ज्याअर्थी, चंद्रपूर शहराच्या वाढीव क्षेत्राची विकास योजना, महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ (१९६६ चा महा.३७ वा) (यापुढे "उक्त अधिनियम" असे संबोधले आहे) चे कलम ३१ (१) अन्वये शासन, नगर विकास विभाग अधिसूचना क्रमांक टिपीएस-२२९४-१३१५-प्र.क्र.२५३-९६-नवि-९, दिनांक ०२ जून, १९९७ अन्वये मंजूर झाली असून ती दिनांक १५ ऑगस्ट, १९९७ पासून अंमलात आली आहे (यापुढे "उक्त विकास योजना" असे संबोधले आहे);
आणि ज्याअर्थी, उक्त विकास योजनेत, मौजे वडगांव येथील सव्र्हे क्र. ७०/१ (नविन), ७०/२ पैकी (नविन), ४३ (जुना) मधील ०.९२ हेक्टर जागा (यापुढे "उक्त जागा" असे संबोधिले आहे ) "आरक्षण क्रमांक १- जकात नाका" म्हणून आरक्षित आहे (यापुढे "उक्त आरक्षण"असे संबोधले आहे);
ना.-एक-अ-१-(१६९५).
(१)२ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, सप्टेंबर १२, २०२५/भाद्रपद २१, शके १९४७ आणि ज्याअर्थी, चंद्रपूर शहर महानगरपालिका, चंद्रपूर यांनी नियोजन प्राधिकरण (यापुढे "उक्त नियोजन प्राधिकरण" असे संबोधले आहे) म्हणून, त्यांच्या सर्वसाधारण सभेचा ठराव क्रमांक १७१, दिनांक २६ नोव्हेंबर, २०२४ नुसार, उक्त आरक्षण वगळून मुक्त झालेले क्षेत्र रहिवास विभागात समाविष्ट करण्याचे ठरवून, त्याअनुषंगाने, उक्त अधिनियमाचे कलम ३७ चे उप कलम (१) मध्ये नमूद वैधानिक कार्यवाही पूर्ण करुन फेरबदल प्रस्ताव मंजुरीसाठी शासनास सादर केलेला आहे (यापुढे "उक्त प्रस्तावित फेरबदल" असे संबोधले आहे);
आणि ज्याअर्थी, आवश्यक त्या चौकशीनंतर व संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर उक्त प्रस्तावित फेरबदल काही अटींसह मान्य करावा, असे राज्य शासनाचे मत झाले आहे ;
आणि ज्याअर्थी, उक्त जमिनीच्या मालकानी सन २०२५-२६ या साठीच्या बाजारमूल्यदर तक्त्यानुसार येणाऱ्या रक्कमेच्या ५% दराने परिगणित होणाऱ्या अधिमूल्य रक्कमेपैकी शासनास देय असलेली अधिमुल्याची ५०% रक्कम रुपये ३०,४७,५००/- सहायक संचालक, नगर रचना, चंद्रपूर शाखा, चंद्रपूर यांचेकडील लेखाशिर्षामध्ये दिनांक ०८ जुलै, २०२५ रोजी जमा केलेली आहे आणि नियोजन प्राधिकरणास देय असलेली ५०% अधिमूल्याची रक्कम रुपये ३०,४७,५००/- आयुक्त, चंद्रपूर शहर महानगरपालिका, चंद्रपूर यांचेकडे दिनांक ०७ जुलै, २०२५ रोजी जमा केलेली आहे;
आता, त्याअर्थी, उक्त अधिनियमाचे कलम ३७ चे उप कलम (२) नुसार प्राप्त असलेल्या अधिकारांचा वापर करुन शासन उक्त विकास योजनेतील उक्त प्रस्ताव काही अटींसह पुढील प्रमाणे मान्यता देत आहे आणि त्यासाठी उपरोल्लिखीत दिनांक ०२ जून, १९९७ ची विकास योजना मंजुरीची अधिसूचना सुधारित करण्यात येत आहे ;
