क्रमाका दिपदिन-२०२५/प्र.क्र.९७ /प.रा. २.— ज्याअथी महाराष्ट्र दिल्हा परिरष आदि पचायात सदिमती अदिधदिनयाम, १९६१ (सन १९६२ चा महाराष्ट्र अदिधदिनयाम पाचा) मधील कालम २ (२०अ), १२ व ५८ (१)(अ) अन्वयाे शासनास प्रान कारण्यात आलेल्या अधीकाराचा वापर कारून, महाराष्ट्र शासनाने ग्राम दिवकास दिवभाग शासन अदिधसूचाना क्र. दिपदिन-२०२५/प्र.क्र.३६/परा-२, दिनाका १२ ून २०२५ नंसार दिल्हा परिरष व पचायात सदिमती दिनवडंकाीच्या उद्देशाने प्रत्याेका दिल्ह्याचाे दिनवडूका दिवभागामध्याे आदि प्रत्याेका तालंक्यातील दिनवडूका दिवभागाचाे ोन दिनवाझचाका गामध्याे दिवभागी काेली आहाे;

आदि ज्याअथी, दिनवडूका दिवभाग व दिनवाझचाका गाच्या सख्याेमध्याे र्झालेल्या बलाच्या पार्श्ववझभाूमीवर अनंसूदिचात ाती, अनंसूदिचात माती, नागरिरकाचा मागास प्रवगझ व मदिहालासाठी दिल्हा परिरषेच्या दिनवडूका दिवभागामध्याे आदि पचायात सदिमतीच्या दिनवाझचाका गामध्याे ागाच्या आरक्षाचाी पद्धत व चाक्रानंक्रम दिनश्चिर्श्वचात कारण्यासाठी नवीन दिनयाम तयार कारे शासनास आवर्श्वयाका वार्टते;

आदि ज्याअथी, सर अदिधदिनयामातगझत दिनवडंका घेण्यासाठी तातडीचाी कायाझवाहाी कारे आवर्श्वयाका असल्याबाबत शासनाचाी खात्री र्झाली आहाे. त्यामंळे उक्त अदिधदिनयामाच्या कालम २७४ च्या पोर्ट-कालम (३) मधील तरतूीमधून वगळेून हाे दिनयाम पूवझप्रदिसद्धी दिशावाया लागू कारे गरेचाे आहाे.

त्याअथी आता, महाराष्ट्र दिल्हा परिरषा आदि पचायात सदिमत्या १९६१ (सन १९६२ चा महाराष्ट्र अदिधदिनयाम पाचा) च्या कालम २७४ चाे पोर्ट-कालम (२) चाे खाड (ोन) व (तेरा) अन्वयाे प्रान कारण्यात आलेल्या अदिधकाराचा आदि त्या बाबतीत महाराष्ट्र शासनास

(१)

भाग चार-ब-२९४–१२ महाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-ब, ऑगस्ट २०, २०२५/श्रावण २९, शाके १९४७ समथझ काराऱ्या इतर सवझ अदिधकाराचा वापर कारून आदि महाराष्ट्र दिल्हा परिरषा आदि पचायात सदिमत्या (ागाच्या आरक्षाचाी पद्धत व चाक्रानंक्रम) दिनयाम,१९९६ अदिधक्रदिमत कारून, महाराष्ट्र शासन खालीलप्रमाे दिनयाम तयार कारीत आहाे :—

१. संकिंप्त नाव :— या दिनयामाना महाराष्ट्र दिल्हा परिरषा आदि पचायात सदिमत्या (ागाच्या आरक्षाचाी पद्धत व चाक्रानंक्रम) दिनयाम, २०२५ असे म्हाता याेईल.

