No. 353/5 (pt), 353/7, 353/8,353/9, 353/11, 353/12, 353/13, 353/15, 353/16, 353/17, & 9.14m(30') inernal road of TPS-III of Ghatkopar, Mumbai in 'N' ward.

NOTICE

No. EE/TP/Vari./Ghatkopar-III/24/TPS.—The State Government in Urban Development department has issued Notification u/no. TPB-4324/1156/C.R.98/2024/UD-11, dtd.16.09.2024 and authorizes Brihanmumbai Municipal Corporation under sub section (2) of section 91 of MRTP Act, 1966 to undertake variation in Town Planning scheme-III, Ghatkopar u/s. 91 of MRTP act 1966 to incorporate the changes as per proposed cluster redevelopment scheme (CDS) under Reg. 33(9) of DCPR 2034 on property bearing F.P. No. 353/5 (pt), 353/7, 353/8, 353/9, 353/11, 353/12, 353/13, 353/15, 353/16, 353/17, & 9.14m (30') inernal road of TPS- III of Ghatkopar, Mumbai in 'N' ward.

A copy of Notification issued by Urban Development department and draft variation are available for inspection of public in the following offices, on any working day, for the period of one month from the date of publication of this notice—

BRIHANMUMBAI MUNICIPAL CORPORATION

NOTIFICATION

No. ChE/DP/00774 /City.—Whereas, in exercise of the powers conferred by sub section (1) and (2) of Section 37 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'MR&TP Act, 1966'), the Planning Authority may, or when so directed by the State Government shall within ninety days from date of such directions publish a notice inviting suggestions/ objections from any person, as mentioned therein and after giving hearing, submit the proposed modification to the State Government and the State Government subject to such condition as it may deem fit sanction the modification or refuse to accord sanction ;

And whereas, as per circular u/no. BMC/ADMN/3, dt.07.04.2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 all the powers of the Corporation are now vested with the Administrator ;

And whereas, Administrator (Improvement Committee) vide resolution no. 97 dtd.28.03.2025 and Administrator (Corporation) vide resolution no. 19 dtd.04.04.2025 have accorded sanction to the proposal to take further action to modify the plot bearing CS no. 710 of Malabar Hill Division in Sanctioned DP-2034 of D ward to invite suggestions/ objections from general public u/sec. 37(1) of MR&TP Act, 1966 and approach State Govt. in Urban Development Department (hereinafter referred to as 'the UDD in GoM') for final sanction u/sec. 37(2) of MR&TP Act, 1966 for modification in Sanctioned DP-2034 ;

And whereas, as per the powers conferred by sub section (1) of Section 31 of the MR&TP Act, 1966, State Government has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as 'the said Development Plan') vide Notification No. TPB-4317/629/ CR-118/2017/DP/UD-11, dtd.08.05.2018 (hereinafter referred to as 'the said Notification') along with the Development Control and Promotion Regulations-2034 (hereinafter referred to as 'DCPR-2034') for Greater Mumbai ;

And whereas, the plot bearing CS no. 710 of Malabar Hill Division of area admeasuring 985.61sqm is affected by Existing Amenity of 'Fuel Station' (EPU2.1) as per sanctioned DP- 2034 and also affected by 27.40m wide sanctioned Traffic RL of Gopalrao Deshmukh Marg(Pedder Road);

And whereas, Owners of CS no. 710 of Malabar Hill Division Shri. Samir N. Bhojwani had made application, vide letter dtd.09.03.2023, to the UDD in GoM requesting therein to delete the existing amenity of 'Fuel Station' (EPU2.1) on plot bearing CS no.710 of Malabar Hill Division in D Ward. UDD in GoM, vide TPB-4323/166/2023/UD-11 dt.15.03.2023, had directed Brihanmumbai Municipal Corporation (hereinafter referred as 'BMC') to submit remarks/report in respect of representation received from owners of plot bearing CS no.710 of Malabar Hill Division to delete the existing amenity of Fuel Station (EPU2.1). BMC had submitted remarks/ report to the UDD in GoM u/no.ChE/05290/ DP/City dt.07.06.2023. Earlier, UDD in GoM had issued directives u/sec.154(1) of MR&TP Act, 1966 u/no.TPB-4308/211/CR86/2009/UD-11 dtd.03.12.2009 wherein it was directed that, all Petrol pump/ Diesel Pump/ CNG etc. within the jurisdictions of the Corporation shall not be closed and shall not carry out change of user. However, thereafter, the UDD in GoM, vide TPB-4323/166/CR-121/2023/ UD-11 dt.04.10.2024, had directed BMC to process the statutory proceedings as per Sec. 37(1) of MR&TP Act, 1966 in the said matter of deletion of existing amenity of 'Fuel Station' (EPU2.1) on CS no.710 of Malabar Hill div. in D Ward in sanctioned DP-2034 as the oil supply company HPCL and its Dealer had handed over back the peaceful possession of subject land designated as EPU2.1 (Fuel Station) in DP-2034 vacating the user of fuel station as per Hon. Small Cause court's judgment and decree dtd.05.05.2016 in TE&R Suit no.351/371 of 2001, Hon. High Court's order dtd.16.06.2017 in WP 6018 of 2018 and Appellate bench of Hon. Small Cause court's order dtd.13.10.2017 ;

And whereas, it is proposed to delete the Existing Amenity of 'Fuel Station' (EPU2.1) on plot bearing CS no. 710 of Malabar Hill Division in D ward of area admeasuring 985.61sqm and to include said CS no. 710 Malabar Hill in adjoining predominant zone of Residential zone (R zone), by following due process of section 37(1) of MR&TP Act, 1966. The details of the plot are as given in following Schedule.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub section (1) of Section 37 of the MR&TP Act, 1966; and of all other powers enabling it in this behalf, BMC hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by Section 37(1) of the said Act, for information of all persons likely to be affected thereby. BMC is further pleased to inform that any objections/ suggestions in respect of the proposed modification mentioned in the Schedule given below may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of Chief Engineer (Development Plan), Brihanmumbai Municipal Corporation, 5th floor, Municipal Head office, Mahapalika Marg, Fort, Mumbai 400 001. Any objections or suggestions, which may be received within stipulated time period, will be dealt with in accordance with the provisions of Section 37(1) of the said Act by the Chief Engineer (Development Plan) BMC.
