जा. क्र.बँक/कस्टोवियनबँालाजाीकोऑबँक/क.१५६/अवि. सन २०२५.—महाराष्ट्र सहाकाराी संस्था अविविनयम, १९६० चे कलाम १५६ अन्ये मला प्रदान कराण्यात आलाेल्या शक्तीचेा ापरा करून मी फयाजा मुलाणी, विजाल्हा उप विनबँंक, सहाकाराी संस्था, नाविशक या आदाेशान्ये कस्टोवियन, श्री बँालाजाी को. ऑप. बँक विला. नाविशक (विसविजाित) या बँकेच्या खालाीला अविकाराी यांना त्यांच्या नापुढे दाशिविलाेल्या कायिक्षेत्रासाठी महाराष्ट्र सहाकाराी संस्था अविविनयम, १९६० चे कलाम १०१ कलाम १०५ कलाम ९१ कलाम ९८ अन्ये प्राप्त झालाेल्या सुलाी प्रमाणीपत्राचेी अंमलाबँजाणी / कजाि सुलाी कराण्याकराीता महाराष्ट्र सहाकाराी संस्था अविविनयम, १९६० चे कलाम १५६ अन्ये विनयम १०७ मीला तरातुदाीनुसारा खालाीला अटोीस अविन राहाून या आदाेशाच्या विदानांकापासून ते विदानांक ३१/०३/२०२६ पयंत शक्ती प्रदान कराीत आहाे.

अंटी.—
(१) सुलाी अविकाराी यांनी महाराष्ट्र सहाकाराी संस्था अविविनयम, १९६० चे कलाम १५६ (१) विनयम, १९६१ चेा विनयम १०७ मीला तरातुदाीनुसारा कजाि सुलाी कराताना सहाकारा कायदा, विनयम यातीला तरातुदाी परिरापत्राकीय सुचेनांचे पालान न केल्याचे विनदाशिनास आल्यास आश्यक ती चेौकशी करून आश्यकता भासल्यास सदाराचे प्रदान केलाेलाे अविकारा तात्काळ काढेून घेण्यात येतीला.
(२) सदाराचे अविकारा सहाकारा कायदा कलाम १०१ १०५ ९१ अन्ये प्राप्त सुलाी दाखाल्याचेी अंमलाबँजाणी कराण्याकराीता असतीला.

भाग एक (म.उ.वि.)–१महाराष्ट्र शासन राजपत्र, भाग एक-मध्य उप-विभाग, गुरुारा ते बुधारा, मे ८-१४, २०२५/ैशाख १८-२४, शाके १९४७ २ (३) सुलाी अविकाराी यांनी मा. सहाकारा आयुक्त विनबँंक, सहाकाराी संस्था, महाराष्ट्र राज्य, पुणीे यांचेकीला विदानांक ३१/१०/२०१८ राोजाी विनगिविमत केलाेल्या परिरापत्राकानुसारा दारामाहा विविहात नमुन्यात कजाि सुलाीचेी माविहाती या कायािलायास सादारा कराी.
(४) अविकारा प्रदान केलाेल्या सुलाी अविकाराी असलाेल्या व्यक्तीचेी बँदालाी झाल्यास विकंा सेाविनृत्त झाल्यास विकंा सेतून काढेून टोाकल्यास विकंा त्याचेा मृत्यू झाल्यास, अशा अविकाऱ्यांस प्रदान केलाेलाे अविकारा आपोआप राद्दा हाोतीला.
(५) सुलाी अविकाराी यांनी नमूदा केलाेल्या कालाीत सुलाीचे कामकाजा समानकाराक केलाे नसल्याचे विनदाशिनास आल्यास विकंा प्रदान केलाेल्या अविकाराचेा गैरापरा कराीत असल्याचे विनदाशिनास आल्यास, प्रदान केलाेलाे अविकारा काढेून घेतलाे जातीला भाविष्यात असे कोणीतेहाी अविकारा अशा व्यक्तीस प्रदान कराण्यात येणीारा नाहाीत.
(६) शासन विनणीिय क्रमांक संविकणीि- १५०४/प्र.क्र.२३१/१५-स, विदा. २३/११/२००६ अन्ये सुलाी अविकाऱ्यां ंना तीन विसंहाच्या राजामुद्रेचेा ापरा कराता येणीारा नाहाी.