२. व्येाख्येा :— सभाझनंसार ंसरा अथझ अपेदिक्षत नसेल तर, या दिनयामात—

(अ) "अदिधदिनयाम" म्हाे महाराष्ट्र दिल्हा परिरषा व पचायात सदिमत्या अदिधदिनयाम, १९६१ ;

(ब) "दिनवाझचाका ग" म्हाे अदिधदिनयामाच्या कालम ५८, पोर्ट-कालम (१) च्या खाड (अ) अन्वयाे दिनश्चिर्श्वचात काेलेला दिनवाझचाका ग;

(का) "मतार दिवभाग" म्हाे अदिधदिनयामाच्या कालम १२ च्या पोर्ट-कालम (१) अन्वयाे रचाना काेलेल्या एखाद्या दिल्ह्याचा मतार दिवभाग;

(ड) "लोकासख्या" म्हाे अदिधदिनयामाच्या कालम २ च्या खाड (२० अ) मध्याे व्याख्या काेलेली लोकासख्या;

(इ) या दिनयामामध्याे वापरण्यात आलेले परतं व्याख्या न काेलेले शाब् व शाब्प्रयाोग याना अदिधदिनयामात अनंक्रमे े अथझ नेमून दिले असतील तेचा त्याचाे अथझ असतील.

३. अनुसूकिंचात जाती, अनुसूकिंचात जमाती, नागरिराकेांचा मागासवगष आकिंण मकिंहालेा येांच्येासाठेी राखून ठेवावयेाच्येा जागांचाी संख्येा राज्ये किंनवडणूके आयेोगाने किंनश्चिचात केराणे :— दिल्हा परिरषेच्या प्रत्याेका सावझदित्रीका दिनवडंकाीसाठी, दिनवडंकाीद्वारे भारावयाच्या एकाू ागापैकाी, अनंसूदिचात ाती, अनंसूदिचात माती, नागरिरकाचा मागासवगझ आदि मदिहाला यामधील व्याक्तंकारिरता राखाून ठीेवावयाच्या ागाचाी सख्या अदिधदिनयामाच्या कालम १२ च्या पोर्ट-कालम (२) मधील तरतंीनंसार राज्या दिनवडूका आयाोग दिनश्चिर्श्वचात कारील.

स्पष्टीकेराण.— ागाचाी सख्या दिनश्चिर्श्ववत कारताना अधाझ दिकांवा त्यापेक्षा ास्त अपूाका आल्यास ती एका पूझ ागा धरण्यात याेईल आदि अध्याझपेक्षा कामी अपूाका असल्यास तो दिवचारात घेतला ार नाहाी.

४. अनुसूकिंचात जाती आकिंण अनुसूकिंचात जमाती येांच्येासाठेी राखूीव असलेल्येा जागांच्येा वाटपाचाी आकिंण चाक्रानुक्रमाचाी पद्धत :—(१) दिनयाम ३ नंसार, अनंसूदिचात ाती आदि अनंसूदिचात मातंच्या व्याक्तंकारिरता राखाून ठीेवावयाच्या ागा या, ज्या मतार दिवभागातील अशा ातंचाी दिकांवा याथाश्चिस्थती, मातंचाी लोकासख्या सवाझदिधका असेल अशा मतार दिवभागापासून संरूवात कारून मतार दिवभागामध्याे उतरत्या क्रमाने वार्टून ेण्यात याेतील :

परतं, वेगवेगळ्या मतार दिवभागातील अनंसूदिचात ातंचाी दिकांवा याथाश्चिस्थती अनंसूदिचात मातंचाी लोकासख्या समान असेल दिकांवा एखाद्या मतार दिवभागात अनंसूदिचात ातंचाी आदि अनंसूदिचात मातंचाी लोकासख्या समान असेल, त्याबाबतीत अशा मतार दिवभागातील दिकांवा मतार दिवभागातील ागाचाे वार्टप सोडत काढून कारण्यात याेईल :

परतं, आखाी असे काी, ेथे एखाद्या मतार दिवभागातील अनंसूदिचात ातंचाी दिकांवा याथाश्चिस्थदित, अनंसूदिचात मातंचाी लोकासख्या अशाी असेल काी, अनंसूदिचात ाती आदि अनंसूदिचात माती या ोन्हाी प्रवगासाठी तो मतार दिवभाग आरदिक्षत हाोऊ शाकाेल, त्याबाबतीत असा मतार दिवभाग अशा प्रवगाझपैकाी ज्याचाी लोकासख्या ास्त असेल त्या प्रवगाझसाठी राखाून ठीेवण्यात याेईल, आदि या प्रदिक्रयाेत, उवझरिरत प्रवगाझसाठी ज्या मतार दिवभागात उतरत्या कामाने पंढूील सवाझदिधका लोकासख्या असेल, दितथे त्या प्रवगाझसाठी ागा राखाून ठीेवण्यात याेईल.

