क्रमांका एमपीआय-२०१६/प्र.क्र.२०४/पीोला-११.— ज्याअर्थी, राजेश सुरेश दिशंदुे व अदिनांला राधाकाृष्ण भाोसलाे (ज्याचा यापीुढे "उक्ता दिवत्तीय संस्र्थीा" असा उल्लाेख कारण्याता आला आहुे) हुी दिवत्तीय संस्र्थीा आदिण दिताच्या संचालानांासाठी जबाबदुार असलाेलाे अध्यक्ष, संचालाका, व्यवस्र्थीापीका, प्रवतागका, भागीदुार आदिण दिताचाे कामगचारी यांनांी ठीेवीदुारांनांा मुदुताीअंताी लाभासहु ठीेवी पीरता कारण्याचाे आश्वादिसता कारूनां ठीेवी स्वीकारल्या हुोत्या ;

आदिण ज्याअर्थी, महुाराष्ट्र शासनांाचाी अशी खात्राी झालाी आहुे काी, उक्ता दिवत्तीय संस्र्थीा व दिताचाे अध्यक्ष, संचालाका, व्यवस्र्थीापीका, प्रवतागका, भागीदुार आदिण दिताचाे कामगचारी हुे ठीेवीदुारांनांा त्यांच्या ठीेवी मुदुतापीुताीनांतार पीरता कारण्यास अपीयशी ठीरलाे असूनां उक्ता दिवत्तीय संस्र्थीेद्वारे ठीेवीदुारांच्या ठीेवी पीरता कारण्याचाी शक्यता दिदुसूनां येता नांाहुी ;

आदिण ज्याअर्थी, महुाराष्ट्र शासनांाला, उक्ता दिवत्तीय संस्र्थीा व दिताचाे अध्यक्ष, संचालाका, व्यवस्र्थीापीका, प्रवतागका, भागीदुार आदिण कामगचारी आदिण अन्य काोणताीहुी व्यक्ताी यांनांी जमा काेलाेल्या ठीेवंमधाूनां, त्यांच्या स्वताःच्या अर्थीवा अन्य व्यक्तांच्या नांावे, रकामा व अन्य मालामत्तीा संपीादुीता कारण्याता आलाी असल्याचाे अदिभाकादिर्थीता असल्यानांे, उक्ता दिवत्तीय संस्र्थीेच्या ठीेवीदुारांच्या दिहुताचाे संरक्षण कारण्याकारिरता अशा रकामा दिकांवा अन्य मालामत्तीा संरदिक्षता कारण्याचाे आदिण अशा संरदिक्षता काेलाेल्या रकामा दिकांवा अन्य मालामत्तीा यांवर दिनांयंत्राण ठीेवण्यासाठी उपी दिजल्हुादिधाकारी तार्थीा सक्षम प्रादिधाकारी (अदिता/दिनांष्का), अंधाेरी-१ यांचाी सक्षम प्रादिधाकारी म्हुणूनां दिनांयुक्ताी कारणे शासनांास आवश्यका वाटताे. भाग चार-ब-२९०–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑगस्ट ७, २०२५/श्रावण १६, शके १९४७ त्याअर्थी, आता, महुाराष्ट्र ठीेवीदुारांच्या दिवत्तीय संस्र्थीांमधाीला दिहुतासंबंधाचाे संरक्षण अदिधादिनांयम, १९९१ (महुा. २००० चा १६) च्या कालाम ४ चाे पीोट-कालाम (१) व कालाम ५ चाे पीोट-कालाम (१) याद्वारे प्रदुानां कारण्याता आलाेल्या अदिधाकारांचा वापीर कारूनां महुाराष्ट्र शासनां याद्वारे - (अ) राजेश सुरेश दिशंदुे व अदिनांला राधाकाृष्ण भाोसलाे हुी दिवत्तीय संस्र्थीा व दिताचाे अध्यक्ष, संचालाका, व्यवस्र्थीापीका, प्रवतागका, भागीदुार आदिण कामगचारी आदिण अन्य काोणताीहुी व्यक्ताी यांच्या नांावे असलाेल्या, सोबताच्या अनांुसूचाीता दिवदिनांदिदुगष्ट काेलाेल्या रकामा दिकांवा अन्य मालामत्तीा संरदिक्षता कारीता आहुे ; आदिण

Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No. MPI-2016/C.R.204/Pol-11.— Whereas, Rajesh Shinde and Anil Bhosale (hereinafter referred to as "the said Financial Establishment"), and its Chairman, Directors, Managers, Promoters, Partners and its employees responsible for its management have received deposits from depositors under the scheme to repay the deposits on maturity along with benefits promised thereof to the depositors ;

And whereas, an offence has been registered against the said Financial Establishment and its Directors, Manager, Promoters, Partners, and its employees at Jogeshwari Police Station vide Complaint Register No. 72/2016 (E.O.W.C.R. No. 39/2016) under sections 409, 420, 465, 467, 468, 471 and 120 B of the Indian Penal Code (45 of 1860) and section 66 of Information Technology Act, 2000 (21 of 2000) read with sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 (Mah. XVI of 2000), that they have collected the deposits and have failed to repay the deposits after maturity ;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishments and its Chairman, Directors, Manager, Promoters, Partners, and its employees have failed to repay the deposits after maturity and the said Financial Establishment is not likely to return the deposits to the depositors ;

And whereas, the Government of Maharashtra considers it expedient to attach the monies or other properties believed to have been acquired by the said Financial Establishment and its Chairman, Directors, Managers, Promoters, Partners, and its employees and any other person either in their own name or in the name of any other person from out of the deposits collected by the said Financial Establishments, in order to protect the interest of the depositors of the said Financial Establishments and to appoint Deputy Collector and Competent Authority (Encroachment and Removal), Andheri-1 as the Competent Authority to exercise control over the monies and the other properties attached.

Now, therefore, in exercise of the powers conferred by sub-section (1) of sections 4 and sub-section (1) of section 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby,—

(a) attaches the monies or other properties in the name of Rajesh Shinde and Anil Bhosale and its Chairman, Directors, Manager, Promoters, Partners and its employees or any other person, as specified in the Schedule appended hereto; and

(b) appoints the Deputy Collector and Competent Authority (Encroachment and Removal), Andheri-1 to be the Competent Authority to exercise control over the monies and other properties attached.