(७) सुलाी अविकाऱ्यांस त्याच्या नापुढे कोठीेहाी "महाराष्ट्र शासन विनयुक्त आविणी विकंा "विसव्हाीला कोटोट" "एक्झाीक्युटोीव्हा कोटोट" या शब्दांचेा अथा तत्सम शब्दांचेा ापरा कराता येणीारा नाहाी. त्या ऐजाी सुलाी अविकाऱ्यां ंनी त्यांच्या नांापुढे "(महाराष्ट्र सहाकाराी संस्था अविविनयम, १९६० विनयम, १९६१ विनयम १०७ अन्ये)" असे विलाहाे.
(८) सुलाी अविकाऱ्यांस सुलाीसाठी ापरा कराण्यात येणीाऱ्या ाहानारा "सुलाी अविकाराी, कस्टोवियन, श्री बँालाजाी को. ऑप.
बँक विला., नाविशक (विसविजाित)" असा फलाक लाता येईला.
(९) सुलाी अविकाऱ्यां ंने पगारा जाप्तीचेी कायिाहाी करातांना कजािदाराच्या / जामीनदाराच्या पगारा कपाती बँाबँत राष्ट्रीयीकृत बँका ा अन्य बँकाके परास्परा ेतन कपातीचेा आदाेश दाेऊन परास्परा पगारा कपात कराता येणीारा नाहाी. संबँंवित कजािदारा / जामीनदारा ज्या आस्थापनेरा काम कराीत आहाे त्या आस्थापनेराीला आहाराणी संवितराणी अविकाराी / पगारा कराणीारा अविकाराी यांचेमाफफत पगारातून कजाि सूला कराण्याचेी कायिाहाी कराी.
(१०) सुलाी अविकाऱ्यांस, थाकबँाकीदाराकून सुलाी दाखाल्यानुसारा सूलापात्रा राक्कम सराचेाजाि राक्कम याविशाय इतरा कोणीतीहाी राक्कम सूला कराता येणीारा नाहाी.
(११) बँकेचे पदाविकाराी/अविकाराी यांना सुलाी अविकाराी अविकारा प्रदान कराण्यात येतीला त्यांनी तीन र्षांांतून विकमान एकदा मान्यताप्राप्त संस्थाेचे विकमान तीन विदासाचेा प्रविशक्षेणी घेणीे अविनायि आहाे.
(१२) सुलाी अविकाराी यांनी प्रस्तासोबँत जाोलाेल्या यादाीतीला प्रकराणीाचेा जांगम जाप्ती, स्थारा जाप्ती, विनयमानुसारा विहाीत मुदातीत पुणीि कराण्यांत याी. विहाीत मुदातीत उक्त कायिाहाी पुणीि न केल्यास आपणीांस विदा ३१/०३/२०२६ पासून पुढेीला कालाीसाठी कलाम १५६ चे अविकारा प्रदान कराण्यात येणीारा नाहाी याचेी गांभाीयािने नंदा घ्याी त्याचेी सिस्ी जाबँाबँदाराी विहा आपलाी राविहाला.
(१३) सुलाी अविकाराी यांनी विनगिविमत करायाच्या नोटोीस, आदाेश / घेोर्षांणीा यामध्ये त्यांना अविकारा प्रदान केलाेल्या आदाेशाचेा संदाभाि नमूदा करा. सुलाी अविकाराी यांनी नोटोीस बँजाताना नोटोीसमध्ये त्याचे ना, पदानाम, भ्रमणीध्नी क्रमांक नमूदा कराणीे आश्यक आहाे.
(१४) कस्टोवियन कालाीत कस्टोवियन यांचेी दा योग्य हाक्क प्रमाणीे येणीे दाेणीे राोखाीकराणी उदा. कजाि सुलाी विनबँंकाच्या तीने३ महाराष्ट्र शासन राजपत्र, भाग एक-मध्य उप-विभाग, गुरुारा ते बुधारा, मे ८-१४, २०२५/ैशाख १८-२४, शाके १९४७ अविविनयम विनयमातीला तरातुदाीप्रमाणीे कराणीेचेी प्रमुखा जाबँाबँदाराी असेला, विनबँंकाने आश्यक ते अविकारा त्यासाठी प्रदान कराेत. तसेचे कजािसुलाीचेा माविसक / त्राैमाविसक अहाला विनबँंक कायािलायास सादारा कराणीे, संस्थाेचेी दारामहा अखाेराचेी राोखाता तरालाता बँक विशल्लाक त्या मविहान्यातीला जामा खाचेि पत्राक, त्या मविहान्यातीला प्रशासकीय खाचेि, न्यायालाय कामकाजा उपस्थिस्थाती इ. कामकाजाबँाबँत माविसक आढेा घेऊन त्यांच्या नंदाी इवितृत्त स्रुपात कस्टोवियन स्तरारा ठीेण्यात याव्यात.