"उक्त विकास योजना मंजुरीच्या अधिसूचनेच्या फेरबदल सुचीतील शेवटच्या नोंदीनंतर पुढील नव्या नोंदीचा समावेश करण्यात येत आहे "-
नोंद
मौजे वडगांव येथील सव्र्हे क्रमांक ७०/१ (नविन), ७०/२ पैकी (नविन), ४३ (जुना) मधील ०.९२ हेक्टर जागा "आरक्षण क्रमांक.१- जकात नाका" मधुन वगळून मुक्त झालेले क्षेत्र, विकास योजना भाग नकाशात दर्शविल्यानुसार, खालील अटींच्या अधिन राहून रहिवास विभागात समाविष्ट करण्यात येत आहे-
अटक्रमांक-१.चंद्रपूर शहराच्या प्रचलित विकास नियंत्रण नियमावलीनुसार, जागेच्या रेखांकनात आवश्यक १०% खुल्या जागेव्यतिरिक्त, १०% सुविधा क्षेत्र सोडणे बंधनकारक राहील.
अटक्रमांक-२. खुल्या जागे सभोवताली कुंपण करणे आवश्यक राहील.
अटक्रमांक-३. उक्त जमिनीसाठी आवश्यक त्या सर्व मुलभूत सेवा-सुविधा जमीन मालकांनी/विकसनकत्यार्ंनी स्वखर्चाने विकसित करुन पुरविणे बंधनकारक राहील. मूलभूत सुविधांमध्ये रस्ते, पाणी पुरवठा, मल नि:सारण व ड्रेनेज इ. यांचा समावेश आहे.
अटक्रमांक-४. उपरोक्त मूलभूत सुविधांचा विकास क्रमाने करताना एकूण अपेक्षित सुविधांचा विकास टप्प्याने होत असताना अर्जदारांवर, एकूण जागेच्या भूखंड विक्रीवर खालीलप्रमाणे बंधन राहील. आयुक्त, चंद्रपूर शहर महानगरपालिका, चंद्रपूर यांनी सदर बाबींवर नियंत्रण ठेवावे. ----
(क) अभिन्यास अंतिमत: मंजूर झाल्यावर एकूण २५% भूखंड/सदनिका विक्री अनुज्ञेय राहील.
(ख) सुमारे ४०% मूलभूत सुविधा पूर्ण झाल्यावर एकूण ५०% भूखंड/सदनिका विक्री अनुज्ञेय राहील.
(ग) सुमारे ६०% मूलभूत सुविधा पूर्ण झाल्यावर एकूण ७५% भूखंड/सदनिका विक्री अनुज्ञेय राहील.
(घ) सुमारे ८०% मूलभूत सुविधा पूर्ण झाल्यावर एकूण ९०% भूखंड/सदनिका विक्री अनुज्ञेय राहील.
(ड) सुमारे १००% मूलभूत सुविधा पूर्ण झाल्यावर एकूण १००% भूखंड/सदनिका विक्री अनुज्ञेय राहील.
३ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, सप्टेंबर १२, २०२५/भाद्रपद २१, शके १९४७जर अभिन्यासात समुह गृहबांधणी योजना विकसित करावयाची असेल तर, आयुक्त, चंद्रपूर शहर महानगरपालिका, चंद्रपूर यांनी विहित केल्यानुसार सर्व मूलभूत सुविधा विकसित झाल्याशिवाय भोगवटा प्रमाणपत्र देण्यात येणार नाही.
उक्त मंजूर फेरबदल दर्शविणारी प्रस्तुत अधिसूचना/विकास योजना भाग नकाशाची प्रत आयुक्त, चंद्रपूर शहर महानगरपालिका, चंद्रपूर यांच्या कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ एक महिन्याच्या कालावधीसाठी, कामकाजाच्या दिवशी कार्यालयीन वेळेत उपलब्ध राहील.