(२) पोर्ट-दिनयाम (१) मध्याे काहाीहाी अतभाू झत असले तरी, दिल्ह्यातील वेगवेगळ्या मतार दिवभागाना दिफोरत्या पद्धतीने आरक्ष ेईपयात, अनंसूदिचात ाती आदि अनंसूदिचात मातं कारिरता राखाून ठीेवलेल्या ागा या, अगोरच्या सावझदित्रीका दिनवडंकाीत ज्या मतार दिवभागात अशा ाती दिकांवा याथाश्चिस्थदित, मातंसाठी ागा राखाून ठीेवण्यात आलेल्या नसतील अशा मतार दिवभागात, पंढूील दिनवडंकामध्याे दिफोरत्या ठीेवण्यात याेतील.

५. नागरिराकेांच्येा मागासवगाषकेरिराता राखून ठेवलेल्येा जागांचाे वाटप व चाकेानुक्रमाचाी पद्धत :— (१) दिनयाम ३ नंसार

नागरिरकाच्या मागासवगाझकारिरता दिनश्चिर्श्वचात काेलेल्या ागा या सोडत काढून मतार दिवभागात वार्टण्यात याेतील :

परतं, सोडत काढूताना अनंसूदिचात ातंच्या आदि अनंसूदिचात मातंच्या व्याक्तंकारिरता अगोरचा राखाून ठीेवलेल्या ागा वगळेण्यात याेतील.

(२) पोर्ट-दिनयाम (१) मध्याे काहाीहाी अतभाू झत असले तरी दिल्ह्यातील मतार दिवभागापैकाी प्रत्याेकास दिफोरत्या पद्धतीने असे आरक्ष ेईपयात पोर्ट-दिनयाम (३) नंसार नागरिरकाच्या मागासवगाझकारिरता राखाून ठीेवलेल्या ागा या, अगोरच्या सावझदित्रीका दिनवडंकाीत ज्या मतार दिवभागात नागरिरकाच्या मागासवगाझच्या प्रवगाझकारिरता ागा राखाून ठीेवण्यात आलेल्या नसतील, अशा मतार दिवभागात पंढूील सावझदित्रीका दिनवडंकामध्याे दिफोरत्या ठीेवण्यात याेतील.

६. मकिंहालेांकेरिराता राखून ठेवलेल्येा जागांचाे वाटप व चाक्रानुक्रमाचाी पद्धत :— (१) दिनयाम ३ नंसार, अनंसूदिचात ातंच्या, अनंसूदिचात मातंच्या दिकांवा याथाश्चिस्थदित, नागरिरकाच्या मागास वगाझच्या मदिहालासाठी राखाून ठीेवलेल्या ागाचाे ज्या मतार दिवभागात अशा ाती, माती दिकांवा नागरिरकाच्या मागासवगाझकारिरता ागा राखाून ठीेवलेल्या असतील त्या मतार दिवभागात सोडत काढून दिनयात वार्टप कारण्यात याेईल :

परतं, पंढूच्या सावझदित्रीका दिनवडंकाीच्या वेळेी सोडत काढूताना, ागा राखाून ठीेवे आवर्श्वयाका आहाे अशा सवझ मतार दिवभागाना दिफोरत्या पद्धतीने आरक्ष ेईपयात, ज्या मतार दिवभागामध्याे अशा ाती, माती दिकांवा याथाश्चिस्थदित, नागरिरकाच्या मागासवगाझच्या मदिहालाकारिरता अगोरच्या दिनवडंकाीत ागा राखाून ठीेवलेल्या असतील ते मतार दिवभाग वगळेण्यात याेतील.

