आविणे ज्याअर्थी, साु-मंोटो रिराट याविचका (विसार्व्हेहाील) क्र. ५/२०२४ मंील मंा. साोच्च न्यायालयाच्या आेांच्या अनांुषंगानांे "बीकेसाी येर्थीे नांीनां एकास्तित्मंक उच्च न्यायालय सांकुल" बांणे या विषंयी मंा. न्यायाीांचे स्टीअरांग साविमंतीची बैठक वि. २१ ऑक्टोबरा २०२४ ंबई येर्थीे पुारा पुडींली; आविणे ज्याअर्थी, मंा. स्टीअरांग साविमंतीच्या सारा बैठकीत, उक्त जविमंनांीरा नांीनां एकास्तित्मंक राोजी उच्च न्यायालय, मंु उच्च न्यायालय सांकुलाकरिराता सांपुूणेश भाूखंडींाचे आराक्षेणे बलण्याची प्रविक्रया साुरू कराण्याबाबत नांगरा विकासा विभागाचे अवितरिराक्त मंुख्य साविच/प्रानां साविच यांनांा विनांती कराण्याचा विनांणेशय घेण्यात आला; आविणे ज्याअर्थी, मंा. स्टीअरांग साविमंतीच्या विनांेानांुसारा आश्यक ती ंबई यांनांी त्यांच्या विनांांक २४/१०/२०२४ राोजीच्या पुत्राद्वाराे अवितरिराक्त कायशाहाी कराणेबाबत मंा. राविजस्ट्रारा (मंूळू ाखा), उच्च न्यायालय, मंु मंुख्य साविच, नांगराविकासा विभाग यांनांा विनांती केली आहाे;

आविणे ज्याअर्थी, मंा. स्टीअरांग साविमंतीचे राील आे विचारात घेऊनां, याअनांुषंगानांे प्रानां साविच (नांवि-१) यांच्या अध्यक्षेतेखाली ंबई मंहानांगरापुाविलकेचे अविकाराी, मंुख्य ेळूोेळूी विवि बैठका घेण्यात आल्या, ज्यामंध्ये साशजविनांक बांकामं विभागाचे अविकाराी, बृहान्मंु ास्तुविारा, मंहाराष्ट्र राज्य उपुस्तिस्र्थीत हाोते. सारा बैठकांमंध्ये सांबंवितांनांी भाौवितक स्तिस्र्थीतीचा अभ्यासा कराण्याचे आविणे अा प्रकाराे आराखडींा तयारा कराण्याचे विनांे ेण्यात आले की, जेणेकरूनां एकास्तित्मंक उच्च न्यायालय सांकुलासाठी जमंीनां आराविक्षेत करातानांा, खेळूाचे मंैानां, बगीचा इत्याी साराखी आराक्षेणे / नांामंविनांेनांे सारासाकट गळूण्याऐजी, ती ांद्रे साराकाराी साहातीच्या आराखड्यात इतरात्रा स्र्थीलांतरिरात कराता येतील आविणे उच्च न्यायालयाच्या इमंारातीच्या आश्यकतेनांुसारा आविणे आजूबाजूच्या रास्त्यांच्या जाळ्याचा विचारा करूनां रास्त्यांचे जाळूे विनांयोविजत केले जाईल याची काळूजी घेण्याबाबत विनांे ेण्यात आले;

आविणे ज्याअर्थी, ासानांाचे साशजविनांक बांकामं विभागानांे मंुख्य ास्तुविारा, साशजविनांक बांकामं विभाग यांचेकडींूनां प्राप्त झालेले वि. १९/०५/२०२५ राोजीचे पुत्रा त्यासाोबत विवि आराक्षेणे/नांामंविनांेनांे यांचे स्र्थीानांांतराणे शविणेारा नांका आविणे उक्त जविमंनांीरा "एकास्तित्मंक उच्च न्यायालय इमंारात सांकुल (विनांासास्र्थीानांांसाहा)" आराक्षेणे शविण्याचा प्रस्ता सारा केला आहाे (यापुढे ज्याचा उल्लेख "उक्त प्रस्ता" असा कराण्यात आला आहाे);

