land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Achalpur Municipal Council, Achalpur, District Amravati during office hours on all working days for inspection to public upto one month.
3. This Order shall also be published on the Directorate's official website www.dtp.maharashtra.gov. in