(२) अनंसूदिचात ादित, अनंसूदिचात माती आदि नागरिरकाचा मागासवगाझतील मदिहालासाठी राखाून ठीेवलेल्या ागाचाे वार्टप र्झाल्यानतर मदिहालासाठी (अनंसूदिचात ादित, अनंसूदिचात माती दिकांवा, याथाश्चिस्थदित, नागरिरकाचा मागासवगझ यामधील मदिहालाव्यादितरिरक्त) राखाून ठीेवलेल्या ागा या वेगवेगळ्या मतार दिवभागात सोडत काढून वार्टण्यात याेतील :

परतं, पंढूच्या सावझदित्रीका दिनवडंकाीच्या वेळेी सोडत काढूताना सवझ मतार दिवभागाना दिफोरत्या पद्धतीने आरक्ष ेईपयात, अगोरच्या दिनवडंकाीत ज्या मतार दिवभागात अशा ागा राखाून ठीेवलेल्या असतील ते मतार दिवभाग वगळेण्यात याेतील.

७. अनुसूकिंचात जाकिंत, अनुसूकिंचात जमाती, नागरिराकेांचा मागासवगष आकिंण मकिंहालेा येांच्येासाठेी राखून ठेवावयेाच्येा जागांचाी संख्येा राज्ये किंनवडणूके आयेोगाने किंनश्चिचात केराणे :— पचायात सदिमतीच्या प्रत्याेका सावझदित्रीका दिनवडंकाीकारिरता, दिनवडंकाीद्वारे भारावयाच्या एकाू ागापैकाी, अनंसूदिचात ाती, अनंसूदिचात माती, नागरिरकाचा मागासवगझ आदि मदिहाला यामधील व्याक्तंकारिरता राखाून ठीेवावयाच्या ागाचाी सख्या, अदिधदिनयामाच्या कालम ५८ च्या पोर्ट-कालम (१-ब) मधील तरतंीनंसार राज्या दिनवडूका आयाोग दिनश्चिर्श्वचात कारील.

स्पष्टीकेराण .— ागाचाी सख्या दिनश्चिर्श्वचात कारताना अधाझ दिकांवा त्यापेक्षा ास्त अपूाका असल्यास ती एका पूझ ागा धरण्यात याेईल आदि अध्याझपेक्षा कामी अपूाका असल्यास तो दिवचारात घेतला ार नाहाी.

८. अनुसूकिंचात जाती व अनुसूकिंचात जमाती येांच्येासाठेी राखूीव असलेल्येा जागांच्येा वाटपाचाी आकिंण चाक्रानुक्रमाचाी पद्धत :—(१) दिनयाम ७ नंसार अनंसूदिचात ाती आदि अनंसूदिचात माती याच्याकारिरता राखाून ठीेवावयाच्या ागा या, ज्या दिनवाझचाका गातील अशा ातीचाी दिकांवा याथाश्चिस्थदित, मातीचाी लोकासख्या सवाझदिधका असेल अशा दिनवाझचाका गापासून संरवात कारून दिनवाझचाका गामध्याे उतरत्या क्रमाने वार्टून ेण्यात याेतील :

परतं, वेगवेगळ्या दिनवाझचाका गातील अनंसूदिचात ातंचाी दिकांवा याथाश्चिस्थती, अनंसूदिचात मातंचाी लोकासख्या समान असेल दिकांवा एखाद्या दिनवाझचाका गात अनंसूदिचात ातंचाी आदि अनंसूदिचात मातंचाी लोकासख्या समान असेल, त्याबाबतीत अशा दिनवाझचाका गातील दिकांवा दिनवाझचाका गातील ागाचाे वार्टप सोडत काढून कारण्यात याेईल :

परतं, आखाी असे काी, ेथे एखाद्या दिनवाझचाका गातील अनंसूदिचात ातंचाी दिकांवा याथाश्चिस्थदित, अनंसूदिचात मातंचाी लोकासख्या अशाी असेल काी, अनंसूदिचात ाती आदि अनंसूदिचात माती या ोन्हाी प्रवगासाठी तो दिनवाझचाका ग आरदिक्षत हाोऊ शाकाेल, त्याबाबतीत असा दिनवाझचाका ग अशा प्रवगापैकाी ज्याचाी लोकासख्या ास्त असेल त्या प्रवगाझसाठी राखाून ठीेवण्यात याेईल, आदि या प्रदिक्रयाेत, उवझरिरत प्रवगाझसाठी ज्या दिनवाझचाका गात उतरत्या कामाने पंढूील सवाझदिधका लोकासख्या असेल, दितथे ागा राखाून ठीेवण्यात याेईल.