आविणे ज्याअर्थी, गराज आश्यकता विचारात घेता, मंु ंबईमंध्ये मंा. उच्च न्यायालय सांकुलाच्या बांकामंासाठी जमंीनां उपुलब् करूनां ेणे आश्यक आहाे त्यानांुसारा खालील पुरिराविष्टामंध्ये विविष्टपुणे नांमंू केल्यानांुसारा उक्त जविमंनांीराील "ासाकीय कमंशचाराी विनांासास्र्थीानांाचे" (ER१.३) नांामंविनांेनां भाग: गळूनां इतरा आराक्षेणे/ नांामंविनांेनांांचे स्र्थीानांांतराणे तसाेच रास्त्यांची आखणेी साुाराीत करूनां उक्त जविमंनांीरा "एकास्तित्मंक उच्च न्यायालय इमंारात सांकुल" असाे आराक्षेणे शविण्याबाबतचा उक्त प्रस्ता स्ीकाराणे साशजविनांक विहाताच्या ृष्टीनांे आश्यक आहाे, असाे ासानांाचे मंत झाले आहाे;

आविणे ज्याअर्थी, उक्त अविविनांयमंाच्या कलमं ३७ च्या पुोटकलमं (१कक) अन्ये प्राप्त अविकाराचा ापुरा करूनां ासानांानांे सामंक्रमंांकाची वि.२०/०६/२०२५राोजीची साूचनांा त्यासाोबतचे पुरिराविष्टामंध्ये नांमंू प्रस्तावित फेराबलारा(यापुढे ज्याचा उल्लेख "प्रस्तावित फेराबल" असा कराण्यात आला आहाे) जनांतेकडींूनां हाराकती/साूचनांा मंागविण्यासाठी प्रविसाध् कराण्यात आली हाोती आविणे ज्याद्वाराे, प्रस्तावित फेराबलाबाबत प्राप्त हाोणेाऱ्या हाराकती/साूचनांांरा सांबंवितांनांा साुनांाणेी ेण्याकरिराता तसाेच उक्त अविविनांयमंाच्या कलमं ३७(१कक) अन्ये विविहात केलेली कायशाहाी पुूणेश करूनां प्रस्ता ासानांासा सारा कराणेसाठी उपु सांचालक, नांगराराचनांा, बृहान्मंु ंबई यांची अविकाराी (यापुढे ज्यांचा उल्लेख "उक्त अविकाराी" असा कराण्यात आला आहाे.) म्हाणेूनां विनांयुक्ती कराण्यात आली आहाे;

आविणे ज्याअर्थी, प्रस्तावित फेराबलाची वि. २० जूनां, २०२५ ची साूचनांा हाी महाराष्ट्र शासन असाधारण राजपत्रामध्ये (भाग-१ कोकणे विभागीय पुराणेी) (यापुढे याचा उल्लेख 'शासकीय राजपत्र' असा कराणेत आलेला आहाे) वि.२३ जूनां, २०२५ राोजी प्रविसाध् कराण्यात आली आहाे आविणे उक्त अविकाराी यांनांी अविविनांयमंाचे कलमं ३७ (१कक) अन्ये ैाविनांक कायशाहाी पुूणेश करूनां वि. २९ जुलै, २०२५ राोजीच्या पुत्रान्ये त्यांचा अहाल नांगराराचनांा सांचालनांालयामंाफेफत ासानांासा सारा केला आहाे:

आविणे ज्याअर्थी, उक्त अविकाराी यांनांी सारा केलेला अहाल विचारात घेता सांचालक, नांगराराचनांा, मंहाराष्ट्र राज्य, पुणे यांचेी साल्ला मंसालत केल्यानांतरा उक्त प्रस्तावित फेराबल मंजूरा कराणे जनांविहाताच्या ृष्टीनांे आश्यक आहाे, असाे ासानांाचे मंत झाले आहाे;

आता त्याअर्थी, उक्त अविविनांयमंाच्या कलमं ३७ (१कक) (ग) अन्ये प्राप्त अविकारात आविणे त्या सांभाशतील साश क्तंचा ापुरा करूनां ासानां याद्वाराे :-

(अ) उक्त प्रस्तावित फेराबलाचे प्रस्तासा खालील पुरिराविष्टामंध्ये नांमंू केलेप्रमंाणे मंजूराी ेत आहाे.

(ब) साराची अविसाूचनांा शासकीय राजपत्रामध्ये प्रविसाध् झालेचा विनांांक हा उक्त फेराबल अंमंलात आलेचा विनांांक असाेल.

ंबई मंहानांगरापुाविलकेच्या उक्त विकासायोजनांा च्या मंजुराी साोबतच्या फेराबलाचे पुरिराविष्टामंध्ये ेटच्या नांीनांतरा (क) बृहान्मंु खालील पुरिराविष्ट सामंाविष्ट कराणेचे विनांे ेत आहाे.

NOTIFICATION

Maharashtra regional & town Planning act, 1966.