(१५) कस्टोवियन विनयुक्ती आदाेशातीला दा योग्य हाक्क प्रकराणी राोखाीकराणीाचेी कायिाहाी कस्टोवियनने कराी. कस्टोवियन विनयुक्तीचे ेळी अस्थिस्त्ात असलाेलाे सुलाीसाठी प्रलांविबँत असलाेलाे सि हाुकूमनामे, सुलाी दाखालाे, ॲाट याप्रमाणीे संबँंवित कजािदाराकून कजाि राकमा विनयमाप्रमाणीे सूला करून घेण्याचेी कायिाहाी कराी.
(१६) संस्थाेके कलाम १०१ अंतगित प्राप्त प्रमाणीपत्रा तथा १०५ प्रमाणीपत्रा आविणी कलाम ९१ अंतगित विनायाचे आाराे येणीे कजाि राोखाीकराणीाचेी कायिाहाी कराी. संबँंवित येणीे कजािदारांना कजाि राक्कम परातफे कराण्याबँाबँत आाहान कराे. सक्तीच्या सुलाीसाठी परिराराक्षेक ने विनबँंकास सविस्तरा प्रस्ता सादारा करा विनबँंकाने आपलाे कलाम १५६ चे अविकारा ापरून अशी कजाि सुलाी कराण्याबँाबँत योग्य ती विनयमामीला कायिाहाी कराी.

(७) सुलाी अविकाऱ्यास त्याच्या नापुढे कोठीेहाी " महाराष्ट्र शासन विनयुक्त " आविणी/विक ंा " विसव्हा ीला कोटोट ", " एक्झाीक्युटोीव्हा कोटोट " या शब्दांचेा अथा तत्सम शब्दांचेा ापरा कराता येणीारा नाहाी. त्या ऐजाी सुलाी अविकाऱ्यांनी त्यांच्या नापुढे सुलाी अविकाराी (महाराष्ट्र सहाकाराी संस्था अविविनयम, १९६० विनयम, १९६१ चे विनयम १०७ अन्ये) असे विलाहाे.
(८) सुलाी अविकाऱ्यास सुलाीसाठी ापरा कराण्यात येणीाऱ्या ाहानारा " सुलाी अविकाराी, विदा सह्याद्रेी सहाकाराी बँक विला., मु ंबँई", असा फलाक लाता येईला.
(९) सुलाी अविकाऱ्याने पगारा जाप्तीचेी कायिाहाी कराताना कजािदाराच्या / जामीनदाराच्या पगारा कपातीबँाबँत राष्ट्रीयीकृत बँका ा अन्य बँका यांच्याके परास्परा ेतन कपातीचेा आदाेश दाेऊन परास्परा पगारा कपात कराता येणीारा नाहाी. संबँंवित कजािदारा/जामीनदारा ज्या आस्थापनेरा काम कराीत आहाे त्या आस्थापनेराीला आहाराणी संवितराणी अविकाराी / पगारा कराणीारा अविकाराी यांचेमाफफत पगारातून कजाि सूला कराण्याचेी कायिाहाी कराी.
(१०) सुलाी अविकाऱ्यास, थाकबँाकीदाराकून सुलाी दाखाल्यानुसारा सूलापात्रा राक्कम या कायािलायाचे कलाम १५६ आविणी त्याखालाीला विनयम १०७ अन्ये आदाेश विदानांक ६ एविप्रला २०१८ मध्ये नमूदा केल्याप्रमाणीे दाराने अंमलाबँजाणी खाचेािचेी राक्कम याविशाय इतरा कोणीतीहाी राक्कम सूला कराता येणीारा नाहाी.
(११) या कायािलायाचे विदानांक ३१ ऑक्टोबँरा २०१८ राोजाीच्या परिरापत्राकीय सूचेनांचे सुलाी अविकाराी यांनी तंतोतंत पालान कराे. बँकेचे मुख्य कायिकाराी अविकाराी यांनी दारामहा सुलाी अविकाऱ्यांचे कामकाजाचेा कजािदाराविनहाय आढेा परिरापत्राकातीला प्रपत्रा पाचे मध्ये नमूदा केल्याप्रमाणीे घ्या.
(१२) सुलाी अविकाराी यांनी विनगिविमत करायाच्या नोटोीस / आदाेश/घेोर्षांणीा यामध्ये त्यांना अविकारा प्रदान केलाेल्या या आदाेशाचेा संदाभाि नमूदा करा. सुलाी अविकाराी यांनी नोटोीसा बँजाताना नोविटोसीमध्ये त्यांचे ना पदानाम भ्रमणीदाुराध्नी क्रमांक नमूदा कराणीे आश्यक आहाे.