(२) पोर्ट दिनयाम (१) मध्याे काहाीहाी अतभाू झत असले तरी, दिल्ह्यातील वेगवेगळेया दिनवाझचाका गाना दिफोरत्या पद्धतीने आरक्ष ेईपयात, अनंसूदिचात ाती आदि अनंसूदिचात मातीकारिरता राखाून ठीेवलेल्या ागा या अगोरच्या सावझदित्रीका दिनवडंकाीत ज्या दिनवाझचाका गात अशा ाती दिकांवा याथाश्चिस्थती, मातीसाठी ागा राखाून ठीेवण्यात आलेल्या नसतील, अशा दिनवाझचाका गात पंढूील दिनवडंकामध्याे दिफोरत्या ठीेवण्यात याेतील.

भाग चार-ब-२९४–१अ४ महाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-ब, ऑगस्ट २०, २०२५/श्रावण २९, शाके १९४७ ९. नागरिराकेांच्येा मागासवगाषकेरिराता राखून ठेवलेल्येा जागांचाे वाटप केराण्येाचाी व चाक्रानुक्रमांचाी पद्धत :— (१) दिनयाम ७ नंसार नागरिरकाच्या मागासवगाझच्या प्रवगाझतील व्याक्तंकारिरता राखाून ठीेवलेल्या ागा दिनवाझचाका गाना सोडत काढून वार्टून ेण्यात याेतील :

परतं, सोडत काढूताना अनंसूदिचात ाती आदि अनंसूदिचात मातंकारिरता अगोरचा राखाून ठीेवलेल्या ागा वगळेण्यात याेतील.

(२) पोर्ट-दिनयाम (१) मध्याे काहाीहाी अतभां झत असले तरी, दिल्ह्यातील दिनवाझचाका गापैकाी प्रत्याेकास दिफोरत्या पद्धतीने आरक्ष ेईपयात, दिनयाम ७ नंसार नागरिरकाच्या मागासवगाझकारिरता राखाून ठीेवलेल्या ागा या, अगोरच्या सावझदित्रीका दिनवडंकाीत ज्या दिनवाझचाका गात नागरिरकाच्या मागासवगाझच्या प्रवगाझ कारिरता ागा राखाून ठीेवण्यात आलेल्या नसतील, अशा दिनवाझचाका गामध्याे पंढूील सावझदित्रीका दिनवडंकामध्याे दिफोरत्या ठीेवण्यात याेतील.

१०. मकिंहालेांकेरिराता राखून ठेवलेल्येा जागांचाे वाटप केराण्येाचाी व चाक्रानुक्रमाचाी पद्धत :— (१) दिनयाम ७ नंसार अनंसूदिचात ाती, अनंसूदिचात माती दिकांवा याथाश्चिस्थदित, नागरिरकाचा मागासवगझ यामधील मदिहालासाठी राखाून ठीेवलेल्या ागा या, ज्या दिनवाझचाका गामध्याे अशा ाती, माती दिकांवा नागरिरकाचा मागासवगझ याकारिरता राखाून ठीेवलेल्या असतील त्या दिनवाझचाका गात सोडत काढून नेमून ेण्यात याेतील :

परतं, पंढूच्या सावझदित्रीका दिनवडंकाीच्या वेळेी सोडत काढूताना, ागा राखाून ठीेवे आवर्श्वयाका आहाे. अशा सवझ दिनवाझचाका गाना दिफोरत्या पद्धतीने आरक्ष ेईपयाझत, ज्या दिनवाझचाका गात अशा ाती, माती दिकांवा नागरिरकाच्या मागासवगाझमधील मदिहालाकारिरता अगोरच्या दिनवडंकाीत ागा राखाून ठीेवण्यात आल्या असतील ते दिनवाझचाका ग वगळेण्यात याेतील.

(२) अनंसूदिचात ादित, अनंसूदिचात माती आदि नागरिरकाच्या मागासवगाझतील मदिहालासाठी राखाून ठीेवलेल्या ागाचाे वार्टप र्झाल्यानतर मदिहालासाठी (अनंसूदिचात ाती, अनंसूदिचात माती दिकांवा याथाश्चिस्थती, नागरिरकाचा मागासवगझ यामधील मदिहालाव्यादितरिरक्त) राखाून ठीेवलेल्या ागा या, वेगवेगळेया दिनवाझचाका गात सोडत काढून वार्टण्यात याेतील :

परतं, पंढूच्या सावझदित्रीका दिनवडंकाीच्या वेळेी सोडत काढूताना, सवझ दिनवाझचाका गाना दिफोरत्या पद्धतीने आरक्ष ेईपयात, अगोरच्या दिनवडंकाीत अशा ागा राखाून ठीेवल्या असतील, ते दिनवाझचाका ग वगळेण्यात याेतील.