No. TPB-4324/C.R.167/ 2024/UD-11.— Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act");

Whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act"), the State Government vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, Dt. 08/05/2018 (hereinafter referred to as "the said Notification") has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") along with the Development Control and Promotion Regulations-2034 for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification. And whereas, Government has issued a corrigendum of even number dt. 22nd June, 2018 to the said Notification; And whereas, thereafter Government has issued a Corrigendum and Addendum of even number dt. 29th June, 2018 to the said Notification, which is published in the Government Gazette, dt. 30th June, 2018. The said Development Plan has came into force from 1/09/2018;

And whereas, as per the said Development Plan, the land bearing CTS No. 629(part), Survey No.329(part), Bandra (East) (hereinafter referred to as "the said Land") is affected by various reservations such as "Play Ground" (ROS1.4), "Cultural Centre"(RSA3.3) and the designations existing amenities such as "Government Staff quarters"(ER1.3), "Play Ground" (EOS1.4), "Garden"(EOS1.5), "Electricity Transmission" (EPU5.2), "Police Station + Police facilities" (EPU3.1+ EPU3.4), "Water Pumping Station + reservoir" (EMS5.2+ EMS5.1), "Utility Building"(ESA4.9), "BEST Bus Facilities"(ET1.4), "Public Hall"(ESA3.8), "Government Office"(EO2.1) and "Existing Roads" ;

And whereas, in the context of directions of Hon'ble Supreme Court in suo-moto Writ Petition (Civil) No.5 of 2024, a meeting of the Hon'ble Judges of the steering committee for subject construction of "New Integrated High Court Building at BKC" was held on 21st October, 2024 in High Court, Mumbai; And whereas, in the said meeting of Hon'ble Steering Committee, it was resolved to request Additional Chief Secretary/ Principal Secretary of Urban Development Department to initiate the process of change of reservations of entire plot of the said land for new Integrated High Court Building Complex; And whereas, Hon'ble Registrar, O.S., High Court, Bombay vide his letter dated- 24/10/2024 has requested Additional Chief Secretary, Urban Development Department to take necessary steps as directed by Hon'ble Steering Committee;

And whereas, considering the aforesaid directions of Hon'ble Steering Committee, various meetings under the chairmanship of Additional Chief Secretary, Urban Development Department, Government of Maharashtra (UD-1) were held time to time, wherein P.W.D. officers, BMC officers, Chief Architect, Public Works Department, Government of Maharashtra, were present, wherein directions were given to concerns to study the physical condition and prepare plan in such a way that while reserving the land for 'Integrated High Court Complex', care be taken that instead of deleting entire designations/ Reservations like P.G. garden etc., it may be shifted within Bandra Government Colony layout and road network be planned as per the requirement of High Court building and considering surrounding road network;

And whereas, Government in Public Works Department has submitted letter dated 19/05/2025 received from Chief Architect PWD along with Plan showing relocation of various reservations/ designations and proposal to show reservation of "Integrated High Court Building Complex (along with Residential Quarters) " on the said land (hereinafter referred to as "the said proposal");

And whereas, considering the need and necessity to make available land for construction of High Court Complex in Mumbai , the Govt. is of the opinion that in the public interest it is expedient to accept the proposal to reserve the said land for "Integrated High Court Building Complex" by deletion of part portion of designation of Government Staff Quarters (ER1.3) and by relocation/ shifting other reservations/ designation and rearranging roads;

And whereas, in exercise of the powers conferred under Sub-Section (1AA) of Section 37 of the said Act, Government had issued Notice dated 20th June, 2025 for inviting suggestions/objections from the general public with regard to the proposed modification as mentioned in the Schedule appended to the said Notice (hereinafter referred to as "the proposed modification") and appointed the Deputy Director of Town Planning, Greater Mumbai as the Officer (hereinafter referred to as "the said Officer") to complete the procedure as stipulated under Section 37(1AA) of the said Act and to submit a report on the objections/suggestions received in respect of the proposed modification to the Government;

And whereas, the said Notice dated 20 June, 2025 was published in the Maharashtra Government Extra Ordinary Gazette (Part 1- Kokan Division supplement) (hereinafter referred to as "the Maharashtra Government Gazette"). dated 23rd June, 2025 and the said officer has submitted his report to the Government vide letter dated 29/07/2025 through the Director of Town Planning, Maharashtra State, Pune after completing the legal procedure as stipulated under Section 37(1AA) of the said Act;

And whereas, after considering the Report of the said Officer and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanctioned.

Now, therefore, in exercise of the powers conferred upon it under section 37(1AA) (c) of the said Act, the Government hereby:—

(A) Sanctions the proposed modification as described more specifically in the Schedule hereinunder.

(B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this modification.

(C) Directs the Municipal Corporation of Greater Mumbai that in the Schedule of Modifications sanctioning the said Development Plan, after the last entry, the Schedule referred to at (A) above shall be added.