सदर आदेश शासनाच्या www.maharashtra.gov.in या वेबसाईटवर उपलब्ध आहे.

ORDER
No. TPS-2225-583-C.R.57-2025-UD-9.–
Whereas, Development Plan of Additional area of Chandrapur City has been sanctioned by the Government vide Urban Development Department's Notification No.TPS-2294-1315-CR-253- 96-UD-9, dated the 02nd June,1997 and has come into force with effect from the 15th August, 1997 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, the land bearing Survey No.70/1 (New), 70/2 Part (New), 43 (Old) area admeasuring 0.92 Hectare of Mouje Wadgaon, (hereinafter referred to as "the said Land") is reserved as "Site No.1-Octroi Naka" (hereinafter referred to as "the said Reservation");
And whereas, the Chandrapur City Municipal Corporation, Chandrapur (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No.171, dated the 26th November, 2024 has resolved to delete the said Land from the said Reservation and to include the land so released in Residential Zone and accordingly submitted a modification proposal to the Government, for its sanction, as per the provisions of sub section (1) of Section 37 of the said Act, (hereinafter referred to as "the said Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that, the said Proposal Modification should be sanctioned with some conditions;
And whereas, the Land Owners of the said Land have deposited Rs.30,47,500/- towards the 50% Government share of 5% premium amount as per the value of the said Land as prescribed in the Annual Statement of Rates (ASR) for the year 2025-26 in the Government Treasury on dated the 08th July, 2025 through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs.30,47,500/- payable to the Planning Authority has been deposited with the Commissioner, Chandrapur City Municipal Corporation, Chandrapur on dated the 07th July, 2025;
४ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, सप्टेंबर १२, २०२५/भाद्रपद २१, शके १९४७Now, therefore, in exercise of the powers conferred on it under sub section (2) of Section 37 of the said Act, the State Government hereby, sanctions the said Proposed Modification subject to some condition and for that purpose amends the above referred Notification dated the 02nd June,1997 as follows:--
"In the Schedule of Modifications appended to the Notification sanctioning the said Develop- ment Plan, the following new entry shall be added after the last entry -
ENTRY
The land bearing Survey No.70/1 (New), 70/2 Part (New), 43 (Old) of Mouje Wadgaon, admeasuring area 0.92 Hectare is deleted from "Site No.1-Octroi Naka" and the land so released are included in Residential Zone, subject to the conditions mentioned below-
Condition No.1 - 10% Amenity Space shall be provided in the layout in addition to 10% compulsory open space, as per the prevailing Development Control Regulations for Chandrapur City.
Condition No.2- It is necessary to construct compound around the open space.
Condition No.3 - It is compulsory for the land owner/ developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities in- cluded as road, water supply, sewerage & drainage etc.
Condition No.4 - If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Commissioner, Chandrapur City Mu- nicipal Corporation, Chandrapur, in relation to development of basic amenities as per the stages given below.–
(A) After final Approral of Layout Sale of 25% of the total shall be permissible.
(B) After completion of 40% Basic Amenities. Sale of 50% of the total shall be permissible.
(C) After completion of 60% Basic Amenities. Sale of 75% of the total shall be permissible.
(D) After completion of 80% Basic Amenities. Sale of 90% of the total shall be permissible.
(E) After completion of 100% Basic Amenities. Sale of 100% of the total shall be permissible.
If Group Housing Scheme is proposed in the layout, then Occupation Certificate shall not be given by the Commissioner, Chandrapur City Municipal Corporation, Chandrapur unless all the basic amenities are fully developed;
A copy of the Notification, along with the part plan showing the aforesaid sanctioned modi- fication, shall be available for inspection of the general public, in the office of the Commissioner, Chandrapur City Municipal Corporation, Chandrapur during office hours on all working days for a period of one month.