११. किंजल्हा परिरार्षदेा व पंचायेत सकिंमत्येांमधाीले राखूीव जागांच्येा संबंधात सोडत केाढण्येाचाी पद्धत :— राखाीव ागाकारिरता काढूावयाचाी सोडत दिल्हादिधकाऱ्याकाडून दिकांवा दिल्हादिधकारी प्रादिधकाृत कारील अशा तहादिसलाराच्या ाझपेक्षा कामी ाझचा नसेल अशा अदिधकाऱ्याकाडून आदि सोडत काढूण्याचाी सूचाना सबदिधत दिल्हा परिरषेच्या दिकांवा पचायात सदिमतीच्या कायाझलयामधील सूचानाफोलकावर प्रदिसद्ध कारावयाच्या सूचानेस प्रदितसा म्हाून े रदिहावासी उपश्चिस्थत राहातील अशा सबदिधत दिल्हा परिरषेच्या दिकांवा याथाश्चिस्थती, पचायात सदिमतीच्या रदिहावाशाच्या उपश्चिस्थतीत काढूण्यात याेईल आदि सोडत काढूण्याचाी सूचाना दिल्हा परिरष दिकांवा याथाश्चिस्थदित, पचायात सदिमती क्षेत्रीातील सवाझदिधका खापाच्या वतझमानपत्रीापैकाी एका वतझमानपत्रीात ती प्रदिसद्ध कारण्यात याेईल. या नोर्टीशाीत सोडत काढूण्याचाे दिठीका, तारीखा व वेळे शाझदिवण्यात याेईल.

१२. चाक्रानुक्रमासाठेी पकिंहालेी किंनवडणूके :— हाे दिनयाम अमलात आल्यानतर घेण्यात याेारी सावझदित्रीका दिनवडूका हाी या दिनयामानंसार ागाच्या चाक्रानंक्रमासाठी पदिहाली दिनवडूका समण्यात याेईल.

No. ZPE-2025/C.R.97/PR-2.— Whereas, in exercise of the powers conferred by sections 2 (20A), 12 and 58 (1)(a) of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961 (Mah V of 1962) the Government of Maharashtra has vide the Government Notification, Rural Development Department, No. ZPN-2025/CR-36/Para.2, dated the 12th June 2025, divided every district into electoral divisions and each electoral division in the Block into two electoral colleges, for the purposes of election of councillors of Zilla Parishads and members of Panchayat Samitis;

And whereas, in view of changes in the number of electoral divisions and electoral colleges, the Government considers it expedient to frame new rules to prescribe the manner and rotation of reservation of seats for the Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and women in electoral divisions of Zilla Parishads and electoral colleges of Panchayat Samitis;

And whereas, the Government of Maharashtra is satisfied that circumstances exists which render it necessary to take immediate action for the purposes of conduct of elections under the said Act to dispense with the condition of previous publication of these rules under the proviso to sub-section (3) of section 274 of the said Act.

Now, therefore, in exercise of the powers conferred by clauses (ii) and (xiii) of sub-section (2) and proviso to sub-section (3) of section 274 of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961 and of all other powers enabling it in this behalf, and in supersession of the Maharashtra Zilla Parishads and Panchayat Samitis (Manner and Rotation of Reservation of Seats) Rules, 1996, the Government of Maharashtra hereby makes the following rules, namely:-.

I. Short title :— These rules may be called the Maharashtra Zilla Parishads and Panchayat Samitis (Manner and Rotation of Reservation of Seats) Rules, 2025.

II. Definition :— In these rules, unless the context requires otherwise,-

(a) " Act " means the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961;

(b) " electoral college " means an electoral college determined under clause (a) of sub-section (1) of section 58 of the Act;

(c) " electoral division " means an electoral division of a district constituted under sub- section (1) of section 12 of the Act;

(d) " population " means population as defined in clause (20A) of section 2 of the Act; (e) words and expressions used in these rules, but not defined shall have the meanings respectively assigned to them in the Act.

III. State Election Commission to determine the number of seats to be reserved for the Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women :— For every general election to a Zilla Parishad, the State Election Commission shall determine, out of the total number of seats to be filled in by election, the number of seats to be reserved for persons belonging to the Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women as provided in sub-section (2) of section 12 of the Act.

Explanation.— While determining the number of seats, the fraction of one-half or more of a seat shall be counted as one and the fraction of less than one-half shall be ignored.

IV. Manner of allotment and rotation of seats reserved for the Scheduled Castes and Scheduled Tribes :— (1) The number of seats reserved for persons belonging to the Scheduled Castes and Scheduled Tribes under rule 3 shall be allotted to the electoral divisions in the descending order beginning with the electoral division where population of such Castes or, as the case may be, Tribes is the highest :

Provided that, where in different electoral divisions the population of Scheduled Castes, or as the case may be, Scheduled Tribes is equal, or in an electoral division where the population of both the Scheduled Castes and Scheduled Tribes is equal, then the allotment of seats in respect of such electoral divisions or electoral division shall be by drawing of lots :

Provided further that, where the population of the Scheduled Castes or, as the case may be, the Scheduled Tribes in an electoral division is such that both the Scheduled Castes and Scheduled Tribes are entitled to have that electoral division reserved for each of them, then such electoral division shall be reserved for such category of them having higher population, and in the process for the other remaining category the electoral division in which it has the next highest population in the descending order, the seat shall be reserved.

(2) Notwithstanding anything contained in 'sub-rule (1) seats reserved for persons belonging to Scheduled Castes and Scheduled Tribes shall be rotated in the subsequent general elections to the electoral divisions in which no seats have, in the previous general elections been reserved for such Castes or, as the case may be, Tribes, until such reservation is given, by rotation to different electoral divisions in a district.

V. Manner of allotment and rotation of seats reserved for Backward Class of Citizens :— (1) The seats reserved for persons belonging to the category of Backward Class of Citizens under rule 3, shall be allotted to the electoral divisions by drawing lots :

Provided that, while drawing lots, the seats already reserved for persons belonging to Scheduled Castes and Scheduled Tribes, shall be excluded.

(2) Notwithstanding anything contained in sub-rule (1), the seats reserved for Backward Class of Citizens under rule 3 shall be rotated, in the subsequent general elections, to the electoral divisions in which no such seats have, in the previous elections, been reserved for the category of Backward Class of citizens, until such reservation is given, by rotation, to each of the electoral divisions in the district.

VI. Manner of allotment and rotation of seats reserved for Women :— (1) The seats reserved for women belonging to Scheduled Castes, Scheduled Tribes or, as the case may be, category of Backward Class of citizens under rule 3 shall be allotted to the electoral division where the seats are reserved for such Castes, Tribes or the Classes, as the case may be, by drawing lots :

Provided that while drawing lots at the time of subsequent general elections, the electoral divisions where such seats were already reserved in earlier election for women belonging to such Castes, Tribes or the category, as the case may be, shall be excluded until all the electoral divisions in which such seats are required to be reserved have been given such reservation by rotation.

(2) After allotment of seats reserved for women belonging to Scheduled Castes, Scheduled Tribes and the Backward Class of Citizens, the seats reserved for women (other than those belonging to the Scheduled Castes, Scheduled Tribes, or, as the case may be, Backward Class of Citizens) shall be allotted to the different electoral divisions by drawing lots :

Provided that while drawing lots at the time of subsequent general elections, the electoral divisions, where such seats were already reserved in earlier elections for such women, shall be excluded until such reservation is given to all the electoral divisions by rotation.

VII. State Election Commission to determine number of seats to be reserved for the Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women :— For every general election to a Panchayat Samiti, the State Election Commission shall determine, out of the total number of seats to be filled in by election, the number of seats to be reserved for persons belonging to the Scheduledमहाराष्ट्र शासन राजपत्र असाधाराण भाग चारा-ब, ऑगस्ट २०, २०२५/श्रावण २९, शाके १९४७ ७ Castes, Scheduled Tribes, Backward Class of Citizens, and women, as provided in sub-section (1B) of section 58 of the Act. Explanation.— While determining the number of seats, the fraction of one-half or more of a seat shall be counted as one and the fraction of less than one-half shall be ignored.

VIII. Manner of allotment and rotation of seats reserved for the Scheduled Castes and Scheduled Tribes :— (1) The number of seats reserved for persons belonging to the Scheduled Castes and Scheduled Tribes under rule 7 shall be allotted to the electoral colleges in the descending order beginning with the electoral college where the population of such Castes, or as the case may be, Tribes is the highest :

Provided that, where in different electoral colleges the population of Scheduled Castes or, as the case may be, Scheduled Tribes is equal, or in an electoral college where the population of both the Scheduled Castes and Scheduled Tribes is equal, then the allotment of seats in respect of such electoral colleges or electoral college shall be by drawing of lots :

Provided further that, where the population of the Scheduled Castes or, as the case may be, the Scheduled Tribes in an electoral college is such that both the Scheduled Castes and Scheduled Tribes are entitled to have that electoral college reserved for each of them, then such electoral college shall be reserved for such category of them having higher population and in the process for the other remaining category the electoral college in which it has the next highest population in the descending order, the seat shall be reserved.

(2) Notwithstanding anything contained in sub-rule (1), the seats reserved for persons belonging to Scheduled Castes and Scheduled Tribes shall be rotated in the subsequent general elections to the electoral colleges in which no seats have, in the previous general elections been reserved for such Castes or, as the case may be, Tribes, until such reservation is given, by rotation to different electoral colleges in a Panchayat Samiti.

IX. Manner of allotment and rotation of seats reserved for Backward Class of Citizens :— (1) The seats reserved for persons belonging to the category of Backward Class of Citizens under rule 7, shall be allotted to the electoral colleges by drawing lots :

Provided that, while drawing lots, the seats already reserved for Scheduled Castes and Scheduled Tribes shall be excluded.

(2) Notwithstanding anything contained in sub-rule (1), the seats reserved for Backward Class of Citizens under rule 7 shall be rotated, in the subsequent general elections, to the electoral colleges in which no such seats have, in the previous elections, been reserved for the category of Backward Class of Citizens, until such reservation is given by rotation to each of the electoral colleges in the district. X. Manner of allotment and rotation of seats reserved for Women :— (1) The seat reserved for women belonging to Scheduled Castes, Scheduled Tribes or, as the case may be, Category of Backward Class of Citizens, under rule 7 shall be allotted to the electoral colleges where the seats are reserved for such Castes, Tribes or the Classes, as the case may be, by drawing lots :

Provided that while drawing lots at the time of subsequent general elections, the electoral colleges, where such seats were already reserved in earlier elections for women belonging to such Castes, Tribes or the category, as the case may be, shall be excluded until all the electoral colleges in which such seats are required to be reserved have been given such reservation by rotation.

(2) After allotment of seats reserved for women belonging to Scheduled Castes, Scheduled Tribes and the Backward Class of Citizens, the seats reserved for women (other than those belonging to Scheduled Castes, Scheduled Tribes or, as the case may be, Backward Class of Citizens) shall be allotted to the different electoral colleges by drawing lots :

Provided that while drawing lots at the time of subsequent general elections the electoral colleges, where such seats were already reserved in earlier elections for such women, shall be excluded until such reservation is given to all the electoral colleges by rotation.

XI. Procedure for drawing lots in respect of the reserved seats in the Zilla Parishad and Panchayat Samiti :— The lots to be drawn in respect of the reserve seats shall be drawn by the Collector or an officer, not below the rank or Tahsildar, authorised by him and in the presence of such residents of the Zilla Parishad or, as the case may be, the Panchayat Samiti concerned who shall remain present in response to the notice to be displayed on the Notice Board in the respective Zilla Parishad and Panchayat Samiti offices, and to be published in one of the widely circulated local newspapers in the Zilla Parishad or, as the case may be, Panchayat Samiti area indicating in such notice the place, date and time at which such lots shall be drawn.

XII. First election for rotation :— For the purposes of rotation of seats under these rules, the general election held after commencement of these rules shall be considered as the first election.
